    2022执法检查情况报告执法检查情况报告 执法检查状况报告执法检查状况报告 市院执法检查工作领导小组:全面贯彻实施检察官法是检察机关的一项重大任务,也是规范和加强队伍管理的一项重要内容。在实行检察官法工作中,我院根据“深化宣扬,强化培训,依法管理,务求实效”的原则,把严格贯彻执行检察官法,作为提高检察官队伍素养的重要法律手段,实行有效措施,着力提高依法管理检察官队伍的工作水平。加强学习和宣扬,为检察官法的贯彻实施营造良好的氛围。检察官法颁布后,我院不断加高校习和宣扬检察官法的工作力度,努力为检察官法的贯彻实施营造良好的氛围。为此,我们组织全体检察人员开展了深化细致的学习、宣扬检察官法活动。通过学习,着重解决了三个问题:一是解决了广阔干警对检察官法重要性相识不足的问题。二是解决了广阔干警对检察官法理解不深的问题。三是解决了广阔检察官职责意识不强的问题。在加强广阔干警对检察官法的学习、宣扬、教化的同时,我院实行多种形式,通过广播、电视、报刊等新闻媒介,广泛深化地开展检察官法的宣扬工作,在省级报刊发表宣扬文章10余篇、在市级媒体发表宣扬文章20余篇。向人民群众宣扬检察官法的意义,宣讲检察官法的内容。结合检察工作实际,实行群众喜闻乐见、生动活泼的方式,争取社会各界和广阔群众了解检察官,支持我们的工作;激励广阔人民群众对检察官的执法活动进行监督。加大培训力度,提高检察官综合素养。检察官法对检察官的任职、续职等提出了严格、详细的标准与要求。为实行检察官法,努力达到检察官法对检察官的学历要求和素养要求,自检察官法实施以来,我院始终坚持“理论联系实际,按需施教,讲求实效”的原则,结合我院实际,有安排、有重点、有步骤地开展检察官教化培训工作,取得了明显的成效。1.主动支持和激励干警参与学历教化,学历教化成果显著。检察官法对初任检察官的学历条件提出了明确详细的标准。检察官法实施前,我院35名检察官中,具有本科的29人,具有专科学历的5人。为使全院干警达到检察官法对任职检察官的学历条件和要求,我们在学习经费、学习时间等方面主动支持和激励干警参与学历教化。对检察官法实施前已担当检察官职务,但未达到检察官法所规定的学历条件的,我们依据上级检察机关的有关精神,区分不怜悯况,分别提出不同要求,分层次进行培训。目前,我院现有省院核定编制34人,地方编制1人。其中具有本科学历29人,专科学历5人,中学学历1人。法律专业34人,非法律专业1人。副处级2人,正科级7人,副科级9人,科员17人;在读本科5人。2.检察官任职、续职资格培训全面开展。20xx年以来,我院先后有1名副检察长2名检察官共3人根据检察官法的要求参与了省院统一组织续职资格培训,并取得了优异的成果。接受任职、续职资格培训,对更好地履行检察官职责,提高检察官执法水平起到了主动作用,也为我们今后全面开展任职、续职资格培训供应了可资借鉴的阅历。3.创新培训机制,干警岗位轮训工作取得实效。为把学历变为实力,把文凭变为水平,我院依据检察官法的基本要求,不断创新培训机制,大力开展干警岗位轮训工作,取得了明显的成效。在岗位轮训工作中,我院坚持开展多种形式的岗位轮训工作,从正副检察长到检察员、助检员的岗位练兵,从书记员、行政人员的应知应会到典型案件的分析探讨,形成了全员性、多层次、立体化的培训机制,使检察官队伍的综合素养和业务水平得到了整体性提高。建立健全长效机制,严格依法管理检察官队伍。自20xx年以来,我院严格依照人民检察院组织法和检察官法的有关规定,仔细实行上级检察机关关于依法管理检察官队伍的一系列指示精神,逐步建立健全了依法管理队伍的长效机制。一是成立检察官考评委员会,依法加强常常性管理。我们严格执行检察官法关于对检察官的任免、考核、晋升、嘉奖的各项规定,建立了干警业绩档案,把检察官的工作实绩作为任免、晋升、嘉奖的主要依据,形成了一套“公开、同等、竞争、择优”的用人机制;二是实行竞争上岗、双向选择的干部管理机制,建立健全了考核机制,对全院干警的工作业绩实行动态考核,奖勤罚懒,奖优罚劣。近几年来,共有3名实绩突出的年轻检察官走上中层领导岗位。三是依法加强检察官执法行为的规范与管理。工作中,我院始终把规范检察官的执法行为作为检察官队伍管理的重点之一,通过加强纪律教化,开展警示教化,实行“一岗双责”,与干警层层签订党风廉政建设责任书,健全戒勉谈话制、八小时以外对干警实施监督的暂行规定等行之有效的监督制度,努力加强事前监督,推动检察官执法行为的规范化。四是完善了监督制约机制。建立了举报中心对侦查部门实行线索查办跟踪反馈制度;首办责任制度;错案责任追究制;控申、监所部门对自侦、批捕、起诉部门执行法定期限检查制;纪检部门个案跟踪回访考核制等,以努力提高检察官仔细履行自身职责的自觉性。规范检察官等级评定,全面开展等级晋升报批工作。检察官法实施后,我院根据上级检察机关的部署和要求,于1998年11月依法开展了首次检察官等级评定及报批工作。首批共评定了33名检察官的检察官等级。其中,四级高级检察官4名;一级检察官13名;二级检察官7名;三级检察官3名;四级检察官6名。首次评定后,因干警退休、离岗、调动、撤职以及等级晋升等多方面因素,我院检察官队伍的等级构成发生了新的改变。目前,我院在职检察官中有四级高级检察官1名;一级检察官13名;二级检察官2名;三级检察官8名;四级2名。全面实行检察官法存在的亟需解决的问题几年来,通过实行检察官法,我院各项检察工作走上了规范化、制度化的轨道。但在实行检察官法的过程中,也遇到了一些不容忽视的问题。一检察官待遇低、健康状况差。检察官法实施已经九年多。但是检察官的职业保障机制,检察官待遇与检察官等级的配套方法、制度仍未得到健全。由于缺乏相关的机制、方法、制度,使得检察官待遇低、健康状况差的问题仍未得到解决。干警出差办案都是自己垫钱。办案收回赃款后交区政府回拨一部分,牵强维持工作,正常的检察工作只能靠关系借款现外欠款百余万元。主要表现在;一是检察官法规定的检察官工资制度和工资福利无法落实、兑现;二是“检衔”津贴没有落实;三是工作任务繁重,人员紧缺,使得检察官长期处于高度惊慌、疲惫状态,得不到应有的休息,健康状况下降,有的甚至积劳成疾,带病工作。前年底,我院与伊春林业中心医院联系,为全体干警统一做了一次健康检查,竟有三分之一的干警身患疾病,这些患病的干警又主要是检察官。二检察官的任职、续职资格等培训经费惊慌。强化培训是实行检察官法,提高检察官素养的必定要求。检察官法其次十七条规定,“对检察官应当有安排地进行理论培训和业务培训”。但是由于公用经费预算标准低,无法从中列支培训经费,影响到教化培训工作的常常性开展。办案经费不足,区政府每月只给一千多元,连电话费一项支出都不够。参与续职培训的3名干警至今都没有核销培训费用,都是个人先垫上。这些问题,通过涉案款物上交区财政后,取得返还款的方式,只能解决部分问题。随着检察机关的规范化、正规化建设工作的深化开展,经费缺口越来越大,经费问题越来越成为制约检察工作的“瓶颈”。而教化培训经费的短缺,已经成为我院真正全面落实检察官法所提出的要对检察官定期开展全员任职、续职等多种形式培训,提高检察官队伍的整体素养要求的主要制约因素。由于教化培训经费惊慌,我院不得不多次将任职、续职等培训机会放弃。三检察官法所规定的检察官管理体制与现行地方管理体制难以接轨。目前,检察机关实行双重管理体制,财政由地方负责,人事由地方和上级检察机关双重管理。在这种管理模式下,检察官法所规定的检察官管理体制与现行地方管理体制难以接轨的问题就渐渐显现出来,集中表现在地方的人事权与检察官法所规定的检察机关的人事制度相冲突,致使检察队伍的新老交替无法顺当实现。我院现有检察专项编制34个,区编委确定的地方编制1个。现实有在职干警35人,在34名检察专项编制人员中,只有检察官25人。根据检察官法的规定和上级检察机关的有关指示精神,只有属于检察专项编制、具有检察官职务的检察人员才具有履行检察官职责的资格,即根据这一规定和精神,只有属于检察专项编制,已被评定检察官等级25名检察官才有办案资格,其他人员无权参加检察业务工作,这就使得“检力”非常惊慌。根据上级院的要求,只有具备法律本科学历的人员才能参与全省统一录用考试,而且,参与全省统一录用考试的对象又主要限定在应届高校法律本科毕业生,这使我院检察专项编制的补充问题处在一种难以为继的境地:想补充的补充不进来,想调进的调不进来。因此,导致检察官队伍出现青黄不接,甚至断档的局面。这种局面的出现,无疑进一步加剧了我院检察官队伍法律化、规范化建设的严峻性和紧迫性。comprehensive coordination ability, writing ability, supervision ability, logistics ability, innovation ability, continuously consolidate and maintain the education on Party members'advancement activities and enhance awareness of the Communist Youth League education achievements, and vigorously promote the construction of civilization advanced units, units and staff home building activities, balanced, focused, pragmatic, innovation, high standard, high quality, high level, high efficiency to complete various tasks throughout the year.First, pay close attention to research information, efforts to improve decision-making servicesIn accordance with the information reflect the information, promote the work of information leading work requirements, adhere to grasp the team construction, mechanism construction and quantitative assessment, give full play to the assistant role of leadership, actively promote the innovation of research information development, and vigorously promote the research work of information to mention upgrading, efforts to improve the ability and level of decision-making.(a) adhere to the decision in the first place.
