中国劳动合同书-中英文版本编号劳动合同书甲方用人单位:乙方劳动者:大连市人力资源和社会保障局制二一四年三月LABORCONTRACTInaccordancewiththeLaborLawofthePeople'sRepublicofChina,theLaborContractLawofthePeople'sRepublicofChinaandtheRegulationsontheImplementationoftheLaborContractLaw,PartyAandPartyBfollowtheprinciplesoflegalfairness,equality,voluntariness,consensusandgoodfaith.Thiscontract,andcommitmenttocommoncompliance.ShanghaiXXXXXCo.,Ltd.(hereinafterreferredtoas"PartyA")AndNameofEmployee:_IdentificationCardNo.:_(hereinafterreferredtoas"PartyB")Article1TermofContractandProbationPeriod1.ThetermofthisContractshallbe_years_months,fromddmmyytoddmmyy,duringthis:thereshallbeaprobationperiodof_years_months,fromddmmyytoddmmyy.2.ThisContractshalltakeeffectonthedayPartyBactuallycommencesworkforPartyA.3.Duringprobationperiod,PartyAshallperformaperformancereviewonPartyB,andshalldecidewhethertoformallyhirePartyBbasedonPartyB'sworkperformanceandcapabilities.TheprobationperiodshallenduponnoticefromPartyAofPartyB'sformalhiring,andPartyBshallbecomePartyA'sformalemployee.IntheeventthatPartyAdoesnotbelievethatPartyBfullymeetshiringconditions,PartyAmayextendtheprobationperiodinaccordancewithapplicablerules.Duringtheprobationperiod,intheeventthatPartyAdoesnotbelievethatPartyBmeetshiringconditionsanddecidesnottohirePartyA,thisContractshallbeterminatedautomatically.4.OnthedayPartyBreportstowork,PartyBshallprovidePartyAwiththelaborcertificateorrelevantseverancecertificatesfromPartyB'spreviousemployer.Intheeventsuchproofisnotprovidedwithinhalfamonth,PartyBmusthaveareasonableapplicationandmaygetanextensiononlyafterPartyAgivesconsent,andsaidextensionshallnotexceedonemonth.IntheeventthatPartyBfailstoproviderelevantproofwithintheprescribedtimeframe,thisContractshallbeautomaticallyterminated.Article2JobPostandJobDuties1.PartyBshallholdthepositionof_withthedepartmentof_.PartyBshallcompletehisworkaccordingtothejobdutiesdefinedbyPartyA.2.PartyAmaychangePartyB'sjobduetoPartyA'sbusinessneedorduetoPartyB'scapabilitiesorperformance.PartyBshallhavetherighttomakehisowncomment,butshallcomplywithPartyA'sworkarrangements,andshallcompletetheproceduresforchangeaccordingtotherules.Article3WorkConditionsandLaborProtection1.PartyAshallimplementa40-hourworkweeksystem.Duetobusinessneeds,management,salesandservicedepartments,etc.,shallimplementanirregularworksystemorcomprehensiveworkhoursystem.2.IntheeventthatPartyAneedsPartyBtoworkovertimeduetobusinessneeds,PartyAmayprovidemakeupbreaksorcompensation.3.PartyAshallprovidePartyBwithaworkenvironmentandlaborprotectionmeasuresconsistentwiththerequirementsoftheChineseGovernment.Article4Compensation1.InaccordancewiththecurrentsalarysystemofPartyA,PartyB'stotalmonthlysalaryshallbeRMB_.Attheendoftheprobationperiod,PartyB'smonthlysalaryshallbeissuedinthefollowingmanner.a.ThebaseamountshallbeRMB_,ofwhich_%shallbetheperformancereviewbonus,whichshallbeissuedafterbeingfloatedaccordingtoPartyA'sperformancereviewsystem.b.ThesalaryshallbeRMB_,plusabonus.ThebonusshallbeissuedinaccordancewithrelevantrequirementsofPartyA.2.PartyAshallissuethesalaryforthepreviousmonthonthe10thofeachmonth.3.PartyB'spersonalincomeadjustmenttaxshallbebornebyPartyBhimself,andshallbewithheldbyPartyA.4.PartyAmaypayPartyBacertainamountofsubsidiesandbonusesdependingonthebusinessoperatingstatusandPartyB'sworkperformance.5.IntheeventthatPartyAimplementsanewsalarysystem,adjustssalarylevelsorintheeventthatPartyB'sdutypostandpositionischanged,PartyAmaymakeanadjustmenttoPartyB'ssalaryinaccordancewiththerelevantrules.Article5LaborInsurance,WelfareandBenefits1.PartyshallpayrelevantsocialinsurancetodesignatedauthoritiesonPartyB'sbehalfinatimelymannerinaccordancewithgovernmentrequirements.2.PartyBshallbeentitledtolegalholidaysspecifiedbytheChineseGovernment,aswellaspaidleaves,suchasannualvacations,maritalleave,bereavementleaveandmaternityleave,etc.3.DuringPartyB'semploymentwithPartyA,intheeventofPartyB'ssicknessornon-jobrelatedinjuries,PartyBshallsetPartyB'smedicalleaveinaccordancewithgovernmentrequirements.Article6LaborDiscipline1.PartyBshallstrictlycomplywiththevariousrulesandregulationspreparedbyPartyAinaccordancewithlaw.2.IntheeventthatPartyBhascompliedwithrulesandregulationsinanexemplarymannerorintheeventthatPartyBhasviolatedsuchrulesandregulations,PartyAshallrewardanddisciplinePartyB,asthecasemaybe.Article7Terminationof,Changesto,RenewalandDissolutionofLaborContract1.Upontheoccurrenceofanyoneofthefollowingcircumstances,thisLaborContractshallbeterminated:a)TheexpirationofthisLaborContract;b)PartyAhasbeendeclaredbankruptinaccordancewithlaw;c)PartyAhasbeendissolvedorrevokedinaccordancewithlaw;d)PartyB'sretirement,severanceordeath;e)Othercircumstancesspecifiedbylawsandregulations;2.ThisLaborContractmaybeterminateduponconsensusbetweenPartyAandPartyB;3.Uponitsexpiration,thisLaborContractmaybereneweduponmutualagreementbetweenPartyAandPartyB;4.Duetochangeofproducts,adjustmenttobusinessoperationsorduetopolicyadjustmentsandotherchangesofcircumstances,PartyAmaychangetherelevantcontentsofthisContractandcompletetheproceduresforsuchchanges;5.PartyBmayterminatethisLaborContractatanytimeupontheoccurrenceofanyoneofthefollowingcircumstances:a)PartyBisintheprobationperiod;b)PartyAforcesPartyBtoperformlaborthroughforce,threatorillegalrestrictiononPartyB'spersonalfreedom;c)PartyAfailstopaylaborcompensationorprovideworkconditions;d)Uponconfirmationbylaborprotectionandlaborhealthoversightauthorities,PartyA'sworksafetyandhealthconditionsdonotmeetthestandardsoflawsandregulations;6.PartyBmustgivePartyA30daysofwrittennoticewhenitrequeststerminationofthisLaborContract.Intheeventthatanyspecialprovisionshavebeencovenantedregardingthedeadlineforadvancenotice,therequirementforsuchaprescribeddeadlineshallbemet.7.Upontheoccurrenceofanyoneofthefollowingcircumstances,PartyAmayterminatethisLaborContract,butmustgivePartyB30daysofwrittennotice:a)IntheeventthatPartyBbecomessickorsuffersnon-workrelatedinjuries,afterPartyB'smedicalleavehasended,PartyBstillhasnotrecovered,oralthoughPartyBhasrecovered,PartyBcannotperformtheworkontheoriginaldutypostoranyotherworkarrangedbyPartyA;b)PartyBisincompetent,andstillremainsincompetentevenaftertrainingoreventhoughPartyB'sdutyposthasbeenadjusted;c)TherehavebeenmajorchangestoinobjectivecircumstancesusedasthebasisfortheexecutionofthisLaborContract,renderingitimpossibletoperformtheoriginalLaborContract,andthepartiesarestillnotabletoreachanagreementonchangestothisLaborContractaftertheirconsultations;8.PartyBmayterminatethisLaborContractatanytimeupontheoccurrenceofanyoneofthefollowingcircumstancesonPartyB'spart:
