劳动合同(英文版)劳动合同英文版LabourContractEmployer:LegalRepresentative:Position:PresidentAddress:Postcode:Employee:Name:Gender:Address:Nationality:IDCardNo.:DateofBirth:EducationDegree:ThisContractissignedonamutualityvoluntarybasisbyandbetweenlhefollowingEmployerandEmployeeinaccordancewiththeLabourLawofPeople'sRepublicofChina.H1.TermoftheContract:Thetermofthiscontractisforyearsandshallcommenceon.?andshallcontinueuntil.unlessearlierterminatedpursuanttothisContract.TheEmployeeshallundergoaprobationaryperiodofmonths,2JobDescription:TheEmployeragreestoemployMr./Ms.(name)as(jobtitle)inDepartment,locatedin(officelocationandcity).3.RemunerationofLaboura.ThesalaryoftheEmployeeshallbemonthlypaidbytheEmployerinaccordancewithapplicablelawsandregulationsofP.R.C.ItshallbepaidbylegaltenderandnotlessthanlhestandardminimumsalaryinTianjin.b.ThesalaryoftheEmployeeisRMB$permonthintheprobationaryperiodandRMB$aftertheprobationaryperiod.c.Ifthedelayordefaultofsalarytakesplace,theEmployershallpaylheeconomiccompensationexceptthesalaryitselfinaccordancewiththerelevantlawsandregulations.4.WorkingHours&Rest&Vocationa.ThenormalworkinghoursoftheEmployeeshallbeeighthourseachday,excludingmealsandrestforanaverageoffivedaysperweek,foranaverageoffortyhoursperweek.b.TheEmployeeisentitledtoalllegalholidaysandotherpaidleavesofabsenceinaccordancewiththelawsandregulationsofthePRCandthecompany'sworkrules.c.TheEmployermayextendworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunionandtheEmployee.buttheextendedworkinghourforadayshallgenerallynolexceedonehour;Ifsuchextensioniscalledforduetospecialreasons,theextendedhoursshallnotexceedthreehoursaday.However,thetotalextensioninamonthshallnotexceedthirty-sixhours.5.SocialSecurity&Welfarea.TheEmployerwillpayforallmandatorysocialsecurityprogramssuchpensioninsurance,unemploymentinsurance,medicalinsuranceoftheEmployeeaccordingtotherelevantgovernmentandcityregulations-b.DuringtheperiodoftheContract,theEmployee'swelfareshallbeimplementedaccordancewiththelawsandrelevantregulationsofP.R.C.6.WorkingProtection&WorkingConditionsa.TheEmployershouldprovidetheEmployeewithoccupationalsafetyandhealthconditionsconformingtolheprovisionsoftheSlateandnecessaryarticlesoflaborprotectiontoguaranteethesafetyandhealthduringtheworkingprocess.b.TheEmployershouldprovidetheEmployeewithsafetyeducationandtechniquetraining;TheEmployeetobeengagedinspecializedoperationsshouldreceivespecializedtrainingandacquirequalificationsforsuchspecialoperations.c.TheEmployeeshouldstrictlyabidebytherulesofsafeoperationintheprocessoftheirwork.httpdocsj/doc/ddf8a97a5afb770bf78a6529647d27284a733745.bourDisciplinea.TheEmployermaydraftbylawsandlabourdisciplinesoftheCompany.Accordingtowhich,theEmployershallhavetherighttogiverewardsortakedisciplinaryactionstotheEmployee;b.TheEmployeeshallcomplywiththemanagementdirectionsoflheEmployerandobeythebylawsandlabourdisciplinesoftheEmployer.c.TheEmployeeshallundertaketheobligationtokeepandnottodisclosethetradesecretfortheEmployerduringtheperiodofthisContract;ThisobligationofconfidentialityshallsurvivetheterminationofthisContractforaperiodoftwo(2)years.Termination,Modification,RenewandDischargeoftheContracta.TherelevantclausesoftheContractmaybemodifiedbylheparties:i.Thespecificclauseisrequiredtobemodifiedbythepartiesthroughconsultation;ii.Duetotheforcemajeure,theContractcannotbeexecuted;iii.TherelevantlawsandregulationshavebeenmodifiedorabolishedbythetimeofsigninglheContract.b.TheContractmaybeautomaticallylerminated:i)ThisContractisnotrenewedattheexpirationofthisContract;ii)TheEmployerislegallyannouncedtobebankruptcy,dismissed,orcanceled;iii)ThedeathoflheEmployeeoccurs;iv)Theforcemajeuretakesplace;v)TheconditionsofterminationagreedintheContractbylhepartiesarise.c.TheContractmayberenewedattheexpirationthroughconsultationbytheparlieswithlhefulfillmentoflheprocedurewithin15daystolheexpiration;d.TheContractmaybedischargedthroughconsultationbytheparties;e.TheContractmaybedischargedbytheEmployerwithimmediateeffectandtheEmployeewillnotbecompensated:i.TheEmployeedoesnotmeetthejobrequirementsduringtheprobalionaryperiod;ii.TheEmployeeseriouslyviolatesdisciplinesorbylawsoftheEmployer;iii.TheEmployeeseriouslyneglectshisduty,engagesinmalpracticeforselfishendsandbringssignificantlosstotheEmployer;iv.TheEmployeeisbeingpunishedbyphysicallabourforitsmisfeasancev.TheEmployeeisbeingchargedwithcriminaloffences:f.TheContractmaybeterminatedbytheEmployerbygivingnoticeinwrittenform30(thirty)daysinadvance:i-TheEmployeefailsillorisinjuredto(other(handuetowork)andaftercompletionofmedicaltreatment,isnotabletoperformhispreviousfunctionoranyotherfunctiontheEmployerassignstohim;ii.TheEmployeedoesnotshowsatisfactoryperformanceandaftertrainingandadjustingmeasuresisstillnotabletoperformsatisfactorily;iii.ThecircumstanceshavemateriallychangedfromthedatethisContractwassignedtotheextentlhatitisimpossibletoexecute(heContractprovided,however,thattheparliescannotreachanagreementtoamendthecontracttoreflectthechangedcircumstances.iv.TheEmployerisbeingconsolidatedinthelegalconsolidationperiodonthebrinkofbankruptcyorthesituationofbusinessisseriouslyintrouble,undersuchcondition,itisrequiredtoreducetheemployee.(inlegalprocedure)g.TheEmployeeshallnotbedismissed:i.TheContracthasneitherexpirednorconformedto8.d.8.e,8.f,8.g;ii.TheEmployeeisillwithoccupationaldiseaseorinjuredduetoworkandhasbeenauthenticatedfullyorpartlydisabledbytheLabourAuthenticationCommissioninBaodiCounty,Tianjin.iii.TheEmployeeisillorinjured(otherthanduetowork)andiswithintheperiodofmedicalleaveprovidedforbyapplicablePRClawandregulationsandCompanypolicy;iv.TheEmployeeiswomanwhoispregnant,onmaternityleave,ornursingababyunderoneyearofage;oriii.TheapplicablePRClawsandregulationsotherwiseprohibittheterminationofthisContract.h.TheContractmaybedichargedbytheEmployeebygivingnoticeinwrittenform3()(thirty)daysinadvance.However,theEmployeemayinformtheEmployertodischargetheContractatrandomunderthefollowingoccasions:i.TheEmployeeisstillintheprobationaryperiod;ii.TheEmployerforcetheEmployeetoworkbyviolence,duressorillegalrestrictiontophysicalfreedom;iii-TheEmployerdoesnotpaytheremunerationoftheEmployeeaccordancewiththerelevantclauseintheContract;iv.TheEmployerviolatestherelevantregulationsofStateorTianjinforitsterriblesafeandhealthcondition,whichisharmfultotheEmployeehealth-LTheContractcannotbeterminatedbytheEmployeebeforetheexpirationifnotconformingto8.d,8.h,j.TheEmployershallpaytheeconomiccompensationtotheEmployeriftheContractisterminatedconformingto8.d,8.f,8.h.i?8.h.iv.AdditionalfeeformedicalallowanceshouldbepaidtotheEmployeeiftheContractisterminatedconformingto8.f.i.9.BreachLiabilitiesa.Duetoeitherparty'sfault,ifbreachingtheContract,thatpartyshallundenakethebreachliabilityaccordingtotheextenttotheperformanceoftheContract;ifthepartiesbothbreachtheContract,theyshallundertakeitsseparateliabilityaccordingtotheconcretesituation.b.Duetoeitherparty'sfault,ifbreachingtheContracttodamagetheotherparty.ThedamageshouldbecompensatedbythefaultypartyaccordancewithlherelevantlawsandregulationsofPRC.c.Duetotheforcemajeure,causingthenon-performanceorthedamagestoeitherparty,theotherpartymaynotundertakelhebreachliability;c.TheEmployeewantsloresignandhasreceivedtrainingprovidedbytheEmployer,theEmployeeshallcompensateforthetrainingcost.Themethodofcompensationshouldbefixedaccordingtotherelevantcompanyregulationsasfollows:TheEmployeeshallcompensateRMBwithinyear(s)inlheCompanyiftheContractisterminatedbytheEmployeeathiscause;TheEmployeeshallcompensateRMBwithinyear(s)intheCompanyiftheContractislenninatedbytheEmployeeathiscause;TheEmployeeshallcompensateRMBwithinyear(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;httpdocsj/doc/ddf8a97a5afb770bf78a6529647d27284a733745.borDisputesWherealabordisputebetweenthepartiestakesplaceduringtheperformanceofthisContract,thepartiesconcernedmayseekforasettlementthroughconsultation;oreitherpartymayapplytothelabordisputemediationcommitteeoftheirunitformediation;ifthemediationfailsandoneofthepartiesrequestsforarbitration,thatparlymayapplytothelabordisputearbitrationcommitteeforarbitration.Eitherpartymayalsodirectlyapplytothelabordisputearbitrationcommitteeforarbitrationwithin60daysstarlingfromlhedateoftheoccurrenceofalabordispute.Ifoneofthepartiesisnotsatisfiedwithlheadjudicationofarbitration,thepartymaybringthecasetoapeople'scourtwithin15daysofthedateofreceivingtherulingofarbitrationIl.TheverificationofthisContractshallbemadeinBaodiLabourBureau,Tianjinwithin30daysafterbeingsignedbytheparties.Employer:(officialstamp)Employee:Representative:Address:Address:Date:July,2003It'sverifiedhereinthattheContractconformstotherelevantlawsandregulationsthroughexaminationandreview.Authority;Clerk:
