easeorinjuredduetoworkandhasbeenauthenticatedfullyorpartlydisabledbytheLabourAuthenticationCommissioninBaodiCounty,Tianjin.iii.TheEmployeeisillorinjured(otherthanduetowork)andiswithintheperiodofmedicalleaveprovidedforbyapplicablePRClawandregulationsandCompanypolicy;Employeeiswomanwhoispregnant,onmaternityleave,ornursingababyunderoneyearofage;orapplicablePRClawsandregulationsotherwiseprohibittheterminationofthisContract.ContractmaybedichargedbytheEmployeebygivingnoticeinwrittenform30(thirty)daysinadvance.However,theEmployeemayinformtheEmployertodischargetheContractatrandomunderthefollowingoccasions:Employeeisstillintheprobationaryperiod;EmployerforcetheEmployeetoworkbyviolence,duressorillegalrestrictiontophysicalfreedom;iii.TheEmployerdoesnotpaytheremunerationoftheEmployeeaccordancewiththerelevantclauseintheContract;EmployerviolatestherelevantregulationsofStateorTianjinforitsterriblesafeandhealthcondition,whichisharmfultotheEmployeeshealth.ContractcannotbeterminatedbytheEmployeebeforetheexpirationifnotconformingto,j.TheEmployershallpaytheeconomicpensationtotheEmployeriftheContractisterminatedconformingto,AdditionalfeeformedicalallowanceshouldbepaidtotheEmployeeiftheContractisterminatedconformingtoLiabilitiesa.Duetoeitherpartysfault,ifbreachingtheContract,thatpartyshallundertakethebreachliabilityaccordingtotheextenttotheperformanceoftheContract;ifthepartiesbothbreachtheContract,theyshallundertakeitsseparateliabilityaccordingtotheconcretesituation.b.Duetoeitherpartysfault,ifbreachingtheContracttodamagetheotherparty.ThedamageshouldbepensatedbythefaultypartyaccordancewiththerelevantlawsandregulationsofPRC.totheforcemajeure,causingthenon-performanceorthedamagestoeitherparty,theotherpartymaynotundertakethebreachliability;EmployeewantstoresignandhasreceivedtrainingprovidedbytheEmployer,theEmployeeshallpensateforthetrainingcost.Themethodofpensationshouldbefixedaccordingtotherelevantpanyregulationsasfollows:TheEmployeeshallpensateRMB_within_year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;TheEmployeeshallpensateRMB_within_year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;TheEmployeeshallpensateRMB_within_year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;DisputesWherealabordisputebetweenthepartiestakesplaceduringtheperformanceofthisContract,thepartiesconcernedmayseekforasettlementthroughconsultation;oreitherpartymayapplytothelabordisputemediationmitteeoftheirunitformediation;ifthemediationfailsandoneofthepartiesrequestsforarbitration,thatpartymayapplytothelabordisputearbitrationmitteeforarbitration.Eitherpartymayalsodirectlyapplytothelabordisputearbitrationmitteeforarbitrationwithin60daysstartingfromthedateoftheoccurrenceofalabordispute.Ifoneofthepartiesisnotsatisfiedwiththeadjudicationofarbitration,thepartymaybringthecasetoapeoplescourtwithin15daysofthedateofreceivingtherulingofarbitrationverificationofthisContractshallbemadeinBaodiLabourBureau,Tianjinwithin30daysafterbeingsignedbytheparties.Employer:(officialstamp)?Employee:Representative:Address:?Address:Date:July,XXItsverifiedhereinthattheContractconformstotherelevantlawsandregulationsthroughexaminationandreview.Authority;
