    Good is good, but better carries it.精益求精,善益求善。laborcontract英文版劳动合同-S/N:EmploymentContractEmployer:Employee:PublishedbyNingboLaborandSocialSecurityBureauEmployer(hereinafterreferredtoas“PartyA”):Name:LegalRepresentative:orChiefLeader:Address:Employee(hereinafterreferredtoas“PartyB”):Name:EducationalBackground:IdentificationCardNo:Residence:Thiscontractisexecutedbytwopartiesinaccordancewiththeapplicableprovisionof“TheLaborLawofthePeoplesRepublicofChina”,“LawofthePeoplesRepublicofChinaonEmploymentContracts”andotherlawsandregulationsonthebasisofequality,voluntarinessandconsensus.Article1TermofcontractandProbationPeriod,andshallcommenceon()A. Fixedperiod.ThetermofthisContractshallbe_years,from_/_/_to_/_/_duringwhichthereshallbeaprobationperiodof_months,from_/_/_to_/_/_.B. Unfixedperiod.ThetermofthisContractshallbecalculatedfromthedateof_/_/_,includingtheprobationperiodof_months.Thiscontractshallbeterminatedwhenthecircumstancesofstatutoryterminationoccur.C. Thetermforfulfillingtheproductionwork.ThetermofthisContractshallbefromthedateof_/_/_,aftersuchproductionworkiscompleted,bothpartiesshallterminatethelaborcontract.IfthisContractissignedbeforeemployment,thelaborrelationshallbeestablishedsincethedateofemployment.Article2JobDescriptionTheEmployeragreetoemployMr./Ms._(name)as_(jobtitle)in_Department,locatedin_(officelocationandcity).PartBshallcompletehisworkaccordingtothejobdutiesdefinedbyPartyA.Article3Workinghours,restbreaksandholidaysPartyAshallimplementthefollowing()typeofworkinghoursystemforthepositionofPartyB.A. Standardworkinghoursystem.B. Comprehensiveworkinghoursystem.Flexibleworkinghoursystem.Inaccordancewithgovernmentrequirements,partyAandpartyBshouldstrictlycomplywithrulesofwokingtimes.ForoptionA,thenormalworkinghoursoftheEmployeeshallbeeighthourseachday,excludingmealsandrestforanaverageoffivedaysperweek,foranaverageoffortyhoursperweek.TheEmployermayextendworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunionandtheEmployee,buttheextendedworkinghourforadayshallgenerallynotexceedonehour;Ifsuchextensioniscalledforduetospecialreasons,theextendedhoursshallnotexceedthreehoursaday.However,thetotalextensioninamonthshallnotexceedthirty-sixhours.ForoptionBorC,onthebasisofensurepartyBhaveagoodhealthandwouldlistentopartyBsidea,partyAcantakemeasuresofconcentratedwork,concentratedrest,additionaltimeoff,flexibleworkinghourtoensurepartyBcanenjoytherightofrests,vocationsandcancompleteproductionsandworkingtasks.PartyBshallbeentitledtolegalannualvacations.Article41. LaborRemunerationThesalaryoftheEmployeeisRMB_permonthintheprobationaryperiod.Thissalaryshouldnotlowerthanthelowestsalarystandardonthesamepositioninourcompanyor80%ofitsofficialwage,anditsalsoshouldntlowerthanlocalminimumwagestandard.2. Aftertheprobationaryperiod,thesalaryoftheEmployeeshallbeRMB_,andthewageswillbemadeby()a.Hourlywagesb.piecewagesAccordingtothewagedistributionsystemofpartyA,bythetwosidesconsensus,Duringthetermofthecontract,thesalaryadjustedbypartyAforpartyBisthewageofthiscontract(shouldntlowerthanlocalminimumwagestandard).3. PartyBssalarywillbepaidby()a.offeredbybanksb.payincash4. PartyAshouldpaythelegaltendertopartyBasmonthlysalary,thepartyAshouldpaythewagesbeforeeachmonth,andofferthepayrolltopartyB.Incaseoftheholidayorweekend,partyAshouldpayattherecentworkingdaypaymentaheadoftime.PartyAshouldpaypartyBovertimewagesinaccordancewithrelevantregulationifpartyArequestpartyBtoworkovertimeonworkingday,workonoff-daysorlegalholidays.AndthisshallbecarriedoutbyrelevantlawsandregulationsandtherelevantregulationspreparedbyPartyAinaccordancewithlaw.Article51. Insurance,WelfareandBenefitsPartyAshallpayrelevantsocialinsurancetodesignatedauthoritiesonPartyBSbehalfinatimelymannerinaccordancewithgovernmentrequirements.Andthepersonalpartwillbedeductedfromthesalary.2. PartyB'svocationofpregnancy,childbirth,breast-feedingandthecorrespondingtreatmentshouldaccordingtotherelevantregulations,suchasmaternityinsurance,femaleemployee'slaborprotection,etc.ThetreatmentforPartyBsoccupationaldiseaseorjobrelatedinjuries(death),sicknessornon-jobrelatedinjuries,andtheproviedofmedicaidexpensespaidshouldbecarryoutbyndustrialinjuryinsurance,medicalinsuranceandrelatedprovisions.Article6a. WorkingProtection&WorkingConditionsPartyAandPartyBshallstrictlycomplywiththenationalregulationswhichconcerningproductionsafetyandabidebyregulationsoflabourprotectionandoccupationalhazardsandprotectionofworkers.b. PartyAshallprovidePartyBprotectionfacilities,equipmentandlaborprotectionarticlesandotherlaborprotectionconditionsinaccordancewiththenationallabor.c. PartyBshallstrictlycomplywiththesafeoperationandtherelevantrulesandregulationspreparedbyPartyAinaccordancewithlaw.IfPartyAillegalcommandorforceriskoperation,partyBhavetherighttorefuseit.d. PartyAmuststrictlyimplementrelevantOccupationalDiseasePreventionLaws,forthepositionsexposetooccupationaldiseasehazards,suchasexposuretodust,radioactivesubstancesandothertoxicandhazardoussubstances,PartyAshouldtellthetruthanditsconsequencesonoccupationalhazards,protectivemeasuresandtreatmentofoccupationaldiseasestopartyB,andtakepreventivemeasuresandprotectionfacilitieswhichmeettherequirementsofthenationaloccupationalhealth.IfPartyBisengagedintheoperationthatmayexposetooccupationaldiseasehazards,PartyAshallorganizeoccupationalhealthexaminationbeforegoondutyandleavethepostinaccordancewithrelevantnationalprovisions,andshallconductregularoccupationalhealthexaminationonPartyBduringthecontractterm.Article7Amendment,TerminationandEndingofEmploymentContracts1.Theemploymentcontractcouldbeamendedinafriendlynegotiationwiththeamendmentprocedureoperatingintime.2.OtherthanthecircumstancesstipulatedinArticle38in“EmploymentContractLaw”,PartyBmayterminatehisemploymentcontractupon30dayspriorwrittennoticetoPartyA.Duringhisprobationperiod,hemayterminatehisemploymentcontractbygivingPartyAthreedayspriornotice.3.PartyAmayterminateemploymentcontractinvolvinginthecircumstancesspecifiedinArticle39,40&41in“EmploymentContractLaw”.ShouldPartyBfallsinthecircumstancespecifiedinArticle42in“EmploymentContractLaw”,PartyAmustnotterminateemploymentcontractaccordingtoitemsregulatedinArticle40&41in“EmploymentContractLaw”.4.Theemploymentcontractmayterminateifitconformstothecircumstanceasspecifiedin“EmploymentContractLaw”andothernational,provincialandmunicipalemploymentcontractrelatedprovisions.5.Terminationofemploymentcontracttoemployeeswhosufferemploymentinjuryoroccupationaldiseaseshallbeoperatedagainstnationalemploymentinjuryprovisions.6.PartyAshallpaytheemployeeseverancepayinvolvinginthecircumstancesspecifiedinArticle46in“EmploymentContractLaw”.7.Atthetimeofterminationorendingofanemploymentcontract,PartyAshallissueaproofofterminationorendingoftheemploymentcontractand,within15days,carryouttheproceduresforthetransferofPartyBsfileandsocialinsuranceaccount.PartyBshallcarryouttheproceduresforthehandoverofhisworkasagreedbytheparties.Article8Covenants1.AccordingtoprovisionsofArticle22,23&24in“EmploymentContractLaw”,covenantsareagreedbelow:a.b.2)Othercovenants:Article9PartyAshallestablishinternalrulesandregulationsagainstlegalprocedureswithPartyBinformedandnoted.PartyBshallstrictlyabidebyrulesandregulationssetbyPartyA.Article10Whereanemploymentdisputebetweenthepartiestakesplaceduringtheperformanceofthiscontract,thepartiesconcernedmayseekforasettlementthroughconsultationormayapplytotheemploymentdisputemediationcommitteeofPartyAsunitformediation.Ifthemediationfailsandoneofthepartiesrequestsforarbitration,thatpartymayalsodirectlyapplytotheemploymentarbitrationcommitteelocatedinPartyAsforarbitrationin60daysupontheemploymentdisputeoccurrence.Article11Formattersnotcoveredbythiscontract,orintheeventthattheprovisionsofthiscontractcontraveneapplicablelaws,regulationsandpolicies,applicablelaws,regulationsandpoliciesshallcontrol.Article12Thiscontractshallbeinduplicatecopies,withonecopyforeachoftheparties,andshalltakeeffectuponaffixationtheretoofthesignatureandsealsoftheparties.PartyAshouldretainthelaborcontractwhichhasbeendissolvedorterminatedatleasttwoyearsforfuturereference.PartyA(CompanySeal):PartyB(Seal):SignatureofAuthorizedRepresentative:orSignatureofChiefLeader:EmploymentContractConclusionDate:EmploymentContractPerformanceStartingDate:-
