姑苏区城管局基层执法行为规范探究,行政管理论文【题目】姑苏区城管局基层执法行为规范探究 【绪论】 【第一章】 【第二章】 【第三章】 【第四章】 【结束语/以下为参考文献】 摘 要 随着我们国家当代化进程的不断推进，城市规模日趋扩张，城市管理已经成为地方的首要职能，自上世纪 90 年代起各地成立城市管理综合行政执法机构，培养了一支数量庞大的城市管理行政执法队伍，在城市管理方面获得了一定成效，但这支新成立的执法队伍面对层出不穷的城市管理问题时可谓是探索着前进。 由于城管执法、法律地位、权限边界的不明确、城市管理理念的滞后等原因导致当前基层城管的执法工作陷入尴尬窘境，并出现部分基层城管执法行为失范现象。基层城管执法行为失范现象主要表现为服务理念缺失带来暴力执法，任意扩大自由裁量权，执法程序不规范和消极执法等。本文以苏州市姑苏区为例，采用文案研究法和个案访谈法分析基层城管执法行为失范现象，通过深切进入分析发现引起执法行为失范的原因主要有法律制度不完善、基层城管执法人员服务理念缺失、执法人员素质不高以及城管执法队伍内部监督机制匮乏等。想要改变基层城管执法行为失范的现在状况，能够通过完善城管法律，转变城管执法理念、提高城管队伍素质，加强外部监督等来规范基层城管执法行为，在详细执法经过中贯彻惩罚与教育相结合的原则，多点耐心和细心，做到文明理性执法，有效杜绝城管执法行为失范现象，提高执法效率。 本文关键词语：基层城管 执法行为 失范 Abstract With the development of China s modernization process and the increasingexpansion of city size , urban management has become the primary functions of localgovernment. The establishment of integrated urban management law enforcementmechanism brings a strong and special urban management law enforcement team. It hasachieved some success in city management, but this newly established law enforcementteam also has to face emerging urban management issues as groping forward . Due to the uncivilized law enforcement of city inspectors, the nature of urbanmanagement, unclear legal status and laggard management theory of UrbanManagement, The law enforcement of city inspectors from grass-roots level chased intothe awkward predicament with city inspectors anomie actions. The anomie actions isform of standardized enforcement procedures, violence law enforcement, negative lawenforcement and abuse of discretion.In Gusu district of Suzhou s case, analyzing theanomie actions of City inspectors from grassroots by using theoretical analysis and casestudies as research methods. The causes may be grouped under three heads: un-complete legislation system, lack of service concept and low quality of lawenforcement officers, also lacking supervision over law enforcement officers.Bychanging the concept of urban management, when refer to specific policies whichshould reflect more interests of opposite person for administration and the public. Meanwhile it s necessary to complete relevant laws, rules and regulations about urbanmanagement. As well as improving the qualities of city inspectors, In order to regulatethe law enforcement of city inspectors, to improve the efficiency of law enforcement.
