无线电发射设备管理规定（2022年12月22日，工业和信 息化部令第57号公布，自2023 年7月1日起施行。）第一条为了加强无线电发 射设备管理，防止和减少无线电 干扰，维护空中电波秩序，促进 无线电技术应用和产业发展，根 据中华人民共和国无线电管理 条例和相关法律、行政法规，无线电发射设备管理规定Provisions on the Administration of RadioTransmission Equipment制定机关：工业和信息化部发文字号：工业和信息化部令第57号公布日期：施行日期：效力位阶：部门规章法规类别：无线电Issuing Authority ： Ministry of Industry & Information TechnologyDocument Number ： Order No. 57 of ihc Ministry of Industry and Inibrmalion TechnologyDate Issued ： 12-22-2022Effective Date ： 07-01-2023Level of Authority ： Departmental RulesArea of Law ： Radioof Radioof RadioProvisions on the Administration Transmission Equipment (Issued by Order No. 57 of the Ministry of Industry and Information Technology on December 22, 2022, and coming into force on July 1, 2023)Article 1 These Provisions are formulated in accordance with the Regulation of the People's Republic of China on Radio Administration and relevant laws and administrative regulations for purposes of strengthening the administration of radio transmission equipment, preventing and reducing radio interference, maintaining the order of airborneshould be made to the radio regulatory authority of the province, autonomous region, or municipality directly under the Central Government where the activity takes place; and进关所在地的省、自治区、直辖 市无线电管理机构提出申请；(2) For the radio transmission equipment used for type approval, an application should be made to the radio regulatory authority of the state.（二）用于办理型号核准的，向 国家无线电管理机构提出申请。Article 20 An application for approval documents for temporary entry into China shall meet the following conditions:第二十条申请临时进关批 准文件应当符合以下条件：(1) The radio transmission equipment applying for temporary entry has clear, specific, and legal purposes;（-）申请临时进关的无线电发 射设备具有明确具体、合法的用 途；(2) The working frequency, power, and other technical indicators of the radio transmission equipment meet the national standards and the state's relevant provisions on radio regulation; and（二）无线电发射设备的工作频 率、功率等技术指标符合国家标 准和国家无线电管理的有关规 定；(3) Other conditions provided by laws and administrative regulations.（三）法律、行政法规规定的其 他条件。Article 21 In applying for approval documents for temporary entry into China, an applicant shall submit to the radio regulatory authority the following application materials and be responsible for their authenticity and completeness:第二十一条申请临时进关 批准文件，应当向无线电管理机 构提交下列申请材料，并对申请 材料的真实性、完整性负责：（一）经申请人法定代表人或者 委托人签署的无线电发射设备进 关核准申请表；（二）加盖申请人签章的营业执 照副本、事业单位法人证书复印 件或者组织机构证明材料（后者 仅限境外申请人）；（三）临时进关合同或者设备运 单；（四）无线电发射设备在有效期 届满前复运出境的承诺书；(5) Other materials required by administrative regulations.第二十二条无线电管理机 构应当自受理临时进关申请之日 起20个工作日内作出批准或者 不予批准的决定。予以批准的， 签发批准文件；不予批准的，应 当书面通知申请人并说明理由。临时进关批准文件有效期不超过 6个月。有效期届满的，应当按 照规定及时复运出境。(1) An application form for approval of the entry of radio transmission equipment signed by the legal representative or principal of the applicant;A copy of the business license signed by the applicant, a photocopy of the legal person certificate of the public institution or the certification materials of the organization (the latter is only for overseas applicants);(2) The temporary entry contract or the equipment waybill;A letter of commitment to re-shipping the radio transmission equipment out of China before the expiration of the period of validity; andlaws and （五）法律、行政法规规定的其 他材料。Article 22 The radio regulatory authority shall decide whether to grant approval or not within 20 working days of acceptance of the application for temporary entry. If approval is granted, an approval document shall be issued; otherwise, the applicant shall be notified in writing and the reasons shall be explained.The period of validity of the approval document for temporary entry shall not exceed six months. If the period of validity expires, the radio transmission equipment shall be re-shipped forthwith out of China in accordance with the provisions.Article 23 Anyone who sells radio transmission equipment that should obtain type approval shall go through the formalities for sales recordation with the radio regulatory authority of a province, autonomous region, or municipality directly under the Central Government. The recordation information shall be valid, and be updated in a timely manner.Article 24 Anyone who maintains the radio transmission equipment that should obtain type approval shall not change the technical indicators approved in the type approval certificate.Article 25 The micro-power short-range radio transmission equipment produced or imported for sale and use in China shall comply with the relevant provisions and technical requirements of the radio regulatory authority of the state, and the special signs for the micro-power short-range radio transmission equipment shall be marked in the micro-power short- range radio transmission equipment and its instructions for use. The marking method and pattern of the special signs shall be formulated separately.第二十三条销售应当取得 型号核准的无线电发射设备的， 应当向省、自治区、直辖市无线 电管理机构办理销售备案。备案 信息应当真实、有效并及时更 新。第二十四条维修应当取得 型号核准的无线电发射设备的， 不得改变型号核准证核定的技术 指标。第二十五条生产或者进口 在国内销售、使用的微功率短距 离无线电发射设备，应当符合国 家无线电管理机构的有关规定和 技术要求，在微功率短距离无线 电发射设备及使用说明中标注微 功率短距离无线电发射设备的专 用标识。专用标识标注方式和样 式另行制定。微功率短距离无线电发射设备使 用说明中应当注明“使用微功率 短距离无线电发射设备应当符合 国家无线电管理有关规定”字 样。The instructions for the use of micro-power short- range radio transmission equipment shall indicate the words “THE USE OF MICRO-POWER SHORT- RANGE RADIO TRANSMISSION EQUIPMENT SHALL COMPLY WITH THE RELEVANT PROVISIONS OF THE STATE ON RADIO ADMINISTRATION".Article 26 For the development, production, sale, and maintenance of high-power radio transmission equipment, measures such as installing filters and shielding equipment and replacing electronic components shall be taken to effectively inhibit the emission of radio waves, and no harmful interference shall be caused to radio stations set up and used according to the law. If a harmful interference occurs, the radio wave emission shall be stopped immediately. Where effective launch tests are carried out, procedures for the temporary installation and use of radio stations shall be completed in accordance with the law.Article 27 The radio regulatory authority shall strengthen the supervision and inspection of the development, production, import, sale, and maintenance of radio transmission equipment, establish and improve the supervision and management system of random spot checks, randomly dispatch inspectors and randomly select inspected objects, and timely announce to the public the list of spot checks, spot checks, and investigation results.The inspected objects shall cooperate on the supervision and inspection by the radio management institution and truthfully provide relevant information and materials.第二十六条研制、生产、 销售和维修大功率无线电发射设 备，应当采取加装滤波器、安装 屏蔽设备以及更换电子元器件等 措施有效抑制电波发射，不得对 依法设置、使用的无线电台 （站）产生有害干扰。产生有害 干扰的，应当立即停止电波发 射。进行实效发射试验的，应当 依法办理临时设置、使用无线电 台（站）手续。第二十七条无线电管理机 构应当加强对研制、生产、进 口、销售和维修无线电发射设备 的监督检查，建立和完善随机抽 查监督管理制度，随机选派检查 人员，随机抽取被检查对象，及 时向社会公布抽查事项目录、抽 查情况和查处结果。被检查对象应当配合无线电管理 机构的监督检查，如实提供有关 情况及材料。第二十八条无线电管理机Article 28 A radio regulatory authority and its staffshall strictly keep confidential the trade secrets and personal privacy information that comes to their knowledge in the performance of their duties, and shall not disclose or illegally provide them to others.Article 29 Whoever develops, produces, imports, sells, or maintains radio transmission equipment in violation of these Provisions shall be ordered by the radio regulatory authority to take corrective action, and be punished in accordance with the Administrative License Law of the People's Republic of China, the Regulation of the People's Republic of China on Radio Administration, and other laws and administrative regulations.Whoever produces or sells radio transmission equipment in violation of laws and regulations on product quality control shall be punished by the market regulatory department according to the law. Whoever imports, carries, delivers, or otherwise ships radio transmission equipment into China in violation of laws and regulations on customs control shall be punished by the customs according to the law.If the violation constitutes a public security administration violation, the violator shall be given a public security administration penalty in accordance with the law; if the violation is criminally punishable, the violator shall be held criminally liable in accordance with the law.构及其工作人员应当对在履行职 责中知悉的商业秘密和个人隐私 信息严格保密，不得泄露或者非 法向他人提供。第二十九条 研制、生产、 进口、销售、维修无线电发射设 备违反本规定的，由无线电管理 机构责令改正，依照中华人民 共和国行政许可法中华人民 共和国无线电管理条例等法 律、行政法规予以处罚。生产、销售无线电发射设备违反 产品质量管理法律法规的，由市 场监督管理部门依法处罚；进 口、携带、寄递或者以其他方式 运输无线电发射设备入境，违反 海关监管法律法规的，由海关依 法处罚。构成违反治安管理行为的，依法 给予治安管理处罚；构成犯罪 的，依法追究刑事责任。第三十条无线电管理机构 及其工作人员不依照中华人民Article 30 If a radio regulatory authority and its staff fail to perform their duties in accordance with the Regulation of the People's Republic of China onRadio Administration and these Provisions, disciplinary actions shall be taken according to the law against the liable leaders and other directly liable persons.共和国无线电管理条例和本规 定履行职责的，对负有责任的领 导人员和其他直接责任人员依法 给予处分。Article 31 The use of radio transmission equipment shall comply with the relevant provisions on the administration of radio stations, unless it is otherwise provided by the state.第三十一条 使用无线电发 射设备，应当遵守无线电台 （站）管理的相关规定，国家另 有规定的，从其规定。Article 32 These Provisions shall come into force on第三十二条本规定自2023July 1,2023.年7月1日起施行。radio waves, and promoting the application of radio 制定本规定。 technology and industrial development.第二条 在中华人民共和国 境内研制、生产、进口、销售和 维修无线电发射设备，应当遵守 本规定。Article 2 The development, production, import, sale, and maintenance of radio transmission equipment within the territory of the People's Republic of China shall be governed by these Provisions.前款所称无线电发射设备是指为 开展各类无线电业务而发射无线 电波的设备。The radio transmission equipment mentioned in the preceding paragraph means the equipment that transmits radio waves for launching various radio services.第三条国家无线电管理机 构负责全国无线电发射设备研 制、生产、进口、销售和维修活 动的监督管理。Article 3 The radio regulatory authority of the state shall be charged with the supervision and administration of the research, production, import, sale, and maintenance of radio transmission equipment nationwide.省、自治区、直辖市无线电管理 机构依照本规定负责本行政区域 内无线电发射设备研制、生产、 进口、销售和维修活动的监督管 理。The radio regulatory authority of a province, autonomous region, or municipality directly under the Central Government shall, in accordance with these Provisions, be charged with the supervision and administration of the research, production, import, sale, and maintenance of radio transmission equipment within their respective jurisdictions.国家无线电管理机构和省、自治 区、直辖市无线电管理机构统称 无线电管理机构。The radio regulatory authority of the state and the radio regulatory authority of provinces, autonomous regions, or municipalities directly under the Central Government are collectively referred to as radio regulatory authorities.Article 4 The radio frequencies used in the development of radio transmission equipment shall comply with the provisions of the state on the divisions of radio frequencies.第四条研制无线电发射设 备使用的无线电频率，应当符合 国家无线电频率划分规定。Article 5 The production and import of radio transmission equipment for sale and use in China shall comply with laws and regulations on product quality, national standards, and the state's relevant provisions on radio regulation.第五条生产或者进口在国 内销售、使用的无线电发射设 备，应当符合产品质量等法律法 规、国家标准和国家无线电管理 的有关规定。Article 6 For production or importation of radio transmission equipment, other than micro-power short-distance radio transmission equipment, for sale and use in China, an application shall be made to the radio regulatory authority of the state for approval of the type of radio transmission equipment. The catalogue for the approved types of radio transmission equipment shall be published by the radio regulatory authority of the state.第六条 生产或者进口在国 内销售、使用除微功率短距离无 线电发射设备以外的无线电发射 设备，应当向国家无线电管理机 构申请无线电发射设备型号核 准。无线电发射设备型号核准目 录由国家无线电管理机构公布。Article 7 In applying for approval of the type of radio transmission equipment, an applicant shall meet the following conditions:第七条 申请无线电发射设 备型号核准，应当符合下列条 件：(1) The applicant has the corresponding production capacity, technical strength, and a quality assurance system;（一）申请人有相应的生产能 力、技术力量、质量保证体系；（二）无线电发射设备的工作频 率、功率等技术指标符合国家标 准和国家无线电管理的有关规 定；(2) The working frequency, power, and other technical indicators of the radio transmission equipment meet the national standards and the state's relevant provisions on radio regulation; and（三）法律、行政法规规定的其 他条件。（三）法律、行政法规规定的其 他条件。(3) Other conditions provided by laws and administrative regulations.第八条申请无线电发射设 备型号核准，应当向国家无线电 管理机构提交下列申请材料，并 对申请材料的真实性、完整性负 责：Article 8 In applying for approval of the type of radio transmission equipment, the applicant shall submit the following application materials to the radio regulatory authority of the state and be responsible for the authenticity and integrity of the application materials.（一）经申请人法定代表人或者 其委托人签署的型号核准申请表 和承诺书；(1) The application form for or letter of commitment to type approval signed by the legal representative or principal of the applicant;（二）加盖申请人签章的营业执 照副本、事业单位法人证书复印 件或者组织机构证明材料（后者 仅限境外申请人）；（二）加盖申请人签章的营业执 照副本、事业单位法人证书复印 件或者组织机构证明材料（后者 仅限境外申请人）；(2) A copy of the business license signed by the applicant, a photocopy of the legal person certificate of the public institution or the certification materials of the organization (the latter is only for overseas applicants);（三）与无线电发射设备生产相 适应的生产能力、技术力量和质 量保证体系说明材料；（三）与无线电发射设备生产相 适应的生产能力、技术力量和质 量保证体系说明材料；(3) Descriptive materials for the production capacity, technical strength, and quality assurance system that are commensurate with the production of radio transmission equipment;（四）无线电发射设备使用说明 （含电子显示的说明）、技术手 册、彩色照片，以及与无线电发（四）无线电发射设备使用说明 （含电子显示的说明）、技术手 册、彩色照片，以及与无线电发(4) Instructions on the use of radio transmission equipment (including instructions on the electronic display), technical manuals, color photos, circuit diagrams relating to radio transmission and receptionfunctions, the circuit principle block diagram, and the list of key radio frequency components; andfunctions, the circuit principle block diagram, and the list of key radio frequency components; and射和接收功能相关的电路图、电 路原理方框图、关键射频元器件 清单；（五）法律、行政法规规定的其 他材料。（五）法律、行政法规规定的其 他材料。(5) Other materials required by laws and administrative regulations.第九条 国家无线电管理机 构应当依法对申请型号核准的无 线电发射设备是否符合本规定第 七条规定的条件进行审查，并自 受理申请之日起15个工作日内 作出核准或者不予核准的决定。 予以核准的，核发纸质或者电子 型号核准证；不予核准的，书面 通知申请人并说明理由。电子型 号核准证与纸质型号核准证具有 同等效力。Article 9 The radio regulatory authority of the state shall, according to the law, examine whether the radio transmission equipment applying for type approval meets the conditions prescribed in Article 7 of these Provisions, and decide whether to grant the approval within 15 working days of acceptance of the ap
