动物诊疗机构管理办法(2022)Measures for the Administration of Veterinary Institutions发布部门：农业农村部发文字号：中华人民共和国农业农村部令2022年第5号发布日期：2022.09.07实施日期：2022.10.01效力级别：部门规章法规类别：农业管理Issuing Authority : Ministry of Agriculture and Rural AffairsDocument Number： Order No. 5 2022 of the Ministry of Agriculture and RuralAffairs of the People's Republic of ChinaDate Issued： 09-07-2022Effective Date： 10-01 -2022Level of Authority： Departmental Rules中华人民共和国农业农村部 令Area of Law： Agriculture AdministrationOrder of the Ministry of Agriculture and Rural Affairs of the People's Republic of China(No. 5 2022)动物诊疗机构管理办法 已于2022年8月22日经农 业农村部第9次常务会议审 议通过，现予公布，自2022 年10月1日起施行。部长唐仁健2022年9月7日（2022年第5号）The Measures for the Administration of Veterinary Institutions, as adopted at the 9th executive meeting of the Ministry of Agriculture and Rural Affairs on August 22, 2022, are hereby issued, and shall come into force on October 1,2022.Minister Tang RenjianSeptember 7, 2022Chapter III Management of Diagnosis Treatment Activitiesand第三章诊疗活动管理Article 17 A veterinary institution shall engage in animal diagnosis and treatment activities in accordance with the law, establish and improve its internal management systems, and hang its animal diagnosis and treatment permit and publicize the basic information about its animal diagnosis and treatment activities in a conspicuous position of the diagnosis and treatment place.第十七条动物诊疗机 构应当依法从事动物诊疗活 动，建立健全内部管理制 度，在诊疗场所的显著位置 悬挂动物诊疗许可证和公示 诊疗活动从业人员基本情 况。Article 18 A veterinary institution shall, through licensed veterinarians filed with it for recordation, conduct animal diagnosis and treatment activities by use of the Internet and other information technology, the scope of which shall not be beyond the scope of diagnosis and treatment activities approved by the animal diagnosis and treatment permit.第十八条动物诊疗机 构可以通过在本机构备案从 业的执业兽医师，利用互联 网等信息技术开展动物诊疗 活动，活动范围不得超出动 物诊疗许可证核定的诊疗活 动范围。Article 19 A veterinary institution shall strengthen supervision of and guidance for veterinary-related students and graduates' participation in animal diagnosis and treatment activities.第十九条动物诊疗机 构应当对兽医相关专业学 生、毕业生参与动物诊疗活 动加强监督指导。10第二十条动物诊疗机 构应当按照国家有关规定使 用兽医器械和兽药，不得使 用不符合规定的兽医器械、 假劣兽药和农业农村部规定 禁止使用的药品及其他化合 物。第二十一条 动物诊疗 机构兼营动物用品、动物饲 料、动物美容、动物寄养等 项目的，兼营区域与动物诊 疗区域应当分别独立设置。第二十二条动物诊疗 机构应当使用载明机构名称 的规范病历，包括门（急） 诊病历和住院病历。病历档 案保存期限不得少于三年。病历根据不同的记录形式， 分为纸质病历和电子病历。 电子病历与纸质病历具有同 等效力。病历包括诊疗活动中形成的 文字、符号、图表、影像、 切片等内容或者资料。Article 20 A veterinary institution shall use veterinary medical devices and drugs according to the applicable provisions issued by the state, instead of using veterinary devices that fail to comply with the applicable provisions, counterfeit veterinary drugs or veterinary drugs of inferior quality, and other medicinal products and chemical compounds prohibited by the Ministry of Agriculture and Rural Affairs from use.Article 21 Where a veterinary institution concurrently engages in pet supplies, pet food, pet grooming, pet foster care, or any other business, the area for such a concurrent business shall be separated from the area for animal diagnosis and treatment services.Article 22 A veterinary institution shall use standard medical records bearing the name of the institution, including medical records for outpatient (emergency) services and inpatient medical records for inpatient services. Medical records shall be retained in the archives for three years or more.Medical records are divided into paper medical records and electronic medical records according to the different forms of records. Electronic medical records and paper medical records shall be equally effective.Medical records include the texts, symbols, charts, images, sections, and other content or information formed in diagnosis and treatment activities.11Artide 23 A veterinary institution shall provide veterinary prescription pads for licensed veterinarians, and the format and preservation of prescription pads, among others, shall comply with the formats and application specifications of veterinary prescriptions prescribed by the Ministry of Agriculture and Rural Affairs.第二十三条动物诊疗 机构应当为执业兽医师提供 兽医处方笺，处方笺的格式 和保存等应当符合农'业农村 部规定的兽医处方格式及应 用规范。Article 24 Where a veterinary institution installs or uses any radioactive equipment for animal diagnosis and treatment, it shall obtain approval from the environmental protection department.第二十四条动物诊疗 机构安装、使用具有放射性 的诊疗设备的，应当依法经 生态环境主管部门批准。Article 25 Where a veterinary institution finds that an animal is infected with an epidemic or is suspected of being infected with an epidemic, it shall immediately report to the local department of agriculture and rural affairs or the local institution for control and prevention of animal epidemics according to the provisions issued by the state, and rapidly take isolation and other control measures to prevent the spread of animal epidemics.第二十五条动物诊疗 机构发现动物染疫或者疑似 染疫的，应当按照国家规定 立即向所在地农业农村主管 部门或者动物疫病预防控制 机构报告，并迅速采取隔 离、消毒等控制措施，防止 动物疫情扩散。Where a veterinary institution finds that an animal is infected with an epidemic or is suspected of being infected with an epidemic, requiring culling according to the provisions of the state, it shall not conduct treatment without permission.动物诊疗机构发现动物患有 或者疑似患有国家规定应当 扑杀的疫病时，不得擅自进 行治疗。12第二十六条动物诊疗 机构应当按照国家规定处理 染疫动物及其排泄物、污染 物和动物病理组织等。动物诊疗机构应当参照医 疗废物管理条例的有关规 定处理诊疗废弃物，不得随 意丢弃诊疗废弃物，排放未 经无害化处理的诊疗废水。第二十七条动物诊疗 机构应当支持执业兽医按照 当地人民政府或者农业农村 主管部门的要求，参加动物 疫病预防、控制和动物疫情 扑灭活动。动物诊疗机构可以通过承接 政府购买服务的方式开展动 物防疫和疫病诊疗活动。第二十八条动物诊疗 机构应当配合农业农村主管 部门、动物卫生监督机构、 动物疫病预防控制机构进行 有关法律法规宣传、流行病 学调查和监测工作。Article 26 A veterinary institution shall dispose of animals infected with epidemics and their excrement, wastes, and animal pathological tissues in accordance with the provisions issued by the stateA veterinary institution shall dispose of wastes in diagnosis and treatment activities with reference to the applicable provisions of the Regulation on the Administration of Medical Wastes, instead of arbitrarily discarding wastes in diagnosis and treatment activities or discharging sewage in diagnosis and treatment activities without innocuous disposal.Article 27 A veterinary institution shall support its licensed veterinarians in participating in such activities as the prevention and control of animal diseases and the elimination of animal epidemics according to the requirements of the local people's government or the local department of agriculture and rural affairs.A veterinary institution may conduct such activities as the prevention of animal epidemics and the diagnosis and treatment of diseases through undertaking services purchased by governments.Article 28 A veterinary institution shall cooperate with a department of agriculture and rural affairs, an animal health supervisory agency, or an institution for control and prevention of animal epidemics in the publicity of relevant laws and regulations or epidemiological investigation and monitoring.13Article 29 A veterinary institution shall provide regular training for its staff members on expertise, biosafety, and relevant policies and regulations.第二十九条动物诊疗 机构应当定期对本单位工作 人员进行专'业知识、生物安 全以及相关政策法规培训。Article 30 A veterinary institution shall report on its animal diagnosis and treatment activities in the last year to the department of agriculture and rural affairs of the people's government at the county level before the end of March each year.第三十条动物诊疗机 构应当于每年三月底前将上 年度动物诊疗活动情况向县 级人民政府农业农村主管部 门报告。Article 31 The department of agriculture and rural affairs of a people's government at or above the county level shall establish and improve a routine regulation system to conduct supervision and inspection of the implementation of laws, regulations, and rules by veterinary institutions and their staff members within its jurisdiction.第三十一条县级以上 地方人民政府农业农村主管 部门应当建立健全日常监管 制度，对辖区内动物诊疗机 构和人员执行法律、法规、 规章的情况进行监督检查。Chapter IV Legal Liability第四章法律责任Article 32 Where a veterinary institution, inviolation of the provisions of these Measures, fallsunder any of the following circumstances,第三十二条违反本办 法规定，动物诊疗机构有下14列行为之一的，依照中华 人民共和国动物防疫法第 一百零五条第一款的规定予punishments shall be imposed on it according to paragraph 1 of Article 105 of the Animal Epidemic Prevention Law of the People's Republic of China:以处罚:（一）超出动物诊疗许可证 核定的诊疗活动范围从事动 物诊疗活动的；(1) It engages in animal diagnosis and treatment activities beyond the scope of diagnosis and treatment activities as approved in its animal diagnosis and treatment permit.（二）变更从业地点、诊疗 活动范围未重新办理动物诊 疗许可证的。第三十三条使用伪 造、变造、受让、租用、借 用的动物诊疗许可证的，县 级以上地方人民政府农业农 村主管部门应当依法收缴， 并依照中华人民共和国动 物防疫法第一百零五条第 一款的规定予以处罚。(2) It fails to apply for a new animal diagnosis and treatment permit in the case of changing the practicing place or scope of animal diagnosis and treatment activities.第三十四条动物诊疗 场所不再具备本办法第六 条、第七条、第八条规定条 件，继续从事动物诊疗活动 的，由县级以上地方人民政 府农业农村主管部门给予警 告，责令限期改正；逾期仍 达不到规定条件的，由原发Article 33 Where a forged, altered, transfen-ed, leased, or lent animal diagnosis and treatment permit is used, the department of agriculture and rural affairs of the local people's government at or above the county level shall confiscate the animal diagnosis and treatment permit and impose punishments in accordance with paragraph 1 of Article 105 of the Animal Epidemic Prevention Law of the People's Republic of China.Article 34 An animal diagnosis and treatment place which no longer meets the conditions as prescribed in Articles 6, 7, and 8 of these Measures but continues to engage in animal diagnosis and treatment activities shall be warned and ordered to take corrective action within a specified period by the department of agriculture and rural affairs of the local people's government at or above the county level; if it still fails to meet the prescribed15conditions within a specified period, the original permit-issuing authority shall take back or cancel its animal diagnosis and treatment permit.证机关收回、注销其动物诊 疗许可证。Article 35 Where any veterinary institution commits any of the following conduct in violation of the provisions of these Measures, it shall be ordered by the department of agriculture and rural affairs of the local people's government at or above the county level to take corrective action within a specified period and shall be fined not less than 1,000 yuan nor more than 5,00() yuan:第三十五条违反本办 法规定，动物诊疗机构有下 列行为之一的，由县级以上 地方人民政府农业农村主管 部门责令限期改正，处一千 元以上五千元以下罚款：(1) Failing to undergo modification formalities in the case ofchanging its name or legal representative (person in charge).（一）变更机构名称或者法 定代表人（负责人）未办理 变更手续的；(2) Failing to hang its animal diagnosis and treatment permit or publicize the basic information about its staff members engaged in diagnosis and treatment activities at the diagnosis and treatment place.（二）未在诊疗场所悬挂动 物诊疗许可证或者公示诊疗 活动从业人员基本情况的；(3) Failing to use standard medical records, failing to provide prescription pads for licensed veterinarians as required, or failing to retain medical records in the archives as required.（三）未使用规范的病历或 未按规定为执业兽医师提供 处方笺的，或者不按规定保 存病历档案的；(4) Engaging in animal diagnosis and treatment activities through licensed veterinarians who fail to be filed with it for recordation.（四）使用未在本机构备案 从业的执业兽医从事动物诊 疗活动的。16第三十六条动物诊疗 机构未按规定实施卫生安全 防护、消毒、隔离和处置诊 疗废弃物的，依照中华人 民共和国动物防疫法第一 百零五条第二款的规定予以 处罚。第三十七条诊疗活动 从业人员有下列行为之一 的，依照中华人民共和国 动物防疫法第一百零六条 第一款的规定，对其所在的 动物诊疗机构予以处罚：（一）执业兽医超出备案所 在县域或者执业范围从事动 物诊疗活动的；（二）执业兽医被责令暂停 动物诊疗活动期间从事动物 诊疗活动的；（三）执业助理兽医师未按 规定开展手术活动，或者开 具处方、填写诊断书、出具 动物诊疗有关证明文件的；（四）参加教学实践的学生 或者工作实践的毕业生未经 执业兽医师指导开展动物诊 疗活动的。Article 36 Where a veterinary institution fails to take such measures as health and safety protection, disinfection, isolation, and disposal of wastes from diagnosis and treatment, it shall be punished in accordance with paragraph 2 of Article 105 of the Animal Epidemic Prevention Law of the People's Republic of China.Article 37 Where a person engaging in animal diagnosis and treatment activities commits any of the following conduct, the veterinary institution where he or she works shall be punished in accordance with paragraph 1 of Article 106 of the Animal Epidemic Prevention Law of the People's Republic of China.(1) A licensed veterinarian engages in animal diagnosis and treatment activities outside of the county or his or her practicing scope.(2) A licensed veterinarian continues to engage in animal diagnosis and treatment activities during a period in which he or she is ordered to suspend such activities.(3) A licensed assistant veterinarian fails to carry out surgical activities or issue prescriptions, complete medical certificates, or issue certification documents related to animal diagnosis and treatment according to the applicable provisions.(4) A student participating in teaching practice or a graduate participating in work practice conducts animal diagnosis and treatment activities without the guidance of a licensed veterinarian.17Article 38 Where, in violation of the provisions of these Measures, any veterinary institution fails to report animal diagnosis and treatment activities, it shall be punished in accordance with Article 108 of the Animal Epidemic Prevention Law of the People's Republic of China.第三十八条违反本办 法规定，动物诊疗机构未按 规定报告动物诊疗活动情况 的，依照中华人民共和国 动物防疫法第一百零八条 的规定予以处罚。Article 39 Where the department of agriculture and rural affairs of a local people's government at or above the county level fails to perform the functions of examination, supervision, and administration in accordance with the law, and neglects its duties, abuses its powers, or makes falsification for private gain, disciplinary actions shall be taken against it according to the applicable provisions; and if it is criminally punishable, the offender shall be held criminally liable in accordance with the law.第三十九条县级以上 地方人民政府农业农村主管 部门不依法履行审查和监督 管理职责，玩忽职守、滥用 职权或者狗私舞弊的，依照 有关规定给予处分；构成犯 罪的，依法追究刑事责任。Chapter V Supplemental Provisions第五章附则Article 40 A rural veterinarian engage in animal diagnosis and treatment activities in rural areas shall have a fixed practicing place.第四十条乡村兽医在 乡村从事动物诊疗活动的， 应当有固定的从业场所。18Article 41 For the purpose of these Measures, "permit-issuing authority?, means the department of agriculture and rural affairs of a people's government at the county (municipal district) level, or means the department of agriculture and rural affairs at the next higher level if no department of agriculture and rural affairs is established in a municipal district.第四十一条本办法所 称发证机关，是指县（市辖 区）级人民政府农业农村主 管部门；市辖区未设立农业 农村主管部门的，发证机关 为上一级农业农村主管部 门。Article 42 These Measures shall enter
