1、 论我国网络购物消费者权益的法律保护 (摘要 ) 专 业:法律硕士(在职 ) 研宄方向:民商法 作者姓名:任怡 指导教师:郑云瑞 互联网技术和网络购物模式蓬勃发展,增加了消费者的选择空间、提高了交 易效率、降低了交易成本,给消费者带来了福音。但同时,网络环境及网络购物 的独有特点也导致消费者在网络购物中处于更为弱势的地位,在网络交易各个阶 段都是风险的最大承担者。虽然,近几年,我国在新法律法规的出台上和原有法 律法规的修订上,都开始注意网络运用带来的变化,竭力将网络购物领域中的法 律问题纳入现有的法律框架和体系内,但由于网络购物引发的法律问题具有其特 殊性,网络购物消费者权益的保障较传统交易中
2、消费者权益保障的情况更为复杂 和困难,目前 的调整仍难以适应网络购物迅猛发展下消费者权益保障的需要。本 文试图通过提出问题、分析问题、解决问题的架构,循序渐进地对我国网络购物 消费者权利保护的问题进行法律分析与探讨,并提出一些有价值的建议。 第一部分,是关于我国网络购物消费者权益保护存在的问题。首先结合最新 数据,以少量篇幅展现网络购物极速发展及其引发问题诸多的现状。继而围绕本 文探讨的目标,对相应法律关系的内容,即网络购物消费者的权利及义务进行归 纳。接着按照位阶梳理我国目前在网络购物消费者权益保护方面的立法现状,并 进行总结。在上述内容的基础上, 得出对我国网络购物消费者权益保护问题进行
3、探讨的必要性。然后,结合实践中的一些案例,逐一梳理出我国目前在网络购物 消费者知情权、公平交易权、人身权和财产权、隐私权、求偿权保护方面存在的 主要问题。 第二部分,是关于我国网络购物消费者权益保护问题的法律分析。在该部分 开头,首先点明网络购物独有特点给网购消费者权益保护带来挑战。然后以法律 的视角,结合相关法律法规,就第一部分梳理的我国网络购物消费者知情权、公 平交易权、人身权和财产权、隐私权、求偿权五项易被侵犯的消费者基本权利, 分别展开分析、探讨,剖析相关权利内涵及被侵害的事实和法律原因。知其然且 知其所以然,才能为第三部分针对性地提出有价值的结论和建议做好铺垫。 第三部分,是关于我国
4、网络购物消费者权益保护问题的法律对策。该部分旨 在前两部分的基础上,就网络购物消费者权益保障分别提出建议:知情权(立法 扩充网络购物消费者知情权范围、立法加强对网络广告的规范管理)、公平交易 权(完善格式合同的制定主体、制定方式、成立条件、解释规则及加大滥用格式 合同的处罚力度) 、人身权和财产权 ( 完善对网络购物第三方支付平台的规制和 监管、完善网络购物消费者人身安全保障的立法规定)、隐私权 ( 推进网络购物 消费者隐私权立法、鼓励网站自律及加强外界监督)、求偿权(规定网络经营者 与网站承担过错补充责任、设立特别诉讼制度助力消费者便捷维权、确立有利于 网络消费者的诉讼管辖原则、确立有利于网
