SourceofFunds2.1 ThePeoplesRepublicofChinahasappliedforaloanandcreditfrom the World Bank hereinafter referred to as the IFI towards thecostofProject,andintendstoapplyaportionoftheproceedsoftheloanandcredittoeligible paymentsundertheContractforwhichthese document

8、s are issued. Payment by the IFI willbe made only at the request of the Chinese Government and upon approval by the IFI and will be subjectinallrespectstothetermsandconditionsoftheLoanAgreement. No party other than the Peoples Republic of China shall derive any rights from the Loan Agreement or have

9、anyclaimtotheloanproceeds.2.2 Payment from the proceeds of the World Bank Loan will be limitedto goods produced in, and services supplied from, Switzerland andthe member countries of the World Bank which have commercial relations with China.2.3 All costs not met by the IFI Loan will be paid by the E

10、mployer fromfundsallocatedbytheGovernmentofChina.3. EligibilityandQualificationRequirements3.1 Thistenderisopentoallpre-qualifiedtenderersfromeligible sourcecountriesasdefinedundertheGuidelinesforProcurementoftheworldBank.3.2 AllgoodsandservicestobesuppliedunderthisContractshallhave their origin in

11、eligiblesource countries, and all expendituresmade under the Contract willbe limitedtosuchgoodsandservices.3.3 Theoriginofgoodsandservicesisdistinctfromthenationalityofthetenderer.3.4 Tobeeligibleforawardofcontract,tenderersshallhave provided evidence satisfactory to the Employer of their eligibilit

12、y under clause 3.1 above, and of their capabilityandadequacyofresourcestoeffectively carryouttheContract.Tothisend,theEmployerand company may, at any time prior to award of contract, request tenderers to amplify or updatepreviouslysubmittedprequalificationdata. AllTenderssubmittedshallincludethefoll

13、owinginformation:acopiesoforiginaldocumentsdefiningtheconstitutionorlegal status,placeofregistrationandprincipalplaceofbusinessofthe company, firm or partnership or, if a jointventure, of each party thereto constitutingthe tenderer ；bthequalificationsandexperienceofkeypersonnelproposedforadministrat

16、lar,shallgive particularsofworkinhandatthedateoftendering.3.6 Tenders submitted by a joint venture of two ormore firms as partnersshallcomplywiththefollowingrequirements:athetender,andincaseofasuccessfultendertheFormof Agreement,shallbesignedsoastobelegallybindingonallpartners；boneoftheJointVenturem

17、embersshall be nominated as sponsor ；and this authorisation shall be evidenced by submitting a power of attorney signed by legally authorised signatories of all the members ofthejointventure；c the joint venture sponsor shall be authorised to incur liabilities and receive instructions for andonbehalf

18、ofanyandallmembersofthejointventureandtheentireexecutionofthe Contractincludingpaymentshallbedoneexclusivelywiththejointventuresponsor ；dallmembersofthejoint venture shall be liable jointly and severally for the execution of the Contract in accordance with theContract terms, and a relevant statement

19、 to this effect shall be included in the authorisation mentioned under b above as well as in the Form of Tender and the Form of Agreement in case of a successful tender；ande a copy of the agreement entered into by the joint venture partners shall be submitted with thetender.3.7 Domestictenderersorco

20、mbinationsorjointventuresofdomestic andforeigntenderersapplyingforeligibilityfortheapplicationofa % margin of preference in the comparison of their tenderwithother tenders shall supply allinformation required to satisfy the criteria for eligibility as described in Clause 29 of these Instructions.4.

21、CostofTendering Thetenderershallbearallcostsassociatedwiththepreparationand submissionofhistenderandneithertheEmployernorhisagent Companywillinanywayberesponsibleorliable for thosecosts,regardlessoftheoutcomeofthetenderingprocess.5. SiteVisit5.1 The tenderer is advised to visit and examine the Site

22、of the Works and the surroundings and to obtainforhimselfonhisownresponsibility,allinformation that may be necessary for preparingthe tender and entering into a contract. The costs of visitingthesiteshallbeatthetenderersownexpense.5.2 Arrangementsforavisittosite,includingtransportationand accommodat

31、not substantially responsive to the requirements of the tender documents may be rejected.6.7 The four volumes of the tender documents have beencollated and bound by mechanical means and tenderers should check to ensure that they contain all pages which are numbered consecutivelyand that all suppleme

Clarificationof7.1 AProspectivetendererrequiringdocuments may notify in writingor by telex atthefollowingaddress:.theresponsequery,butwithoutidentifyingthesourceThe Employer or his agentwill respond in writing to any request f

AmendmentofTenderDocuments8.1 Prior to the deadline for submission of

34、 tenders, the Employer may, for any reason, whether at its own initiative or inresponse to a clarification requested by a prospective tenderer, modifythe tender documentsbytheissueofanAddendum.8.2 The Addendum will be sent in writing or by telex or telegram toall pre-qualified tenderers who have pic

35、ked up the tender documents and will be binding upon them. Prospective tenderersshall promptlyacknowledgereceiptthereofbytelexortelegramto .8.3 Inordertoaffordprospectivetenderersreasonabletimeinwhich totakeanAddendumintoaccountinpreparingtheirtenders,theEmployerorhisagent may,attheirdiscretion,exte

36、ndthedeadlineforthesubmissionoftendersinaccordancewithClause19hereof.PreparationofTenders9. LanguageofTender9.1 ThetenderandallcorrespondencerelatingtothetenderexchangedbythetendererandtheEmployerorhisagent shallbeinEnglish.Supportingdocumentsandprintedliteraturefurnishedbythe tendererwiththetenderm

DocumentsComprisingtheTender10.1 ThetendertobePreparedbythetenderershallcontainthe following:theFormofTend

38、erandAppendixthereto；theTenderSecurity；thepricedBillofQuantities； theSchedulesofSupplementaryInformation；theinformationoneligibilityandqualifications；any；andsubmittedinaccordancewithalternativeoffers,ifanyotherinformationrequiredtobetheseInstructions.The Forms, Bill of Quantities and Schedules provided in Volume3 of these documents shall be used without exception subject to extensions of the Schedules in the same format, and to the provisions of Clause 14.2hereofregardingthealternativeformsoftendersecurity.besignedandwithClauses17and18shallbereturnedtothe1
