2、均已在文中以明确方式标 明。因本学位论文引起的法律结果完全由本人承担。 本学位论文成果归西南财经大学所有。 特此声明 学位申请人 : 2009年月日 中文摘要 土地是农业发展最基本的物质基础，也是农民最基本的生活保障。农村 土地管理制度完善与否，流转是否规范，都将对国民经济的发展产生深远的 影响。基层府直接面对农民，最了解民意， :所以基层政府在农村土地流转 中起着重要作用，基层政府在农村土地转中的行为是否正确直接关系到城 乡统筹发展和新农村的建设。 . 本文通过整理调研资料和参考相关的文献，总结出了基层政府在农村土 地流转工作中行为方面出现的各种问题。本文将基层政府行为主要分为在土 地流转中

3、的宏观调控行为、提供公共服务行为和管理行为三个方面， :并总结 出基层政府行为在这三方面存在的问题。然后分析基层政府在农村土地流转 中为什么会宏观调控引导缺乏、提供公共服务缺失、管理不善的问题。最后 针对这些问题，笔者提出了一些改善的政策建议。本文主要内容由以下六个 部分组成。 , .第一部分是绪论。这一部分主要概述写作背景。党的十七届三中全会审 议通过的中共中央关于推进农村改革发展若干重大问题的决定，把农村 土地管理制度改革作为其中一项重要内容。决定指出： 赋予农民更加 充分而有保障的土地承包经营权，现有土地承包关系要保持稳定并长久不 变 ；，按照依法自愿有偿原则，允许农民以转包、出租、互换

4、、转让、股 份合作等形式流转土地承包经营权 。在这个政策背景下，笔者选择研究基 层政府在农村土地流转中行为的问题，具有其现实意义。另外笔者还介绍了 本文采用的主要研究方法，即文献研究法和调查研究法。最后简单的介绍了 本文的写作思路。 第二部分是阐述基本概 念和理论依据。在基本概念部分对本文所选用的 农村土地流转的概念做了定义，对基层政府的概念做了界定。本文的理论依 据主要是有限政府理论和服务型政府理论。 . 第三部分是 分析基层政府在农村土地流转中行为存在的问题。主要存在 三个方面的问题：一是基层政府在农村土地流转中的干预过度。主要表现为 基层政府干预过多；引导乏力。二是基层政府在农村土地流转

5、中提供的公共 服务缺失。主要表现是对土地流转的政策宣传不够；土地流转中公共产品供 给不足 ;对参与土地流转的农民保障缺失。三是基层政府在农村土地流转中 的管理不完善。主要体现是土地流转中的信息不透明；土地流转的程序不规 范；土地流转中的矛盾冲突得不到有效的解决；土地流转的管理机构不健全。 第四部分是分析基层政府在农村土地流转中的行为存在 问题的原因。针 对第三部分中的三个方面的问题做原因分析。基层政府在农村土地流转中干 预过度，缺乏引导的原因主要有土地流转中的政府寻租、土地流转中基层官 员服务理念薄弱和土地流转中的监督机制不健全；基层政府在土地流转中提 供的公共服务缺失是由于地方财政的困难、农

6、村土地流 If市场发育不健全和 公共服务领存在矛盾这三方面造成的；基层政府在农村土地流转工作中管 理不完善的原因主要有农村土地流转的相关法律法规不健全、配套政策不完 整等。 第五部分是提出优化基层政府在农村土地流转中行为的对策建议。针对 存在的问题提出如下对策建议。第一，加强基层政府在农村土地流转中的调 控引导，具体做法是：基层干部在农村土地流转中要树立为民服务的观念； 基层政府职能在农村土地流转中定位为服务为主、干预为辅；加强对基层政 府的监督。第二，完善基层政府在农村土地流转中提供的公共服务，主要做 法是：加强宣传引导；提供信息；加强农村基础设施建设；做好社保工作； 为农民提供技能培训。第

7、三，完善基层政府在农村土地流转中的管理，要做 到以下几方面：健全土地流转的管理机构；规范土地流转的程序；制定合理 的冲突管理制度；提高基层干部的管理 能力；提高参与土地流转农民的思想 意识；在农村土地流转中注重追求综合效益。 第六部分是结论。基层政府就应满足农村广大农民的公共需求，提供充 足的公共产品和高效的公共服务，减少和取消对农村土地流转微观的管理限 制，使农民成为农村土地流转的主体。政府进行引导，健全农村土地流转的 管理机构，规范农村土地流转的程序，从而使农村土地流转有效的进行，促 进新农村的建设。 本文的特色之处主要有以下几个方面：第一，详细研究了基层政府在农 村土地流转中的行为，在论

8、题上有其可取之处。 因为笔者在查阅文献的过程 中发现研究土地流转的模式、流转过程中存在的问题、土地流转中农民权益 等的文献较多，有些文献中也提到了地方政府在农村土地流转中的职能定位 不准等问题，但系统研究政府行为的文献较少。笔者认为可以尝 i 式着研究在 土地流转中基层政府的行为，所以选择了该论题。第二，在成都周边的乡镇 做了相关的调研，并分析调研中发现的问题。第三，借鉴其他地区的调研资 料，进行深入分析。借鉴这些数据，制作成图表，以便更直观的分析问题。 本文的不足之处主要有：由于调研条件限制、资料的整理利用能力有限、 理论功底 和实践经验的欠缺，使得本文研究还缺乏一定的深度，数据论证不 是很

9、充分，需要今后进一步调查研究，以弥补不足。 关键词：基层政府土地流转行为 Vi Abstract i The lan is not only the material basic of the development of agriculture, but also the basic livelihood safeguard of farmers. Whether the rural land management system , is improved or not, and whether the norms of land transfer is set down normative

10、ly or not, these all will have a profound impact on the development of national economy. The grass-roots government directly faces farmers. It is the ultimate executor of land policy. So the grass-roots government plays a very important role in the procedure of land transfer. The behavior of governm

11、ent in the land transfer will be related to the planning of urban and rural development, and new building in rural areas. Through field research and refer other literature, this thesis sums up some issue about the grass-roots govemment, behavior in the procedure of land transfer. Now I divide these

12、issues into three parts. As follow, the positioning of function, the provision of public services and management. First, this paper sums up the issue about the behavior of grass-roots government that exists in the procedure of land transfer. Second, we analyze the reason why the problem product. And

13、 last, we provide some policies recommendations. This thesis has six parts as follow. Part I is the introduction. This part introduces the background of this paper. The Partys Third Plenary Session of 17 considers and passes the act that named t4CPC Central Committee on rural reform and development

14、and the decision of a number of major issues,?. The reform on the rural land management system takes very important position in the bill. Decision points out “to give farmers flill and safe rights on the land contract management, and make the existing contract be stable and long-term availability55;

15、 obeying the principle of voluntary and compensating, the bill allows farmers transfer the land by following styles, including subcontract, lease, exchaage, transfer, transfer of shares in the form of co-operation and so- on.,? Basing on the policy background, this paper chooses the grass-roots gove

16、rnment behavior in the procedure of land transfer as an issue to research. This part includes literature review; the methods of research (including An Empirical Analysis of Law, theoretical research, drawing on law, case analysis); and the idea of this thesis. Part II discourses the basic concepts a

17、nd theoretical basis. We introduce the concept of land transfer and define the concqpt of grass-roots government. The government which is referred to in this paper is township government. In this part， we also define the behavior of the grass-roots government and point out its value. This thesis is

18、mainly based on the theory of limited government theory and the theoryofservice-orientedgovemment. In part III, we point out that the grass-government mainly has three problems in the procedure of land transfer. As follow: first, It presents some phenomenon of vacancy, offside and dislocation. Grass

19、-roots cadres in the government dont have a clear concept of land transfer. Second, the service which should be provided by the grass-roots government in land transfer is lacked. Details as follow three aspects, the lack of propagmdizing; the lack of insufficient supply of public goods; the lack of

20、help should be provided by government to farmers who take part in land transfer. Third, the mode of management which provided by government in land transfer is imperfect. It reflects in four aspects as follow. The government management in land transfer is noii-trisparent; land transfer procedures ar

21、e not standardized; contradictions and conflicts in the land transfer can5t be resolved very well; the management institution is not perfect. In Part IV ? we analyze that how the problem of grass-roots govemmenf behavior product. This analysis is based on the three aspects which are referred to in p

22、art IE. Firstly, rent-seeking behavior is allowed in the land transfer; secondly, the subject of land transfer is not clear; lastly, the supervision mechanism is not sound. The reason of the lack of public service which provide by grass-roots government is mainly due t6 the local financial difficult

23、ies and a shortage of public goods in rural areas. The reason that why the imperfect management system which provided by government produced is mainly due to some aspects as follow. The law of land transfer is lacked and so on. In part V, it is gave some recommendations which are used to optimize th

24、e grass-toots government， behavior in the land transfer. The first aspect， to define the function of grass-roots government clearly, the three aspects should be done as follow. First the concept of public service must be established. Second, grass-roots government should be positioned as a service-o

25、riented intervention supplement object. Last, strengthen the supervision level of the Government. The second aspect, we can strengthen govemmenfs capability in provision of public services by the following method. As detail, step up publicity and guidance; provide information; strengthen infrastruct

26、ure construction in rural aipas; do a good job in social security work; provide skills training for farmers. The third aspect, strengthen the management capability of grass-roots government in land transfer by the following method. Make the land management agencies sound; standardize the procedures

27、for land transfer; develop rational management for the contradictions and conflicts; improve the management of grass-roots cadres the ability of the conflict; improve ideology of farmers who take part in land transfer; pay attention to overall benefit. Part VI is the conclusion. The orient of instit

28、utional reform and function transform is adapted to public demand; the grass-roots government should provide efficient public service and adequate public goods. Reduce and eliminate restrictions in micro-aspect. Make farmers become the mainstay in land transfer. Through the guidance of government, i

29、mprove and perfect management institution; standardize the procedures for land transfer. So that the land transfer can be effectively carried on and promote the building of new countryside. Innovations: First, the topics of innovation; Second, innovation in research methods. Inadequacies: Data proce

36、1选题背景 党的十七届三中全会审议通过的中共中央关于推进农村改革发展若干 重大问题的决定把农村土地管理制度改革作为其中一项重要内容。中共 中央关于推进农村改革发展若干重大问题的决定指出： 赋予农民更加充 分而有保障的土地承包经营权，现有土地承包关系要保持稳定并长久不变 ； 按照依法自愿有偿原则，允许农民以转包、出租、 .互换、转让、股份合作 等形式流转土地承包经营权 。土地承包经营权是农村土地制度的核心，促 进土地承包经营权流转，是实施农村土地制度创新、解决土地问题、建设社 会主义新农村，促进城乡统筹发展的必由之路。在土地新政出台之际的背景 下，政府的作用显得尤为重要。而基层政府更是最接近农民

37、的，也是政策的 实施者，所以在土地新政出台之际对基层政府在农村土地流转中的行为探析 是很有必要的。 农村的土地流转早在 20世纪 80年代后期就开始了，都是农民自发进行 的土地使用权流转。有 些试点地区做的较好，形成了比较成熟的流转模式， 但是农村的土地流转绝大多数都处于没有规范化、制度化的状态。十七届三 中全会提出允许农村土地流转后，各地方政府响应党的政策，积极推进相应 的改革措施。在目前的农村土地流转过程中，基层政府由于行为不规范，损 害了农民的利益，所以对基层政府在农村土地流转中的行为如何优化做研究 是具有重要意义的。. 中共十七大报告中首次提出 创造条件让更多群众拥有财产性收入 。 对

38、农民而言，土地不应仅仅是一种生产资料，而应真正成为他们的财产。然 而，由于不合理的土地制度的存在，加上一些基层政府及其工作人员与非法 基层政府在农村土地流转中的行为探析 _ / 土地开发商的利益勾结，城市化不仅没有纟合农民带来财富，反而造成了几千 万无地、无业和无社会保障的三无农民。这是当前亟待解决的社会问题。甚 至可以说，如何让农民真正拥有自己的土地和房屋，并享受到因土地增值所 获得的收益，不应只是一个经济问题，它应是农民作为公民的基本权利。为 此，在农村的土地流转中，更要保障农民的权益，让农民的财产不受侵害， 使农 民在土地流转中能真正的受益。 本 .文在研究基层政府在农村土她流转中的行为

39、的基础上，提出如何优化 基层政府在农村土地流转中行为的对策，希望能为农村土地的有效流转、统 筹城乡发展、社会主义新农村的建设提供一些有效的参考建议。 1.2文献综述 现在学者对于基层政府在农村土地流转中的行为研究主要从政府的职能 转变和公共服务提供等方面进行研究的。以下是从土地流转的概念、流转的 必要性、基层政府在农村土地流转中行为存在的问题以及如何怵化其行为做 了综述。 一 . 土地流转的概念 土地流转的确切涵义在目前的法律法规中还没有明确的表述，理论界也 没有统一的提法。主要的说法有：喻燕 (2006)在文章中提到，土地流转 （ Land Conversion)是指土地产权在不同经济实体之

40、间的流动和转让，即土地所有 、权或土地使用权在不同经济实体之间的流动和转让。土地产权流转首先是指 土地所有权的流转，其次是指土地使用权的流转。 李先春 （ 1996)认为土地 流转的市场机制是通过地租、地价等经济指标的合理确定，以转让、出租和 抵押等形式，将土地使用权的流转引入市场。 张安录 .(2003)提出，近年来 在理论上对土地流转提出了狭义和广义之分，狭义的流转是土地各种权利的 转移，而广义的流转将各种土地功能的转变也视为流转的一种形式。在我国 土地转换包括 3个方面：农地内部转换、城市土地转换和农地向城市土地转 喻燕城中村 改造中土地产权流转研究 D.武汉 :武汉大学， 2005 李

41、先春 .农村土地流转制度浅识 J.农村发展论丛， 1996(2) :31-32 换。 二 . 农村土地流转的必要性研究 对农村土地流转的必要性研究是为基层政府在农村土地流转中的行为探 析提供一些依据。因为农村土地流转具有必要性，对基层政府在农村土地流 转中的行为的研究才具有研究价值，所以对农村土地流转的必要性也做了文 献综述。 对于农村土地流转的必要性研究的文献较多，本文主要综述了以下部分 观点。郝朝晖 (2005)在其文章中谈到了农地使用权流转的必要性有四点 ： 1. 弥补和完善家庭承包经营制度的缺陷与不足。 2.促进农村土地资源的优化配 置，充分利用土地资源。在家庭承包经营责任制下，农户所拥有的承包地是 固定不变的，农民转让土地使用权受到各种因素的制约，土地资源的优化配 置难以实现。通过土地使用权流转，实现土地资源的充分利用，促进农业效 益的提高
