2、合同双方当事人:Parties to Contract(出租)出租人(甲方):Lessor (Party A): 承租方(乙方): Lessee (Party B): 根据中华人民共和国合同法、上海市房屋租赁条例(以下简称:条例)的规定,甲、乙双方在平等、自愿、公平和诚实信用的基础上,经协商一致,就乙方承租甲方可依 出租 (出租)的 商品房 (房屋/商品房)事宜,订立本合同。In accordance with the Laws of Contract of the Peoples Republic of China and the Tenancy Regulations of the Sha
3、nghai Municipality (hereinafter referred to as “the Provisions”), Party A and Party B, having reached an agreement based on the principles of equality, willingness and mutual benefit, hereby enter into this Contract on matters in relation to the Lease of the Property by Party A to Party B.一、出租房屋情况Co
4、ndition of the Lease or Pre-Lease Property1-1甲方 出租 (出租)给乙方的房屋座落在本市 (区/县) 路 . (弄/新村) (号/幢) 室(部位)(以下简称该房屋)。该房屋 实测 (【出租】实测)建筑面积为 平方米,房屋用途 住宅 ,房屋结构为 钢混。甲方已向乙方出示:Party A shall lease Party B the Property situated at District (hereinafter referred to as “the Property”). The total gross area of the Lease Pr

The floor plan of the Property see Appendix 1 of this Contract. Party A has already presented to Party B:1)【出租】房地
6、产权证/房屋所有权证/ 沪 房地产权证 市字 ;(证书编号: 号。Lease Shanghai Certificate of Ownership of the Property (Certificate No.).1-2甲方作为该房屋的 房地产权利人 (房地产权利人/代管人/法律规定的其他权利人)与乙方建立租赁关系。签订本合同前,甲方已告知乙方该房屋 未 已/未)设定抵押。Party A being the Owner of the Property and Party B have developed a lessor/lessee relationship. Before the sign
7、ing of this Contract, Party A has already informed Party B that the Property is not subject to a mortgage.1-3该房屋的公用或合用部位的使用范围、条件和要求;现有装修、附属设施、设备状况和甲方同意乙方自行装修和增设附属设施的内容、标准及需约定的有关事宜,由甲、乙双方分别在本合同附件(二)、(三)中加以列明。甲、乙双方同意该附件作为甲方向乙方交付该房屋和本合同终止时乙方向甲方返还该房屋的验收依据。The area and the use of the public or common par
8、t of the Property; the existing fixtures, facilities, condition of equipment and the contents, standard and other relevant matters to be ascertained in relation to the fixtures and the facilities added by Party B with the consent of Party A shall be specified in Appendix 2, 3 of this Contract. Party
9、 A and Party B have agreed the said Appendix shall represent the condition of the Property at the time of hand over of the Property by Party A to Party B and when Party B deliver up the Property to Party A at the expiry of this Contract.二、租赁用途Purpose of the Property2-1乙方向甲方承诺,租赁该房屋作为 住宅 使用,并遵守国家和本市有
10、关房屋使用和物业管理的规定。Party B warrants to Party A that the Property shall be used for Residential purpose and follows the regulations of the State and this Municipality in relation to the use and management of Property.2-2乙方保证,在租赁期内未征得甲方书面同意以及按规定须经有关部门审批核准前,不擅自改变上款约定的使用用途。Party B guarantee that during the l
11、ease term, it shall not alter the purpose of the Property without Party As prior written consent as well as the approval from the relevant governmental department.三、交付日期和租赁期限Delivery Date and Lease Term3-1甲乙双方约定,甲方于 2009-06-12前向乙方交付该房屋。【出租】房屋租赁期自 2009-06-12起至2010-06-11止。Party A and Party B have agre
12、ed that Party A shall hand over the Property to Party B before 2009-06-12 .LeaseThe lease term of the Property shall be from 2009-06-12 until 2010-06-11 。3-2租赁期满,甲方有权收回该房屋,乙方应如期返还。乙方需继续承租房屋的,则应于租赁期届满前 一个月,向甲方提出续租书面要求,经甲方同意后重新签订租赁合同。Upon expiry of the lease term, Party A shall have the right to repos
13、sess the Property in its entirety and Party B shall deliver it up accordingly. If Party B wishes to renew the lease, it shall submit such intent in writing to Party A one months prior to the expiry of the lease and sign a new lease contract with the consent of Party A.四、租金、支付方式和期限Rent, Method of Pay
14、ment and Term4-1甲、乙双方约定,【出租】人民币( 元 )(大写: 元整)。该房屋租金 1 (年)内不变。自第 2 (年)起,双方可协商对租金进行调整。有关调整事宜由甲、乙双方在补充条款中约定。Party A and Party B have agreed that.Lease The total monthly rent shall be RMB 15800Yuan.The rent shall remain unchanged for 1 year. The rent may be adjusted by both parties through consultation c
15、ommencing from 2 year. Matters related to the adjustment shall be agreed by Party A and Party B in supplementary clauses.4-2乙方应于每月 10 日前向甲方支付租金。逾期支付的,每逾期一日,则乙方需按月租金的0.5 %支付违约金。Party B shall pay the rent by the 10 day of each month. Late payment by Party B shall be subject to a penalty of 0.5% of the
16、 monthly rent per day.4-3 考虑到乙方为外籍员工,每月自行支付租金有困难,甲乙双方一致同意由乙方雇主 会计师事务所有限公司(“ ”)代为支付租金.甲乙双方在此同时明确同意(1) 的前述代付行为仅系解决乙方可能存在的付款困难而为,该等代付行为在任何情形下不意味亦不得被解释为 已因此成为本合同的一方. (2) 在任何情形下将无须为该等代付行为承担任何责任. 甲乙双方今在此明确放弃一切因此而追究 任何责任的权利.4-4乙方支付租金的方式如下:The rent shall be paid by Party B as follows:银行转帐,bank transfer五、保证金
17、和其他费用Deposit and Other Fees and Charges5-1甲、乙双方约定,甲方交付该房屋时,乙方应向甲方支付房屋租赁保证金,保证金为贰个月的租金,即( )。甲方收取保证金后应向乙方开具收款凭证。租赁关系终止时,甲方收取的房屋租赁保证金除用以抵充合同约定由乙方承担的费用外,剩余部分一周内无息归还乙方。Party A and Party B have agreed that at the time of the hand over of the Property by Party A, Party B shall pay to Party A a rental depos
18、it of the Property, the deposit shall be Two months of rent, that is ( RMB Currency) yuan.Party A shall issue a receipt to Party B after receiving payment of deposit.At the termination of the lessor/lessee relationship, the remaining deposit of the lease of the Property obtained by Party A shall be
19、refunded to Party B after setting off the fees and expenses borne by Party B under the Contract without interest within one week.5-2租赁期间,使用该房屋所发生的水、电、煤气、通讯,发票税金等费用由 乙方 (甲方/乙方)承担。其他物业管理费、卫星电视和ADSL以及电话的安装费,均由甲方 (甲方/乙方)承担。During the lease term, the water, electricity, gas, communication of the Property
20、 ,rental tax fee and other fees resulted from the use of the Property shall be borne by Party B. All other management fee,satellite TV, ADSL and telephone installation fee, shall be borne by Party A.5-3 乙方 (甲方/乙方)承担的上述费用,计算或分摊办法、支付方式和时间:根据上述企事业单位列出的帐单凭证支付,如不按期付款,滞纳金由乙方承担。 Party B shall be responsibl
21、e to pay the above fees and charges, the computation or amortization, method and time of payment: According to the demand notes, if delaying payment, Party B should be responsible for the penalty.六、房屋使用要求和维修责任Standard Required for Use of Property and Responsibility of Property Maintenance and Repair
22、6-1租赁期间,乙方发现该房屋及其附属设施有损坏或故障时,应及时通知甲方修复;甲方应在接到乙方通知后的3 个工作 日内进行维修。逾期不维修的,乙方可代为维修,费用由甲方承担。During the lease term, if Party B discovers any damages or defects of the Property and facilities attached, it shall notify Party A immediately for repair. Party A shall carry out the repair within 3 working days
23、after receiving notification from Party B. Any delay in repair may be repaired by Party B on Party As behalf and the expenses incurred shall be borne by Party A.6-2租赁期间,乙方应合理使用并爱护该房屋其附属设施。因乙方使用不当或不合理使用,致使该房屋及其附属设施损坏或发生故障的,乙方应负责维修。乙方拒不维修,甲方可代为维修,费用由乙方承担。During the lease term, Party B shall reasonably
