3、his:thereshallbeaprobationperiodof_years_months,fromddmmyytoddmmyy.2.ThisContractshalltakeeffectonthedayPartyBactuallycommencesworkforPartyA.3.Duringprobationperiod,PartyAshallperformaperformancereviewonPartyB,andshalldecidewhethertoformallyhirePartyBbasedonPartyBsworkperformanceandcapabilities.Thep

4、robationperiodshallenduponnoticefromPartyAofPartyBsformalhiring,andPartyBshallbecomePartyAsformalemployee.IntheeventthatPartyAdoesnotbelievethatPartyBfullymeetshiringconditions,PartyAmayextendtheprobationperiodinaccordancewithapplicablerules.Duringtheprobationperiod,intheeventthatPartyAdoesnotbeliev

5、ethatPartyBmeetshiringconditionsanddecidesnottohirePartyA,thisContractshallbeterminatedautomatically.4.OnthedayPartyBreportstowork,PartyBshallprovidePartyAwiththelaborcertificateorrelevantseverancecertificatesfromPartyBspreviousemployer.Intheeventsuchproofisnotprovidedwithinhalfamonth,PartyBmusthave

6、areasonableapplicationandmaygetanextensiononlyafterPartyAgivesconsent,andsaidextensionshallnotexceedonemonth.IntheeventthatPartyBfailstoproviderelevantproofwithintheprescribedtimeframe,thisContractshallbeautomaticallyterminated.Article2JobPostandJobDuties1.PartyBshallholdthepositionof_withthedepartm

7、entof_.PartyBshallcompletehisworkaccordingtothejobdutiesdefinedbyPartyA.2.PartyAmaychangePartyBsjobduetoPartyAsbusinessneedorduetoPartyBscapabilitiesorperformance.PartyBshallhavetherighttomakehisowncomment,butshallcomplywithPartyAsworkarrangements,andshallcompletetheproceduresforchangeaccordingtothe

8、rules.Article3WorkConditionsandLaborProtection1.PartyAshallimplementa40-hourworkweeksystem.Duetobusinessneeds,management,salesandservicedepartments,etc.,shallimplementanirregularworksystemorcomprehensiveworkhoursystem.2.IntheeventthatPartyAneedsPartyBtoworkovertimeduetobusinessneeds,PartyAmayprovide

9、makeupbreaksorcompensation.3.PartyAshallprovidePartyBwithaworkenvironmentandlaborprotectionmeasuresconsistentwiththerequirementsoftheChineseGovernment.Article4Compensation1.InaccordancewiththecurrentsalarysystemofPartyA,PartyBstotalmonthlysalaryshallbeRMB_.Attheendoftheprobationperiod,PartyBsmonthly

10、salaryshallbeissuedinthefollowingmanner.a.ThebaseamountshallbeRMB_,ofwhich_%shallbetheperformancereviewbonus,whichshallbeissuedafterbeingfloatedaccordingtoPartyAsperformancereviewsystem.b.ThesalaryshallbeRMB_,plusabonus.ThebonusshallbeissuedinaccordancewithrelevantrequirementsofPartyA.2.PartyAshalli

11、ssuethesalaryforthepreviousmonthonthe10thofeachmonth.3.PartyBspersonalincomeadjustmenttaxshallbebornebyPartyBhimself,andshallbewithheldbyPartyA.4.PartyAmaypayPartyBacertainamountofsubsidiesandbonusesdependingonthebusinessoperatingstatusandPartyBsworkperformance.5.IntheeventthatPartyAimplementsanewsa

12、larysystem,adjustssalarylevelsorintheeventthatPartyBsdutypostandpositionischanged,PartyAmaymakeanadjustmenttoPartyBssalaryinaccordancewiththerelevantrules.Article5LaborInsurance,WelfareandBenefits1.PartyshallpayrelevantsocialinsurancetodesignatedauthoritiesonPartyBsbehalfinatimelymannerinaccordancew

13、ithgovernmentrequirements.2.PartyBshallbeentitledtolegalholidaysspecifiedbytheChineseGovernment,aswellaspaidleaves,suchasannualvacations,maritalleave,bereavementleaveandmaternityleave,etc.3.DuringPartyBsemploymentwithPartyA,intheeventofPartyBssicknessornon-jobrelatedinjuries,PartyBshallsetPartyBsmed

14、icalleaveinaccordancewithgovernmentrequirements.Article6LaborDiscipline1.PartyBshallstrictlycomplywiththevariousrulesandregulationspreparedbyPartyAinaccordancewithlaw.2.IntheeventthatPartyBhascompliedwithrulesandregulationsinanexemplarymannerorintheeventthatPartyBhasviolatedsuchrulesandregulations,P

15、artyAshallrewardanddisciplinePartyB,asthecasemaybe.Article7Terminationof,Changesto,RenewalandDissolutionofLaborContract1.Upontheoccurrenceofanyoneofthefollowingcircumstances,thisLaborContractshallbeterminated:a)TheexpirationofthisLaborContract;b)PartyAhasbeendeclaredbankruptinaccordancewithlaw;c)Par

16、tyAhasbeendissolvedorrevokedinaccordancewithlaw;d)PartyBsretirement,severanceordeath;e)Othercircumstancesspecifiedbylawsandregulations;2.ThisLaborContractmaybeterminateduponconsensusbetweenPartyAandPartyB;3.Uponitsexpiration,thisLaborContractmaybereneweduponmutualagreementbetweenPartyAandPartyB;4.Du

17、etochangeofproducts,adjustmenttobusinessoperationsorduetopolicyadjustmentsandotherchangesofcircumstances,PartyAmaychangetherelevantcontentsofthisContractandcompletetheproceduresforsuchchanges;5.PartyBmayterminatethisLaborContractatanytimeupontheoccurrenceofanyoneofthefollowingcircumstances:a)PartyBi

18、sintheprobationperiod;b)PartyAforcesPartyBtoperformlaborthroughforce,threatorillegalrestrictiononPartyBspersonalfreedom;c)PartyAfailstopaylaborcompensationorprovideworkconditions;d)Uponconfirmationbylaborprotectionandlaborhealthoversightauthorities,PartyAsworksafetyandhealthconditionsdonotmeetthesta

19、ndardsoflawsandregulations;6.PartyBmustgivePartyA30daysofwrittennoticewhenitrequeststerminationofthisLaborContract.Intheeventthatanyspecialprovisionshavebeencovenantedregardingthedeadlineforadvancenotice,therequirementforsuchaprescribeddeadlineshallbemet.7.Upontheoccurrenceofanyoneofthefollowingcirc

20、umstances,PartyAmayterminatethisLaborContract,butmustgivePartyB30daysofwrittennotice:a)IntheeventthatPartyBbecomessickorsuffersnon-workrelatedinjuries,afterPartyBsmedicalleavehasended,PartyBstillhasnotrecovered,oralthoughPartyBhasrecovered,PartyBcannotperformtheworkontheoriginaldutypostoranyotherwor

21、karrangedbyPartyA;b)PartyBisincompetent,andstillremainsincompetentevenaftertrainingoreventhoughPartyBsdutyposthasbeenadjusted;c)TherehavebeenmajorchangestoinobjectivecircumstancesusedasthebasisfortheexecutionofthisLaborContract,renderingitimpossibletoperformtheoriginalLaborContract,andthepartiesarestillnotabletoreachanagreementonchangestothisLaborContractaftertheirconsultations;8.PartyBmayterminatethisLaborContractatanytimeupontheoccurrenceofanyoneofthefollowingcircumstancesonPartyBspart:
