2、ontractissignedonamutualityvoluntarybasisbyandbetweenthefollowingEmployerandEmployeeinaccordancewiththeLabourLawofPeoplesRepublicofChina.一、劳动合同期限TermoftheContract:第一条本合同期限类型为固定期限劳动合同双方合同期为年,即从_年_月_日起至_年_月_日止,其中,从_年_月_日起至_年_月_日为试用期,试用期为个月。在试用期内,乙方被证实不符合录用条件的,甲方有权随时解除劳动合同。Thetermofthiscontractshallcom

5、tablishedanemploymentrelationshipwithanotherEmployerwhichmateriallyaffectsthecompletionofhistaskswiththefirst-mentionedEmployer,orherefusestorectifythematterafterthesameisbroughttohisattentionbytheEmployer;(5)causestheemploymentcontracttobeinvalidduetothecircumstancespecifiedinitem(6)二、工作内容JobDescri
6、ption:第二条乙方同意根据甲方工作需要,承当下面职责_TheEmployeragreestoemployMr./Ms._(name)as_(jobtitle)in_Department第三条甲方有权根据公司发展的需要对乙方的工作内容进行变更PartAmaychangePartBspositionaccordingtothedevelopmentofthecompany.三、劳动报酬RemunerationofLabour第四条乙方基本工资根据职位和岗位等级标准支付,正式录用后每月基本工资为人民币_元,试用期工资为正式录用后工资的80%;每年依据工作表现调整,但不低于国家所规定的最低工资标准
7、。ThesalaryoftheEmployeeis_,andshallbemonthlypaidbytheEmployerinaccordancewithregulationofthecompany.ItshallbepaidbylegaltenderandnotlessthanthestandardminimumsalaryinGuangdongprovince.第五条甲方向乙方支付薪金的期限为次月的号前遇节假日的,不超过假日回来后下个月最后一天足额发放乙方上月的工资,乙方收到工资后如有异议应当在3天内提出,否则视为无异议处理Thesalaryshallbepaidbefore_.Ifthe
8、delayordefaultofsalaryduetoholidayorotherspecialreason,thesalaryshallbepaidnotlaterthantheendofnextmonth。PartBshouldtoraiseanobjectioninthreedaysafterreceivingthesalary,oritmeansthatPartBagreeswiththat.第六条甲方根据公司的经营效益和乙方的个人表现和业绩发放奖金,奖金的数额没有明确的规定,完全根据甲方效益和乙方绩效来确定。PartAmaypaybonusaccordingtotheperforma
9、nceofPartB四、劳动合同的变更、解除、终止、续订Termination,Modification,RenewandDischargeoftheContract第八条订立本合同所根据的客观情况发生重大变化,致使本合同无法履行的,经甲乙双方协商同意,能够变更本合同的相关内容。Duetotheforcemajeure,TherelevantclausesoftheContractmaybemodifiedbytheparties.第十条经甲乙双方协商一致,本合同能够解除。Thecontractcanbemodifiedorterminatedbythepartiesthroughconsul
10、tation;第十一条乙方有下面情形之一的,甲方有权解除劳动合同并无须给乙方任何经济补偿金:一严重违背公司员工手册、人力资源管理制度、行政管理制度、岗位职责规定、上司任务安排等一系列公司规章制度的;二严重渎职,营私舞弊,给甲方利益造成重大损害的;三被依法追查弄事责任的;四乙方同时在其他地方兼职或以任何形式,对甲方的工作任务造成严重影响,或者经过甲方提出后仍不改正。五在试用期被证实不录用条件的;六乙方被发现其存在虚假欺骗行为包括但不限于其假工作经历、假学历证、假身份证实等,使甲方违犯真实意思的情况下与乙方订立合同的;TheContractmaybedischargedbytheEmployerw
11、ithimmediateeffectandtheEmployeewillnotbecompensatediftheemployee:(1MateriallybreachestheEmployersrulesandregulations;(2)Commitsseriousderelictionofdutyorpracticesgraft,causingsubstantialdamagetotheEmployer;(3)hasadditionallyestablishedanemploymentrelationshipwithanotherEmployerwhichmateriallyaffect
12、sthecompletionofhistaskswiththefirst-mentionedEmployer,orherefusestorectifythematterafterthesameisbroughttohisattentionbytheEmployer(4)TheEmployeeisbeingchargedwithcriminaloffences:第十二条有下列情况之一的,甲方提早三十天以书面形式通知乙方本人或者额外支付乙方一个月工资后,能够解除劳动合同:一乙方患病或者非因工负伤,在规定的医疗期满后不能从事原工作,也不能从事单位另行安排的工作的;二乙方不能到达所担任岗位的绩效指标或
13、者相应的要求的,经过培训或者调整工作岗位,仍不能到达的;三劳动合同订立时所根据的客观情况发生重大变化,致使劳动合同无法履行,经甲乙双方协商,未能就变更劳动合同内容达成协议的。AnEmployermayterminateanemploymentcontractbygivingtheEmployeehimself30dayspriorwrittennotice,oronemonthswageinlieuofnotice,if:(1)afterthesetperiodofmedicalcareforanillnessornon-work-relatedinjury,theEmployeecaneng
14、ageneitherinhisoriginalworknorinotherworkarrangedforhimbyhisEmployer;(2)TheEmployeeisincompetentandremainsincompetentaftertrainingoradjustmentofhisposition;or(3)Amajorchangeintheobjectivecircumstancesrelieduponatthetimeofconclusionoftheemploymentcontractrendersitunperformableand,afterconsultations,t
15、heEmployerandEmployeeareunabletoreachagreementonamendingtheemploymentcontract.第十三条乙方提早三十日以书面形式通知甲方,能够解除劳动合同,但双方有服务期约定的除外。AEmployeemayterminatehisemploymentcontractupon30dayspriorwrittennoticetohisEmployer.Duringhisprobationperiod,aEmployeemayterminatehisemploymentcontractbygivinghisEmployerthreedays
16、priornotice.第十四条本合同期限届满,劳动合同即终止。甲乙双方经协商同意,能够续订劳动合同;若甲方维持或者提高劳动合同约定条件续订劳动合同,乙方不同意续订的,甲方将根据(劳动合同法)第四十六条第5点的规定不向乙方支付经济补偿金。TheContractmayberenewedattheexpirationthroughconsultationbythepartieswiththefulfillmentoftheprocedurewithin15daystotheexpiration;第十五条有下列情形之一的,劳动合同终止:一劳动合同期满;二劳动者已开场依法享受基本养老保险待遇的;三劳动
17、者死亡,或者被人民法院宣告死亡或者失踪的;四用人单位被依法宣告破产的;五用人单位解散、被吊销营业执照或者责令关闭的;六有法律、行政法规规定的其他情形的。Anemploymentcontractshallendif:(1)Itstermexpires;(2)TheEmployeehascommenceddrawinghisbasicoldageinsurancepensioninaccordancewiththelaw;(3)TheEmployeedies,orisdeclareddeadormissingbyaPeoplesCourt;(4)TheEmployerisdeclaredbankr
18、upt;(5)TheEmployerhasitsbusinesslicenserevoked,isorderedtocloseoriscloseddown,ortheEmployerdecidesonearlyliquidation;or(6)Anothercircumstancespecifiedinlawsoradministrativestatutesarises.五、劳动争议处理setllmentofdisputes第十六条因履行本合同发生的劳动争议,双方应积极协商解决;解决不成,当事人一方要求仲裁的,应当自劳动争议发生之日起六十日内向_fo山市禅城区_劳动争议仲裁委员会申请仲裁。当事
19、人一方可以以直接向劳动争议仲裁委员会申请仲裁。对裁决不服的,能够向人民法院提起诉讼。Alldisputesinconnectionwiththiscontractortheexecutionthereofshallbesettledfriendlythroughnegotiations.Incasenosettlementcanbereached,thecasemaythenbesubmittedforarbitrationtolaboradministrationauthority,chanchengdistrict,Foshancity.第十七条本合同自乙方赴甲方处报到之日起并经甲方双方签字或盖章生效,双方必须严格执行,未经双方同意,任何一方不得修改和变更。Thiscontractbecomeeffectiveaftersignedbytheauthorizedofbothparties第十八条本合同壹式贰份,甲、乙双方各执壹份,具同等法律效力。Thiscontract,witheightpagesofthemaindocumentwillbeinduplicate,andeachpartykeepsonecopy.Bothcopiesareequallyauthentic.甲方(用人单位):乙方(职工):
