2、contractisforoneyearandshallcommenceon_,_,andshallcontinueuntil_,_,unlessearlierterminatedpursuanttothisContract.TheEmployeeshallundergoaprobationaryperiodofthreemonths.2.JobDescription:TheEmployeragreestoemployMr./Ms._(name)as_(jobtitle)in_Department,locatedin_(officelocationandcity).3.Remuneration

3、ofLaboura.ThesalaryoftheEmployeeshallbemonthlypaidbytheEmployerinaccordancewithapplicablelawsandregulationsofP.R.C.ItshallbepaidbylegaltenderandnotlessthanthestandardminimumsalaryinTianjin.b.ThesalaryoftheEmployeeisRMB$_permonthintheprobationaryperiodandRMB$_aftertheprobationaryperiod.c.Ifthedelayor

4、defaultofsalarytakesplace,theEmployershallpaytheeconomiccompensationexceptthesalaryitselfinaccordancewiththerelevantlawsandregulations.4.WorkingHours&Rest&Vocationa.ThenormalworkinghoursoftheEmployeeshallbeeighthourseachday,excludingmealsandrestforanaverageoffivedaysperweek,foranaverageoffortyhoursp

5、erweek.b.TheEmployeeisentitledtoalllegalholidaysandotherpaidleavesofabsenceinaccordancewiththelawsandregulationsofthePRCandthecompanysworkrules.c.TheEmployermayextendworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunionandtheEmployee,buttheextendedworkinghourfor

6、adayshallgenerallynotexceedonehour;Ifsuchextensioniscalledforduetospecialreasons,theextendedhoursshallnotexceedthreehoursaday.However,thetotalextensioninamonthshallnotexceedthirty-sixhours.5.SocialSecurity&Welfarea.TheEmployerwillpayforallmandatorysocialsecurityprogramssuchpensioninsurance,unemploym

7、entinsurance,medicalinsuranceoftheEmployeeaccordingtotherelevantgovernmentandcityregulations.b.DuringtheperiodoftheContract,theEmployeeswelfareshallbeimplementedaccordancewiththelawsandrelevantregulationsofP.R.C.6.WorkingProtection&WorkingConditionsa.TheEmployershouldprovidetheEmployeewithoccupation

8、alsafetyandhealthconditionsconformingtotheprovisionsoftheStateandnecessaryarticlesoflaborprotectiontoguaranteethesafetyandhealthduringtheworkingprocess.b.TheEmployershouldprovidetheEmployeewithsafetyeducationandtechniquetraining;TheEmployeetobeengagedinspecializedoperationsshouldreceivespecializedtr

9、ainingandacquirequalificationsforsuchspecialoperations.c.TheEmployeeshouldstrictlyabidebytherulesofsafeoperationintheprocessoftheirwork.httpdocsj/doc/c1e652d948fe04a1b0717fd5360cba1aa8118cb1.bourDisciplinea.TheEmployermaydraftbylawsandlabourdisciplinesoftheCompany,Accordingtowhich,theEmployershallha

10、vetherighttogiverewardsortakedisciplinaryactionstotheEmployee;b.TheEmployeeshallcomplywiththemanagementdirectionsoftheEmployerandobeythebylawsandlabourdisciplinesoftheEmployer.c.TheEmployeeshallundertaketheobligationtokeepandnottodisclosethetradesecretfortheEmployerduringtheperiodofthisContract;This

11、obligationofconfidentialityshallsurvivetheterminationofthisContractforaperiodoftwo(2)years.8.Termination,Modification,RenewandDischargeoftheContracta.TherelevantclausesoftheContractmaybemodifiedbytheparties:i.Thespecificclauseisrequiredtobemodifiedbythepartiesthroughconsultation;ii.Duetotheforcemaje

12、ure,theContractcannotbeexecuted;iii.TherelevantlawsandregulationshavebeenmodifiedorabolishedbythetimeofsigningtheContract.b.TheContractmaybeautomaticallyterminated:i)ThisContractisnotrenewedattheexpirationofthisContract;ii)TheEmployerislegallyannouncedtobebankruptcy,dismissed,orcanceled;iii)Thedeath

13、oftheEmployeeoccurs;iv)Theforcemajeuretakesplace;v)TheconditionsofterminationagreedintheContractbythepartiesarise.c.TheContractmayberenewedattheexpirationthroughconsultationbythepartieswiththefulfillmentoftheprocedurewithin15daystotheexpiration;d.TheContractmaybedischargedthroughconsultationbythepar

14、ties;e.TheContractmaybedischargedbytheEmployerwithimmediateeffectandtheEmployeewillnotbecompensated:i.TheEmployeedoesnotmeetthejobrequirementsduringtheprobationaryperiod;ii.TheEmployeeseriouslyviolatesdisciplinesorbylawsoftheEmployer;iii.TheEmployeeseriouslyneglectshisduty,engagesinmalpracticeforsel

15、fishendsandbringssignificantlosstotheEmployer;iv.TheEmployeeisbeingpunishedbyphysicallabourforitsmisfeasancev.TheEmployeeisbeingchargedwithcriminaloffences:f.TheContractmaybeterminatedbytheEmployerbygivingnoticeinwrittenform30(thirty)daysinadvance:i.TheEmployeefailsillorisinjuredto(otherthanduetowor

16、k)andaftercompletionofmedicaltreatment,isnotabletoperformhispreviousfunctionoranyotherfunctiontheEmployerassignstohim;ii.TheEmployeedoesnotshowsatisfactoryperformanceandaftertrainingandadjustingmeasuresisstillnotabletoperformsatisfactorily;iii.ThecircumstanceshavemateriallychangedfromthedatethisCont

17、ractwassignedtotheextentthatitisimpossibletoexecutetheContractprovided,however,thatthepartiescannotreachanagreementtoamendthecontracttoreflectthechangedcircumstances.iv.TheEmployerisbeingconsolidatedinthelegalconsolidationperiodonthebrinkofbankruptcyorthesituationofbusinessisseriouslyintrouble,under

18、suchcondition,itisrequiredtoreducetheemplouee.(inlegalprocedure)g.TheEmployeeshallnotbedismissed:i.TheContracthasneitherexpirednorconformedto8.d,8.e,8.f,8.g;ii.TheEmployeeisillwithoccupationaldiseaseorinjuredduetoworkandhasbeenauthenticatedfullyorpartlydisabledbytheLabourAuthenticationCommissioninBa

19、odiCounty,Tianjin.iii.TheEmployeeisillorinjured(otherthanduetowork)andiswithintheperiodofmedicalleaveprovidedforbyapplicablePRClawandregulationsandCompanypolicy;iv.TheEmployeeiswomanwhoispregnant,onmaternityleave,ornursingababyunderoneyearofage;oriii.TheapplicablePRClawsandregulationsotherwiseprohib

20、ittheterminationofthisContract.h.TheContractmaybedichargedbytheEmployeebygivingnoticeinwrittenform30(thirty)daysinadvance.However,theEmployeemayinformtheEmployertodischargetheContractatrandomunderthefollowingoccasions:i.TheEmployeeisstillintheprobationaryperiod;ii.TheEmployerforcetheEmployeetoworkby

21、violence,duressorillegalrestrictiontophysicalfreedom;iii.TheEmployerdoesnotpaytheremunerationoftheEmployeeaccordancewiththerelevantclauseintheContract;iv.TheEmployerviolatestherelevantregulationsofStateorTianjinforitsterriblesafeandhealthcondition,whichisharmfultotheEmployeeshealth.I.TheContractcann

22、otbeterminatedbytheEmployeebeforetheexpirationifnotconformingto8.d,8.h,j.TheEmployershallpaytheeconomiccompensationtotheEmployeriftheContractisterminatedconformingto8.d,8.f,8.h.i-8.h.iv.AdditionalfeeformedicalallowanceshouldbepaidtotheEmployeeiftheContractisterminatedconformingto8.f.i.9.BreachLiabil

23、itiesa.Duetoeitherpartysfault,ifbreachingtheContract,thatpartyshallundertakethebreachliabilityaccordingtotheextenttotheperformanceoftheContract;ifthepartiesbothbreachtheContract,theyshallundertakeitsseparateliabilityaccordingtotheconcretesituation.b.Duetoeitherpartysfault,ifbreachingtheContracttodam

24、agetheotherparty.ThedamageshouldbecompensatedbythefaultypartyaccordancewiththerelevantlawsandregulationsofPRC.c.Duetotheforcemajeure,causingthenon-performanceorthedamagestoeitherparty,theotherpartymaynotundertakethebreachliability;c.TheEmployeewantstoresignandhasreceivedtrainingprovidedbytheEmployer

25、,theEmployeeshallcompensateforthetrainingcost.Themethodofcompensationshouldbefixedaccordingtotherelevantcompanyregulationsasfollows:TheEmployeeshallcompensateRMB_within_year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;TheEmployeeshallcompensateRMB_within_year(s)intheCompanyiftheCo

26、ntractisterminatedbytheEmployeeathiscause;TheEmployeeshallcompensateRMB_within_year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;httpdocsj/doc/c1e652d948fe04a1b0717fd5360cba1aa8118cb1.borDisputesWherealabordisputebetweenthepartiestakesplaceduringtheperformanceofthisContract,thepart

27、iesconcernedmayseekforasettlementthroughconsultation;oreitherpartymayapplytothelabordisputemediationcommitteeoftheirunitformediation;ifthemediationfailsandoneofthepartiesrequestsforarbitration,thatpartymayapplytothelabordisputearbitrationcommitteeforarbitration.Eitherpartymayalsodirectlyapplytothela

28、bordisputearbitrationcommitteeforarbitrationwithin60daysstartingfromthedateoftheoccurrenceofalabordispute.Ifoneofthepartiesisnotsatisfiedwiththeadjudicationofarbitration,thepartymaybringthecasetoapeoplescourtwithin15daysofthedateofreceivingtherulingofarbitration11.TheverificationofthisContractshallbemadeinBaodiLabourBureau,Tianjinwithin30daysafterbeingsignedbytheparties.Employer:(officialstamp)Employee:Representative:Address:Address:Date:July,2003ItsverifiedhereinthattheContractconformstotherelevantlawsandregulationsthroughexaminationandreview
