4、$_aftertheprobationaryperiod.c.Ifthedelayordefaultofsalarytakesplace,theEmployershallpaytheeconomiccompensationexceptthesalaryitselfinaccordancewiththerelevantlawsandregulations.4.WorkingHours&Rest&Vocationa.ThenormalworkinghoursoftheEmployeeshallbeeighthourseachday,excludingmealsandrestforanaverage

5、offivedaysperweek,foranaverageoffortyhoursperweek.b.TheEmployeeisentitledtoalllegalholidaysandotherpaidleavesofabsenceinaccordancewiththelawsandregulationsofthePRCandthecompanysworkrules.c.TheEmployermayextendworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunion

6、andtheEmployee,buttheextendedworkinghourforadayshallgenerallynotexceedonehour;Ifsuchextensioniscalledforduetospecialreasons,theextendedhoursshallnotexceedthreehoursaday.However,thetotalextensioninamonthshallnotexceedthirty-sixhours.5.SocialSecurity&Welfarea.TheEmployerwillpayforallmandatorysocialsec

7、urityprogramssuchpensioninsurance,unemploymentinsurance,medicalinsuranceoftheEmployeeaccordingtotherelevantgovernmentandcityregulations.b.DuringtheperiodoftheContract,theEmployeeswelfareshallbeimplementedaccordancewiththelawsandrelevantregulationsofP.R.C.6.WorkingProtection&WorkingConditionsa.TheEmp

8、loyershouldprovidetheEmployeewithoccupationalsafetyandhealthconditionsconformingtotheprovisionsoftheStateandnecessaryarticlesoflaborprotectiontoguaranteethesafetyandhealthduringtheworkingprocess.b.TheEmployershouldprovidetheEmployeewithsafetyeducationandtechniquetraining;TheEmployeetobeengagedinspec

9、ializedoperationsshouldreceivespecializedtrainingandacquirequalificationsforsuchspecialoperations.c.TheEmployeeshouldstrictlyabidebytherulesofsafeoperationintheprocessoftheirwork.httpdocsj/doc/2f4d05d3195f312b3169a552.bourDisciplinea.TheEmployermaydraftbylawsandlabourdisciplinesoftheCompany,Accordin

10、gtowhich,theEmployershallhavetherighttogiverewardsortakedisciplinaryactionstotheEmployee;b.TheEmployeeshallcomplywiththemanagementdirectionsoftheEmployerandobeythebylawsandlabourdisciplinesoftheEmployer.c.TheEmployeeshallundertaketheobligationtokeepandnottodisclosethetradesecretfortheEmployerduringt

11、heperiodofthisContract;ThisobligationofconfidentialityshallsurvivetheterminationofthisContractforaperiodoftwo(2)years.8.Termination,Modification,RenewandDischargeoftheContracta.TherelevantclausesoftheContractmaybemodifiedbytheparties:i.Thespecificclauseisrequiredtobemodifiedbythepartiesthroughconsul

12、tation;ii.Duetotheforcemajeure,theContractcannotbeexecuted;iii.TherelevantlawsandregulationshavebeenmodifiedorabolishedbythetimeofsigningtheContract.b.TheContractmaybeautomaticallyterminated:i)ThisContractisnotrenewedattheexpirationofthisContract;ii)TheEmployerislegallyannouncedtobebankruptcy,dismis

13、sed,orcanceled;iii)ThedeathoftheEmployeeoccurs;iv)Theforcemajeuretakesplace;v)TheconditionsofterminationagreedintheContractbythepartiesarise.c.TheContractmayberenewedattheexpirationthroughconsultationbythepartieswiththefulfillmentoftheprocedurewithin15daystotheexpiration;d.TheContractmaybedischarged

14、throughconsultationbytheparties;e.TheContractmaybedischargedbytheEmployerwithimmediateeffectandtheEmployeewillnotbecompensated:i.TheEmployeedoesnotmeetthejobrequirementsduringtheprobationaryperiod;ii.TheEmployeeseriouslyviolatesdisciplinesorbylawsoftheEmployer;iii.TheEmployeeseriouslyneglectshisduty

15、,engagesinmalpracticeforselfishendsandbringssignificantlosstotheEmployer;iv.TheEmployeeisbeingpunishedbyphysicallabourforitsmisfeasancev.TheEmployeeisbeingchargedwithcriminaloffences:f.TheContractmaybeterminatedbytheEmployerbygivingnoticeinwrittenform30(thirty)daysinadvance:i.TheEmployeefailsilloris

16、injuredto(otherthanduetowork)andaftercompletionofmedicaltreatment,isnotabletoperformhispreviousfunctionoranyotherfunctiontheEmployerassignstohim;ii.TheEmployeedoesnotshowsatisfactoryperformanceandaftertrainingandadjustingmeasuresisstillnotabletoperformsatisfactorily;iii.Thecircumstanceshavemateriall

17、ychangedfromthedatethisContractwassignedtotheextentthatitisimpossibletoexecutetheContractprovided,however,thatthepartiescannotreachanagreementtoamendthecontracttoreflectthechangedcircumstances.iv.TheEmployerisbeingconsolidatedinthelegalconsolidationperiodonthebrinkofbankruptcyorthesituationofbusines

18、sisseriouslyintrouble,undersuchcondition,itisrequiredtoreducetheemplouee.(inlegalprocedure)g.TheEmployeeshallnotbedismissed:i.TheContracthasneitherexpirednorconformedto8.d,8.e,8.f,8.g;ii.TheEmployeeisillwithoccupationaldiseaseorinjuredduetoworkandhasbeenauthenticatedfullyorpartlydisabledbytheLabourA

19、uthenticationCommissioninBaodiCounty,Tianjin.iii.TheEmployeeisillorinjured(otherthanduetowork)andiswithintheperiodofmedicalleaveprovidedforbyapplicablePRClawandregulationsandCompanypolicy;iv.TheEmployeeiswomanwhoispregnant,onmaternityleave,ornursingababyunderoneyearofage;oriii.TheapplicablePRClawsan

20、dregulationsotherwiseprohibittheterminationofthisContract.h.TheContractmaybedichargedbytheEmployeebygivingnoticeinwrittenform30(thirty)daysinadvance.However,theEmployeemayinformtheEmployertodischargetheContractatrandomunderthefollowingoccasions:i.TheEmployeeisstillintheprobationaryperiod;ii.TheEmplo

21、yerforcetheEmployeetoworkbyviolence,duressorillegalrestrictiontophysicalfreedom;iii.TheEmployerdoesnotpaytheremunerationoftheEmployeeaccordancewiththerelevantclauseintheContract;iv.TheEmployerviolatestherelevantregulationsofStateorTianjinforitsterriblesafeandhealthcondition,whichisharmfultotheEmploy

22、eeshealth.I.TheContractcannotbeterminatedbytheEmployeebeforetheexpirationifnotconformingto8.d,8.h,j.TheEmployershallpaytheeconomiccompensationtotheEmployeriftheContractisterminatedconformingto8.d,8.f,8.h.i-8.h.iv.AdditionalfeeformedicalallowanceshouldbepaidtotheEmployeeiftheContractisterminatedconfo

23、rmingto8.f.i.9.BreachLiabilitiesa.Duetoeitherpartysfault,ifbreachingtheContract,thatpartyshallundertakethebreachliabilityaccordingtotheextenttotheperformanceoftheContract;ifthepartiesbothbreachtheContract,theyshallundertakeitsseparateliabilityaccordingtotheconcretesituation.b.Duetoeitherpartysfault,

24、ifbreachingtheContracttodamagetheotherparty.ThedamageshouldbecompensatedbythefaultypartyaccordancewiththerelevantlawsandregulationsofPRC.c.Duetotheforcemajeure,causingthenon-performanceorthedamagestoeitherparty,theotherpartymaynotundertakethebreachliability;c.TheEmployeewantstoresignandhasreceivedtr

25、ainingprovidedbytheEmployer,theEmployeeshallcompensateforthetrainingcost.Themethodofcompensationshouldbefixedaccordingtotherelevantcompanyregulationsasfollows:TheEmployeeshallcompensateRMB_within_year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;TheEmployeeshallcompensateRMB_within

27、act,thepartiesconcernedmayseekforasettlementthroughconsultation;oreitherpartymayapplytothelabordisputemediationcommitteeoftheirunitformediation;ifthemediationfailsandoneofthepartiesrequestsforarbitration,thatpartymayapplytothelabordisputearbitrationcommitteeforarbitration.Eitherpartymayalsodirectlya
