5、beadoptedforPartyB,thatis,PartBshallwork8hoursperdayand5daysperweek,withoutadditionalremunerationforovertimework.3.2AnyextensionofworktimeasrequiredbyPartyAsproductionandoperationshallbegovernedbyArticle41oftheLaborLaw.Article4SalaryandTreatment4.1PartyAshallformulatethesalarysystemaccordingtolawand

6、notifyPartyBthereof.ThesalarypaidbyPartyAtoPartyBshallnotbelowerthantheminimumsalaryissuedbythelocalmunicipalgovernmentinthatyear.4.2ThemonthlysalaryofPartyBshallbeRMB。4.3PartyAshallpaythesalarytoPartyBonthe30thdayofeachmonth.PartyAshallpaytoPartyBthesalaryatleastonceineachmonthbymeansofcurrency.4.4

7、Theovertimesalary,salaryduringvacation,leaveandparticularcircumstancesshallbegovernedbytherelevantlawsandregulations,suchastheRegulationsofShenzhenRegardingPaymentofEmployeesSalaries.4.5OtherprovisionsonsalaryasagreedbybothParties:withinthevalidtermofthisContract,performancebonusshallbedeterminedbas

8、edonthenetsalepriceofequipment(i.e.,thepriceafterthefreightandtheexpensesforinstallationandcommissioningarededucted).Thecontractsforsaleofsparepartsandcomponentsandforinstallationshallnotbeincludedintheplanonperformancebonus.Article5LaborProtectionandLaborConditions5.1PartyAshall,inaccordancewiththe

9、relevantprovisionsonlaborprotectionoftheState,providethelaborandoperationplacesandnecessarylaborprotectivearticlesinconformitywiththehealthstandardsoftheState,soastopracticablyensurethesafetyandhealthofPartyBintheproductionandwork.5.2PartyBwillbeengagedintheoperationof/thatmaycausetheprofessionaldan

10、gerof/,so,PartyAshalltaketheprotectivemeasuresof/andarrangePartyBformedicalcheck/timeeachyear.5.3PartyBshallhavetherighttorefusetooperateifPartyAcommandstheoperationinviolationofrulesandregulationsorforcesPartyBtorunrisksinoperation;PartyBshallhavetherighttorequirePartyAtorectifytheactsofPartyAendan

11、geringthesafetyofhislifeandhealthorreportsuchcasetothecompetentdepartments.Article6SocialInsuranceandWelfare6.1PartyAshallhandletheproceduresforsocialinsuranceforPartyBaccordingtolaw,andthepaymentofsocialinsurancepremiumshallbegovernedbythelaws,regulationsandrulesregardingsocialinsurance.6.2IfPartyB

12、issickorsuffersjob-unrelatedinjury,PartyAshallprovidethemedicaltreatmentperiodandmedicaltreatmentinaccordancewithrelevantprovisionsoftheState.6.3IfPartyBcontractsanoccupationaldisease,orsuffersjob-relatedinjuryordeath,PartyAshallhandlethecaseinaccordancewiththerelevantlawsandregulationssuchastheLawo

13、nPreventionfromandTreatmentofOccupationalDiseaseandtheRegulationsonJob-RelatedInsurance.6.4PartyBshallbeentitledtolegalholidays,annualvacation,marriageleave,maternityleaveandfuneralleave,etc.,accordingtolaw.Article7LaborDiscipline7.1TherulesandregulationsformulatedbyPartyAaccordingtolawshallbemadepu

14、blicandnotifiedtoPartyB.7.2PartyBshallconsciouslyabidebytherelevantlawsandregulationsatthelevelofState,provinceandcityandtherulesandregulationsformulatedbyPartyAaccordingtolaw,complywiththeoperationregulationsinsafety,besubjecttothemanagementoftheCompany,andcompletehisworkingtaskstimely.7.3PartyBsha

15、llconsciouslyabidebytheprovisionsonfamilyplanatthelevelofState,provinceandcity.Article8ChangeThisContractmaybechangeduponagreementreachedbybothPartiesthroughconsultation.AnychangeofthisContractshallbehandledinwriting.Article9Revocation9.1PriortoexpirationofthisContract,anyrevocationofthisContractbyb

16、othPartiesoreitherpartyinadvanceshallcomplywiththerelevantprovisionsofthelawsandregulations.9.2Iftheconditionsonpaymentofeconomiccompensationaremet,PartyAshallpaytoPartyBtheeconomiccompensationaccordingtolaw.9.3IfthisContractisrevokedbybothParties,PartyAshallprovideawrittencertificatetoPartyB,andtim

17、elyhandletherelevantproceduresforrevocationofthisContract.Article10Termination10.1UponexpirationofthisContractorsatisfactionoftheconditionsonterminationofthisContractasagreedbybothParties,thisContractshallbeterminated.Incaseofsuchtermination,PartyAshallprovideawrittencertificatetoPartyB,andtimelyhan

18、dletherelevantproceduresforterminationofthisContract.10.2IfbothPartiesagreetorenewthisContractuponexpirationofthisContract,therelevantproceduresshallbehandledwithin30dayspriortoexpirationofthisContract.Article11LiabilityforBreachofContract11.1PartyAsliabilityforbreachofcontract:.11.2PartyBsliability

19、forbreachofcontract:.Article12DisputeResolutionAnylabordisputebetweenbothPartiesshallberesolvedthroughconsultation,failingwhich,itmaybesubmittedtotheLaborDisputeMediationCommitteeoftheCompanyformediation,oritmaybesubmitteddirectlytotheLaborDisputeArbitrationCommitteeforarbitration.Incaseofnoobjectio

20、ntothearbitrationaward,bothPartiesmustperformtheaward;shouldtherebeanyobjectiontotheaward,eitherpartymaybringalawsuitinthepeoplescourt.Article13OtherMattersRequiredtobeAgreedbybothParties:TheinformationontheclientsandthebusinesssecretsoftheCompanyshallnotbedisclosedtoanythirdparty.Article14Miscellan

21、eous14.1AnymatternotcoveredbythisContractoranytermshereofinviolationoftheapplicablelawsandregulationsshallbegovernedbytheapplicablelawsandregulations.14.2ThisContractshallbebasedonthefollowingrulesandregulations.i)TheLaborContractLaw;and,ii)therulesandregulations(orthePersonnelManual)issuedbytheComp
