16、therelevantprovisionsofGanYuXianlianyungangcity.Article6rulesandregulationsandlabordiscipline(a)partyawillhave,inaccordancewithlaw,establishandperfecttherulesandregulationsoftheinformpartyb;Partyasrulesandregulationsifthereisachange,willinformpartybthroughpublicway.(2)partybhasthehandbook,knowsthela

17、wfullyformulatetherulesandregulationsandlabordiscipline,andpromisestostrictlyabideby.(3)ifpartybviolateslabordisciplineandrulesandregulations,partyamayaccordingtotherulesandregulationstogivecorrespondingprocessing,untilterminatethiscontract.Article7Laborcontracttermination,renewandchangeA:laborcontr

18、actterminate1,partyaandpartybbothsidestalksthingsoverconsistent,mayterminatethelaborcontract.2,partybputsforwardtoremovelaborcontract,shallnotifypartyainwrittenform:(1)probationadvancethreeday.(2)theprobationperiod,thelaborcontractperiod,30daysinadvance.Thereareotheragreedfromtheiragreement.3,partya

19、underthefollowingcircumstances,partybmayterminatethelaborcontract:(1)notaccordingtolaborcontractpartybtoprovidelaborprotectionorworkingconditions;(2)notpromptlyandinfullamount,paypartyblaborremuneration;(3)notforpartybinaccordancewiththepaysocietyinsurancepremium;(4)partyasrulesandregulationsinviola

20、tionoftheprovisionsofthelawsandregulations,partybsdamage;(5)becauseofthelaborcontractlawarticle26inthecaseoftheprovisionsofthefirstparagraphofthiscontractshallbeinvalid,(6)legalandadministrativeregulationspartybmayterminatethiscontractinothercircumstances.Partyawiththeviolence,threatorillegalrestric

21、tionofpersonalfreedomtocompelthelaborpartyb,orpartyaofemployingunitsinviolationofendangeringthepersonalsafetyofpartyb,partybmayterminatethiscontractimmediately,donotneedtoinformpartyainadvance.4,partybhasthefollowingcircumstances,partyamaycancelthecontract:(1)intheprobationaryperiodbeenprovednotmeet

22、thefollowingemploycondition:Partybbyphysicalexamination,healthconditionsdonotconformtopostrequirementorconcealchronicdiseases;Partybshouldprovidefalseidentitycardorotheridcardandotherpersonalfalseinformation;Partybemploymentproceduresincomplete;Partybisnotcompetentfortheemploymentpostregulationindex

23、orappraisalunqualified;Partyahappenedrulesandregulationsandhandbookregulationsinothermayterminatethecontractsituation;(2)partyaseriousviolationofrulesandregulations;(3)seriousderelictionofduty,malpractice,whichcausesgreatdamagetopartyainterests;(4)partybatthesametimeandtheotherunitofchooseandemployp

24、ersonstoestablishanemploymentrelationship,apartyatocompletethetaskofcauseseriousinfluence,orputforwardbypartya,refusestomakecorrections;(5)beshallbeinvestigatedforcriminalresponsibility;(6)laws,regulationsandtheprovisionsofrulesformulatedbytheothersituations;(7)forlaborcontractlawinthefirstparagraph

25、ofarticle26,paragraph1ofthesituationthatthecontractinvalid.5,underthefollowingcircumstances,partyainwrittenform30daysinadvancenoticetopartyborextrapaypartybamonthlywages,mayterminatethelaborcontract:(1)partybsickornotbeinjuredatwork,aftertheexpirationofthemedicaltreatment,cannotbeengagedintheorigina

26、lwork,alsocannotbeengagedinotherjobassignedbypartya;(2)partybisnotcompetentforwork,aftertrainingoradjustmentofthepost,stillisnotcompetentforwork;(3)thecontractreliesonaremajorchangesintheobjectivecircumstances,thelaborcontractcantbecarriedout,andbothpartiesthroughconsultationbypartyaandpartyb,failed

27、toreachagreementonamendingtheemploymentcontract;(4)partyaproductionandbusinessoperationseriousdifficulties,ofitspersonnelbecomesreallynecessary,(5)thelaws,regulationsandtheprovisionsofrulesformulatedbytheothersituation.6,partybhasthefollowingcircumstances,partyashallnotaccordingtoparagraph1ofarticle

28、7ofthiscontractparagraph5removelaborcontract:(1)engagedintheoccupational-disease-inductiveoperationstaffnotforwhomtheoccupationalhealthexaminationsbefore,oroccupational-disease-likediseasespatientsinmedicaldiagnosisorduringtheperiodofobservation.Butnotinaccordancewithpartyapartybarrangeparticipatein

29、themedicalexaminationofexcept;(2)inpartyatooccupationaldiseaseorbeinjuredatworkisconfirmedthelossofpartorloselaborability;(3)sickenorblamebeinjuredatwork,intheprovisionofmedicaltreatmentperiod;(4)femaleworkerisinpregnancy,produceperiod,lactation,(5)inthepartyacontinuousworkisfull15years,andfromthele

30、galandemeritusagelessthan5years;(6)laws,regulationsandtheprovisionsofrulesformulatedbytheothersituation.B.laborcontractterminationandrenewit1,oneofthefollowingconditions,laborterminationofcontract:(1)thelaborcontracthasexpired;(2)inaccordancewithpartybbegantoenjoytreatmentofprimaryendowmentinsurance

31、;(3)partybdeath,orthepeoplescourtdeclareddeadormissing; (4)partyaisdeclaredbankruptaccordingtolaw;(5)partyaismayrevokeitsbusinesslicense,shallorderittoclosedown,cancelorpartyainadvancetodissolve;(6)thelawsandadministrativerulesandregulationsinothercircumstances.2,thelaborcontractexpires,paragraph1of

32、article7ofoneofthecircumstancesprescribedinparagraph6,laborcontractdeadlineautomaticgodowntotherelevantcircumstanceceasestoterminate.Butinpartyatooccupationaldiseaseorbeinjuredatworkandwasconfirmedthelossofpartorloselaborabilityoflaborcontractinaccordancewithrelevantregulationsofinductrialinjuryinsu

33、rance.3,thiscontractexpires,partyaandpartybafteragreementthroughconsultationbetweenbothpartiescanrenewthecontract.c.thechangeoflaborcontractBothpartyaandpartybafterconsultationandcanchangethecontentofthecontract,andtodetermineinwrittenform.Article8theeconomiccompensationA:thefollowingcircumstances,p

35、rtya,inaccordancewiththefirstparagraphofarticle7paragraph5agreedtoterminatethiscontract;4,Inadditiontopartyatomaintainorimprovetheconditionsofcontractrenewalofthecontract,andpartybdoesnotagreetorenewthecircumstances,inaccordancewithparagraph2,article7,paragraph1,4,5eyeseyesagreedtoterminatethiscontr

36、act;5,Lawsandadministrativerulesandregulationsinothercircumstances.B.Economiccompensationaccordingtopartybinpartyaworkofthefixednumberofyear,everyfullayeartopayamonthlywagesstandardpaytopartyb.Sixmonthsbutlessthanoneyear,thecalculatebyayear;Dissatisfactionsixmonths,paytopartybthehalfofthemonthlypaye

37、conomiccompensation.C.ifpartybmonthlywageshigherthanreleasedinlianyungangregionalyearworkerismeanmonthlysalarythreetimes,economiccompensationpaidtothestandardaccordingtotheworkerismeanmonthlysalarythreetimestheamounttopay,topaytheeconomiccompensationoffixednumberofyearishighestdonotexceed12years.Men

38、tionedmonthlywagesistopointtopartybinthiscontractisterminatedorthe12monthspriortotheterminationoftheaveragewage.Article9specialtermsandconditionsA.Partybintheshifttoanearlierdate30daystosubmittopartyaallremovelaborcontract(resignation)writtenreport,partyashallcontinuetoperformintheprovisionsofthepos

39、tresponsibility,abidebypartyasrulesandregulations,andshallnotwithoutauthorizationdontcometoworkorforcedexit.Ifpartybhasviolatedbehavior,partyamaybedismissedbyseriousdiscipline,andatthesametimemayrequirecompensationtopartyapartybwithoutleavingtheeconomiclosscaused.B.Whateverthereasonrescindorterminat

40、ethiscontract,partybshall,inaccordancewiththeprovisionsofthepartyajobtransfer,allnotaccordingtoregulations,causeslossestopartya,partybshallbeartheliabilityofcompensation.C.Bothpartiesanyonepartytofraudorfraudulentmeanstosignlaborcontract,causeconsequences,thepartyshallbearallfault.Causesalosstotheot

41、herside,thefaultpartyshallbeartheliabilityforcompensation.Article10liabilityforbreachofcontractA.partyaviolationofthecontractconditionsandtoterminatethecontract,orduetopartyasreason,theconclusionofanyinvalidcontracts,causeslossestopartybshallbeliableforcompensationaccordingtothedegreeofloss.B.partyb

42、violatesthecontractconditionsandtoterminatethecontract,orduetopartybcausestheconclusionofanyinvalidcontracts,causeslossestopartya,andshallbeliableforcompensationaccordingtothedegreeofloss.C.partybviolatesserviceperiodagreedorbreachofthecompetitionrestrictionprovisions,heshallpayliquidateddamagestopa

43、rtyainaccordancewiththecontract.Article11agreedotheritems:Producelabordispute,bothsidescantalkthingsover.Bothsideswouldnotconsultation,theconsultationfailsorreachareconciliationagreementnottoperform,canapplyformediationtothemediationorganization;Dontletconciliationormediationorreachamediationagreeme

44、ntnottoperform,mayapplytothelabordisputearbitrationcommitteeforarbitration;Notsatisfiedwiththeadjudicationofarbitration,exceptotherwiseprovidedbylawoutside,cantopeoplecourttolodgeacomplaint.Article13otherA:thecontractannexandthiscontractareequallyvalid.B:partybpromises1,Thiscontractfirstaddressandzi

45、pcodeaspartyaeffectivewaytorelevantmaterials,ifhavechange,partybshallpromptlynotifypartyainwrittenform,Otherwise,causedbyallconsequencesorlossshallbebornebypartyb.2,Inthepartybincontactdisorderstate(includingbutnotlimitedtopartybduetoillnessbeinhospital,lossofpersonalfreedomandsoonsituation),partybs
