5、itledtoalllegalholidaysandotherpaidleavesofabsenceinaccordancewiththelawsandregulationsofthePRCandthepanysworkrules.c.TheEmployermayextendworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunionandtheEmployee,buttheextendedworkinghourforadayshallgenerallynotexceedo

6、nehour;Ifsuchextensioniscalledforduetospecialreasons,theextendedhoursshallnotexceedthreehoursa,thetotalextensioninamonthshallnotexceedthirty-sixhours.Security&WelfareEmployerwillpayforallmandatorysocialsecurityprogramssuchpensioninsurance,unemploymentinsurance,medicalinsuranceoftheEmployeeaccordingt

7、otherelevantgovernmentandcityregulations.theperiodoftheContract,theEmployeeswelfareshallbeimplementedaccordancewiththelaws?andrelevantregulationsofProtection&WorkingConditionsEmployershouldprovidetheEmployeewithoccupationalsafetyandhealthconditionsconformingtotheprovisionsoftheStateandnecessaryartic

8、lesoflaborprotectiontoguaranteethesafetyandhealthduringtheworkingprocess.EmployershouldprovidetheEmployeewithsafetyeducationandtechniquetraining;TheEmployeetobeengagedinspecializedoperationsshouldreceivespecializedtrainingandacquirequalificationsforsuchspecialoperations.c.TheEmployeeshouldstrictlyab

9、idebytherulesofsafeoperationintheprocessoftheirwork.DisciplineEmployermaydraftbylawsandlabourdisciplinesoftheCompany,Accordingtowhich,theEmployershallhavetherighttogiverewardsortakedisciplinaryactionstotheEmployee;EmployeeshallplywiththemanagementdirectionsoftheEmployerandobeythebylawsandlabourdisci

10、plinesoftheEmployer.EmployeeshallundertaketheobligationtokeepandnottodisclosethetradesecretfortheEmployerduringtheperiodofthisContract;ThisobligationofconfidentialityshallsurvivetheterminationofthisContractforaperiodoftwo(2)years.,Modification,RenewandDischargeoftheContracta.TherelevantclausesoftheC

11、ontractmaybemodifiedbytheparties:specificclauseisrequiredtobemodifiedbythepartiesthroughconsultation;totheforcemajeure,theContractcannotbeexecuted;relevantlawsandregulationshavebeenmodifiedorabolishedbythetimeofsigningtheContract.Contractmaybeautomaticallyterminated:i)ThisContractisnotrenewedattheex

12、pirationofthisContract;ii)TheEmployerislegallyannouncedtobebankruptcy,dismissed,orcanceled;iii)ThedeathoftheEmployeeoccurs;iv)Theforcemajeuretakesplace;v)TheconditionsofterminationagreedintheContractbythepartiesarise.Contractmayberenewedattheexpirationthroughconsultationbythepartieswiththefulfillmen

13、toftheprocedurewithin15daystotheexpiration;d.TheContractmaybedischargedthroughconsultationbytheparties;ContractmaybedischargedbytheEmployerwithimmediateeffectandtheEmployeewillnotbepensated:Employeedoesnotmeetthejobrequirementsduringtheprobationaryperiod;Employeeseriouslyviolatesdisciplinesorbylawso

14、ftheEmployer;Employeeseriouslyneglectshisduty,engagesinmalpracticeforselfishendsandbringssignificantlosstotheEmployer;EmployeeisbeingpunishedbyphysicallabourforitsmisfeasanceEmployeeisbeingchargedwithcriminaloffences:ContractmaybeterminatedbytheEmployerbygivingnoticeinwrittenform30(thirty)daysinadva

15、nce:Employeefailsillorisinjuredto(otherthanduetowork)andafterpletionofmedicaltreatment,isnotabletoperformhispreviousfunctionoranyotherfunctiontheEmployerassignstohim;Employeedoesnotshowsatisfactoryperformanceandaftertrainingandadjustingmeasuresisstillnotabletoperformsatisfactorily;circumstanceshavem

16、ateriallychangedfromthedatethisContractwassignedtotheextentthatitisimpossibletoexecutetheContractprovided,however,thatthepartiescannotreachanagreementtoamendthecontracttoreflectthechangedcircumstances.Employerisbeingconsolidatedinthelegalconsolidationperiodonthebrinkofbankruptcyorthesituationofbusin

17、essisseriouslyintrouble,undersuchcondition,itisrequiredtoreducetheemplouee.(inlegalprocedure)Employeeshallnotbedismissed:i.TheContracthasneitherexpirednorconformedto,;EmployeeisillwithoccupationaldiseaseorinjuredduetoworkandhasbeenauthenticatedfullyorpartlydisabledbytheLabourAuthenticationCommission

18、inBaodiCounty,Tianjin.iii.TheEmployeeisillorinjured(otherthanduetowork)andiswithintheperiodofmedicalleaveprovidedforbyapplicablePRClawandregulationsandCompanypolicy;Employeeiswomanwhoispregnant,onmaternityleave,ornursingababyunderoneyearofage;orapplicablePRClawsandregulationsotherwiseprohibittheterm

19、inationofthisContract.ContractmaybedichargedbytheEmployeebygivingnoticeinwrittenform30(thirty)daysinadvance.However,theEmployeemayinformtheEmployertodischargetheContractatrandomunderthefollowingoccasions:Employeeisstillintheprobationaryperiod;EmployerforcetheEmployeetoworkbyviolence,duressorillegalr

20、estrictiontophysicalfreedom;iii.TheEmployerdoesnotpaytheremunerationoftheEmployeeaccordancewiththerelevantclauseintheContract;EmployerviolatestherelevantregulationsofStateorTianjinforitsterriblesafeandhealthcondition,whichisharmfultotheEmployeeshealth.ContractcannotbeterminatedbytheEmployeebeforethe

21、expirationifnotconformingto,j.TheEmployershallpaytheeconomicpensationtotheEmployeriftheContractisterminatedconformingto,AdditionalfeeformedicalallowanceshouldbepaidtotheEmployeeiftheContractisterminatedconformingtoLiabilitiesa.Duetoeitherpartysfault,ifbreachingtheContract,thatpartyshallundertaketheb

22、reachliabilityaccordingtotheextenttotheperformanceoftheContract;ifthepartiesbothbreachtheContract,theyshallundertakeitsseparateliabilityaccordingtotheconcretesituation.b.Duetoeitherpartysfault,ifbreachingtheContracttodamagetheotherparty.Thedamageshouldbepensatedbythefaultypartyaccordancewiththerelev

23、antlawsandregulationsofPRC.totheforcemajeure,causingthenon-performanceorthedamagestoeitherparty,theotherpartymaynotundertakethebreachliability;EmployeewantstoresignandhasreceivedtrainingprovidedbytheEmployer,theEmployeeshallpensateforthetrainingcost.Themethodofpensationshouldbefixedaccordingtotherel

24、evantpanyregulationsasfollows:TheEmployeeshallpensateRMB_within_year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;TheEmployeeshallpensateRMB_within_year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;TheEmployeeshallpensateRMB_within_year(s)intheCompanyiftheContract

25、isterminatedbytheEmployeeathiscause;DisputesWherealabordisputebetweenthepartiestakesplaceduringtheperformanceofthisContract,thepartiesconcernedmayseekforasettlementthroughconsultation;oreitherpartymayapplytothelabordisputemediationmitteeoftheirunitformediation;ifthemediationfailsandoneofthepartiesre

26、questsforarbitration,thatpartymayapplytothelabordisputearbitrationmitteeforarbitration.Eitherpartymayalsodirectlyapplytothelabordisputearbitrationmitteeforarbitrationwithin60daysstartingfromthedateoftheoccurrenceofalabordispute.Ifoneofthepartiesisnotsatisfiedwiththeadjudicationofarbitration,theparty
