9、cle4 Working Remuneration（一） 甲方依法制定工资分配制度并告知乙方。甲方支付给乙方的工资不得低于公布的当年度最低工资。Party A is entitle to adjust salary of Party B. But will not below the municipal government minimum wage standards.二甲方经与乙方协商同意按以下第 种方式支付乙方的工资。 The working pay shall be determined as set forth in Item below.1、 乙方每月正常工作时间工资 元；试用内每

12、ce and Welfare（一） 甲乙双方按照和、有关规定参加社会缴纳社会费。 Party a and Party B must participate in social insurance and pay social insurance premiums on a monthly basis in accordance with the national and provincial law. （二） 乙方患病或非因工负伤甲方应按和、的有关规定给予乙方享受医疗和医疗待遇。Where Party B has contracted an illness or sustained a non

13、-work-related injury, Party A should give Party B medical treatment and medical leave accordance with National or provincial regulation.（三） 乙方患职业病、因工负伤的甲方按?职业病防治法?、?工伤?等有关法律法规的规定执行。Where Party B has contracted an occational diseases or industrial injury, party A have to implement related provisions

14、according to the occation disease prevention law, industrial injury insurance regulations and other relevant laws and regulations.（四） 甲方为乙方提供以下福利待遇 party A provides the following benefits for party B 。六、 劳动保护、劳动条件和职业危害防护Article 6 Labor Protection, Working Conditions and Protections against Occationa

15、l Hazards（一） 甲方按照和、有关劳动保护规定提供符合平安卫生的劳动作业场所和必要的劳动防护用品实在保护乙方在消费工作中的平安和安康。Party A shall give Party B education and training programs relating to labor safety, professional skills and labor disciplines etc. According to the requirements of state labor protection and safe-production, Party A shall provid

16、e necessary working condition to ensure Party Bs safety and health.（二） 甲方按照和、有关规定做好员工和未成年工的特殊劳动保护工作。Party A must conscientiously carry out relevant provisions formulated by the state for the protection of female and under-aged employees.（三） 乙方从事 作业可能产生 职业危害甲方应采取 防护措施且按照卫生行政部门的规定组织上岗前、在岗间和离岗时的职业安康检查并

17、将检查结果如实告知乙方。职业安康检查费用由用人承担。The Employee is engaged in the , possible occation hazard, Employer should take protective measures, and in accordance with the health administrative department of the State Council shall organize job occation health examination before,during and post time, and the inspecti

Occation health inspection fees shall be borne by the employer.四乙方有权回绝甲方的违章指挥和强冒险作业；对甲方危害生命平安和身体安康的行为乙方有权要求改正或向有关部门举报。The Employee must strictly abide by rules of safe operations during working process, and has the right to refuse peccant mand and the

19、 right to demand correction or report to the relevant departments.七、 规章制度Article 7 Regulation and Rules（一） 甲方依法制定的规章制度应当告知乙方。Party A draw the regulation and rules accordance to law and shall inform Party B.（二） 乙方应遵守和、有关法律法规和甲方依法制定的规章制度按时完成工作任务进步职业技能遵守平安操作规程和职业道德。Party B shall obey the related Law an

20、d the Regulation whi is draw by Party A; to plete task on time, ply with the safety rules and occation moral.（三） 乙方自觉遵守和、方案生育的有关规定。Party B shall ply with the Family Planning regulation accordance to the Law.八、 劳动合同变更 Article 8 Alternation of Contract甲乙双方经协商一致可以变更劳动合同。变更劳动合同应采用书面形式。变更后的劳动合同文本双方各执一份。B

Both parties shall keep a copy of revised contract.九、 劳动合同解除和终止 Article 9 Dissolution and Termination of Contract（一） 甲乙双方协商一致可以解除劳动合同。 Where Party A and Party B rea a consensus, the contract can be te

22、rminated.（二） 乙方提早三以书面形式甲方可以解除劳动合同；乙方试用内提早甲方可以解除劳动合同。To terminate the contract, Party B shall inform Party A in written notice in a thirty days advance. Party B in three days advance notice to Party A in probation period.（三） 甲方有以下情形之一的乙方可以甲方解除劳动同： In any of the following circumstances, Party B may no

23、tify Party A to terminate this contract1、 未按照劳动合同约定提供劳动保护或者劳动条件的； Failure on the part of Party A to provide working conditions as agreed on this contract.2、 未及时足额支付劳动报酬的； Failure on the part of Party A to pay labour remuneration.3、 未依法为乙方缴纳社会费经乙方要求甲方缴纳超过一个月仍未缴纳的；Party B shall pay social insurance pr

24、emiums fall short of legal provisions, Party B request Party A to pay, not pay more than a month;4、 规章制度违犯法律、法规的规定损害乙方权益的；Bylaw violates the legal provisions regulations, damage to Party Bs rights and interests;5、 以欺诈、胁迫的手段或者乘人之危使乙方在违犯意思的情况下订立或者变更本劳动合同致使劳动合同无效的；By means of fraud and intimidation or

25、position of vulnerability, so that Party B conclude or ange the labor contract in violation of the true meaning of the case, the labor contract is invalid;6、免除自己的法定责任、排除乙方权利致使劳动合同无效的；Escaping their own legal responsibilities and eliminating Party Bs rights lead to the labor contract invalid;7、违犯法律、行

26、政法规强迫性规定致使劳动合同无效的；In violation of laws, administrative regulations of the mandatory provisions,the labor contract is invalid；8、法律、行政法规规定乙方可以解除劳动合同的其他情形。 Legal and administrative regulations, Party B may terminate the labor contract situation.四甲方以、威胁或者限制人身的手段强迫乙方劳动的或者甲方违章指挥、强冒险作业危及乙方人身平安的乙方可以立即解除劳动合同

27、不需事先告知甲方。Party A forces Party B to work by violence, threat or illegal limitations of Party Bs freedom or Party A forces Party B to work by means of force, threat or illegal restriction of personal freedom. Party B may notify Party A of terminating the contract at any time.（五） 乙方有以下情形之一的甲方可以解除劳动合同：T

28、he pany may diiss the Employee at any time without further notice if the Employee: 1、 在试用间被证明不符合录用条件的； Is proven to be inpetent for the employing requirement during his/her period of probation;2、 严重违犯甲方的规章制度的； Seriously brea labor disciplines or regulations as stipulated by the pany3、 严重渎职营私舞弊给甲方造成重

29、大损害的； Seriously neglects his duty and engages in malpractices for selfish ends, thuscausing significant harm to the interests of the pany.4、 同时与其他用人建立劳动关系对完本钱的工作任务造成严重影响或者经甲方提出拒不改正的；Party B holds another job without the permit of Party A, whi seriously affects the pletion of Party As work task, or P

30、arty B refuses to correct the error after Party As warning;5、 以欺诈、胁迫的手段或者乘人之危使甲方在违犯意思的情况下订立或者变更本劳动合同致使劳动合同无效的；By means of fraud and intimidation or position of vulnerability, so that Party A conclude or ange the labor contract in violation of the true meaning of the case, the labor contract is inval

31、id; 6、被依法追究刑事责任的。 I（六） 有以下情形之一的甲方提早三以书面形式乙方或者额外支付乙方一个月工资后可以解除劳动合同?劳动合同法?第四十二条规定的情形除外： In any of the following circumstances, Party A may terminate this Contract on prior written notice of thirty (30) days to Party B or one month salary in lieu of the notice,expect forty-second Labor Law of the Peopl

32、es Republic of ina:1、 乙方患病或者非因工负伤在规定的医疗满后不能从事原工作也不能从事由甲方另行安排的工作的； Party B, due to sickness or injury inflicted off the job, can not resume his or her work or do the other job reassigned by Party A after specified period of medical treatment; 2、 乙方不能胜任工作经过培训或者调整工作岗位仍不能胜任工作的； Party B is unqualified, e

33、ven after a training or job adjustment.3、 劳动合同订立时所根据的客观情况发生重大变化致使劳动合同无法履行经甲乙双方协商未能就变更劳动合同内容达成协议的。 The objective conditions on whi the contract is based have materially anged to the extent that it is impossible to perform the contract while both parties cannot rea an agreement to amend the contract t

34、o reflect the anged conditions.（七） 有以下情形之一甲方需要裁减人员二十人以上或者裁减缺乏二十人但占甲方职工总数百分之十以上的甲方应提早三向工会或者全体职工说明情况在听取工会或者职工的并将裁减人员方案向人力资源保障劳动部门后可以裁减人员?劳动合同法?第四十二条规定的情形除外：One of the following circumstancesParty A would require reductions in staff of 20 people or more reduction of less than 20 but accounts for more t

35、han 10 per cent of the total number of Party workersParty A shall be thirty days in advance to the trade union or all the workers to explain the situation. After listening to the opinions of the trade union or employees, and will cut staff plan to the guarantee of human resources (labour) Department

36、 report, you can reduce the number of personnelexpect forty-second Labor Law of the Peoples Republic of ina:1、按照企业破产法规定进展重整的； Party A is declared bankrtcy legally;2、 消费经营发生严重困难的; In case Party A is face bad business situation;3、 企业转产、重大技术革新或者经营方式调整经变更劳动合同后仍需裁减人员的； Enterprise transformation,Major ten

37、ological innovation or Operation mode adjustment.After amendment of employment contracts , still needs to reduce its workforce;4、其他因劳动合同订立时所根据的客观经济情况发生重大变化致使劳动合同无法履行的。 The basis for the conclusion of the contract has greatly anged so that the contract can no longer be carried out,while both parties

38、cannot rea an agreement on modifying the contract by mutual negotiation.（八） 有以下情形之一的劳动合同终止： The contract will terminate in case any of the following occurs: 1、劳动合同满的；The labor contract expires;2、 乙方到达法定退休年龄的；Party B shall rea the statutory retirement age;3、乙方亡或者被人民宣告亡或者宣告失踪的； Party B is dead, pronou

39、nced dead or pronounced missing by the peoples court;4、 甲方被依法宣告破产的； Party A is declared bankrtcy legally;5、 甲方被撤消营业执照、责关闭、撤销或者甲方提早解散的； Party As business license is revoked; Party A is pelled to close down or dissolve; or Party A decides to dissolve in advance6、 法律、行政法规规定的其他情形。 Other situations stipu

40、lated in laws and administrative provisions十、 经济补偿 Article 10:Economic pensation（一） 符合以下情形之一的甲方应当向乙方支付经济补偿： Party A shall pay economic pensation to Party B in follow case;1、甲方根据本劳动合同第九条第一项规定向乙方提出解除劳动合同并与乙方协商一致解除劳动合同的； Party A to Party B in accordance with the labor contract in Article 9 ( a ) the pr

41、ovisions of proposed dissolution of the labor contract , and in consultation with the Party B agreed to terminate the labor contract;2、 乙方根据本劳动合同第九条第三项、第四项规定解除劳动合同的；Party B in accordance with the labor contract in Article 9 (3) or paragraph (4) provides labor contract is terminated ; 3、 甲方根据本劳动合同第九条

42、第六项、第七项规定解除劳动合同的；Party A according to the labor contract of article 9 ( 6 ) , the provisions of paragraph ( 7) of the labor contract is terminated；4、 除甲方维持或者进步劳动合同约定条件续订劳动合同乙方不同意续订的情形外根据本合同第九条第八工程规定终止固定限劳动合同的； In addition to party a to maintain or improve the condition of the labor contract renew the labor contract Party B does not agree to renew the situation,Fixed term labor contract is terminated pursuant to this Agreement in Article 9 ( 8 ) of the first subparagraph；5、根据本合同第九条第八项第4目、第5目规定终止劳动合同的；on the basis of this contract Article ninth ( eight ) of fourth, fifth eye
