1、Food Supply Contract供餐服务合同Party A: 甲方: Party B 乙方: After friendly consultation in accordance with the principles of equality and mutual benefit; Party A and Party B conclude the following articles in accordance with the CONTRACT LAW OF THE P.R.C., FOOD SAFETY LAW OF THE P.R.C., Supervision and manag
2、ement measures of catering services, Catering and delivery for group meal hygienic practices: 经甲、乙双方友好协商,本着平等互惠的原则,根据合同法、食品安全法、餐饮服务食品安全监督管理办法和餐饮业和集体用餐配送单位卫生规范等相关法律法规,双方达成如下协议:Article 1 Canteen第一条 餐厅The canteen of Party A is provided by _甲方餐厅由_提供。Article 2 Contract Terms第二条 履行期限This contract is valid
3、 from January 13th 2014 to December 31st 2014. 本协议有效期自2014年 01月13日至2014年12月31日止。Article 3 Food Supply Expenses第三条 供餐服务费用支付3.1 The work meal for each unit is 12 RMB, include two meat-diet, one vegetable-diet, one soup, one piece fruit, principle food and other condiment.3.1 工作餐以每份人民币 拾贰 元为标准,提供二荤一素一汤
4、一粥一水果,特色主食以及咸菜、辣椒、醋等。3.2 The work meal for the next week shall be published to Party A on the designated place, and shall be revised when requested by Party A; by written or E-mail consent by Party A or Party A representatives (Work Meal Committee), the work meal shall be carried out by Party B. 3.2
5、 乙方须在每周末前提供下一周的菜单公示于指定位置供甲方参考,并应甲方的要求作部分修订,经甲方或甲方指定代表(工作餐委员会)书面或邮件确认后实施。3.3 Party A uses work meal card to take food, Party B acquires money by the real card swipe number.3.3 甲方持就餐卡就餐,乙方按实际刷卡次数收取餐费。Article 4 Party As rights and obligations第四条 甲方权利和义务4.1 Party A is entitled to request the information
6、 of canteen staff, service standard, quality assurance system, cost & profit, food standard, food material price and etc. 4.1 甲方有权提出食堂人员配置、服务标准、质量保证体系、成本利润、供餐标准和方式以及食品价格构成等。4.2 Party A is entitled to request Party B to follow the applicable laws and administrative regulations and catering industry r
7、egulations from health department.4.2甲方有权要求乙方执行国家有关法律法规以及卫生部门的餐饮行业规定等。4.3 Party A is a member of work meal committee; the work meal committee is entitled to supervise the food supplied by Party B from time to time; in the event that the food cannot meet requirement, such as insects in meal, salty, f
8、ood insufficient and etc., Party A is entitled to request written statement to improve to Party B. 4.3甲方成立工作餐委员会随时对乙方所提供的伙食进行监督,如若发现不合格(如饭、菜中有虫子、菜太咸、菜量太少等),甲方有权要求乙方做出书面说明并采取措施加以改善。4.4 Party A is entitled to make performance evaluation to Party B in accordance with this contract. 4.4甲方有权按照本合同约定对乙方进行考
9、核。4.5 Party A is liable to use meal card to take food from Party B. 4.5 甲方有义务配合乙方持就餐卡用餐。Article 5 Party Bs rights and obligations第五条 乙方的权利和义务5.1 Party B shall strictly perform the national applicable laws and administrative regulations and catering industry regulations from health department. 5.1乙方要
10、严格执行国家有关法律法规以及卫生部门的餐饮行业规定等。5.2 Party B shall deliver the lunch before 10:00 and diner before 18:00 to the canteen of Party A. 5.2乙方应在每日中午10:00,晚上18:00之前将工作餐送到甲方餐厅,以保证甲方按时用餐。5.3 The staffs of Party B shall work with health certificate, wear health cap, musk, gloves; during the catering services, Part
11、y B shall reasonably arrange its staffs to ensure the food-fetching is in order, shorten the waiting time of Party A; Party B shall satisfy the food quantity requirement of Party A, no rejection to second food request from Party A. The whole premise shall be tide from time to time by Party B, to ens
12、ure the catering environment is health and clean. 5.3乙方服务员应佩戴健康证、帽子、口罩、手套等上岗,做到热情、礼貌服务。乙方在给甲方盛饭过程中, 应合理安排相关岗位,确保盛饭过程顺畅有序,最大限度的缩短甲方等待时间;乙方应保证甲方对饭菜量数的要求,不得以任何理由拒绝甲方再次要求;乙方应安排专门人员及时清理餐桌,员工用餐后做到随走随清理,以保证就餐环境干净、卫生。5.4 All food material, such as oil, sediment, dessert, frozen food, bean products, vegetabl
13、es, and other health products, shall be purchased from regular store and meet the relevant standards. All the dishware provided by Party B shall be nontoxic and clean; Party B shall be responsible for the food quality and quantity to Party A. 5.4乙方配送的工作餐所使用的原材料,如:粮油、调味品、副食品、冷冻制品、豆制品、蔬菜等,以及洗涤与卫生用品等物资
14、必须到正规商店采购,保障质量合格,符合相关标准。乙方运送饭菜的容器及餐具应无毒、卫生;乙方需要确保甲方每日饭菜的质量及数量。5.5 Without written consent of Party A, Party B neither carry out any other business activities in the working area and canteen, nor transfer the catering service or subcontract to any third party.
