1、Food Supply Contract供餐服务合同Party A: 甲方： Party B 乙方： After friendly consultation in accordance with the principles of equality and mutual benefit; Party A and Party B conclude the following articles in accordance with the CONTRACT LAW OF THE P.R.C., FOOD SAFETY LAW OF THE P.R.C., Supervision and manag

2、ement measures of catering services, Catering and delivery for group meal hygienic practices: 经甲、乙双方友好协商，本着平等互惠的原则，根据合同法、食品安全法、餐饮服务食品安全监督管理办法和餐饮业和集体用餐配送单位卫生规范等相关法律法规，双方达成如下协议：Article 1 Canteen第一条 餐厅The canteen of Party A is provided by _甲方餐厅由_提供。Article 2 Contract Terms第二条 履行期限This contract is valid

3、 from January 13th 2014 to December 31st 2014. 本协议有效期自2014年 01月13日至2014年12月31日止。Article 3 Food Supply Expenses第三条 供餐服务费用支付3.1 The work meal for each unit is 12 RMB, include two meat-diet, one vegetable-diet, one soup, one piece fruit, principle food and other condiment.3.1 工作餐以每份人民币 拾贰 元为标准，提供二荤一素一汤

4、一粥一水果，特色主食以及咸菜、辣椒、醋等。3.2 The work meal for the next week shall be published to Party A on the designated place, and shall be revised when requested by Party A; by written or E-mail consent by Party A or Party A representatives (Work Meal Committee), the work meal shall be carried out by Party B. 3.2

5、 乙方须在每周末前提供下一周的菜单公示于指定位置供甲方参考，并应甲方的要求作部分修订，经甲方或甲方指定代表（工作餐委员会）书面或邮件确认后实施。3.3 Party A uses work meal card to take food, Party B acquires money by the real card swipe number.3.3 甲方持就餐卡就餐，乙方按实际刷卡次数收取餐费。Article 4 Party As rights and obligations第四条 甲方权利和义务4.1 Party A is entitled to request the information

6、 of canteen staff, service standard, quality assurance system, cost & profit, food standard, food material price and etc. 4.1 甲方有权提出食堂人员配置、服务标准、质量保证体系、成本利润、供餐标准和方式以及食品价格构成等。4.2 Party A is entitled to request Party B to follow the applicable laws and administrative regulations and catering industry r

7、egulations from health department.4.2甲方有权要求乙方执行国家有关法律法规以及卫生部门的餐饮行业规定等。4.3 Party A is a member of work meal committee; the work meal committee is entitled to supervise the food supplied by Party B from time to time; in the event that the food cannot meet requirement, such as insects in meal, salty, f

8、ood insufficient and etc., Party A is entitled to request written statement to improve to Party B. 4.3甲方成立工作餐委员会随时对乙方所提供的伙食进行监督，如若发现不合格（如饭、菜中有虫子、菜太咸、菜量太少等），甲方有权要求乙方做出书面说明并采取措施加以改善。4.4 Party A is entitled to make performance evaluation to Party B in accordance with this contract. 4.4甲方有权按照本合同约定对乙方进行考

9、核。4.5 Party A is liable to use meal card to take food from Party B. 4.5 甲方有义务配合乙方持就餐卡用餐。Article 5 Party Bs rights and obligations第五条 乙方的权利和义务5.1 Party B shall strictly perform the national applicable laws and administrative regulations and catering industry regulations from health department. 5.1乙方要

10、严格执行国家有关法律法规以及卫生部门的餐饮行业规定等。5.2 Party B shall deliver the lunch before 10:00 and diner before 18:00 to the canteen of Party A. 5.2乙方应在每日中午10：00，晚上18：00之前将工作餐送到甲方餐厅，以保证甲方按时用餐。5.3 The staffs of Party B shall work with health certificate, wear health cap, musk, gloves; during the catering services, Part

11、y B shall reasonably arrange its staffs to ensure the food-fetching is in order, shorten the waiting time of Party A; Party B shall satisfy the food quantity requirement of Party A, no rejection to second food request from Party A. The whole premise shall be tide from time to time by Party B, to ens

12、ure the catering environment is health and clean. 5.3乙方服务员应佩戴健康证、帽子、口罩、手套等上岗，做到热情、礼貌服务。乙方在给甲方盛饭过程中, 应合理安排相关岗位，确保盛饭过程顺畅有序，最大限度的缩短甲方等待时间；乙方应保证甲方对饭菜量数的要求，不得以任何理由拒绝甲方再次要求；乙方应安排专门人员及时清理餐桌，员工用餐后做到随走随清理，以保证就餐环境干净、卫生。5.4 All food material, such as oil, sediment, dessert, frozen food, bean products, vegetabl

13、es, and other health products, shall be purchased from regular store and meet the relevant standards. All the dishware provided by Party B shall be nontoxic and clean; Party B shall be responsible for the food quality and quantity to Party A. 5.4乙方配送的工作餐所使用的原材料,如：粮油、调味品、副食品、冷冻制品、豆制品、蔬菜等，以及洗涤与卫生用品等物资

14、必须到正规商店采购，保障质量合格，符合相关标准。乙方运送饭菜的容器及餐具应无毒、卫生；乙方需要确保甲方每日饭菜的质量及数量。5.5 Without written consent of Party A, Party B neither carry out any other business activities in the working area and canteen, nor transfer the catering service or subcontract to any third party. Once the abovementioned is found, Party

15、A is entitled to terminate this contract and hold the right to pursue responsibility of contract violation. 5.5 未经甲方书面同意，乙方不得在甲方工作区域及就餐场所进行其他经营活动；不得将供餐服务转让或委托他人经营。一经发现，甲方有权终止本合同,并有权追究乙方违约责任。5.6 Party B shall be responsible for any damages coursed to Party A, due to the disqualified catering services

16、. 5.6 因乙方原因未按照甲方要求提供优质合格的供餐服务给甲方造成损害的，乙方承担全部责任。Article 6 Contract Alternation and Termination第六条 合同的变更与解除6.1 Any party may alter or terminate this contract, the counterparty shall be written informed one month in advance, otherwise the party shall be borne the responsibility of contract violation. 6

17、.1因一方原因需要变更、解除本合同的，必须提前一个月以书面形式告知对方，否则由违约方承担相应责任。6.2 This contract may altered or terminated upon agreement reached by both parties. 6.2经甲乙双方协商一致，可以变更或解除本合同。6.3 A party shall not be borne any responsibility in the event that the party unperformed the whole or part of this contract under the influenc

18、ed of force majeure. 6.3本合同任何一方因受不可抗力影响而未能履行本合同全部或部分义务，不承担任何责任。Article 7 Breach of Contract第七条 违约责任7.1 Party A adopts Points-system to evaluate the catering service of Party B, in the event that the point deduction reaches or exceeds 10 during this contract term, Party A reserve the right to termina

19、te this contract. 7.1 甲方采用计分制方法对乙方供餐服务进行评价，本合同期内累计扣分达到或超过10分的，甲方有权单方解除本合同。7.1.1 Food delivery untimely or insufficient, deduct 1 point, if the task of Party A is influenced, Party B shall be borne the loss of Party A. 7.1.1 送餐不及时或数量不够，扣1分，若因此影响甲方工作，乙方应赔偿由此给甲方造成的损失。7.1.2 In the event that the hair, l

20、ittle insects, fly, cockroach or cigarettes end is found in food, Party A has the right to withdraw the meal fee and claim ten times compensation to Party B. 7.1.2 餐中发现有头发、小虫、苍蝇、蟑螂、烟头等，甲方有权要求乙方退还本次用餐费用，并附加十倍用餐费用赔偿甲方。7.1.3 Other claim coursed by contract violation from Party B. 7.1.3 其他因乙方违反本合同条款而产生的

21、赔偿，由甲方根据具体情况确定。7.2 In the event of that the accumulated violation reaches three times in a month, or the accumulated violation reaches six times in six month, Party A is entitled to terminate this contract. 7.2送餐公司如一个月内累计出现3次违约，或6个月内累计出现6次违约，甲方有权解除与供餐公司的合同。7.3 In the event that Party A is poisoning,

22、 diarrhea or in similar symptom coursed by Party B, Party B shall borne all responsibility to Party A, which includes but not limited in treatment, hospital, salary loss and etc.; if equal or more than twenty people are confirmed with poisoning, diarrhea or similar symptom, the Work Meal Committee c

23、an represent Party A terminate this contract. 7.3如由于饭菜及餐具原因引起甲方任何程度的食物中毒或集体腹泻等类似症状，乙方将承担由此对甲方造成的一切责任（包括但不限于甲方的诊疗费、住院费、误工费等），经确认中毒或集体腹泻等类似症状等于或超过20人时，甲方工作餐委员会有权代表甲方解除本合同。Article 8 Miscellaneous第八条 其他规定8.1 Party A has the right to take sample from work meal supplied by Party B8.1 甲方有权对乙方所供饭菜留样8.1.1 Th

24、e Work Meal Committee may designate special person to responsible for sampling work; 8.1.1 留样工作由甲方组成的工作餐委员会指定专人负责、专人操作、专人记录，使用专业器具，留样冷藏柜由专人管理。8.2 The sample may contain all food proceeded by Party B8.2 留样食品范围为经过加工后被运输到甲方的所有菜品。8.2.1 All sampling food, after cooling, may be covered in airproof box, wi

25、th label contain the information of time, food type, name of the sampling people on the box; 8.2.1所有留样饭菜冷却后，放入专用器皿中加盖，并在外面贴上标签，标明编号、留样时间、餐别、留样人等。8.2.2 Sample should be kept during the temperature 0-10, and 48 hours is needed.8.2.2 留样饭菜在冰柜内冷藏温度为0-10。留样时间应在48小时或以上，时间到后乙方可销毁。8.2.3 Keep the cupboard and

26、 airproof container clean, and avoid empoison.8.2.3 随时保持留样柜、留样餐具、留样包装容器的清洁，以免污染样品。Article 9 Dispute resolution第九条 争议的解决Any disputes during contract performance shall be settled through friendly negotiation; in case that the parties cannot make consensus, any party may bring to the court where this c

27、ontract is signed. 双方在合同履行中发生争议，应当协商解决，协商无法达成一致的，向本合同签订地人民法院起诉。Article 10 Validity of Contract 第十条 合同的生效10.1 All pending issues shall be regulated by the supplemental agreements which need to be otherwise signed by both parties. The supplemental agreements shall have the same legal effect with this

28、contract. 10.1本合同未尽事宜由双方协商并签订补充协议。协议附件、补充协议与本合同具有相同的法律效力，是本合同不可分割的组成部分。10.2 This agreement is made in duplicate with the same legal effect either of which shall be held by both parties respectively, and shall enter into force upon signature by both parties. 10.2本协议一式两份，甲乙双方各执一份，签字盖章后生效。甲方： 乙方： 法定代表人（负责人）：委托代理人： 委托代理人： 年 月 日 年 月 日6
