8、章总那么Guidelines on the Protection of Intellectual Property Rights at ExhibitionsGeneral Provisions保护管理，根据中华人民 共和国民法典中华人民 共和国专利法中华人民 共和国商标法中华人民 共和国电子商务法展会 知识产权保护方法等法律 法规及相关政策，制定本指 引。第二条本指引适用于 在中华人民共和国境内举办 的各类线上线下经济技术贸 易展览会、展销会、博览 会、交易会、展示会等活动 中有关知识产权的保护。Article 1 For the purposes of further implementi

10、 Law of the Peoples Republic of China, the Trademark Law of the Peoples Republic of China, the E-Commerce Law of the Peoples Republic of China, the Measures for the Protection of Intellectual Property Rights at Exhibitions and other laws and regulations and relevant policies.Article 2 These Guidelin

11、es shall apply to the protection of relevant IPRs at various online and offline economic and technological trade exhibitions, trade shows, expos, trade fairs, presentations and other activities held within the territory of the Peoples Republic of China.第三条展会知识产权 保护工作遵循职能部门指导 监管、展会主办方具体负 责、参展方诚信自律、社会

12、 公众广泛监督的原那么。第四条展会举办地知 识产权管理部门应当加强对 本区域内所举办展会的知识 产权保护统筹协调、专业指 导和监督检查，维护展会知 识产权保护秩序。第二章展前保护第五条展会举办地知 识产权管理部门应加强展会 知识产权保护宣传，提供知 识产权保护法律和相关技术 咨询，帮助参展方提升知识 产权保护意识。第六条展会举办地知 识产权管理部门应对参展合 同中知识产权保护相关条款 加强指导，推动相关方在约 定条款中明确以下内容：Article 3 The protection of IPRs at exhibitions shall follow the principles of gui

13、dance and regulation by functional departments, assumption of specific responsibilities by exhibition sponsors, integrity and self-regulation of exhibitors, and extensive supervision by the public.Article 4 The IPR administrative departments at the places where exhibitions are held shall strengthen

14、the overall coordination, professional guidance, and supervision and inspection of the protection of IPRs at exhibitions held in local regions, and maintain the order of the protection of IPRs at exhibitions.Chapter I Pre-Exhibition ProtectionArticle 5 The IPR administrative departments at the place

15、s where exhibitions are held shall strengthen the publicity of the protection of IPRs at exhibitions, provide legal and relevant technical consultation on IPR protection, and help exhibitors improve their awareness of IPR protection.Article 6 The IPR administrative departments at the places where ex

16、hibitions are held shall strengthen guidance on the relevant clauses on IPR protection in exhibition participation contracts, and boost relevant parties to clarify the following contents in the agreed clauses:(1) Commitments that exhibitors consciously abide by (一)参展商自觉遵守展会 the rules on the protecti

19、ts at the places where exhibitions are held may, at the request of exhibition sponsors, guide the exhibition sponsors in checking the IPR status of exhibition items.第七条展会举办地知 识产权管理部门可以应展会 主办方的请求，指导展会主 办方对参展工程进行知识产 权状况核查。Article 8 The IPR administrative departments at the places where exhibitions are

20、 held may, in conjunction with relevant departments, direct exhibition sponsors to set up workstations according to relevant provisions issued by the state and actual needs, and coordinate the stationing of relevant functionaries, law enforcement personnel, professional technicians and legal profess

21、ionals in workstations at the request of exhibition sponsors. Workstations shall mainly undertake the following tasks:第八条展会举办地知 识产权管理部门可以会同有 关部门指导展会主办方根据 国家有关规定和实际需要设 置工作站，并应展会主办方 请求协调相关工作人员、执 法人员、专业技术人员和法 律专业人员进驻工作站。工 作站主要承当以下工作：(1) Accepting IPR-related complaints.（一）受理涉及知识产权的 相关投诉；（二）调解展会期间知识产exh

22、ibitions权侵权纠纷;(3) Providing consultation on relevant IPR laws, regulations and policies.（三）提供知识产权有关法 律法规及政策咨询；(4) Providing judgment opinions on complaints about suspected IPR infringements, and coordinating exhibition sponsors in handling them.（四）对涉嫌侵犯知识产权 的投诉提供判断意见，协调 展会主办方进行处理；(5) Transferring re

23、levant complaint information and materials to the IPR administrative departments at the places where exhibitions are held, and transferring the clues to suspected violations of laws to the relevant law enforcement departments.（五）将有关投诉情况及材 料移送展会举办地知识产权 管理部门，涉嫌违法线索移 送相关执法部门；(6) Summarizing and analyzi

24、ng the information on the protection of IPRs at exhibitions.（六）对展会知识产权保护 信息进行汇总和分析；(7) Other relevant matters.（七）其他相关事项。Article 9 The IPR administrative departments at the places where exhibitions are held may, as needed, request the CNIPA to coordinate the IPR administrative departments of all loca

25、lities, direct enterprises participating in exhibitions within their respective jurisdictions to conduct self-examination of risks of suspected IPR infringements, and strengthen business guidance on the protection of exhibitors1 IPRs.第九条展会举办地知 识产权管理部门可根据需要 请求国家知识产权局协调各 地知识产权管理部门，指导 辖区参展企业开展知识产权 涉嫌侵权

29、ringing upon IPRs during exhibitions may be accepted by workstations.第十二条向工作站提 出投诉的，投诉材料一般应 包括：Article 12 If a complaint is filed with a workstation, the complaint materials shall generally include:（一）投诉申请书，包括投 诉人与被投诉人基本情况， 被投诉参展工程涉嫌侵犯知 识产权的事实、理由和相关 证据材料；(1) the written application for the complaint

30、, including the basic information on the complainant and the respondent, the fact of the suspected infringement of any IPR by the exhibition item against which the complaint is filed and the grounds thereof, and relevant evidentiary materials;（二）有效知识产权权属证 明，包括专利证书、专利授 权公告文本、专利权人身份 证明、商标注册证明文件、 商标权利人

35、workstation shall handle the relevant complaint in strict accordance with laws, regulations and procedural requirements, and notify the exhibition sponsor and the respondent in a timely manner.第十四条被投诉人接 到通知后24小时内无正当 理由未提交书面陈述意见及 证据材料的，或被投诉参展 工程侵权事实已经由生效的 法律文书确认的，或被投诉 人成认侵权的，工作站应当 协调展会主办方及时采取措 施，包括但不

36、限于撤展、遮 盖以及删除、屏蔽、断开网Article 14 If a respondent fails to submit a written statement of opinions or evidentiary materials without any justifiable reason within 24 hours after receiving the notice, or the fact of the infringement by the exhibition item against which a complaint is filed has been confirm

37、ed by a valid legal document, or the respondent admits the infringement, the workstation shall coordinate the exhibition sponsor to take measures, including but not limited to withdrawing from the exhibition, covering up the item and deleting, blocking, or disconnecting links to websites, among络链接等。

40、he complaint materials that do not meet the provisions of Article 12 of these Guidelines, it shall notify the complainant to supplement the materials in a timely manner. If the complainant fails to supplement the materials as required during a specified period, the complaint shall not be accepted.第十

42、exhibitions are held shall strengthen the guidance and supervision of and the handling of disputes over the protection of IPRs at exhibitions.第四章展后保护及其他管 理Chapter IV Post-Exhibition Protection andAdministration of Other Matters第十九条展会举办地 知识产权管理部门可以根据 投诉处理情况，将相关材料 移送参展商注册地的知识产 权管理部门进行处理。Article 19 The

43、 IPR administrative departments at the places where exhibitions are held may, according to the handling of disputes, transfer relevant materials to the IPR administrative departments at the places where exhibitors are registered for handling.第二十条展会举办地 知识产权管理部门应当指导 展会主办方记录参展方知识 产权侵权假冒、恶意投诉等 行为。第二十一条展

46、e handling of IPR complaints and disputes at the exhibition, among others, and submit such information to the IPR administrative department at the place where the exhibition is held within ten working days after the conclusion of the exhibition.Article 22 The IPR administrative departments at the places where exhibitions are held shall strengthen the coordination and connection with law enforcement departments and other relevant administrative departments in terms of the protection of IPRs at exhibitions.
