1、租赁合同LEASE CONTRACT出租方：以下简称甲方：Lessor (hereinafter referred to as Party A):承租方：以下简称乙方：Tenant (hereinafter referred to as Party B):甲、 乙双方经过友好协商一致订立本合同，以资共同遵守。Party A and Party B ,having had friendly discussion,hereby agree to enter into the following contract to be abided by both parties.一、房屋地址：甲方将其所有的

4、 月 日以前支付给甲方定金共计 元整。2、在本合同签定之后至租期开场之前如甲方违约，那么上述定金由甲方双倍返还乙方，如乙方违约那么定金由甲方没收。定金的赔偿不影响违约金的索赔。3、租期开场之后，上述定金全额自动转化为： 。 Earnest Money:1、Party B will pay as an earnest money.The earnest money should be paid to Party A before (month) (day) (year).2、After the contract is signed and before the lease term begins

Party B shall pay the rental before it moves into the house.(If Party B pays the rental in the form of remitta

9、nce, the date of remitting shall be day of rental payment. The remittance fee shall be borne by the remitter.) Party A should sign a written receipt after each payment of rental is received.4、If Party B delays such rental payment, the interest would be imposed on overdue account at a daily rate of 1

10、%of month rental. After formal informing by Party A, if Party B still delays in the excess of ten working days, it shall deemed as automatically quitting tenancy, which shall constitute of contract.六、保证金1、 为确保房屋及其附属设施之平安与完好及租赁内相关费用之如期结算，乙方同意于 年 月 日之前支付给甲方 元整。作为乙方确保合同之保证金。甲方在收到保证金后应予以书面签收。2、 除合同另有约定之

11、外，甲方应于租赁关系消除且乙方迁空、点清、并付清所有应付费用后，当天将保证金全额无息退还乙方。3、 因乙方违反本合同的规定，而产生的违约金、损害赔偿以及应付租金及相关费用，甲方可在保证金扣抵，缺乏局部乙方必须在接到甲方付款通知后十天内补足。Deposit of Security:1、To ensure that the house and its accessory facilities are safe and in good condition and that accounts of relevant fees are settled on schedule during the ter

12、m of lease, Party B agrees to pay to Party A before (month) (day) (year) as a deposit of security for fulfilling to Contract. After receiving the deposit ,Party A should sign a written receipt.2、Unless otherwise agreed upon, Party A should return to Party B the full amount of deposit of security int

13、erest free on the day lease is dissolved and Party B has vacated the house ,left everything in the house intact and paid up all expenses due.4、 Any penalty for breach of contract, compensation for damage and rental and other relevant fees payable arising from Party Bs violation of the provisions of

14、the Contract may be made up for by Party B within ten days of the receipt of the notice of payment issued by Party A.七、其他费用1、 乙方应承当租赁期内的水费、电费、煤气费、通讯费与其他由乙方实际使用而产生的费用，并按单如期缴纳。2、 地租、房产税、租赁所得税、房屋维修费、物业管理费等原由甲方支付的费用，仍由甲方承当。Other Fee:1、 Party B should bear the water, electricity, gas and communication fe

15、es and all other fees incurred by Party B in actual use and pay the bills on schedule during the term of lease.2、 The land rent, house tax, income tax and house maintenance fee, management fees that were originally payable by Party A shall continue to be paid by Party A.八、甲方的义务：1、 甲方须按时将房屋及附属设施交付乙方使

16、用。2、 房屋设施如因质量原因，自然损耗或灾害而受到损坏时，甲方有修缮的责任并承当有关的费用。3、 甲方应确保所出租的房屋享有出租的权利，如在租赁期内，该房屋发生所有权全部或局部的转移、设定他项物权或其他影响乙方权益的事情时，甲方应保证所有权人，他项权利人或其他影响乙方权益的第三者能继续遵守本合同所有条款，反之如乙方权益因此而遭受损害，甲方应负赔偿责任。Obligations of Party A:1、 Party A shall turn over the house and accessory facilities (see the appendix for detail) on sche

17、dule to Party B for use.2、 Party A shall be responsible for repairing any damage of the house due to poor quality, natural tear and wear or calamities and bear the expenses thereof.3、 Party A should ensure that the house let out is entitled, to the lease. If all or part of the ownership of the house

18、 is transferred, other rights item are settled, or any other happening affects the rights and interests of Party B during the leasehold, Party A should guarantee that the owner, person to the rights item or any other third party that affects the rights and interest of Party B continue to abide by al

19、l the articles of the Contract. Otherwise, Party A shall be liable for compensating to loss to the rights and interests suffered by Party Btherefrom.九、乙方的义务：1、 乙方应按合同的规定，按时支付租金、保证金及其他各项应付费用。2、 乙方经甲方同意，可在承租用房内进展装修及添置设备。租赁期满后，乙方可将添置的可拆动的动产局部自行拆运，并保证不影响房屋的完好及正常使用。3、 未经甲方同意，乙方不得将承租的房屋转租或分租，并保护使用租赁的房屋。如因

20、乙方的过失或过错致使房屋及设施受到损坏，乙方应负赔偿责任。4、 乙方应按本合同的约定合法使用租赁房屋，不得擅自改变使用性质，不应存放危险物品，如因此发生损害，乙方应承当全部责任。Obligations of Party B:1、 Party B should pay the rental, deposit of security and other fees payable on schedule according to the provisions of the contract.2、 Party B may, upon approval by Party A , fit up the r

21、ented house and add equipment therein during the leasehold. Upon expiration of the leased hold, Party B may remove the added part of property that is removable, but it must ensure that the house is in good condition for normal use.3、 Party B must not transfer the lease of the house it has rented or

22、sublet it without the approval by Party A. Party B should take good care of the house rented. Party B shall be liable for compensating for any damage caused to the house and facilities due to Party Bs fault or misuse.4、 Party B should use the rented house lawfully according to the provisions of the

23、Contract. It must to not change the nature of the use of the house without authorization. No hazardous materials and goods shall be allowed to be kept in the house. If any damage is attributable to such use, Party B shall fully liable.十、合同终止及解除的规定：1、 乙方在租赁期满后，乙方有优先承租权，如需续租，应提前两个月通知对方，由双方另行协商续租事宜。2、

24、租赁期满后，乙方应在 天内将承租的房屋交还甲方，如有留置的任何物品，在未取得甲方谅解之下，均视为放弃，任凭甲方处置，乙方决无异议。3、 本合同一经双方签字后立即生效，未经双方同意，不得任意终止，如有未尽事宜，甲、乙双方可另行协商。Termination and Dissolution of the Contract:1、 If Party B intends to renew the leased hold upon its expiration, it should notify Party A of such intention two month in advance. Then, th

25、e two parties shall discuss matter over the renewal of leasehold.2、 Upon the expiration of the leasehold, Party B should turn the rented house back to Party A within days. Any belongings left behind in the house shall, without obtaining previous understanding of Party A, be deemed as things given up

26、 by Party B and shall be disposed of by Party A at its discretion, to which Party B shall raise no objection.3、 This contract shall go into effect the moment it is signed by both parties. It must not be terminated at will without the approval of both parties. Anything not covered in the Contract sha

27、ll be discussed separately by Party A and Party B.十一、违约处理：1、甲乙任何一方如未按合同的条款履行，导致中途终止合同，并且过错方在未征得对方谅解的情况下，那么视为违约，双方同意违约金为 元整。假设违约金缺乏弥补无过错方之损失，那么违约方还需就缺乏局部支付赔偿金。3、 凡在执行本合同或与本合同有关的事情时双方发生争议，应首先友好协商，协商不成，可向有管辖权的人民法院提起诉讼。Handing of Breach of Contact:1、If failure of either Party A or Party B to fulfil the

28、articles of the Contract before its expiration, the Party at fault shall be deemed as violating the Contract without obtaining the understanding of the other Party. The two parties agree that the penalty for breach of contract shall be .In case such penalty is not sufticient to make up for the loss

29、suffered by the faultless party. The party that has violated the Contract shall pay additional compensation.3、 Any dispute arising from execution of the Contract or in connection with the Contract should be settle through friendly discussion between the two parties. If no settlement can be reached t

30、hrough discussion, both parties shall have the right to sue with the peoples court, which has jurisdiction over the matter.十二、其他：1、 本合同的附件是本合同的有效组成局部，具有同等法律效力。2、 本合同一式 份，甲乙丙三方及中介见证方各执 份。Others:1、 Any appendix is the integral part of this Contract, which shall have equally legal bindings.2、 This cont
