3、itions as below for joint compliance in accordance with the Labor Law of the Peoples Republic of China and relevant rules and regulations.一、工作合同期限 Contract Term第一条 本合同为 壹年 期限合同。Clause 1 This is a one-year contract.本合同于 年 月 日生效，其中试用期至 年 月 日止。This Contract shall come into effect on _ (dd/mm/yy), and t

5、gree to take the position as _ pursuant to Party As work need. 第三条 乙方工作应达到 国内相关职业要求管理标准，并能完成公司所安排合理的工作要求。Clause 3 Party B shall perform its work in line with relevant national standards on the occupational requirements management and shall be capable of reasonable works arranged by Party A. 三、工作保护和条

6、件Working Protection and Working Conditions第四条 原则上执行标准工时制度，乙方每日工作时间8小时，每周工作40小时。Clause 4 Party B shall be subject to the standard working hour system in principle, namely eight hours per workday and forty hours per week.第五条 因设计工作的特殊性，如项目要求需要加班，不计加班费。Clause 5 Any extra hour worked by Party B for proje

7、ct need as the result of special feature of design work shall not be charged.第六条 甲方为乙方提供必要的工作条件，建立健全工作方式，制订工作规范和工作制度。Clause 6 Party A shall provide necessary work conditions for Party B, establish sound work mode, and formulate job specification and system.四、劳动报酬Labor Remuneration第七条 甲方每月 18 日前以货币形式

8、支付乙方工资，每月实发工资税后为 元。Clause 7 Party A shall on a monthly basis pay Party Bs salary in currency prior to the 18th day, and Party Bs monthly salary after tax shall be _ Yuan.五、福利待遇Welfare and Benefits第八条 乙方患病或非因工负伤的医疗待遇按国家、北京市有关规定执行。甲方按 XXX管理制度 支付乙方病假工资。Clause 8 Party B shall be entitled to the medical

Party A shall pay Party B the salary during the sick leave in accordance with XXX management system. 第九条 乙方患职业病或因工负伤的待遇按国家和北京市的有关规定执行。Clause 9 Party B shall be entitled to the benef

10、its as set forth in the relevant rules and regulations of the State and Beijing Municipality if he/she is ill with occupational disease or injured due to work.第十条 甲方为乙方提供以下福利待遇：详则见XXX管理制度。Clause 10Party A shall enable Party B to be entitled to the following welfare and benefits: refer to XXX managem

11、ent system for details.六、合约的变更、解除Contract Alternation and Cancellation 第十一条 有下列情形之一的，甲乙双方应变更合同并及时办理变更合同手续：Clause 11Party A and Party B shall alter this Contract and promptly go through contract alternation procedures if any of the following circumstances happens: （一）甲乙双方协商一致的；Party A and Party B rea

12、ch an agreement on alternation upon negotiation;（二）订立本合同所依据的客观情况发生重大变化，致使本合同无法履行的；The performance of this Contract is rendered discontinued by the substantial change of objective circumstances which the conclusion of this Contract is relied upon; （三）订立本合同所依据的法律法规、规章发生变化的。Laws, rules and regulations

13、upon which the conclusion of this Contract is relied change.第十二条 乙方有下列情形之一的，甲方可以解除本合同：Clause 12 Party A shall be entitled to cancel this Contract in any of the following circumstances:（一） 在试用期间被证明不符合录用条件的；Party B is proven during the probationary period not to satisfy the requirements of employment;

14、（二） 严重违反劳动纪律或者甲方利益造成重大损害的；Party B materially violates labor disciplines or causes substantial damage to Party As interests;（三） 严重失职，营私舞弊，对甲方利益造成重大损害的；Party B seriously neglects his duty, engages in malpractice for selfish ends and brings significant damage to Party As interests;（四） 被依法追究刑事责任的。Part B

15、 is being investigated for criminal liability in accordance with the law. 第十三条 有下列情形之一的，甲方可以解除本合同，但应当提前30日以书面形式通知乙方：Clause 13 Party A may dissolve this Contract by giving a thirty-day prior written notice to Party B if any of the following circumstances happens:（一）乙方患病或者非因工负伤，医疗期满后，不能从事原工作也不能从事由甲方另行

16、安排的工作的；Party B is incapable of performing his original work and any new job as arranged by Party A after the stipulated period of medical leave for an illness or non-work-related injury expires;（二）乙方不能胜任工作，经过培训或者调整工作岗位，仍不能胜任工作的；Party B is incompetent and remains incompetent after training or adjustm

17、ent of his position;（三）本合同订立时所依据的客观情况发生重大变化，致使本合同无法履行，经甲方双方协商不能就变更工作合同达成协议的。A major change in the objective circumstances on which the conclusion of this Contract is relied hinders continued performance of this Contract, and after consultation, Party A and Party B are unable to reach an agreement on

18、 amending this Contract.第十四条 甲方濒临破产进行法定整顿期间或者生产经营状况发生严重困难，符合裁减人员条件的，甲方可以解除合同。Clause 14 Party A shall be entitled to rescind this Contract in the event that Party A is bankrupt or enters statutory consolidation period or experiences difficulties in the production and operation or finds it necessary t

19、o reduce the workforce.第十五条 乙方有下列情形之一的，甲方不得解除本合同；Clause 15 Party A shall not cancel this Contract in any of the following circumstances:（一）患病或者非因工负伤，在规定的医疗期内的；Party B is ill or injured not due to work and the mandatory medical treatment period has not expired;（二）女职工在孕期、产期、哺乳期内的; Party B is a woman w

20、ho is pregnant, on materiality leave, or nursing a baby;第十六条 乙方解除本合同，应当提前30日以书面形式通知甲方，甲方应予以办理相关手续。但乙方给甲方造成经济损失尚未处理完毕或因其他问题正在被审查期间的情况除外。Clause 16 Unless otherwise all economic losses caused to Party A by Party B have been completely covered or Party B is not under any investigation for other issues,

21、Party B may cancel this Contract by giving a thirty-day prior written notice to Party A, and Party A under this circumstance shall go through relevant formalities.第十七条 有下列情形之一的，乙方可以随时通知甲方解除本合同：Clause 17 Party B may terminate this Contract by giving a notice to Party A any time if any of the followin

22、g circumstances occurs:（一） 在试用期内的；Party B is still in the probationary period;（二） 甲方以暴力、威胁或者非法限制人身自由的手段强迫劳动的；Party A forces Party B to work by violence, duress or illegal restriction to physical freedom;（三）甲方未按照本合同约定支付劳动报酬或者提供劳动条件的；Party A fails to pay labor remuneration or provide labor conditions

23、in accordance with relevant clauses of this Contract.第十八条 有下列情形之一的，本和同终止：Clause 18 This Contract shall cease to be valid in any of the following circumstances:（一）合同期限届满；The term of this Contract expires;（二）合同约定的终止条件出现；Conditions for termination as stipulated in this Contract appear;（三） 乙方达到离休、退休、退职条

24、件。Party B satisfies resignation and retirement conditions.第十九条 有下列情形之一的，甲方根据乙方在甲方工作年限和乙方解除本合同前12个月的平均工资，工作需满1年后支付1个月的经济补偿金：Clause 19 Party A shall be entitled to dissolve this Contract in any of the following circumstance, provided however that severance pay shall be provided according to Party Bs w

25、orking years at Party A and Party Bs average salary in the past twelve months prior to such dissolution. If Party B works a full year, such severance pay shall be one-month salary.（一） 双方协商一致，由甲方解除本合同； Two parties hereto agree upon consultation to let Party A terminate this Contract;（二） 乙方不能胜任工作，经过培训

26、或调整工作岗位，仍不能胜任工作，由甲方解除本合同的；Party B is incapable of the job and remains incapable after training or position adjustment.第二十条 乙方违反本合同约定条件解除工作合同或违反保守商业秘密事项，给甲方造成经济损失的，应依法承担赔偿责任。Clause 20 Party B shall assume compensation liability for any economic loss sustained by Party A due to Party Bs termination of

27、 this Contract in violation of the terms and conditions agreed herein or breach of non-disclosure obligation for business secrets.七、争议及其它Dispute and Miscellaneous第二十一条 双方因履行劳动合同发生争议，当事人可以向本单位劳动争议调解委员会申请调解；调解不成的，应当自劳动争议发生之日起，60日内向劳动争议仲裁委员会提出书面申请。Clause 21Disputes arising from or in connection with th

28、e performance of the labor contract by two parties hereto may be furnished to Party As labor dispute mediation committee for mediation; if mediation effort fails, an application may be filed to the labor dispute arbitration committee for an arbitral award within sixty days of the occurrence of such

29、labor dispute. 当事人一方也可以直接向劳动争议仲裁委员会申请仲裁。Either party concerned may directly apply to the labor dispute arbitration committee for an arbitral award.第二十二条 其他：1、如有其他需求在试用期结束后双方协商确定。 Clause 22Miscellaneous: 1. Any other demands if any shall be subject to separate negotiation of two parties hereto after
