1、土地厂房租赁合同以及通用厂房租赁合同合同编号:_土地厂房租赁合同甲方:_乙方:_签订日期:_年_月_日土地厂房租赁合同出租方(以下简称甲方)承租方(以下简称乙方)根据中华人民共和国合同法及相关法律规定,为了明确甲、乙双方的权利、义务,经双方平等协商,签订本合同。一、甲方将位于 市 路 号的 亩土地的使用权及地上建筑物、构筑物、附着物等(见附件)出租给乙方使用。二、乙方承租本宗土地必须进行合法经营,否则甲方有权收回土地使用权,终止合同。三、乙方不得擅自转租本宗土地的使用权,如需进行转租应征得甲方书面同意,否则甲方有权收回土地使用权,终止合同。四、甲方应保证本宗土地上的水、电、暖等基本设施完整,并
2、帮助乙方协调同水、电、暖的提供方的有关事宜,但具体收费事宜由乙与水电暖的提供方协商,所有费用由乙方承担。五、乙方在租用期间,不得随意改变本宗土地状况和地上的建筑物、构筑物、附着物及水、电、暖管网等设施,如确需改动或扩增设备应事先征得甲方书面同意后方可实施,对有关设施进行改动或扩增设备时如需办理相关手续,由乙方办理,甲方根据实际情况给予协助,所需费用有乙方承担,否则,乙方应恢复原状,并赔偿由此给甲方造成的损失。六、乙方租用期间,有关市容环境卫生、门前三包等费用由乙方承担。国家行政收费,按有关规定由甲、乙双方各自负担。七、乙方在租赁期间因生产经营所发生的所有事故及造成他人损害的,由乙方承担责任,与
3、甲方无关。八、合同约定的租赁期限界满或双方协商一致解除合同后10日内,乙方应向甲方办理交接手续,交接时乙方应保证工作人员撤离、将属于自己的设备腾清,并将租赁范围内的垃圾杂物等清理干净。九、租赁期限为 年,从 年 月 日 至 年 日。十、经甲乙双方商定,租金的交纳采取按年支付先付后用的方式,年租金为 元,由乙方于每年 日交纳给甲方 .如逾期交纳租金30日以内,乙方除应补交所欠租金外还应向甲方支付年租金日千分之二的违约金;如逾期超过30日,甲方有权解除合同,乙方应甲方支付年租金百分之二十五的违约金。十一、甲方向乙方收取约定租金以外的费用,乙方有权拒付。十二、在租赁期限内,因不可抗拒的原因或者因城市

10、ntal Purpose1、乙方向甲方承诺,租赁厂房作为办公及仓储展示设施使用,并遵守国家和本市有关租赁厂房使用和物业管理的规定。如该等使用用途需要经过有关部门审批或核准,甲方应当尽一切努力协助乙方获得该等审批或批准。1. Party B promises to Party A that the leased factory will be used for office work, storage and display of facilities, and will obey the domestic and municipal regulations concerning the use
11、 and property management of the leased factory. If such use needs to be approved by relative departments, Party A should make every effort to assist Party B to gain such approval.2、乙方保证,在租赁期内未征得甲方书面同意以及按规定须经有关部门审批而未核准前,不擅自改变上述约定的使用用途。2. Party B promises not to change the above agreed use without Par
12、ty A’s written agreement or not yet gained the approval after checking by relative department according to the regulations during the lease term.第三条交付日期和租赁期限:Article Delivery Date and Lease Term:1、双方约定,甲方应于合同签订且乙方支付首期租金及其他费用后按照本合同的约定向乙方交付租赁厂房。1. Under the agreement of both sides, Party A shoul
13、d deliver to Party B the leased factory after the contract is signed and Party B has paid the down payment and other expenses in accordance with this contract.2、租赁期为四年(含甲方同意乙方续租的二年),自2011年1月1日(“起租日”)起算。乙方续租申请时,应至少于届时当期租期届满前的叁个月前向甲方发出书面通知。续租期内,除租金按本合同第四条第1款作出调整外,本合同其他条款不做变更,双方应按本合同条款(租金除外
14、)在续租期内继续履行本租赁合同。租赁期及续租期(若适用)最终届满时,甲方有权于租赁期最后一日收回租赁厂房,乙方应按期返还租赁厂房。2. The lease term is four years (including Party B’s 2-year extended lease term agreed by Party A), starting from Jan. 1st2011 (Lease Inception Date). When Party B applys for extending the lease, Party A should be noticed in writ
15、ten form within three months before the termination date of the present contract. During the extended lease term, except the rent is adjusted according to Item 1 of Article in this contract, other articles of this contract remain as the same, both parties should obey the articles of this lease contr
16、act ( except the rent). When the lease term and the extended lease term (if applicable) finally end, Party A has the right to repossess the leased factory at the last date of the lease term, Party B should return the leased factory in time.3、如乙方未在上述期限内书面提前续租要求的,乙方应当允许并配合甲方或甲方代理人陪同有承租意向的第三方进入和参观租赁厂房,
17、但甲方应注意尽量减少对乙方正常生产经营的影响,经乙方确认该第三方非竞争对手后,按照乙方确定的时间安排第三方进入和参观。3. If Party B did not demand for extending the lease term in advance in the above term, Party B should allow and assist Party A or Party A’s agent to accompany the third party who is willing to take rent to enter and visit the leased f
18、actory, but Party A should reduce as much as possible the infuence to Party B’s normal production and operation. After confirmed by Party B that the third party is not a competitor, the third party can be arranged to enter and visit the leased factory according to the time determined by Party
19、B.第四条租金Article the Leasing Rent1、租赁期(含续租期)内前二年租赁厂房的租金为每日每平方米建筑面积人民币1.70 元,合计每月租金为人民币玖万肆仟叁佰伍拾元整(小写:¥94,350.00元);第三年的日租金标准由甲方根据届时的市场价格适当上调,但上调的幅度最多不得超过前一年的日租金标准的10%,从第三年开始以后每二年按照前一年的租金标准上调,但上调的幅度最多不得超过前一年租金标准的10%。1. The leasing rent for the first two years of the lease term(including the extended leas
20、e term) of the leased factory is RMB 1.70yuan per square meter of the construction area per day, total monthly rent is RMB NINETY FOUR THOUSAND THREE HUNDRED FIFTY YUAN (lower case: 94,350.00yuan); the daily rent for the third year will be adjusted appropriately by Party A according to the present m
21、arket, but the increased extent does not exceed 10% of the daily rent standard for the last year, the daily rent will be adjusted according to the rent for the former year every two years since the third year, but the increased extent does not exceed 10% of the daily rent standard for the former yea
22、r.2、乙方应每叁个月向甲方支付一次租金,如租金起算日不是该月首日的,租金起算日所在月之租金应按该月内实际租赁天数计算,并应连同此后叁个月的租金一并同时支付。2. Party B should pay the leasing rent to Party A every three months, if the starting date for rent is not the first day of that month, the rent of the first month since the starting date for rent should be counted accord
23、ing to the practical lease days, and paid together with the rent of the following three months.3、租金支付为先付后用,乙方应于每叁个月届满前10个工作日向甲方支付下叁个月的租金(首期租金除外)。甲方应在届满前20日向乙方开具应付租金金额之正式发票。3. The rent payment method is use after payment, Party B should pay to Party A the rent for the following three months within 10
24、 working days before the present three-month term ends (except the down payment). Party A should offer to Party B the formal invoice for the payable rent amount within 20 days before the present three-month term ends.4、租赁期内的首期租金(即从2011年1月1日起到2011年3月31日止的租金,共计人民币贰拾捌万叁仟零伍拾元整(小写:283050.00元),乙方应于本合同签订之日
