14、各自承担）。甲方用所在建的工程项目提供给乙方保证金作反担保。十、合同价款结算方法：按江西省2004年江西省建筑工程消耗量定额及江西省装饰装修工程消耗量定额、全国统一安装工程定额（江西省单位估价表）、（2004 年版）及相应工程类别取费下浮 5 个点计取相关费用。人工费执行2013年赣建价（2013）5 号文件标准。材料差价按鹰潭市当季信息价进行调整。信息价上未列的材料和项目由甲乙双方协商定价。凡转包给他人的施工项目，仍由乙方办理相关手续，乙方按规定收取配套管理费。工程款的支付和工程量的确认：承包人向工程师提交已完工程量报告的时间：每月25 日承包人向发包人提供本月工程量报告。双方约定的工程款（

21、ble.和在一个月内将乙方的工程款全部付清。（保修金3应扣除）第二期工程全部竣工验收合格后，甲方按工程进度支付工程款至90%，并在90 天内将乙方的工程款全部付清（保修金3%应扣除）如甲方在约定时间内不能付款，则承担乙方工程款逾期支付利息，逾期付款利息按月息 3计.如甲方在房屋预售后仍出现支付工程款资金短缺困难时，乙方以借款的方式给予甲方短期少量借款。甲方的借款以在建工程作为担保，接受乙方财务监督，保证专款专用，不挪为他用。借款利息甲、乙双方议定为月息1.5%，年息为 18%，利息每三个月结算一次。甲方在房屋销售时，对收回的款项应优先用于乙方借款的偿还。十一、安全生产文明施工，杜绝安全责任事故

22、。乙方在施工过程中必须严格遵循安全规范操作，一旦发生的安全事故，由乙方自行负责，并承担其经济赔偿责任和民事责任。十二、甲方负责三通一平，水电到位。乙方在施工中所使用的各种材料等必须达到国标指定标准。乙方不得使用其它低于国标的材料，品牌有甲方选定。否则，由此而造成的经济损失由乙方承担。十三、甲方违约：1、甲方在获得工程用地许可证及工程规划许可证后两个月内组织完成工程的招标、开标等有关手续，属乙方范围内的投标费用由乙方承担，如因甲方原因造成乙方不能中标，则甲方双倍返还乙方已缴纳的合同履约保证金。名师资料总结-精品资料欢迎下载-名师精心整理-第 3 页，共 5 页 -relationship,est

28、d cubes relationship between characteristics of circular cone is slightly solid surfa ce area and volume 1,size 2,table.和2、甲方应在 2013年 12 月 30 日前完成开工准备工作，如未能按期开工则乙方可顺延工期。3、甲方不按合同约定履行义务，应承担违约责任并赔偿乙方由此造成的经济损失。十四、乙方违约：1、乙方在工程施工过程中未能按质量要求施工，而延误工期，除返工损失由乙方自行负责外，给甲方造成经济损失的，则应赔偿甲方的经济损失。2、乙方在工程施工过程中，因乙方原因未能履

29、行合同工期交付甲方使用。乙方延误工期不超过二十天时，乙方应按每天 10000 元支付违约金。如在二十天后整个工程仍不能交甲方，从第二十一天起每天按 20000元进行罚款3、乙方在承包施工期间不得以本工程的名义对外拖欠各种材料款及人工工资等，不得以本工程施工名义骗取他人钱财，如造成经济和民事纠纷则由乙方自负其责，并承担一切法律责任。4、法律规定的不可抗力的因素除外。十五、乙方在施工过程中，如遇到实际施工困难的情况下，应向甲方提出书面要求，由甲方会同设计院、监理公司和有关主管及技术部门共同研究新的方案后，方可执行。如工程量变更及增加的按实际签证结算，工期按相关规定顺延。名师资料总结-精品资料欢迎下
