11、 of,substantially comprise 等等。A.连接词辩析：用 comprising,including,containing来表达“包含”、“包括”或“含有”。用 consisting of 来表达“由.组成”，consisting essentially of 基本上由.组成”或“大体上由.成,。两类连接词的重大意义差别为：consisting of A and B：只包括A 及 B，无其他；comprising A and B：除包括 A 及 B 外，尚可能包括C、D 等。B.第几个的表示法a first MOSFET transistor and a second MO

14、接部份为包括，主体部份为一刀片，其刃口呈锯齿状；及一握把。此种摘要之表达法在美国为最普通常见者，藉前言部份将申请专利之发明标的示出，以主体部份详述其标的之内容，并用连接部份将前言部份与主体部份相连。上述申请专利之手术刀子亦可能藉另一种方式在摘要中表达：一种外科手术刀子，包含一刀片及一握把，其特征为：该刀片之刃口呈锯齿状。A surgery knife comprising a blade and a handle,characterized in that the edge of the blade is of zig-zag shape.在此摘要中，前言部份为一种：一握把，主体部份为该刀片：

15、锯齿状，连接部份为其特征为。此种表达方式在欧洲及日本较常见，优点为较清楚地显现发明之特点所在。在我国，上述二种表达法皆通行。某些申请人会将摘要写成下列之形式：In a surgery knife,which comprises a blade and a handle,the improvement residing in that the blade edge is of zig-zag shape.对于此种着重 改良(improvement)之摘要，翻译时请勿译为 在一种外科手术刀子中，此刀子包括一刀片及一握把，其改良为刃口呈锯齿状。此种译法忠于原文，但缺点为申请保护之标的不明(改良并不是

18、聚乙烯物品，其具有如请求项5 之方法所处理之表面。（5）如申请专利范围写成：A process for preparing compound A.请译成 一种制备化合物A 之方法，不要译成 一种化合物A 之制法。(首先开头必须是一种,然后结尾必须是申请专利发明的主旨)（6）在化学案件之申请专利范围中，对化合物常用化学通式表示。在通式下方之化学取代基定义部份占很大篇幅，以致译文难以一气呵成，此时可适当利用大、中、小括号帮助翻译，将取代基之部份列入括号内。例如：A process for preparing a compound of the following general formula：w

19、herein R is C1-C18 alkyl；and F,Cl,Br or I，comprising reacting RH with HX in the presence of a zeolite catalyst.可译为一种制造下列(following)通式化合物之方法：(其中 X 为 C1-C18 烷基，X 为 F、Cl、Br 或 I)，此方法包括于一沸石触媒存在下使RH 及 HX 反应。摘要常用的连接字词如下：prising,including,containing 上列字皆译为包括、包含或含有。2.consisting of 应译为由 组成consisting essential

20、ly of 应译为基本上由组成或大体上由组成。(请注意上列二类连接字词之重大意义差别：consisting of A and B：只包括A 及 B，无其它。comprising A and B：除包括 A 及 B 外，尚可能包括C、D 等。)3.characterized in that,characterized by(U x8 D$A4 d皆译为其特征为。四、权利要求书(Claims)1.前言部份2.连接部份及3.主体部份。权利要求书之起头应译为如请求项XX 之 或根据请求项XX 之，不必加一种，亦不必加上述。其中.as claim 1，.of claim 1，.as claimed in

22、须与摘要之标的相同。以下列举数种权利要求书之写法与译法以供参考：（1）The knife according to Claim 1,wherein the blade is receivable in the handle.请译为如请求项1 之刀子，其中该刀片可收纳入握把中。或根据请求项1 之刀子，其中该刀片可收纳入握把中。上例中前言部份为如刀子或根据刀子，主体部份为该刀片握把中，连接部份为其中。为了符合智能财产局对申请专利范围格式之要求，在权利要求书前言中出现之according to请务必译为如或依据。（2）一权利要求书可依附一摘要，亦可依附在其前之权利要求书。若同时依附两项以上，必须用或来表示。请见下列实例：-1.一种刀子，包括。2.如请求项1 之刀子，其中。3.如请求项1 或 2 之刀子，其中。4.如请求项1，2 或 3 之刀子，其中。上列之第4 项有时英文写为The knife of any of Claims 1 to 3，此时应译为 如请求项1 至 3中任一项之刀子。权利要求书仅能依附在其前之项。若英文中之权利要求书依附其自身或在其后之项，则属错误，请告知本所。例如：3.如请求项3 之刀子，其中(错),3.如请求项4 之刀子，其中(错)3.如请求项2 之刀子，其中(对)名师资料总结-精品资料欢迎下载-名师精心整理-第 5 页，共 5 页 -
