1、 太原理工大学硕士研宄生学位论文 马克思土地产权理论 在我国农地产权制度改革中的应用研究 摘要 马克思说， 土地是一切生产和一切存在的源泉 ，而农地产权制度是 土地合理开发和有效利用的重要制度保证。我国农地产权制度改革一直以 马克思土地产权理论为指导，随着生产力的快速发展，现行农村土地产权 制度日益显露出一些缺憾，己经成为阻碍农村经济变革的壁垒。因此，在 新的时代环境下，如何创新应用马克思土地产权理论，来指引新一轮的农 地变革，己经是时代赋予马克思土地产权制度理论的新的历史使命。 马克思土地产权制度理论是一个系统的科学体系，马克思虽然没有明 确提出 土地产权 这一范畴，却在资本论、剩余价值论等

2、经典著 作中，对土地产权的内涵与外延做了许多精辟而精彩的论述。在本论文的 写作中，笔者始终牢牢以马克思主义土地产权理论为切入视角，应用辩证 唯物史观，引用大量历史数据，从政治、经济、民生等多角度综合审视、 细致剖析、总结经验、探讨问题，试图探索出一条适合国情的中国特色农 地制度改革路线。 本论文由六个篇章组成，第一章为绪论。概 述了本课题研宄的现实与 理论背景，阐述了研宄目的及意义所在，综述了国内外对此课题的研宄动 态，初步归纳出本次研宄所使用的研宄方法及创新之处。第二章，具体阐 述马克思土地产权理论。首先明确土地产权的理论内涵和相关权能结构， 太原理工大学硕士研宄生学位论文 其次论述了土地产

3、权商品化理论和相关的地租理论。第三章，引入大量数 据，对我国土地革命时期、合作化运动时期以及家庭承包经营责任制阶段 的农村土地制度变革进行了整体梳理，应用马克思的土地产权理论细致分 析不同历史阶段土地权能的分离变化，总结改革实践的得与失。第四章， 探讨我国现行农地产权制度所存在的困境。涉及所有权主体虚置、农民土 地权能弱化、土地细碎化限制规模化经营、城乡二元结构制约农民发展、 农地经营融资困难，土地流转缺乏法律规范等范畴，深入揭示了产生这些 问题的原因，为后续解决措施的探讨提供了理论和实践依据。第五章，我 国农地产权制度改革的路径选择及措施。首先阐明我们要 坚定不移地在现 有制度基础上进行渐进

4、式改革；其次针对出现的问题，提出八大改革建议 , 即在改革中要以坚持保障农民权益、明晰产权权能主体为原则，创新 三 权分置 举措，推进征地制度改革，发展农业信息服务，注重农业人才培 养，完善农民培训路径，同时尝试金融改革，开展土地信托模式，探索农 地使用权证券化。第六章为结语，阐述中国是一个传统的农业大国，农地 制度的变革一定要稳健慎重，以确保农民的安居乐业、农村的和谐稳定。 另一方面，也要乘时乘势、鉴往知来、推陈出新，牢牢以马克思土地产权 理论为指导，结合中国实践，开创具 有中国特色的农地产权制度。 关键 词：土地产权，土地权能，土地所有权，土地承包权，土地经营权 太原理工大学硕士研究生学位

Chinas farmland property institution reform has been under the guide of Marxist theory of land property rights ， but with the rapid development of productivity, current farmland property institution is increasingly revealing some shortcomings ， which has become

7、 barriers to the reform of rural economy. Therefore, in the new era, how to innovate the application of Marxist theory of land property rights, to guide a new round of property rights reform, that is the new historical mission of Marxist theory of land property rights. Marxist theory of land propert

8、y rights is a systematic scientific theory, and it is also the theoretical basis for guiding the reform of agricultural land property rights system in China. For the several farmland reform led by the CPC, the author through the analysis of the historical documents, the application of dialectical materialism, reference to a large number of historical data, from

10、 the political, economic and peoples livelihood multi-angle comprehensive review, a detailed analysis， sum up experience， to explore issues. At the same time， the author has always been firmly to cut into the Angle of marxism property rights theory , trying to find a road suited to Chinas national c

11、onditions. Specifically, this paper consists of six chapters, the first chapter is the introduction.First overview of the subject of the reality and the theory background. It explains the research purpose and significance; secondly both at home and abroad is summarized this research direction of the

12、 new research trends. Finally, it illustrates research methods used in this study and innovations points of this paper.In the second chapter, Marxs theory of land property rights. First of all, it is clear that the theory of land property rights and related power structure, Secondly, it discusses th

13、e theory of land property right commercialization and related land rent theory.The third chapter, through a large number of data, using Marxs theory of land property rights theory and detailed interpretation of the history of the development and changes of Chinas rural land system. This chapter describes the six p

16、erformance of the current dilemma, mainly: ownership dummy, the weakening of main body of property right, land broken restricted to operate on a large scale, the management of farmland financing difficulties, land transfer lack of legal norms . At the same time, it reveals the reasons for these prob

17、lems, and provides a theoretical and practical basis for the follow-up of the measures to solve the problem. The fifth chapter, the path choice and measures of the reform of rural land property rights system. Clarified first we must unswervingly in on the basis of the existing system of progressive

18、reform, secondly to solve the problems, put forward nine proposals for reform, namely in the reform to to adhere to the security rights and interests of farmers, respect the farmers pioneering spirit, clear property rights main body principle, innovation, the three powers separation initiatives, pro

19、mote the reform of land expropriation system and development of agricultural information service, pay attention to agricultural personnel training, improve the training path of farmers, and try to reform the financial, carry out land trust model ， exploration of farmland use right securitization. 26、出适合长远发展的高层次定位。 1.1 研究目的和意义 新中国成立以来，在农地产权制度方面进行了积极的探索，历经地主所有租赁经营 农户所有农户经营一集体所有统一经营一集体所有家庭承包经营的转变，并且取得了 不同的制度绩效。 回首这段岁月， 从 1931 年， 确定土地革命路线，农民实现 耕者有 其田 ，即土地的农户所有农户经营，中国农民历经千年努力终于成为了土地的主人， 没有地租、没有剥削，农民真正拥有了土地的终极所有权，可以自由支配土地，并从土 地获益。之后在社会主义建设的探索中，我们尝试进行合作化运动，前期稳健顺利，后 期急于求成，实行集体所有统一经营，挫伤农民积极性，给经济造成了一定损伤。

27、党的 第二代领导集体值此当务之急，改革土地制度为土地承包责任制，即农地的集体所有家 庭承包经营，这项肇史于小岗村的改革，适应了经济发展的一般规律，农村经济发展迎 来了一个新的春天。但进入八十年中期以来，农民收入增长开始放缓，大批农民举家进 城务工，农村 抛荒 现象严重，为此，从 20 世纪 80 年代中后期开始，中央开始在全 国部分地区开展农村改革试验区活动，到 2015 年我国共有 58 个县市成为改革试验区， 农地制度改革的顶层设计思路正在形成。基于这样的现实背景，本文尝试从马克思主义 土地产权理论研宄着手，探讨其所涉及的原理和矛盾规律，并以此来深入审视困扰中国 1)马 克 思 恩 格 斯

28、 全 集 （ 第 2 卷 M,北 京 ： 人 民 出 版 社 ， 2003, 109. 太原理工大学硕士研宄生学位论文 2 农地快速发展的现实问题，为中国农地的健康发展献计出力。 从理论角度看， 土地产权 这个概念范畴，马克思虽未形成体系具体阐述，但在 其诸多经典著作中都有涉及，土地产权的思想犹如星星洒落在马克思的整个理论体系之 中，需要我们去总结和探讨。也正因为如此，这些论述一直以来未受到理论界应有的重 视。在市场化高度发达的今天，在高层密切关注农地制度变革的大背景下，时代要求我 们必须系统地梳理马克思土地产权制度观点， 为中国农地制度的改革提供理论上的指 导。 从现实意义来看， 天下之大，

29、黎元为先 ，土地问题是关系到国计民生的重大课题。 对于土地问题的研宄， 尤其是土地制度研宄是近 20 年来经济学、 社会学研宄的重点和 热点课题之一。随着商品经济的高速发展，中国既定的土地制度逐渐显现出一些与现实 生产力不相适应的矛盾冲突，并产生了相关的消极后果。这时候就迫切需要理论层面高 屋建瓴的保驾护航，马克思土地产权制度理论可以为农地制度的改革提供科学的理论指 导，对整个中国国民经济的可持续增长具有不可忽视的现实意义。 1.2 国内外研究动态 1.2. 1 国内学者的研究概况 对农地土地产权制度的探讨，是个老生常谈的课题。早在建国前，就有一批有远见 卓识的知识分子，通过学习西方的土地产权

30、模式，回国后就开始孜孜不倦致力于中国农 地制度的建设问题研宄。那个时期，他们对土地产权的切入角度往往从经济学、制度学、 法学等多个门类来进行阐述，为之后的中国农地改革提供了理论上的借鉴。新中国成立 后，结合公有制的社会基础，继续在这些学科门类中试图重构以公有制为基础的农地改 革的模式。十一届三中全会之后，退出人民公社，赋予农民土地承包经营权能，在商品 经济的浪潮中，各个专家们也开始以市场经济的眼光，来重新打量中国的农地制度问题， 发现了一些新问题，提出了一些新建议，具体陈述如下。 (1) 土地权能的研宄。 在土地权能实现方面，钟怀宇 (2007)指出，当前我国农地产权主体模糊，农地的所 太原理

31、工大学硕士研宄生学位论文 3 有权人呈现多元现象， 这容易对农民的土地利益造成损伤 张燕梅 (2012) 认 为， 由于 土地所有权归集体所有，但集体的概念法律却一直规定不清；农民的承包经营权如今也 出现需要就经营权、 承包权进行具体法律界定的问题 气蔡镇疆 (2006) 指出， 由于土地 归集体所有，容易出现地方政府与民夺利的状况 * * 3。杨显贵 (2005)等认为，受历史原因 影响，中国目前土地呈现 细碎化 状态，直接限制了土地的优化配置 4 *。 IVIAELYSDE LARUPELLE(2008) 等认为， 私有制下， 农民可以实现与农地的密切结合， 而中国的农地 制度却使得两者相

32、分离，这对于中国农民会造成一定的心理焦虑，会影响他们从事农业 劳动的积极性 在 土 地的 所 有 权 、 承 包 权 、 经 营 权 的三 权 权能 关 系方 面 ， 刘 守 英（ 2015) 指 出 ， 面 向市 场 ， 使承包 经 营权分离已 经 是大势所 趋 6 。 黄 小 虎 （ 2014) 指出 ， 农业企业 要 使 土 地 被 挤压的 效 能充 分 发挥， 就 涉及 到 了土地 承 包经 营 权的抵 押 问题 ， 现在法 律 进入 了 一 个误 区 ， 即农民 自 己不能抵押 土 地 ， 流转 后 该权能却 得 以实现 7 。 姜 红 丽 （ 2016) 指 出 要 对 土地 经

33、营权 进 行解 锁 ，但 前 提是 在 法律 上 对三 权 做出 明 确规 定 8 9。 通过以上论述 ,可以发现土地权能实现方面，主要集中于两个方面的大问题，一是产 权主体不清，所有权呈现虚置现象；另一方面是农民实际享有的土地权能受多方面影响， 呈现弱化状态。而对所有权、承包权、经营权三权分立的趋势及所涉及的法律问题，尚 有很多争议。 (2)制度改革方向的研宄。 王裕雄等 (2013)指出，一定要坚持现有的制度，一可以防止土地兼并的出现，二来 中国实行的城乡二元结构，城市居民天然没有土地，农民从拥有村集体成员身份的一刻 起，就天然拥有了土地，这种现状的形成有其深厚的历史原因，冒然仿制西方私有
