Comprehensiveworkinghoursystem.Flexibleworkinghoursystem.Inaccordancewithgovernmentrequirements,partyAandpartyBshouldstrictlycomplywithrulesofwokingtimes.ForoptionA,thenormalworkinghoursoftheEmployeeshallbeeighthourseachday,excludingme

7、alsandrestforanaverageoffivedaysperweek,foranaverageoffortyhoursperweek.TheEmployermayextendworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunionandtheEmployee,buttheextendedworkinghourforadayshallgenerallynotexceedonehour;Ifsuchextensioniscalledforduetospecialr

8、easons,theextendedhoursshallnotexceedthreehoursaday.However,thetotalextensioninamonthshallnotexceedthirty-sixhours.ForoptionBorC,onthebasisofensurepartyBhaveagoodhealthandwouldlistentopartyBsidea,partyAcantakemeasuresofconcentratedwork,concentratedrest,additionaltimeoff,flexibleworkinghourtoensurepa

9、rtyBcanenjoytherightofrests,vocationsandcancompleteproductionsandworkingtasks.PartyBshallbeentitledtolegalannualvacations.Article41. LaborRemunerationThesalaryoftheEmployeeisRMB_permonthintheprobationaryperiod.Thissalaryshouldnotlowerthanthelowestsalarystandardonthesamepositioninourcompanyor80%ofits

10、officialwage,anditsalsoshouldntlowerthanlocalminimumwagestandard.2. Aftertheprobationaryperiod，thesalaryoftheEmployeeshallbeRMB_,andthewageswillbemadeby()a.Hourlywagesb.piecewagesAccordingtothewagedistributionsystemofpartyA,bythetwosidesconsensus,Duringthetermofthecontract,thesalaryadjustedbypartyAf

PartyAshouldpaythelegaltendertopartyBasmonthlysalary,thepartyAshouldpaythewagesbeforeeachmonth,andofferthepayrolltopartyB.Incaseoftheholidayorweekend,partyAshouldpay

12、attherecentworkingdaypaymentaheadoftime.PartyAshouldpaypartyBovertimewagesinaccordancewithrelevantregulationifpartyArequestpartyBtoworkovertimeonworkingday,workonoff-daysorlegalholidays.AndthisshallbecarriedoutbyrelevantlawsandregulationsandtherelevantregulationspreparedbyPartyAinaccordancewithlaw.A

Insurance,WelfareandBenefitsPartyAshallpayrelevantsocialinsurancetodesignatedauthoritiesonPartyBSbehalfinatimelymannerinaccordancewithgovernmentrequirements.Andthepersonalpartwillbedeductedfromthesalary.2. PartyBsvocationofpregnancy,childbirth,breast-feedingandthecorrespondingtreatmentshou

14、ldaccordingtotherelevantregulations,suchasmaternityinsurance,femaleemployeeslaborprotection,etc.ThetreatmentforPartyBsoccupationaldiseaseorjobrelatedinjuries(death),sicknessornon-jobrelatedinjuries,andtheproviedofmedicaidexpensespaidshouldbecarryoutbyndustrialinjuryinsurance,medicalinsuranceandrelat

15、edprovisions.Article6a. WorkingProtection&WorkingConditionsPartyAandPartyBshallstrictlycomplywiththenationalregulationswhichconcerningproductionsafetyandabidebyregulationsoflabourprotectionandoccupationalhazardsandprotectionofworkers.b. PartyAshallprovidePartyBprotectionfacilities,equipmentandlaborp

16、rotectionarticlesandotherlaborprotectionconditionsinaccordancewiththenationallabor.c. PartyBshallstrictlycomplywiththesafeoperationandtherelevantrulesandregulationspreparedbyPartyAinaccordancewithlaw.IfPartyAillegalcommandorforceriskoperation,partyBhavetherighttorefuseit.d. PartyAmuststrictlyimpleme

17、ntrelevantOccupationalDiseasePreventionLaws,forthepositionsexposetooccupationaldiseasehazards,suchasexposuretodust,radioactivesubstancesandothertoxicandhazardoussubstances,PartyAshouldtellthetruthanditsconsequencesonoccupationalhazards,protectivemeasuresandtreatmentofoccupationaldiseasestopartyB,and

18、takepreventivemeasuresandprotectionfacilitieswhichmeettherequirementsofthenationaloccupationalhealth.IfPartyBisengagedintheoperationthatmayexposetooccupationaldiseasehazards,PartyAshallorganizeoccupationalhealthexaminationbeforegoondutyandleavethepostinaccordancewithrelevantnationalprovisions,andsha

19、llconductregularoccupationalhealthexaminationonPartyBduringthecontractterm.Article7Amendment,TerminationandEndingofEmploymentContracts1.Theemploymentcontractcouldbeamendedinafriendlynegotiationwiththeamendmentprocedureoperatingintime.2.OtherthanthecircumstancesstipulatedinArticle38in“EmploymentContr

20、actLaw”,PartyBmayterminatehisemploymentcontractupon30dayspriorwrittennoticetoPartyA.Duringhisprobationperiod,hemayterminatehisemploymentcontractbygivingPartyAthreedayspriornotice.3.PartyAmayterminateemploymentcontractinvolvinginthecircumstancesspecifiedinArticle39,40&41in“EmploymentContractLaw”.Shou

21、ldPartyBfallsinthecircumstancespecifiedinArticle42in“EmploymentContractLaw”,PartyAmustnotterminateemploymentcontractaccordingtoitemsregulatedinArticle40&41in“EmploymentContractLaw”.4.Theemploymentcontractmayterminateifitconformstothecircumstanceasspecifiedin“EmploymentContractLaw”andothernational,pr

22、ovincialandmunicipalemploymentcontractrelatedprovisions.5.Terminationofemploymentcontracttoemployeeswhosufferemploymentinjuryoroccupationaldiseaseshallbeoperatedagainstnationalemploymentinjuryprovisions.6.PartyAshallpaytheemployeeseverancepayinvolvinginthecircumstancesspecifiedinArticle46in“Employme

23、ntContractLaw”.7.Atthetimeofterminationorendingofanemploymentcontract,PartyAshallissueaproofofterminationorendingoftheemploymentcontractand,within15days,carryouttheproceduresforthetransferofPartyBsfileandsocialinsuranceaccount.PartyBshallcarryouttheproceduresforthehandoverofhisworkasagreedbytheparti

24、es.Article8Covenants1.AccordingtoprovisionsofArticle22,23&24in“EmploymentContractLaw”,covenantsareagreedbelow:a.b.2)Othercovenants:Article9PartyAshallestablishinternalrulesandregulationsagainstlegalprocedureswithPartyBinformedandnoted.PartyBshallstrictlyabidebyrulesandregulationssetbyPartyA.Article1

25、0Whereanemploymentdisputebetweenthepartiestakesplaceduringtheperformanceofthiscontract,thepartiesconcernedmayseekforasettlementthroughconsultationormayapplytotheemploymentdisputemediationcommitteeofPartyAsunitformediation.Ifthemediationfailsandoneofthepartiesrequestsforarbitration,thatpartymayalsodi

26、rectlyapplytotheemploymentarbitrationcommitteelocatedinPartyAsforarbitrationin60daysupontheemploymentdisputeoccurrence.Article11Formattersnotcoveredbythiscontract,orintheeventthattheprovisionsofthiscontractcontraveneapplicablelaws,regulationsandpolicies,applicablelaws,regulationsandpoliciesshallcont
