Notwithstanding local requir

Inhumane treatment of employeesThe supplier must create and maintain an environment that treats all employe

3、es with dignity and respect and must not use any threats of violence, sexual exploitation or abuse, verbal or psychological harassment or abuse. Living wage Wages and benefits paid for a standard working week must satisfy, at a minimum, national legal standards or local industry benchmarks, whicheve

4、r is higher. In nation states where no minimum wage legislation exists, the supplier must seek to establish a living wage that ensures an adequate standard of living for all its employees and their dependants. Workplace health and safetyThe supplier must ensure: the provision of safe and healthy wor

5、king facilities and appropriate precautionary measures to protect employees from work-related hazards and anticipated dangers in the workplace. workers receive regular and recorded health and safety training. accommodation, where provided, is clean, safe, and meet the basic needs of the workers. The

6、 supplier must: follow all relevant legislation, regulations and directives in the countries in which the contract activities are undertaken to ensure a safe and healthy workplace; ensure, at a minimum, systems implemented for the prevention of occupational injury and illness including, at a minimum

7、, standards for fire safety; emergency preparedness and response; industrial hygiene; lighting and ventilation; machinery safeguarding; reporting and investigation of occupational injuries and illness; reasonable access to potable water; assign responsibility for health and safety to a management re

8、presentative comply with Group HSEC Group Level Documents relevant to work completed as part of the supply contract with BHP Billiton. Compliance with laws The supplier must comply with the letter and, where it is clear, the intent of all laws and regulations relating to their business conduct. This

9、 includes understanding laws and regulations relevant to their work and complying with legal requirements of the country they are working. 10、hostilities between PotashCorp and its suitor BHP Billiton escalated yesterday when the Canadian fertiliser producer accused the multinational miner of “highly unethical” behaviour.Potash said that BHP had made unsolicited contact with its customers as part of BHPs $39bn hostile bid for the Canadian

11、 company.Stephen Dowdle, PotashCorps sales chief, said in a letter to customers that the company had learnt that BHP had “begun to cold call many of you”.“We can only assume that BHP Billitons purpose is to sow seeds of doubt and confusion about the future of PotashCorp,” he said.The calls, accordin

12、g to the letter, came from Chris Ryder, director of potash marketing for BHP.Mr Dowdle added: “Since the purpose of BHP Billitons call clearly was not to solicit your potash order from BHP Billitons Jansen project . we consider this contact to be inappropriate and highly unethical.”BHPs Jansen proje

13、ct is a large greenfield potash development in Saskatchewan, the Canadian province where PotashCorp is based.BHP declined to comment on the latest spat, which follows the groups $130 a share cash offer to take over PotashCorp, launched a week and a half ago. PotashCorp has rejected the offer as “gro

14、ssly inadequate”.People familiar with BHP said that it was not uncommon on a deal of this type to make contact with a range of interested parties.The calls, they added, were merely a courtesy, offering to answer any questions that customers of the company might have.Both companies have been on a cha

18、the 2008 Beijing Olympics.A Fairfax Media investigation can reveal the allegations are the subject of a probe by the US Department of Justice and the Australian Federal Police. In response to a freedom of information request, the Justice Departments criminal division said it was conducting law enfor

19、cement proceedings involving BHP Billiton.The federal police said they had received a formal referral about the mining giant from US investigators and were working closely with them.The probe is linked to the miners activities in several countries before 2009, including China and at least two other

20、Asian countries, believed to be Cambodia and the Philippines. Also being examined is a deal in Western Australia involving the miner.The federal police have reviewed US files and have discovered - according to a briefing given by federal agents to an international bribery taskforce last year - suspi

21、cious transactions that had been recorded as legitimate business payments by BHP Billiton.Laws that may have been broken by the mining company, its staff or consultants are the US Foreign Corrupt Practices Act and Australian state or federal corporate and criminal laws, including foreign bribery leg

22、islation that prohibits any benefit being given to a public official in order to obtain a business advantage. Breaches of US or Australian bribery laws can result in jail sentences of up to 10 years or large fines.Until now, public knowledge of BHP Billitons possible exposure to foreign bribery inqu

23、iries had been limited to its formal statement to the market in 2010 that it had given the US Securities and Exchange Commission information from an internal probe regarding possible violations of applicable anti-corruption laws involving interactions with government officials.The company declined t

24、o respond to questions from Fairfax Media sent on Tuesday morning about alleged impropriety linked to the Beijing Games and activities in Western Australia, other than to say it believed our Olympics activities complied with all applicable law.Investigators are scrutinising activities of BHP Billito

25、n in the lead-up to and during the Beijing Olympics. Between 2000 and 2008, the company spent millions on a major Olympics sponsorship deal and a hospitality package which, according to the resume of one Chinese BHP Billiton employee, involved more than 170 VIPs including senior government officials

26、 and CEOs of Chinese minerals/ steel industry.A US-based consultant, Jet Set Sports, used by the miner in Beijing, was in 2002 implicated in a bribery scandal around the Salt Lake City Winter Olympics, in which officials were offered inducements.BHP Billiton also supplied materials to Beijing to mak

27、e the gold, silver and bronze medals.Part of the US inquiry is understood to relate to how transparently the expenditure on hospitality and largesse was recorded internally by the company.A former senior executive close to the companys Olympics bid program defended its integrity, saying it was run u

28、pside down and backwards through BHP lawyers theres a good reason no one from BHP is in jail.The former executive said that all expenditure had been approved at the companys Melbourne headquarters and that the total cost of the Olympic project was less than $100 million. In a confidential briefing l

29、ast year with officials from the Organisation for Economic Co-operation and Developments anti-bribery taskforce, federal police revealed that their investigators had identified questionable dealings that BHP Billiton had disguised as legitimate business transactions.It is understood that a likely ou

30、tcome of the US probe may be a negotiated settlement, in which the company pays large fines and shows that it has rectified internal shortcomings that may have risked laws being breached.BHP Billiton has voluntarily disclosed thousands of documents and the results of its internal inquiries to US inv

31、estigators. It is unclear whether the Australian Federal Police will consider its own prosecution in Australia.An AFP statement said it was engaged in this matter and is working very closely co-ordinating activities with our foreign counterparts and local regulatory agencies.Notwithstanding that the

32、 AFP does not comment on current operational activities, the AFP has received a referral that relates to the Australian aspects of the US investigation into BHP Billiton, it said.The AFP said in a statement to Fairfax Media that the BHP Billiton allegations had been scrutinised by its recently established foreign bribery panel of experts to ensure they were investigated properly. In reports published several years ago and rejected by BHP Billiton, NGOs questioned payments made by the company in connection to now closed projects in the Philippines and Cambodia.
