2、blicofChina(hereinafterreferredtoastheTrademarkLaw).Article2TheprovisionsmadeintheseImplementingRegulationsconcerninggoodsmarksshallapplytoservicemarks.Article3TheuseoftrademarksreferredtointheTrademarkLawandtheseRegulationsinclude,amongotherthings,theuseoftrademarksongoods,Packagesorcontainersthere

3、ofandcommoditytradinginstruments,oruseoftrademarksinadvertisements,exhibitionsandothercommercialactivities.Article4GoodsrequiredtobearregisteredtrademarksasprescribedbytheStatementionedinArticle6oftheTrademarkLawrefertogoodsinrespectofwhichregisteredtrademarksmustbeusedasprescribedbylawandadministra

4、tiveregulations.Article5UndertheTrademarkLawandtheseRegulations,whenaninterestedpartybelieveshistrademarkconstitutesawell-knowntrademarkwhenadisputearisesinthecourseoftrademarkregistrationortrademarkreviewandadjudication,hemayfilearequestwiththeTrademarkOfficeortheTrademarkReviewandAdjudicationBoard

5、toestablishitasawell-knowntrademark,torejectthetrademarkregistrationapplicationcontrarytotheprovisionofArticlel3oftheTrademarkLaw,ortocancelthetrademarkregistrationcontrarytotheprovisionofArticle13oftheTrademarkLaw.Whenfilinganapplication,aninterestedpartyshallsubmitproofsthathistrademarkconstitutes

6、awell-knowntrademark.Attherequestoftheinterestedparty,theTrademarkOfficeortheTrademarkReviewandAdjudicationBoardshall,onthebasisofascertainedfacts,establishwhetherhistrademarkconstitutesawell-knowntrademarkpursuanttotheprovisionofArticle14oftheTrademarkLaw.Article6Applicationsmaybefiledforregistrati

7、onofgeographicindicationsprovidedforinArticlel6oftheTrademarkLawascertificationmarksorcollectivemarksinaccordancewiththeprovisionsoftheTrademarkLawandtheseRegulations.Whereageographicindicationisregisteredasacertificationmark,thenaturalperson,legalpersonorotherorganizationwhosegoodshasmettherequirem

8、entimposedonthegeographicindicationsmayrequestforusingthecertificationmark,andtheorganizationhavingcontrolonthecertificationmarkshallgiveitspermission.Whereageographicindicationisregisteredasacollectivemark,thenaturalperson,legalpersonorotherorganizationwhosegoodshasmettherequirementimposedonthegeog

9、raphicindicationsmayrequestformembershipofthebody,associationorotherorganizationhavingthegeographicindicationasitscollectivemark.Thebody,associationorotherorganizationshallaccepthimoritasitsmemberaccordingtothearticlesofconstitutionthereof.Anypersonwhodoesnotasktojointhebody,associationorotherorgani

10、zationhavingthegeographicindicationasitscollectivemarkmayalsodulyusethegeographicindication,andthebody,associationorotherorganizationdoesnothavetherighttoprohibittheuse.Article7Aninterestedpartyentrustingatrademarkagencywiththefilingofanapplicationfortrademarkregistrationorattendingtoothertrademarkm

11、attersshallsubmitaPowerofAttorney.ThePowerofAttorneyshallindicatesuchcontentsandcompetenceasauthorized:thePowerofAttorneyfromaforeignpersonorforeignenterpriseshall,inaddition,indicatethenationalityoftheentruster.NotarizationandlegalizationofthePowerofAttorneyandotherrelevantcertificatesfromaforeignp

12、ersonorforeignenterpriseshallbedonebasedontheprincipleofreciprocity.TheforeignpersonorforeignenterprisementionedinArticlel8oftheTrademarkLawreferstotheforeignpersonwhoorforeignenterprisewhichdoesnothaveitshabitualresidenceorplaceofbusinessinChina.Article8TheChineselanguageshallbeusedinapplyingfortra

13、demarkregistrationorattendingtoothertrademarkmatters.Wherethevariouscertificates,certifyingdocumentsandproofssubmittedundertheTrademarkLawandtheseRegulationsareinaforeignlanguage,theChinesetranslationthereofshallbeattached;wheretheChinesetranslationisnotattached,thecertificates,certifyingdocumentsan

14、dproofsshallbedeemednottohavebeensubmitted.Article9Inanyoneofthefollowingcircumstances,anystaffmemberoftheTrademarkOfficeandtheTrademarkReviewandAdjudicationBoardshallwithdraw,orapartyorinterestedPartmayrequesthimtowithdraw:(l)heisapartyoracloserelativetoapartyoragent;(2)heisrelatedinsuchawaywithapa

15、rtyoragentinsofarastherelationwouldaffectimpartiality;or(3)hehasinterestsinanapplicationfortrademarkregistrationoranothertrademarkmatters.Articlel0UnlessotherwiseprovidedforintheseRegulations,whereanydocumentissenttotheTrademarkOfficeortheTrademarkReviewandAdjudicationBoard,thedateofreceiptshallbeth

16、edateofdeliverywhereitisdeliveredpersonally.orthedateofpostingindicatedbythepostmarkifitissentbypost;wherethedateofpostingindicatedbythepostmarkisillegible,orthereisnopostmark,thedateofreceiptshallbethedateonwhichtheTrademarkOfficeortheTrademarkReviewandAdjudicationBoardactuallyreceivesthedocument,e

17、xceptthattheinterestedPartisabletopresentevidenceastotheactualdateofpostingindicatedbythepostmark.Article11AnydocumentoftheTrademarkOfficeortheTrademarkReviewandAdjudicationBoardmaybeservedbypost,bypersonaldeliveryorbyothermeans.Whereaninterestedpartyentrustsatrademarkagency,deliveryofthedocumenttot

18、hetrademarkagencyshallbedeemeddeliverythereoftotheinterestedparty.WhereanydocumentissenttoaninterestedpartybytheTrademarkOfficeortheTrademarkReviewandAdjudicationBoard.thedateofreceiptshallbethedateofreceiptindicatedbythepostmarkonwhichtheinterestedpartyreceivesitifitissentbypost;wherethedateofPosti

19、ngindicatedbythepostmarkisillegible,orwherethereisnopostmark.Thedocumentshallbedeemedtohavebeendeliveredtotheinterestedpartyonthefifteenthdayfromthedateofpostingthedocument;thedateofreceiptshallbethedateofdeliveryifitisdeliveredpersonally.Whereanydocumentcannotbesentbypostorbypersonaldelivery,thedoc

20、umentmaybeservedbymakinganannouncement.Attheexpirationofthethirtiethdayfromthedateoftheannouncement,thedocumentshallbedeemedtohavebeenserved.Article12Whereanapplicationisfiledforinternationalregistration,itshallbedoneinaccordancewiththerelevantinternationaltreatiestowhichChinahasacceded.Thespecificm

21、easuresshallbeprescribedbytheadministrativedepartmentforindustryandcommerceundertheStateCouncil.ChapterIIApplicationforTrademarkRegistrationArticle13inapplicationfortheregistrationofatrademark,aseparateapplicationshallbefiledinrespectofeachclassofgoodsorserviceaccordingtothepublishedClassificationof

22、GoodsandServices.Foreachapplicationforthetrademarkregistration,anApplicationforTrademarkRegistrationshallbefiledwiththeTrademarkOffice,accompaniedbyfivecopiesofthereproductionofthetrademark;ifcolorisclaimed,fivecopiesofthecolorreproductionofthetrademarkshallbeattached,soshallbeablackandwhitedesignof

23、thetrademark.Thereproductionofthetrademarkmustbeclearandeasytopasteandshallbeprintedonsmoothandcleandurablepaperorsubstitutedbyaphotograph.Itslengthorbreadthshallnotbemorethanl0cmandlessthan5cmeach.Whereanapplicationisfiledfortheregistrationofathree-dimensionalsignasatrademark,astatementshallbemadei

24、ntheapplication,andthereproductioncapableofdefiningthethree-dimensionalformationbesubmitted.Whereanapplicationisfiledfortheregistrationofacombinationofcolorsasatrademark,astatementshallbemadeintheapplication,andanexplanationthereofbesubmittedinwriting.Whereanapplicationisfiledfortheregistrationoface

25、rtificationmarkorcollectivemark,astatementshallbemadeintheapplication,andthecertificatesofthequalificationoftheapplicantandregulationsfortheadministrationoftheusethereofbesubmitted.Whereatrademarkisinaforeignlanguageorcontainslexicalelementsinaforeignlanguage,explanationofitsmeaningshallbemade.Artic

26、le14whenfilinganapplicationfortheregistrationofatrademark,theapplicantshallsubmitacopyofeffectivecertificatecapableofprovinghisidentification.Thenameoftheapplicantfortrademarkregistrationshallbeconsistentwiththecertificatesubmitted.Article15Thegoodsorservicesshallbelistedintheapplicationaccordingtot

27、heClassificationofGoodsandServices.IfthegoodsorservicesarenotlistedintheClassificationofGoodsandServices,adescriptionofthe5aidgoodsorservicesshallbeattached.Thedocumentsrelatingtoanapplicationfortrademarkregistrationshallbetypewrittenorprinted.Article16Ifanapplicationisjointlyfiledforregistrationoft

28、hesametrademark,arepresentativeshallbedesignatedintheapplication;ifsuchrepresentativeisnotdesignated,thefirstpersonlistedintheapplicationshallbetherepresentative.Article17Ifanapplicantchangeshisname,address,agent,ordeletesorreducesdesignatedgoods,hemaygothroughtheformalitiesforthechangewiththeTradem

29、arkOffice.AnapplicantwhoassignshisapplicationfortrademarkregistrationshallgothroughtheformalitiesfortheassignmentwiththeTrademarkOffice.Article18thefilingdateofanapplicationfortrademarkregistrationshallbethedateonwhichtheTrademarkOfficereceivestheapplicationdocuments.Wheretheformalrequirementsofthea

30、pplicationarefulfilledandtheapplicationformfilledoutaccordingtotherelevantrules,theTrademarkOfficewillaccepttheapplicationandnotifytheapplicantinwriting.Wheretheformalrequirementsarenotfulfilledortheapplicationformnotfilledoutaccordingtotherelevantrules,theTrademarkOfficewillnotacceptit,anditshallno

31、tifytheapplicantinwritingandexplainthereason.Wheretheformalrequirementsarebasicallyfulfilledortheapplicationformfilledoutbasica1lyaccordingtotherelevantrules,butamendmentsarerequired,theTrademarkOfficeshallnotifytheapplicanttomaketheamendmentsandrequirehimtodosoaccordingtothecontentsprescribedandre-

32、submitittotheTrademarkOfficewithinthirtydaysfromthedateonwhichhereceivesthenotification.Wheretheapplicationisamendedandre-submittedtotheTrademarkOfficewithinthetimelimit,thedateoffilingshallberetained.Wheretheapplicationisnotamendedwithinthetimelimit,theapplicationshallbedeemedtohavebeenabandoned,an

33、dtheTrademarkOfficeshallnotifytheapplicantinwriting.Article19Wheretwoormoreapplicantsrespectivelyapplyfortheregistrationofidenticalorsimilartrademarksusedontheidentica1orsimilargoodsonthesameday,eachapplicantsha1l,withinthirtydaysfromthedateofreceiptofthenotificationoftheTrademarkOffice,submitaproof

34、ofhisprioruseofthemarkinrespectofwhichhehasappliedfortheregistration.Wheretheapplicantsusedthemarkforthefirsttimeonthesamedayorwherenoneofthemhasusedthemark,theyshalltrytoresolvethematterthroughconsultation,andsubmitawrittenagreementtotheTrademarkOfficewithinthirtydaysfromthedateofreceiptofthenotifi

35、cationfromtheTrademarkOffice;wheretheapplicantsarereluctanttoresolvethematterthroughconsultationoranagreementisnotreached,theTrademarkOfficeshallnotifytheapplicantsthatoneapplicantwillbesingledoutbylot,andrejecttheregistrationapplicationsfiledbytheotherapplicants.WheretheTrademarkOfficenotifiesanapp

36、licant,buttheapplicantdoesnotshowupanddrawhislot,hisapplicationshallbedeemedtohavebeenabandoned,andtheTrademarkOfficeshallnotifyinwritingtheapplicantwhohasfailedtoshowup.Article20whereanapplicantclaimstherightofpriorityaccordingtoArticle24oftheTrademarkLaw,thecopyoftheapplicationdocumentwhichhefirst

37、filedfortheregistrationofthetrademarkshallbecertifiedbythecompetenttrademarkauthorityacceptingtheapplication,withthedateoffilingandtheapplicationnumberindicated.WhereanapplicantclaimstherightofpriorityaccordingtoArticle25oftheTrademarkLaw,thecertificationdocumentssubmittedbyhimshallbecertifiedbythea

38、dministrativedepartmentforindustryandcommerceundertheStateCouncil,exceptthattheinternationalexhibitiononwhichthegoodsareputondisplayisheldinsidetheterritoryofChina.ChapterIIIExaminationofApplicationforTrademarkRegistrationArticle21TheTrademarkOfficeshall,inaccordancewiththeTrademarkLawandtheseRegula

39、tions,examinetheapplicationsfortheregistrationoftrademarkithasaccepted.Applicationswhichconformtotherelevantprovisions,orthosefortheregistrationoftrademarksinrespectofapartofthedesignatedgoodswhichconformtotherelevantprovisions,shallbepreliminarilyapprovedandpublished.Applicationswhichdonotconformto

40、therelevantprovisions,orthosefortheregistrationoftrademarksinrespectofapartofthedesignatedgoodswhichdonotconformtotherelevantprovisions,shallberejected.TheTrademarkOfficeshallnotifytheapplicantinwritingandexplainthereasonfortherejection.WheretheTrademarkOfficehaspreliminarilyapprovedapplicationsfort

41、heregistrationoftrademarksonapartofthedesignatedgoods,theapplicantmayapplyfortheabandonmentthereofbeforethedateofexpirationoftheoppositionperiod;wheretheapplicantabandonstheregistrationoftrademarksinrespectofapartofthedesignatedgoods,theTrademarkOfficeshallwithdrawthepreliminaryapproval,terminatethe

42、examinationprocedure,andrepublishit.Article22Whereanoppositionisfiledtoatrademarkwhich,afterexamination,hasbeenpreliminarilyapprovedandpublishedbytheTrademarkOffice,theopponentshallsubmittheApplicationforTrademarkOppositioninduplicatetotheTrademarkOffice.TheApplicationforTrademarkOppositionshallindi

43、catetheissuenumberoftheTrademarkGazetteonwhichtheopposedtrademarkispublished,andthenumberofpreliminaryapprovaloftheopposedtrademark.TheApplicationforTrademarkOppositionshallcontainthespecificrequestsandfactsandgrounds,withrelevantproofsandcertificatesattached.TheTrademarkOfficeshallsendacopyoftheApp

44、licationforTrademarkOppositiontotheopposedpartyandrequirehimtomakeareplywithinthirtydaysfromthedateofhisreceiptofthecopy.Hisfailuretomakearep1yshallnotaffecttheadjudicationbytheTrademarkOfficeontheopposition.Whereaninterestedpartyneedstosupplementrelevantproofsandcertificatesafterheraisesanoppositio

45、napplicationormakesareply,heshallmakeastatementintheapplicationorreply,andsubmittheproofsandcertificateswithinthreemonthsfromthedateofsubmissionoftheapplicationorrep1y;wherehefailstosubmitthemattheexpirationofthetimelimit,theinterestedpartyshallbedeemedtohaveabandonedsupplementingtherelevantproofsan

46、dcertificates.Article23ThejustificationoftheoppositionmentionedinArticle34,paragraphtwo,oftheTrademarkLawshallincludethejustificationoftheoppositiontoaregistrationinrespectofapartofthedesignatedgoods.Wheresuchoppositionisjustified,theapplicationfortheregistrationoftrademarksinrespectofthatpartofthed

47、esignatedgoodsshallnotbeapproved.Whereanopposedtrademarkhas,priortothecomingintoeffectoftheadjudicationontheopposition,beenannouncedasaregisteredtrademarkintheTrademarkGazette,theregistrationannouncementshallbecancelled.Thetrademarkthathasbeenapprovedforregistrationupontheadjudicationontheopposition

48、sha1lbere-published.Thetrademarkapprovedforregistrationupontheadjudicationontheoppositionshallnothavetheretroactiveeffectonanotherpersonsacttouseasignidenticalwithorsimilarlytothetrademarkonthesameorsimilargoodsfromthedateonwhichtheperiodfortrademarkoppositionexpiresandbeforetheadjudicationontheoppo

49、sitiontakeseffect;however,thelossesinflictedtothetrademarkregistrantduetothebadfaithinwhichthesignisusedshallbecompensated.Thetimelimitfortheapplicationforreviewandadjudicationofthetrademarkapprovedforregistrationupontheadjudicationontheoppositionshallbecalculatedfromthedateofpublicationoftheadjudicationonthetrademarkopposition.ChapterIVModification,AssignmentandRenewalofRegist
