1、合伙购房协议书本协议由以下双方于2018 年月日在市区签订:共同出资人:(以下简称“甲方”)身份证号:共同出资人:(以下简称“乙方”)身份证号:甲乙双方经过平等、充分协商,就双方共同投资购买房屋及房屋后续使用等相关事宜达成如下协议,以资信守:1.房屋基本情况1.1 双方共同出资购买的房屋位于省市区街(路)号(小区)号,房屋的建筑面积为M2,房屋由公司投资开发建设,房屋的现状:,现房屋已取得商品房预售许可证(证号:)。1.2 房屋的销售价格为元/M2,总价款元人民币,交易税和费元、维修基金元,合计元。2.出资金额及比例2.1 甲方首次出资元人民币,占出资总额的%;2.2 乙方首次出资元人民币,占
2、出资总额的%;2.3 剩余部分申请银行按揭贷款支付,贷款本息由双方根据 按揭贷款合同的相关约定按本条前款约定的出资比例承担并清偿。2.4 双方均承诺:无论按揭贷款合同是由双方共同签订,还是由以本协议中任何一方名义签订,所涉及的银行贷款本息均由双方按本协议的比例承担和清偿。如因一方未按约承担贷款的还本付息义务,导致贷款逾期或者另一方垫付的,违约方须赔偿守约方的全部损失,否则,守约方有权主张调整房屋的产权比例以弥补其损失。3.产权比例3.1 甲乙双方按照本协议第2 条约定的出资比例各自享有所购房屋的产权。3.2 甲、乙双方对房屋的出资份额、还款份额及产权比例均不持异议,并自愿接受。4.物业考察、购
3、买4.1 甲乙双方共同对所购房屋进行了实际考察、了解,并出于双方自愿按本协议约定的全部条件而购买。5.产权证署名、保管及购置物业文件签署、款项支付、手续办理5.1 甲方同意本协议项下购买的房屋产权登记在乙方名下,乙方在此郑重承诺:本协议项下购买的房屋产权系甲、乙双方共同所有,产权比例按本协议第3 条和第 2 条的约定确定,甲方产权比例由乙方代持,乙方承认并确认甲方系本协议项下房屋共同产权人的地位。5.2 产权证由甲方保管;5.3 甲方委托乙方由乙方全权办理购房定金、首付款及其他购房相关款项的支付、购房合同等法律文件的签署、房产交接、房屋所有权证办理、“水”“电”“煤气”“有线电视开通”等所有购

12、屋的使用及处置(包括但不限于出租、借用、出售、置换等)事宜,乙方必需要征得甲方短信或书面同意方可与相关当事人签订协议,否则协议无效,因此而造成的善意第三人的损失由乙方全部承担;7.4 房屋转让必须由双方共同决定,倘若乙方未经甲方决定同意,自行转让本协议项下房屋,乙方应向甲方全部损失(转让房屋时,该房屋市场评估价 本协议约定的甲方产权比例)并承担相当于损失30%违约金。7.5 本房屋未经甲方决定,乙方不得进行抵押、担保,否则参照本条第四款执行。8.收益分配8.1 倘若本协议项下房屋因使用而产生收益的,由双方按本协议约的产权比例分配。8.2 双方决定转让该房屋时,所产生的高于购买时的利润时由双方按
