1、乡镇农村小型水利工程产权制度改革实 施 方 案为贯彻落实中央和省委关于全面深化改革的重大决策部署,积极稳妥地推进我镇农村小型水利工程产权制度改革,根据中央、省、市、县有关文件要求,结合我镇实际,制定本方案。一、指导思想以党的十八大、十八届三中、四中全会、省委十一届四次、五次全会为指导,以“明晰产权”为核心,赋权释能,落实管护主体、管护责任和管护经费,探索社会化和专业化的多种小型水利工程管理模式,建立健全科学的管理体制和良性运行机制,确保工程安全运行和效益充分发挥。二、改革目的、原则、范围和内容(一)改革目的:通过改革,从根本上解决长期以来农村小型水利工程重建轻管、产权不明晰、管护经费严重不足等
2、问题,彻底扭转我镇农村小型水利工程老化失修、损坏严重,小型水利资产闲置、效益衰减局面,为我镇农业和农村经济社会发展提供必要支持和保障。(二)改革原则1.权责一致原则。明晰所有权,界定管理权,明确使用权,搞活经营权,落实管护主体和责任。2.政府主导原则。强化政府责任,加强组织领导,调动各方力量,综合推进改革。3.突出重点原则。重点解决产权不明晰,管护主体、管护责任和管护经费不落实等问题。4.因地制宜原则。结合各项工程实际,积极探索专管、共管、代管、托管、自用自管等多种有效的工程管护模式。5.民主、公开、公平、公正原则。根据水利工程运行现状及效益发挥情况,通过召开群众会,广泛征求群众意见,合理界定
3、工程所有权,明确工程管理范围和保护范围。(三)改革范围:镇级及镇级以下管理的各类已建成的小型水利工程及其配套管理设施,主要包括:1.蓄水工程:小(二)水库;蓄水量等于或大于500m3 的山塘;蓄水量等于或大于50 m3 的水池水窖。2.引水工程:用于农业灌溉的拦河坝、引水渠、水闸。3.提水工程:装机功率小于1000 千瓦的电力提灌站、水能泵站、机井泵站。4.排水工程:流域面积小于3000km2 的中小河流堤防、排洪渠、排洪洞涵。5.灌溉工程:流量小于1 m3 的灌溉渠系、喷灌设施、微灌设施、量水设施。6.安全饮水工程:日供水小于 1000 m3 的集中式供水工程及农村分散式各类安全饮水工程。(

11、属性、保证原有功能和生态保护的前提下,具备条件的,可以通过竞标拍卖方式明晰工程产权;不具备条件的,可单独竞标拍卖使用权、水权或采取租赁、承包等形式明确权属。邀请县水务局专家组和镇、村负责工程产权界定工作,向明晰产权的工程所有者颁发相应的权属证书,载明工程功能、管理与保护范围、权属所有者及其权利与义务、有效期等基本信息。2.落实管护主体和责任。工程产权所有者是工程的管护主体,依法承担管护责任。小型水利工程管护的主要内容包括安全管理、运行管理、经营管理及维修养护等。管护主体要建立健全管护制度,落实管护责任,确保工程良性运行。镇水务站要加强对小型水利工程管理与运行维护的监管和技术指导,督促工程权属所

19、积极给予支持和鼓励。4.探索工程管理模式。可以结合实际,针对不同类型工程特点,因地制宜采取专业化集中管理及社会化管理等多种方式,积极推行集约化、专业化的维修养护服务。在确保工程安全和公益属性的前提下,小型水利工程所有者可自行管理,也可采取承包、租赁、委托管理等方式,引入竞争机制,择优选择经营管理主体。对各类国有公益性小型水利工程,村(居)可以探索成立专业化的小型水利工程物业管理公司,实行政府购买服务进行管护。小型水利工程的管护,所有者与经营管理者要签订管护责任书,明确管护内容,落实管护责任和安全责任,工程所有者负责对安全责任落实情况进行检查考核。镇水务站和村(居)要加强对非国有工程所有者及经营
