1、*州地方海事局关于印发行政执法投诉和举报制度的通知各县海事处:为完善社会监督机制,对于社会监督、舆论监督中反映的问题能得到及时回应和整改,有效促进执法人员依法、合理行政、及时办理有关行政执法的投诉、举报。根据有关规定,特制订本制度。请遵照执行。附件:1、*州地方海事局行政执法投诉和举报制度。2、*州地方海事局行政执法过错责任追究制度。此通知*州地方海事局201*年 5 月 1 日抄报:州交通运输局*州地方海事局201*年 5 月 1 日附件.1*州地方海事局行政执法投诉和举报制度第一条为加强海事行政执法社会监督工作,促进执法人员依法、合理行政,及时办理有关行政执法的投诉、举报,根据有关规定,特
2、制定本制度。第二条投诉举报工作,坚持事实求是、依法高效、有错必究的原则。第三条任何公民、法人或其他组织发现下列行为,均可以依法向*州地方海事局投诉、举报或意见反映:(一)执法人员有违法或不当行政行为的;(二)执法人员违反海事部门相关规定的;(三)公民、法人或其他组织违反海事行政管理秩序的行为。第四条公民、法人或其他组织进行投诉、举报应符合下列条件:(一)有明确的投诉、举报对象;(二)有具体事实和依据;(三)属本局职权范围;(四)属于行政执法投诉、举报的范围。第五条*州地方海事局督察部门负责行政执法投诉、举报的受理和意见反馈工作。其他部门或人员接到公民、法人或其他组织的投诉、举报或意见反映后,应

10、讼的,应告知当事人可以依法申请复议或提起诉讼,如果当事人坚持投诉、举报的,应予受理。第七条督察部门受理后,应如实记录公民、法人或其他组织的投诉、举报或意见反映,提出处理意见,报局分管领导批准后组织相关单位(部门)开展调查核实,并在15个工作日内向投诉、举报人做出相应的答复或说明。各单位(部门)应根据督察部门提出的处理意见,认真做好调查核实的配合工作。第八条经调查核实后,发现涉及执法过错或错案的,由督察部门处理;涉及违反廉政纪律的,移送纪检监察部门处理;涉及刑事犯罪的,移送公安部门处理。第九条对违反海事行政管理秩序的行为,经调查属实的,应依法对违法行为人作出相应处理。第十条投诉、举报人对投诉、举

25、W2Z5U1O6 ZO3N9Z8X10H5文档编码:CV9I2L9C7P1 HO1W2Z5U1O6 ZO3N9Z8X10H5附件.2*州地方海事局行政执法过错责任追究制度第一条、为了促进依法行政,规范交通执法行为,保护公民、法人或其他组织的合法权益,制定本制度。第二条、本制度所称行政执法过错责任,是指执法单位及其执法人员在行政执法活动中,因违法行使职权侵犯公民、法人或其他组织的合法权益,而应承担的责任。第三条、追究行政执法过错责任,必须以事实为依据,以法律为准绳,坚持实事求是、惩诫与教育相结合的原则,根据违法事实、行为人的法定职责及违法行为的后果确定。第四条、州海事局行政执法督察办公室行使对海
