4、和废止部分行政法规的决定第二 次修订）第一章总则Chapter I General ProvisionsArticle 26 The price of urban water supply shall be set under the principles of maintaining meagre profits in domestic water use and reasonable prices for the use of water in production and business operations.The methods for setting water supply p

5、rices in an urban area shall be formulated by the peoples government of the relevant province, autonomous region, or municipality directly under the Central Government.第二十六条城市供水价格应当 按照生活用水保本微利、生产和经营 用水合理计价的原则制定。城市供水价格制定办法，由省、自治 区、直辖市人民政府规定。Chapter V Maintenance of Urban Water Supply Facilities第五章城市供

6、水设施维护Article 27 An urban water utility or an enterprise supplying water externally through a self-constructed facility in an urban area shall conduct the regular inspections and maintenance of the designated reservoirs, water diversion channels, water intakes, pump stations, wells, water transportat

7、ion (distribution) pipe network, general water meters of households, water purification (distribution) factories, public water stations and other facilities, which are under its management for urban water supply, and shall ensure their safe operation.第二十七条 城市自来水供水企 业和自建设施供水的企业对其管理的 城市供水的专用水库、引水渠道、取

10、 facilities, it is prohibited to conduct such activities as digging holes for collection of soil or constructing buildings or structures, which endanger the safety of water supply facilities.第二十九条在规定的城市公共 供水管道及其附属设施的地面和地下 的安全保护范围内，禁止挖坑取土或 者修建建筑物、构筑物等危害供水设 施安全的活动。Article 30 Where any urban public wat

11、er supply facility has to be modified, dismantled or relocated due to the construction of a project, the construction employer shall report to the administrative department of urban planning and the administrative department of urban water supply of the peoples government at or above the county leve

12、l for approval, and take corresponding remedial measures.第三十条 因工程建设确需改 装、拆除或者迁移城市公共供水设施 的，建设单位应当报经县级以上人民 政府城市规划行政主管部门和城市供 水行政主管部门批准，并采取相应的 补救措施。第三十一条涉及城市公共供水 设施的建设工程开工前，建设单位或 者施工单位应当向城市自来水供水企 业查明地下供水管网情况。施工影响 城市公共供水设施安全的，建设单位 或者施工单位应当与城市自来水供水 企业商定相应的保护措施，由施工单Article 31 Before commencing the construc

13、tion of a construction project involving any urban public water supply facility, the construction owner or construction contractor shall ascertain the information about the underground water supply pipeline network with the relevant urban water utility. Where such construction may affect the safety

14、of any urban public watersupply facility, the construction owner or 位负责实施。construction contractor shall adopt corresponding protection measures through consultation with the relevant urban water utility, and the construction owner shall be responsible for the implementation of the measures.Article 3

15、2 It is prohibited to connect the water supply pipe system of self-constructed facilities to the urban public water supply pipe network without authorization. Where it is necessary to connect under exceptional circumstances, the consent of the urban water utility must be obtained, and necessary prot

16、ective measures shall be taken at the pipe connections.第三十二条 禁止擅自将自建设 施供水管网系统与城市公共供水管网 系统连接；因特殊情况确需连接的， 必须经城市自来水供水企业同意，并 在管道连接处采取必要的防护措施。A producer or user of toxic or hazardous substances shall be prohibited from directly connecting its production-use water pipe system to the urban public water sup

17、ply pipe network.禁止产生或者使用有毒有害物质的单 位将其生产用水管网系统与城市公共 供水管网系统直接连接。Chapter VI Penalties第六章罚则Article 33 Where an urban water utility or an enterprise supplying water externally through a self-constructed facility in an urban area commits any of the following conducts, the administrative department of urba

18、n water supply shall order it to take corrective actions and may impose a fine on it; shall report to the第三十三条 城市自来水供水企 业或者自建设施对外供水的企业有下 列行为之一的，由城市供水行政主管 部门责令改正，可以处以罚款；情节 严重的，报经县级以上人民政府批 准，可以责令停业整顿；对负有直接 责任的主管人员和其他直接责任人员，其所在单位或者上级机关可以给 予行政处分：（一）供水水质、水压不符合国家规定 标准的；（二）擅自停止供水或者未履行停水通 知义务的；（三）未按照规定检修供水设

19、施或者在 供水设施发生故障后未及时抢修的。第三十四条 违反本条例规定， 有下列行为之一的，由城市供水行政 主管部门责令停止违法行为，可以处 以罚款；对负有直接责任的主管人员 和其他直接责任人员，其所在单位或 者上级机关可以给予行政处分：（一）无证或者超越资质证书规定的经 营范围进行城市供水工程的设计或者 施工的；peoples government at or above the county level for approval, and order it to suspend business operations for an overhaul if the circumstances

20、are serious, and the directly liable executive in charge and other directly liable persons shall be given disciplinary actions by their employer or the superior competent department thereof:(1) Failing to meet the standards prescribed by the state regarding the water quality or water pressure of the

21、 water supplied;Suspending water supply without authorization or failing to perform the obligation of issuing a notice of suspension of water supply; or(2) Failing to maintain its water supply facility as required or failing to make a repair in a timely manner after its water supply facility breaks

22、down.Article 34 Whoever commits any of the following conducts as in violation of this Regulation shall be ordered by the administrative department of urban water supply to cease the violation of law and may be fined; and the directly liable executive in charge and other directly liable persons may b

23、e given disciplinary actions by their employer or the superior competent department thereof: (1) Designing or constructing an urban water supply project without a license or beyond the business scope specified in the qualificationcertificate;(2) Failing to design or construct an urban water supply p

24、roject in accordance with the technical standards and specifications prescribed by the state; or（二）未按国家规定的技术标准和规范 进行城市供水工程的设计或者施工 的；(3) Constructing an urban water supply project as in violation of the urban water supply development plan and the annual construction plan.（三）违反城市供水发展规划及其年度 建设计划兴建城市供水工

25、程的。Article 35 Whoever commits any of the following conducts as in violation of this Regulation shall be ordered by the administrative department of urban water supply or its authorized entity to take corrective actions during a prescribed period and may be fined:(1) Misappropriating or transferring

26、urban public water supply;Conducting activities that endanger the safety of any water supply facility within the specified safety protection areas of urban public water supply pipelines and their auxiliary facilities;第三十五条违反本条例规定， 有下列行为之一的，由城市供水行政 主管部门或者其授权的单位责令限期 改正，可以处以罚款：（一）盗用或者转供城市公共供水的;（二）在规定的城

27、市公共供水管道及其 附属设施的安全保护范围内进行危害 供水设施安全活动的；(3) Connecting the water supply pipe system ofself-constructed facilities water supply pipe authorization;to the urban publicnetwork without（三）擅自将自建设施供水管网系统与 城市公共供水管网系统连接的；（4） Directly connecting the production-use （四）产生或者使用有毒有害物质的单water pipe system of any produc

29、urban public water supply facility without authorization.（六）擅自拆除、改装或者迁移城市公 共供水设施的。Water supplied to anyone that commits any conduct as set forth in subparagraph (1), (3), (4), (5) or (6) of the preceding paragraph may be suspended for a certain period of time, subject to approval by the peoples gove

30、rnment at or above the county level, if the circumstances are serious.有前款第（一）项、第（三）项、第（四） 项、第（五）项、第（六）项所列行为之 一，情节严重的，经县级以上人民政 府批准，还可以在一定时间内停止供 水。Article 36 Where the construction of a building project endangers urban public water supply facilities, the administrative department of urban water supply

31、 shall order it to stop the hazardous activities; where any loss is caused, the responsible party shall compensate for the losses in accordance with the law; and the directly liable executive in charge and other directly liable persons may be given disciplinary actions by their employer or the super

32、ior competent department thereof.第三十六条建设工程施工危害 城市公共供水设施的，由城市供水行 政主管部门责令停止危害活动；造成 损失的，由责任方依法赔偿损失；对 负有直接责任的主管人员和其他直接 责任人员，其所在单位或者上级机关 可以给予行政处分。Article 37 Where any staff member of anadministrative department of urban water第三十七条城市供水行政主管supply neglects his or her duty, abuses his or her powers, practice

33、s favoritism, or makes falsification, he or she shall be given disciplinary actions by his or her employer or the superior competent department thereof; and where it is criminally punishable, he or she shall be held criminally liable in accordance with the law:部门的工作人员玩忽职守、滥用职 权、徇私舞弊的，由其所在单位或者 上级机关给予

34、行政处分；构成犯罪 的，依法追究刑事责任。Chapter VII Supplemental Provisions第七章附则Article 38 The amount of fines as set out in Articles 33, 34 and 35 of this Regulation shall be specified by the peoples governments of relevant provinces, autonomous regions and municipalities directly under the Central Government.第三十八条本条

35、例第三十三 条、第三十四条、第三十五条规定的 罚款数额由省、自治区、直辖市人民 政府规定。Article 39 This Regulation shall come into force on October 1, 1994.第三十九条本条例自1994年 10月1日起施行。第一条 为了加强城市供水管 理，发展城市供水事业，保障城市生 活、生产用水和其他各项建设用水， 制定本条例。第二条本条例所称城市供水, 是指城市公共供水和自建设施供水。本条例所称城市公共供水，是指城市 自来水供水企业以公共供水管道及其 附属设施向单位和居民的生活、生产 和其他各项建设提供用水。本条例所称自建设施供水，是指城市

36、 的用水单位以其自行建设的供水管道 及其附属设施主要向本单位的生活、 生产和其他各项建设提供用水。Article 1 This Regulation is formulated for the purposes of strengthening the administration of urban water supply, developing the urban water supply undertaking, and ensuring the water supply for everyday life, production activities and various const

37、ructions.Article 2 For the purpose of this Regulation, “urban water supply“ means urban public water supply and water supply from self-constructed facilities.For the purpose of this Regulation, “urban public water supply means the supply of water by urban water utilities for the everyday life, produ

38、ction activities and various constructions of entities and residents through public water supply pipelines and the auxiliary facilities thereof.For the purpose of this Regulation, water supply from self-constructcd facilities means the supply of water by urban water users for their own everyday life

39、, production activities and various constructions through their selfconstructed water supply pipelines and the auxiliary facilities thereof.Article 3 Entities and individuals engaged in urban water supply and use of water supplied to urban areas must observe this Regulation.第三条从事城市供水工作和使 用城市供水，必须遵守本

40、条例。第四条城市供水工作实行开发 水源和计划用水、节约用水相结合的 原则。第五条县级以上人民政府应当 将发展城市供水事业纳入国民经济和 社会发展计划。Article 4 Urban water supply shall follow the principles of combining the exploitation of water sources with planned water use and water conservation.Article 5 The peoples governments at or above the county level shall incorp

41、orate the urban water supply undertaking into their plans for economic and social development.Article 6 The state will implement the policies that are conducive to the development of urban water supply, encourage scientific and technological research on urban water supply, promote advanced technolog

42、ies, and enhance the modernization of urban water supply.第六条国家实行有利于城市供 水事业发展的政策，鼓励城市供水科 学技术研究，推广先进技术，提高城 市供水的现代化水平。Article 7 The administrative department of urban construction of the State Council shall be in charge of urban water supply across the country.The administrative departments of urban co

43、nstruction of the peoples governments of provinces and autonomous regions shall be in charge of urban water supply within their respective administrative regions.The administrative departments of urban water supply determined by the peoples governments第七条国务院城市建设行政主 管部门主管全国城市供水工作。省、自治区人民政府城市建设行政主 管部门

46、 urban water supply, administrative department of geology and mineral resources and other appropriate administrations to jointly prepare a water source development and utilization plan for urban water supply and, as an integral part of its urban water supply development plan, incorporate it into its

47、 urban comprehensive plan.第九条县级以上城市人民政府 应当组织城市规划行政主管部门、水 行政主管部门、城市供水行政主管部 门和地质矿产行政主管部门等共同编 制城市供水水源开发利用规划，作为 城市供水发展规划的组成部分，纳入 城市总体规划。Article 1() A water source development and utilization plan for urban water supply shall be prepared from the needs of urban development and coordinate with the overall
