3、 negotiation and good faith.一、合同协议期限 Contract Term.合约甲方机构与合约乙方机构签订固定期限劳动合同协议。本劳动合同协议期限为年,自年 月 日起,至 年 月 日止,其中试用期为 个月,自 年 月 日起, 至 年 月 日止。Party A and Party B signs a fixed-term labor contract. 4、合约乙方机构从事 岗位工作。Party A employs Party B to engage in.1 .工作地点:,根据合约甲方机构工作需要,经合约缔结双方协调一致,可 变更工作地点。The workplace is, which can be changed on the basis of mutual agreement as per Party As business requirements.2 .合约乙方机构应积极遵守公司所有规章规章制度,按质、按量 按时完成其本职工作。Party B shall fulfill his job in a high-quality, quanti
5、tative and time-efficient manner and abide by all the pany rules.3 .合约甲方机构可以根据实际工作需要,根据合约乙方机构的工作能力和表现,调整合约乙方机构 工作岗位或安排合约乙方机构临时从事其他工作岗位,合约乙方机构应予以认可配合。Party A may adjust Party Bs job or appoint Party B to do another job temporarily by virtue of its business requirements as well as Party Bs petence and

Party B shall agree and cooperate with Party A.三、工作时间和休息时间 Working Hours & Rest Hours.甲、乙双方同意按以下正式正式生效确定合约乙方机构的工作时间(正常工作时间:09: 00-18: 00;其中12: 3013: 30为午餐时间。)标准工时制,即每日工作一小时,每周周一至周五工作。Both parties agree Party Bs working hours are specified as follows (normal working hours: 09:00 - 18: 0

Standard working hours system, i.e.hour(s)/day, Work from Monday to Friday.四、劳动报酬 Labor Remuneration.合约甲方机构每月5日前以货币的形式足额支付合约乙方机构工资,结算周期为上月月初到上月 月末,实行先工作后发薪的规章制度。Party A shall pay off salary to Party B in currency on the 5th of every month. The pay period is from the b
8、eginning to the end of last month. Party B works before paid.7 .在试用期,合约乙方机构的税前工资为每月 元人民币;在试用期后,合约乙方机构薪金模式为工作基本月薪 元人民币,加年度奖金模式。其中年度奖金根据公司经营状况和合约乙方机构工作表现另行确定。Party Bs probation period salary is RMB. After the probation period, Party Bs normal basic salary is, plus annual bonus, which can be adjusted a
9、s per the ponys operation and Party Bs performance.8 .在合约甲方机构取得中国企业营业执照之前,合约甲方机构不承担合约乙方机构社会保险费用和 医疗保险费用;在合约甲方机构取得其企业营业执照后,合约甲方机构须承担合约乙方机构相关社会、 医疗保险费用,并按照国家有关规定对合约乙方机构所应承担的社会保险费用及个人所得税进行代缴。 Before Party A obtains its Business License officially, Party A is not responsible for paying off Party Bs soci
10、al and medical insurance; after Party A obtains its Business License, it must pay related Party Bs social and medical insurance and will deduct Party Bs own social and medical insurance premium and individual ine tax from Party Bs salary to pay to the Chinese government.9 .合约甲方机构调整合约乙方机构工作岗位的,根据合约乙方
11、机构能力及其相关职位,双方协商一 致后调整合约乙方机构劳动报酬。Party Bs labor remuneration will be adjusted as per Party B*s petence and job requirements on the basis of consensus in case Party A adjust Party Bs job.10 .合约甲方机构将每年对合约乙方机构的工作成绩 表现,以及劳动报酬进行评估. Party A will review Party Bs work performance and salary on an annual basi
12、s.五、社会保险和福利待遇 Social Welfare& Benefits.合约甲方机构根据国家有关规定为合约乙方机构缴纳北京市城镇社会保险(养老、医疗、失业、 工伤),个人缴纳部分由合约甲方机构从合约乙方机构工资中代扣代缴。合约缔结双方解除、终止劳 动合同协议时,合约甲方机构按有关规定为合约乙方机构办理社会保险相关手续。According to the States related rules, Party A will pay Beijing social insurance in urban area (i.e. pension insurance, unemployment insu
13、rance, Occupational Injury and medical insurance) for Party B. And Party A will deduct Party B,s part from his or her salary. When the labor contract is terminated by both parties, Party A will handle the related procedures for Party Bs social insurance according to the related regulations.11 .合约乙方机
14、构非因工疾病或负伤,在医疗期内工资及其医疗待遇按照本合同协议16条执行。合 约乙方机构患职业病或因工负伤后的工资和医疗补助执行按照国家和地方的有关法律法规执行。In case of illnesses or injuries unrelated to work, the salary during the remedial period as well as medical treatment shall be paid in accordance with Clause 16. The salary and Medicare benefits of Party B in case of oc
15、cupational diseases or work-related injuries shall be paid in accordance with the relevant national and local laws and regulations.12 .因公出差按公司规定实行差旅费报销与补贴。In case Party B travels on business, Party A will reimburse travelling expenses and give subsidy to Party B in accordance with the pany rules.六、假
16、期安排 Annual Leave and Sick Leave.带薪年假-雇佣期满一年后,合约甲方机构每年为合约乙方机构提供十天带薪年假。合约乙方 机构需根据合约甲方机构经营和工作等实际情况,安排年假,尽量将合约甲方机构损失最小化。合约 乙方机构休年假时,必须提前一个月通知合约甲方机构,并取得合约甲方机构批准,方可休假。Annual Leave - Party B shall be entitled to take paid annual leave of ten (10) working days per annum after the first year the employment.
17、Leave may be taken as it is accrued but may only be taken at times agreed to by the pany in order that disruption will be minimal. Request for leave must be submi甘ed one (1) month in advance and approved by Party A.13 .病假-如合约乙方机构不涉及住院治疗,合约甲方机构将每年批准合约乙方机构共计15天带 薪病假;其中全薪病假五天,三分之二薪金病假五天,以及三分之一薪金病假五天。如合
18、约乙方机构 病假日期总数超过合约甲方机构允许的病假日期总数,超出部分将在合约乙方机构带薪年假日期数中 扣除;如果合约乙方机构病假日期总数超出了合约甲方机构允许的病假和带薪年假日期总和,合约甲 方机构将不会支付合约乙方机构超出日期的任何薪金。合约乙方机构必须向合约甲方机构财务或行政部出具医院的相关病假证明并通知合约乙方机构上级 部门机构,如合约乙方机构不能提供相关医院病假证明,视为合约乙方机构旷工处理,合约甲方机构 有权不支付合约乙方机构旷工期间任何薪金。Party B is entitled to five (5) days sick leave per full calendar year
19、at full pay, next five (5) days sick leave at two-third pay and next five (5) days sick leave at one-third pay, if no hospitalization is incurred. Medical Certificates must be submitted to our Accounts/Admin department upon returning to the office; if not. Party A has right not to pay for Party Bs a
20、bsence.Party B is required to inform its supervisor and the directors if Party B requires sick leave. All absence beyond Party Bs allocated sick leave is deducted from its vacation time. If both the sick leave and vacation leaves are used up, Party B will not be entitled to be paid for its time that
21、 Party B is absent from work.七、劳动纪律 Labor Disciplines.合同协议期间,合约乙方机构应严格遵守国家的各项法律法规及合约甲方机构依法制定的各项规 章规章制度及要求,严格遵守劳动安全卫生、操作规程及工作规范;应爱护合约甲方机构财产,遵守 职业道德,积极维护公司荣誉和利益。Within the contract term. Party B shall abide by the Stated laws and regulations as well as the rules formulated by Party A according to the
22、laws; follow labor security and hygiene systems, production processes, operating instructions and job specifications; take good care of Party A*s property; and safeguard the benefits and reputation of the pany.14 .合约乙方机构违反劳动纪律,合约甲方机构可依据本公司的规章规章制度给予纪律处分,直至 解除本劳动合同协议。另外,由于合约乙方机构的原因对合约甲方机构造成经济损失的,原则上必须
23、 按照实际损失金额由合约乙方机构向合约甲方机构承担损害赔偿责任,数目重大者合约甲方机构有权 追究其法律责任。In case Party B violates any of the labor disciplines, Party A may punish Party B or even release the contract according to the rules and regulations of the pany. Moreover, Party B will be held liable for Party As economic losses on a case-by-cas
24、e basis, in the event that Party Bs behavior damages Party As interests. In case of the considerable amount of losses, Party A will retain the right to pursue legal actions against Party B.15 .在本合同协议履行过程中,合约甲方机构根据国家有关规定可以制定新的规章规章制度,也可以 对公司制定的规章规章制度进行修改,发布的各种规章规章制度、操作规定、通知、公告等均对合约 乙方机构有约束力。During the
