18、八、劳动合同的解除八、劳动合同的解除 The remove of labor contractThe remove of labor contract（一）双方协商一致，劳动合同可以解除。The two party may terminate the labor contractwith mutual agreement.（二）乙方有下列情形之一的，甲方可以即行解除劳动合同：Of any of the followingcircumstances,party A may immediately terminate the labor contract.1、在试用期内被证明不符合录用条件的；Be

19、en proven not to meet the conditions ofemployment during the trial period.2、采取欺诈手段订立本合同的；Adopted fraudulent means to enter into this contract.3、严重违反劳动纪律或规章制度给甲方造成重大损害的；Seriously violated labordiscipline or regulations to cause significant harm to the Party A.4、严重失职、营私舞弊，或泄露甲方商业秘密，给甲方利益造成重大损失的；Gross

20、negligence,malpractice,or disclosure of trade secrets Party A,to cause heavy losses to theinterests of the Party A.5、乙方同时与其他用人单位建立劳动关系，对完成本单位的工作任务造成严重影响，或者经用人单位提出，拒不改正的；Party A built labor relationships with other unit,to causea serious impact on the completion of the tasks of the unit,or refused to

22、borcontract ahead of 30 days.1、乙方不能胜任工作，经培训或调整工作岗位仍不能胜任工作的；Party B is not competentfor work,after training or adjustment of jobs.2、乙方患病或者非因工负伤，医疗期满后，不能从事原工作，也不能从事甲方另行安排工作的；Party B was ill or injured due to non-work relation,after completion of medical,Part A is not competent for his original work,or

25、of Party A metserious difficulties.3、甲方转产、重大技术革新或者经营方式调整，经变更劳动合同后，仍需裁减人员的；production,technological innovation or business method of Party A adjusted,after thechange of labor contracts,still needed to reduce staff.4、其他因劳动合同订立时依据的客观经济情况发生重大变化，致使劳动合同无法履行的。Ifother objective situation this contract based

26、 on,changes significantly,to result thecontract unable to perform.（五）乙方 有下列情 形之一的，甲方不得 解除劳动合 同：Of any of thefollowingcircumstances,party A can not terminate the labor contract.1、在本单位患职业病或者因工负伤并被确认丧失或者部分丧失劳动能力的；Injured due tooccupational disease or work-related reasons,and was confirmed as having los

27、t orpartially lost the ability to work.2、患病或者非因工负伤，在规定的医疗期内的；Illness or non-work related injury withinthe prescribed period of medical treatment.3、女职工在孕期、产期、哺乳期的；women workers in pregnancy,childbirth,breastfeeding.4、在本单位连续工作满十五年，且距法定退休年龄不足五年的；Worked continuously for 15years and less than five years

33、revoked,ordered to close,cancellation or early dissolution of.6、法律、行政法规规定的其他情形。Other circumstances stipulated by laws,administrative regulations.（二）乙方应在劳动合同期满前 30 天通知甲方，甲方同意续订，乙方应及时申请办理续订手续；若甲方不同意续订，到期即办理终止合同手续。乙方未办理终止合同手续而离职的，甲方保留追究其法律责任的权利。Party B shall give notice to inform Party A to renew the l
