1、国际知识产权法（双语）教学大纲课程代码： U1122100/N0301Z12总学时（理论+实践）：32+0学分一2课程性质：必修课程类别：专业选修课先修课程：知识产权法面向专业：.知识产权专业及双学位开课二级学院：.法学院开课学科：知识产权法一、课程的地位与任务国际知识产权法产生于国际间的知识产权合作，其表现形式为国际条约。国际知识产权 法在知识经济时代已日趋重要，应为知识产权专业学生所了解和掌握。开设该课程的目的是让学生了解国际社会协调不同知识产权保护制度体系的原因，以及 其主要制度体系、原则、标准、国际组织和纠纷解决机制，以便学生在将来的工作中能处理 与此有关的法律事务。二、课程主要内容与

2、基本要求第一章国际知识产权法导论了解世界知识产权组织公约、世贸组织制定的与贸易有关的知识产权协定及世界知识产 权法的特点。第二章世界知识产权法的产生与发展了解世界知识产权法的发展历程及趋势，如从双边协定到多边协定，从一般管理性组织 到专业化组织，以及世界知识产权法的新阶段：与贸易有关的知识产权协定的产生。第三章世界知识产权法的社会基础了解国际知识产权保护中平衡不同利益时考虑的主要因素一一垄断利益与公共利益的 协调，以及国际社会在知识产权方面的利益平衡。第四章世界知识产权条约体系了解、认识具有代表性的主要世界知识产权协定的内容：世界知识产权条约分类、巴黎 公约体系、伯尔尼公约体系、著作权公约、与

3、贸易有关的知识产权协定，以及各协定之间的 关系。第五章知识产权体系国际协调的组织体系认识各知产权体系国际组织的组成、法律基础、成员资格、功能、决策机制、各组织间 的相互关系。第六章知识产权体系国际合作的原则与标准熟悉知识产权国际保护一般原则与特殊原则，保护工业产权的国际标准，著作权保护的 国际标准，相邻权保护的国际标准、知识产权实施的国际标准。第七章知识产权分类的国际安排掌握知识产权获取与分类的国际安排：专利的国际分类体系、商标的国际注册与分类体 系、外观设计的国际分类体系。要求在实践中会用。第八章国际知识产权纠纷的解决制度掌握知识产权国际纠纷解决制度安排与解决机制：巴黎公约和伯尔尼公约中纠纷
