1、新城镇化下进城务工人员劳资纠纷问题探究,民商法论文【题目】新城镇化下进城务工人员劳资纠纷问题探究 【第一章】 【第二章】 【第三章】 【第四章】 【第五章】 【结束语/以下为参考文献】 内容摘要 . 伴随着新型城镇化建设的大潮,大量农村人口向城市聚集,非农产业由村入镇成为了社会发展的客观趋势。超过两亿的进城务工人员作为生产要素不断涌向城镇,成为了现今中国社会的 第三元 .其作为生产要素融入到新型城镇化建设大潮中,因其工作的临时性、流动性及亦工亦农等特征,难以被工会所吸收。1 因现有劳资纠纷处理机制的刚性冗长,进城务工人员之权益保障、公平正义需求与现前阶段新型城镇化具备的社会治理能力不相适应的矛
2、盾已特别尖锐,运用法治思维和法治方式,探究劳资纠纷解决途径,以解决牵涉进城务工人员亲身利益的矛盾和问题确迫在眉睫,纠纷多元解决机制是化解新型城镇化中进城务工人员劳资纠纷的可行途径。 本文共分为五章: 第一章:引言。包括研究目的及意义;国内、外的研究现在状况;研究方式方法与创新。 第二章:论证及时化解进城务工人员劳资纠纷是新型城镇化中的重大课题。该部分从的十八大、十八届四中全会、城镇化工作会议及领导人主要谈话入手,深切进入理解和阐述新型城镇化,进而对新型城镇化中进城务工人员劳资纠纷进行分析和讨论。 第三章:研究进城务工人员劳资纠纷的原因及特征。重点讨论进城务工人员讨薪、工伤纠纷。该纠纷类型产生的
3、原因主要有:1.经济原因目的偏差,利益受损;2.制度缺陷行政调解缺位,利益诉求、权利救济受阻;3.心理诱因维权的非理性。 第四章:探寻现有进城务工人员劳资纠纷解决机制的缺乏。以笔者亲身代理的劳资纠纷案例为蓝本,重点阐述纠纷解决程序过于繁复、 裁审 关系的衔接维度不清、社会气力对进城务工人员支撑缺乏等现前阶段处理劳资纠纷所存在的问题,揭示出现行劳资纠纷争议解决机制的缺乏。即对 法治中国 这一 新背景 重视不够,法不责众损害司法权威;对进城务工人员这一 新群体 的 新纠纷 具备的组织性、突发性、毁坏性认识缺乏;对提高维护进城务工人员稳定能力的详细措施不多,现有解决机制适用范围不明,衔接维度不清。
4、第五章:建构新型城镇化中进城务工人员劳资纠纷多元解决机制。以 枫桥经历体验 为蓝本,充分发挥农民工工会、社区组织、法律援助组织等在维护进城务工人员稳定中的作用,就地治理社会治安。整合政策、法律与民间习惯,十分关注中华 和 文化与法治中国建设之间的衔接,求同存异,定纷止争。 以司法裁判为中心,发挥人民调解、行政调解、法律援助等各种机制优势,注重新媒体时代的舆论引导;防微杜渐,主动出击,避免事态扩大;对于已经发生的纠纷,厘清、重视 裁审 关系形式的优势及其二者之间的衔接维度,加强仲裁委员会与法院的沟通协调,能裁则裁,当判则判,绝不姑息纵容;纠纷的生效判决必须不折不扣地执行,以维护法治权威,保障劳资
