10、uality of project should achieve the requirements of acceptance agreed by bothparties.二乙方必须严格按照施工图纸、说明文件和国家颁发的建筑工程规范、规程和标准进行施工，并接受甲方的监督。3/6Party B should carry on the construction in strict accordance with drawing,specification file and regulations and specifications authorized by the competentautho

11、rities and be under the supervision of Party A.三乙方在施工过程中必须遵守下列规定：Party B should,during the construction,comply with the provisions as follows:1由乙方提供给甲方的所有材料必须经甲方同意方可使用，未按要求购买严禁使用；All materials provided by Party B should be subject to the approval of Party A priorto use,And none of the same being bou

12、ght without conformity with Party A requirementscan be used.2隐蔽工程必须经甲乙双方检查，方可进行下一道工序；The concealed works should be checked by both parties before the next progress;3工程竣工后，乙方按规定对工程实行保修，保修时间自通过竣工验收之日算起，保修期一年。Party B shall take the liability of maintenance following the complete of works.The period of

13、maintenance shall be one year from the day of acceptance of complete.第五条 工程价款的支付与结算 Article 5Payment and settlement of the contractprice合同总价 50%,即元 The total contract price 50%,whichisYuan.中期款 The payment of medium-term工程进度过半三日内 Within 3(three)days after the progress more than half.合同总价 40%,即元 The t

14、otal contract price 40%,whichisYuan.尾款 Final Payment竣工验收结算后七日内 Within 7(seven)days after the completion acceptance andsettlement.合同总价 10%,即元 The total contract price 10%,whichisYuan.第六条 施工与设计变更 Article6 The Modification of Construction and Design一乙方交付的设计图纸、说明和有关技术资料，作为施工的有效依据，开工前由甲方组织签字认同，作为施工的补充依据，

15、甲、乙双方均不得擅自修改。4/6Design drawing,illustration and relevant technical data consigned by party B arethe basis for construction and shall be confirmed by party As signature,whichis deemed as the supplementary basis and shall be modified by any party withoutauthorization.二施工中如发现因甲方要求而发生的设计错误或严重不合理的地方，乙方应及

16、时以书面形式通知甲方，由甲方及时会同乙方等有关单位研究确定修改意见或变更设计文件，乙方按修改或变更的设计文件进行施工。若发生增加费用（包括返工损失、停工、窝工、人员和机构设备调迁、材料构配件积压的实际损失）由甲方负责，并调整合同造价。If and when any error or material unreasonable problem of design due to party Asrequirement,Party B shall notify Party A promptly in writing and decide theamendment or modification of

17、 the design documentation by the consultation andnegotiation between parties and units concerned.Party B shall carry outconstruction according to the design documents modified or changed.If project costincrease(including the actual loss of rework loss,stoppage or slowdown,personneland machine equipm

18、ent relocated,material structures,fixtures backlog),shall beresponsibility by Party A,and be adjusted the contract price together with PartyB.三乙方在保证工程质量和不降低设计标准的前提下，提出修改设计、修改工艺的合理化建议，经甲方、设计单位或有关技术部门同意后采取实施。Any reasonable suggestion on the modifications of design and craft proposed by PartyB,subject

19、to the quality and without reducing standards of design,could be carriedout upon the approval of Party A,design unit or concerned technical department.四甲方如需设计变更，必须作出正式修改通知书和修改图纸，乙方才予实施。重大修改和增加造价时，必须另行协商，乙方才予实施。Party A should,if any necessary design change,make the formal amendment and modifydrawings

20、 for Party Bs implementation.Material changes and cost increased mustbe negotiated by both parties before Party B implement the same.第七条 工程验收 Article 7Acceptance of project一工程施工中地下工程、结构工程必须具有隐蔽验收签证、试水、抗渗等验收合格记录。甲方须及时办理验收签订手续。The underground engineering,structural engineering in the construction of p

21、rojectshould be checked and with issue of certificate and the record of acceptance of watertest,anti-permeability and so on.Party A should deal with the acceptance signedformalities timely.二工程竣工验收后，甲方才可使用 Party A can use the project after completionacceptance在规定的保修期内，凡因施工造成的质量缺陷应由乙方无偿保修。其保修条件、范围和期限按

23、ring guarantee measures(Trial)by Urban and RuralConstruction and Environmental Protection Department(84).第八条 违约责任 Article 8Liability for breach of contract乙方的责任：Responsibility of Party B:一工程质量不符合合同规定的，负责无偿修理和返工。Take charge of gratis repair and rework if project quality doesnt meet contactsstipulatio

24、n二工程不能按合同规定的工期交付使用的，按合同中关于建设工期提交或拖后的奖罚规定偿付逾期罚款。If fail to deliver the construction according to the contract on time,The overduefines according to punishment or award of the provision concerning the delivery ordelay.甲方的责任：The responsibility of Party A:一未能按照合同的规定履行自己应负的责任，除竣工日期得以顺延外，还应赔偿乙方由此造成的实际损失。F

25、ailed to fulfill their responsibilities in accordance with the provisions of thecontract,in addition to the completion date to be postponed should be compensationfor the actual loss of Party B.二工程中途停建、缓建或由于设计变更以及设计错误造成的返工，应采取措施弥补或减少损失。同时，赔偿乙方由此造成的停工、窝工、返工、倒运、人员和机械设备调迁、材料和构件积压的实际损失。The ongoing projec

27、ials andcomponents.第九条 纠纷解决办法 Article 9 Dispute settlement任何一方违反合同规定，双方协商不成，均可向北京仲裁委员会申请仲裁。Either party could,if any partys breach and fail to negotiation,submit theapplication of arbitration to the Beijing ArbitrationCommittee第十条 附则 Article 10 Supplementary一本合同一式贰份，甲乙双方各执正本一份。6/6This contract is ex
