3、1. 双方商定机械由 方负责操作与维护。本合同商定的操作维护方应当根据机械运营、操作规定配备符合国家或地方法律法规规定上岗条件的操作、指挥、维护等人员，也可托付具备相应资质的专业公司担当机械的操作与维护，受托方行为视为该托付方行为。 1. 8、OBLIGATIONS OF PARTIES 甲方权利义务 Rights and obligations of Party A 1. 甲方有权要求乙方根据合同商定供应合格的机械。 1. Party A has the right to require Party B to provide qualified machinery in accordance with the contract. 2. 甲方有权要求乙方根据合同商定供应机械的修理保养效劳。若因乙方缘由导致机械毁损、灭失或者消失故障无法使用的，甲方有权解除合同或要求乙方更换同等型号、性能的机械，并要求乙方赔偿损失。 2. Party

9、A has the right to require Party B to provide maintenance services for the machinery in accordance with the contract. If the machinery is damaged, lost or malfunctioned beyond use due to Party B, Party A has the right to terminate the contract or request Party B to replace the machinery with the sam

10、e type and performance and request Party B to compensate for the loss therefrom. 3. 甲方应当根据合同商定的时间、方式和金额支付租金和其他费用。 3. Party A shall pay the rent and other charges at the time, in the manner and in the amount as specification in the contract. 4. 甲方应当为乙方供应机械进出场作业、其他维护作业的帮助和便利，按时接收乙方交付的机械。 4. Party A sh

11、all provide Party B with the assistance and facilities for entry and exit of machinery operations and other maintenance in addition to receive the machinery delivered by Party B on time. 5. 甲方应当为机械供应安全作业环境，负责机械设备在施工现场的看护，爱护设备的安全。如因甲方缘由造成机械毁损、灭失的，应向乙方赔偿。 5. Party A shall provide the safe working envi

12、ronment for the machinery, be responsible for the care of the machinery and equipment at the construction site, in addition to protect the safety of the equipment, and shall make compensation to Party B provide that the machinery damaged or lost due to Party A. 6. 甲方应当按操作规程或机械使用规定或合同商定治理和使用机械，不得违章或超

13、负荷作业。由甲方指派的操作人员必需持证上岗。 6. Party A shall manage and use the machinery in accordance with the operating rules or the regulations on the use of machinery or the contractual agreement, and shall not operate in violation of the rules or overload. The operators assigned by Party A should be licensed to wo

14、rk. 7. 未经乙方书面同意，甲方不得转租机械，不得对机械进展改善或增设他物。 7. Party A shall not, without the written consent of Party B, sublet the machinery, make improvements to the machinery or add other things to it. 乙方权利义务 Rights and obligations of Party B 1. 乙方有权根据合同商定收取租金。 1. Party B has the right to collect the rent as stipu

15、lated herein. 2. 因甲方缘由导致的机械毁损灭失，乙方有权要求甲方赔偿。 2. Party B shall be entitled to claim compensation from Party A for any damage to or loss of machinery due to Party A. 3. 乙方应当根据商定的时间、地点向甲方供应商定的机械，不得供应已经淘汰或报废的机械。 3. Party B shall provide Party A with the agreed machinery at the agreed time and place and s

16、hall not provide machinery that has been eliminated or scrapped. 4. 法律法规规定应当供应生产厂家生产许可证或产品合格证等文件，或者需要到相关部门备案的，乙方应当供应或办理备案手续。 4. Where laws and regulations require the provision of documents such as the manufacturer“s production licence or product certificate of conformity, or where filing with the r

17、elevant authority is required, Party B shall provide or go through the filing procedures. 5. 乙方应当向甲方供应机械的使用环境、安全使用要求、操作维护留意事项等必要的技术资料或技术说明。 5. Party B shall provide Party A with the necessary technical information or technical instructions on the environment in which the machinery is to be used, the

18、 requirements for safe use and the precautions for operation and maintenance. 6. 乙方应当供应技术保障，担当租赁期间的修理保养义务。 6. Party B shall, during the rental period, provide technical support and undertake maintenance obligations. 7. 合同商定应由乙方派出随机操作人员的，派出的随机操作人员必需持证上岗，听从甲方治理，遵守甲方各项规章制度，并应拒绝甲方提出的违章指挥。 7. 合同商定应由乙方派出随

20、Party A“s proposed violation of rules and regulations. 第九条：违约责任 ARTICLE 9 LIABILITY FOR BREACH 甲方违约责任：Party A“s liability for breach 1. 甲方不履行合同，应向乙方支付违约金 元。 1. Party A shall pay Party B liquidated damages in the amount of RMB for its failure of performance. 2. 甲方未按合同商定支付租金的，每逾期一日应根据 元/日的标准向乙方支付拖延履行违

21、约金。凡逾期满 日的，乙方有权解除合同并要求甲方支付违约金。 2. Where Party A fails to pay the rent as agreed in the contract, Party B shall be liable for late payment of liquidated damages at the rate of Yuan RMB/day for each day of delay. Where overdue payment for more than days, Party B has the right to terminate the contract

22、 and request Party A to pay liquidated damages. 3. 甲方未按有关法律法规规定或合同商定的方法使用机械，致使租赁机械受到损失的，乙方有权解除合同并要求甲方赔偿损失。 3. Party B has the right to terminate the contract and request Party A to compensate for the loss due to Party As failure of using the machinery in accordance with the relevant laws and regulat

23、ions or the method specified herein the contract, which resulting in damage to the leased machinery. 4. 甲方未经乙方书面许可擅自将机械转租的，乙方有权解除合同并要求甲方赔偿损失。 4. Provided that Party A sublets the machinery without Party B“s written permission, Party B has the right to terminate the contract and request Party A to co

24、mpensate for the loss. 5. 甲方未经乙方书面许可擅自改善或增设他物的，乙方有权要求甲方准时恢复原状或者赔偿损失。 5. Party B has the right to require Party A timely to restore the original condition or compensate for the loss for Party As improving or adding other objects without party B“s written permission. 6. 其他 6. Others 乙方违约责任：Party B“s l

25、iability for breach 1. 乙方无法供应合同商定的机械或供应的机械型号和规格与合同不符，经甲方书面催告仍不能按时履行或供应的替代机械达不到甲方要求，导致合同无法履行的，甲方有权解除合同并要求乙方支付违约金 元。 1. Provided that Party B is unable to provide the machinery specified herein or the type and specification of the machinery provided fail to conform to the contract, and still cannot pe

26、rform it on time after party A“s written demand or the alternative machinery provided does not meet Party A“s requirements, which resulting in failure to perform the contract, Party A has the right to terminate the contract and require Party B to pay liquidated damages of Yuan RMB. 2. 乙方未按合同商定日期供应机械

27、的，每逾期一日应根据 元/日的标准向甲方支付拖延履行违约金。凡逾期满 日的，甲方有权解除合同并要求乙方支付违约金。但甲方未预付进出场费或保证金的，无权要求乙方支付逾期交付违约金。 2. Where Party B fails to provide the machinery on the date specified herein, it shall pay Party A liquidated damages for each day of late performance at the rate of Yuan RMB/day. Provided that the overdue deli

28、very for more than days, Party A has the right to terminate the contract and require Party B to pay liquidated damages. However, where Party A has not paid the entry and exit fees or security deposit in advance, shall not be entitled to require payment of the liquidated damages for overdue payment. 3. 在合同期间因乙方缘由（包括乙方指派的操作、维护人员的行为，但乙方根据合同商定对机械进展修理保养的时间除外）导致机械停工的，每停工一天，甲方除扣减相应租金外，可要求乙方支付相当于该机械日租金 %的违约金。凡停工超过 日的，甲方有权解除合同并向乙方追偿损失。 3. Provided that the machinery suspend or shutdown during the contract period for reasons attributable to Party B (including the actions of the operators and m.
