3、oming into force on February 1, 2023)（2022年12月22日，工业和信 息化部令第58号公布，自2023 年2月1日起施行。）Article X For the purposes of regulating industrial energy conservation supervision, promoting enterprises energy conservation and improvement of energy utilization efficiency, accelerating green and low-carbon develop

4、ment and promoting carbon dioxide peaking and carbon neutrality in industrial fields, these Measures are developed in accordance with the Energy Conservation Law of the Peoples Republic of China and other relevant laws and administrative regulations.第一条 为了规范工业节能 监察，促进企业节约能源和提高 能源利用效率，加快绿色低碳发 展，推动工业领

5、域碳达峰碳中 和，根据中华人民共和国节约 能源法等有关法律、行政法 规，制定本办法。应当制作现场监察笔录，如实记 录监察时间、地点、内容、参加 人员、过程等事项，经被监察单 位核对无误后签字或者盖章确 认。被监察单位拒绝确认的，由 2名以上工业节能监察人员在现 场监察笔录中注明。第十八条实施书面监察， 应当以书面形式告知被监察单位 监察的依据、内容，列明被监察 单位需报送资料的名称、内容、 时间和其他要求等。第十九条实施书面监察， 发现被监察单位所报材料不完整 或者存在疑问的，应当要求被监 察单位补充或者书面说明；发现 所报材料存在隐瞒事实、弄虚作 假等行为的，应当实施现场监 察。第二十条实施

6、工业节能监 察，发现被监察单位有违反节能 管理有关法律、法规、规章以及 强制性国家标准的行为，依法应 当给予行政处罚的，按照中华 人民共和国节约能源法中华on-site transcripts shall be made to faithfully record the time, places, content, participants, process and other matters concerning the supervision, and be confirmed by the supervisees with their signatures or seals after

If any supervisee refuses to make confirmation, two or more industrial energy conservation supervisors shall indicate it in the on-site supervision transcripts.Article 18 When written supervision is conducted, a supervisee shall be notified in writing of the basis and content

8、 of supervision, and the names and content of the materials that need to be submitted by the supervisee, time of submission, and other requirements, among others, shall be listed.Article 19 If it is found during written supervision that the materials submitted by a supervisee are incomplete or there

9、 is any doubt about such materials, the supervisee shall be required to make supplements and give written explanations. In case of any concealment of facts or falsification, among others, in the materials submitted, on-site supervision shall be conducted.Article 20 Where it is found during industria

10、l energy conservation supervision that a supervisee commits any violation of laws, regulations or rules or compulsory national standards on energy conservation administration and shall be subject to administrative punishment in accordance with the law, it shall be handled in accordance with theEnerg

11、y Conservation Law of the Peoples Republic of China, the Administrative Punishment Law of the Peoples Republic of China, and other relevant laws, regulations and rules.Where any administrative punishment is imposed on a supervisee in accordance with the provisions of the preceding paragraph, the sup

12、ervisee shall be ordered to take corrective action or correct the illegal act during a specified period.Article 21 Where it is found during industrial energy conservation supervision that a supervisee commits any violation of laws, regulations or rules or compulsory national standards on energy cons

13、ervation administration but is not required to be subject to administrative punishment in accordance with the law, the supervisee shall be educated and ordered to take corrective action or correct the illegal act during a specified period.人民共和国行政处罚法以及其 他相关法律、法规、规章的规定 处理。依据前款规定给予被监察单位行 政处罚的，应当责令被监察单位

14、 改正或者限期改正违法行为。第二十一条实施工业节能 监察，发现被监察单位有违反节 能管理有关法律、法规、规章以 及强制性国家标准的行为，但依 法可以不予行政处罚的，应当对 被监察单位进行教育，责令被监 察单位改正或者限期改正违法行 为。第二十二条限期改正违法 行为的期限一般不超过6个月。 确需延长改正期限的，经被监察 单位申请和工业节能监察部门或 者受委托实施工业节能监察的组 织批准，可以延长3个月。法 律、法规、规章另有规定的，从 其规定。Article 22 A specified period for correcting an illegal act shall generally n

If it is truly necessary to extend the correction period, the period may be extended by three months upon request by the supervisee and upon approval by the industrial energy conservation supervision department or the organization entrusted with the industrial energy conservati

16、on supervision, except as otherwise provided for by any law, regulation or rule.Article 23 Where it is found during industrial energy conservation supervision any unreasonable energy utilization by a supervisee, which, however, does not violate laws, regulations, rules, and compulsory national stand

17、ards on energy conservation administration, the supervisory opinions on reasonable energy utilization shall be offered to the supervisee in accordance with the law.Article 24 Industrial energy conservation supervision departments shall strengthen the building of industrial energy conservation superv

18、ision capabilities, and improve industrial energy conservation supervision systems.Article 25 Industrial energy conservation supervision departments shall strengthen interdepartmental interaction, and develop in an overall manner annual work plans for industrial energy conservation supervision.第二十三条

19、实施工业节能 监察，发现被监察单位有不合理 用能行为，但未违反节能管理有 关法律、法规、规章以及强制性 国家标准的，应当依法向被监察 单位提出合理用能的监察意见。第二十四条工业节能监察 部门应当加强工业节能监察能力 建设，健全工业节能监察体系。第二十五条工业节能监察 部门应当加强部门联动，统筹制 定工业节能监察年度工作计划。在同一年度内对同一被监察单位 的同一监察事项，不得重复实施 工业节能监察，但确认被监察单 位落实监察意见、改正违法行 为，以及查处违法案件等原因实 施的工业节能监察除外。法律、 法规、规章另有规定的，从其规 定。It is not allowed to conduct re

20、peated industrial energy conservation supervision of a supervisees same matter under supervision within the same year, except that the industrial energy conservation supervision is conducted for the confirmation of the supervisees implementation of supervision opinions or correction of any illegal a

21、ct, investigation and handling of any case on a violation of laws, or other reasons. Where there are other provisions in any law, regulation or rule, such provisions shall prevail.Article 26 Industrial energy conservation supervision departments and the organizations entrusted with industrial energy

22、 conservation supervision shall record the whole process of industrial energy conservation supervision in the forms of texts or video recordings, among others, and archive and preserve them in accordance with relevant provisions issued by the state.Article 27 Industrial energy conservation supervisi

23、on departments and the organizations entrusted with industrial energy conservation supervision and their staff members, as well as other institutions and personnel participating in industrial energy conservation supervision shall keep confidential the state secrets, trade secrets and personal privac

24、y information to which they have access during industrial energy conservation supervision in accordance with the law.Article 28 Any industrial energy conservation supervisor who abuses his or her power, neglects his or her duties, or practices favoritism or makes falsification for personal gains dur

25、ing industrial energy conservation supervision shall be held criminally liable in accordance with the law; and if the act is not criminally punishable, he or she shall be subject to disciplinary action in accordance with the law.第二十六条工业节能监察 部门、受委托实施工业节能监察 的组织应当以文字、录像等形 式，对工业节能监察进行全过程 记录，并按照国家有关规定归档

26、保存。第二十七条工业节能监察 部门、受委托实施工业节能监察 的组织及其工作人员，以及其他 参加工业节能监察的机构、人 员，对在工业节能监察中知悉的 国家秘密、商业秘密或者个人隐 私信息，应当依法予以保密。第二十八条工业节能监察 人员在工业节能监察中滥用职 权、玩忽职守、徇私舞弊构成犯 罪的，依法追究刑事责任；不构 成犯罪的，依法给予处分。第二十九条本办法自2023 年2月1日起施行。Article 29 These Measures shall come into force on February 1, 2023.14第二条本办法所称工业节 能监察，是指工业节能监察部门 依法对工业和信息化领

27、域能源生 产、使用、服务等相关企业、机 构执行节能管理有关法律、法 规、规章以及强制性国家标准情 况进行监督检查，查处违法用 能，提出依法用能、合理用能建 议的行为。第三条工业和信息化部负 责全国工业节能监察工作，组织 制定和实施全国工业节能监察年 度工作计划，加强全国工业节能 监察的指导和统筹协调。县级以上地方人民政府工业和信 息化主管部门或者县级以上地方 人民政府确定的其他管理工业节 能监察的部门负责本行政区域内 工业节能监察，制定和实施本行 政区域内工业节能监察年度工作 计划。Article 2 For the purpose of these Measures, industrial

28、energy conservation supervision” means industrial energy conservation supervision departments* legal supervisory inspection of the implementation of the laws, regulations and rules and compulsory national standards on energy conservation administration by energy production, utilization, service and

29、other relevant enterprises in the field of industry and information technology, investigation and punishment of illegal energy utilization, and provision of suggestions on legal and rational energy utilization.Article 3 The Ministry of Industry and Information Technology shall be responsible for ind

30、ustrial energy conservation supervision nationwide, organize the development and implementation of the annual work plans fbr industrial energy conservation supervision nationwide, and strengthen the guidance and overall coordination of industrial energy conservation supervision nationwide.The depart

31、ments of industry and information technology of the local peoples governments at or above the county level or other industrial energy conservation supervision administrative departments determined by the local peoples governments at or above the county level shall be responsible for industrial energ

32、y conservation supervision within their respective administrative regions, and develop and implement the annual work plans for industrial energy conservation supervision within their respective administrative regions.The Ministry of Industry and Information Technology, the departments of industry an

33、d information technology of the local peoples governments at or above the county level, and other industrial energy conservation supervision administrative departments determined by the local peoples governments at or above the county level are collectively referred to as industrial energy conservat

34、ion supervision departments.工业和信息化部、县级以上地方 人民政府工业和信息化主管部 门、县级以上地方人民政府确定 的其他管理工业节能监察的部 门，统称工业节能监察部门。Article 4 Industrial energy conservation supervision shall be conducted under the principles of legality, openness, fairness, impartiality and efficiency.第四条工业节能监察遵循 依法、公开、公平、公正和效能 原则。No fees shall be

35、charged from the supervisees for conducting industrial energy conservation supervision.工业节能监察不得向被监察单位 收取费用。Article 5 Supervisees shall support industrial energy conservation supervision, faithfully explain the circumstances, and provide relevant materials; and shall not conceal or fabricate facts, f

36、orge, conceal, destroy or tamper with relevant materials, or refuse or obstruct industrial energy conservation supervision.第五条被监察单位应当配 合工业节能监察，如实说明情 况，提供有关资料，不得隐瞒、 虚构事实，不得伪造、隐匿、销 毁、篡改有关资料，不得拒绝和 阻碍工业节能监察。Article 6 Industrial energy conservation supervision departments may, in accordance with the prov

37、isions of laws, regulations and rules, entrust in writing the organizations that meet the conditions as prescribed by laws with the industrial energy conservation第六条工业节能监察部门 可以依据法律、法规、规章的规 定，在其法定权限范围内书面委 托符合法律规定条件的组织实施 工业节能监察。supervision within the scope of their statutory powers.The entrusted organ

38、izations shall, within the scope of entrustment, conduct industrial energy conservation supervision in the name of the entrusting departments, and report the information on industrial energy conservation supervision to the entrusting departments in a timely manner; and shall not entrust other organi

39、zations or individuals with the industrial energy conservation supervision.受委托组织应当在委托范围内以 委托部门的名义实施工业节能监 察，及时向委托部门报告工业节 能监察情况；不得再委托其他组 织或者个人实施工业节能监察。The entrusting departments shall strengthen the supervision over the entrusted organizations* implementation of industrial energy conservation supervis

40、ion.委托部门应当加强对受委托组织 实施工业节能监察的监督。Article 7 Industrial energy conservation supervision shall be conducted by two or more industrial energy conservation supervisors who have obtained administrative law enforcement qualifications.第七条工业节能监察应当 由2名以上取得行政执法资格的 工业节能监察人员实施。Article 8 Where any industrial energy

41、 conservation supervisor has a direct interest relationship or any other relationship with the supervisee, which may affect the impartial supervision, the supervisor shall disqualify himself or herself.第八条工业节能监察人员 与被监察单位有直接利害关系或 者有其他关系可能影响公正监察 的，应当回避。If the supervisee considers that any energy conse

42、rvation supervisor has a direct interest relationship or any other relationship with the supervisee, which may affect the impartial supervision, it shall have the right to apply for the supervisors disqualification.被监察单位认为工业节能监察人 员与被监察单位有直接利害关系 或者有其他关系可能影响公正监 察的，有权申请回避。第九条工业节能监察部 门、受委托实施工业节能监察的 组织，因

43、工业节能监察需要，可 以聘请第三方机构或者有关专家 开展工业节能监察辅助工作。从事工业节能监察辅助工作的机 构、人员，不得独立开展工业节 能监察。（一）执行单位产品能耗限额， 用能产品、设备能源效率等强制 性国家标准情况；（二）执行落后的耗能过高的用 能产品、设备和生产工艺淘汰制 度情况；（三）加强能源计量管理情况;（四）建立能源消费统计和能源 利用状况分析制度情况；Article 9 Industrial energy conservation supervision departments and the organizations entrusted with the implement

44、ation of industrial energy conservation supervision may, as needed for industrial energy conservation supervision, engage third-party institutions or relevant experts to conduct the auxiliary work of industrial energy conservation supervision.Institutions and personnel engaging in the auxiliary work

45、 of industrial energy conservation supervision shall not independently conduct industrial energy conservation supervision.工业节能监察包括Article 10 Industrial energy conservation 第十条 supervision shall include the following:下歹U内容：(1) Implementation of compulsory national standards on quotas for energy consu

46、mption per unit product, and the energy efficiency of energy using products and equipment, among others.(2) Implementation of rules for the elimination of outdated and highly energy-consuming, energy using products, equipment and production techniques.(3) Enhancement of energy measurement management
