7、on & Labor Condition1、甲方根据国家有关安全生产、劳动保护、职业卫生的规定，为乙方提供必要的工作条件和 劳动保护设施，保障乙方的安全与安康；According to the related stipulation of safety manufacture/labor protection/occupational health from the state, Party A provides necessary working condition and labor protection facilities, insuring Party B s safety and

8、health.2、甲方根据国家有关规定制定工时制度，乙方确因生产经营需要延时的，甲方应当依法安排 乙方补休或支付相应的加班费；假设乙方实行的是级别工资，则在当月的绩效考核中表达； According to the relevant regulations of working hour system, if Party Bneeds to extend the working hours due to the need of production and operation, party A shall arrange party B compensatory time off or pay

12、 compensation management by thecompany五、社会保险 Social Insurance甲方应按照国家有关社会保险的法律、法规和政策为乙方缴纳 基本养老、基本医疗、失业、工伤、生育保险费用；社会保险费个人缴纳局部，甲方从乙方工资中代扣代缴。In accordance with national laws, regulations and policies relating to social insurance, Party A shall pay the basic pension, basic medical, unemployment, work inj

17、act with mutual agreement.二乙方有以下情形之一的）甲方可以即行解除劳动合同：Of any of the following circumstances, party Am ay immediately terminate the labor contract.1、在试用期内被证明不符合录用条件的；Been proven not to meet the conditions of employment during the trial period.2、采取欺诈手段订立本合 同 的；Adopted fraudulent means to enter into this

23、照企业破产 法规定进展重 整的；Party A restructured pursuant to the Enterprise Bankruptcy Law2、甲方生产经营发生严重困难的；Production and businessoperation of Party Amet serious difficulties.3、甲方转产、重大技术革新或者经营方式调整，经变更劳动合同后，仍需裁减人员的； production, technological innovation or business method of Party A adjusted, after the change of l

25、tract.1、在本单位患职业病或者因工负伤并被确认丧失或者局部丧失劳动能力的；Injureddue to occupational disease or work-related reasons, and was confirmed as having lost or partially lost the ability to work.2、患病或者非因工负伤，在规定的医疗期内的；Illness or non-work related injury within the prescribed period of medical treatment.3、女职工在孕期、产期、哺乳期 的；wome

26、n workers in pregnancy, childbirth, breastfeeding.4、在本单位连续工作满十五年，且距法定退休年龄缺乏五年的；Worked continuously for 15 years and less than five years away from his legal retirement age In this unit.5、法律、行政法规规定的其他情形。Other circumstances stipulated by laws and administrative regulations.六乙方解除劳动合同，应当提前三十日试用期内提前三日以书面

29、付工资报酬的；Party A failed to pay wages in accordance with the labor contract.5、法律、行政法规规定劳动者可以解除劳动合同的其他情形。Other circumstances stipulated by laws, administrative regulations by which employee may terminate the labor contract.九、劳动 合同的 终止 Termination of labor contracts一有以下情形之一的，劳动合同即行终止：0f any of the follow

31、as declared bankrupt by the peoples court5、甲方被撤消营业执照、责令关闭、撤销或者提前解散的；Business license of Party B was revoked, ordered to close, cancellation or early dissolution of.6、法律、行政法规规定的其他情形。Other circumstances stipulated by laws, administrative regulations.二乙方应在劳动合同期满前30天通知甲方，甲方同意续订，乙方应及时申请办理续订手 续；假设甲方不同意续订，

32、到期即办理终止合同手续。乙方未办理终止合同手续而离职的，甲方 保存追究其法律责任的权利。Party B shall give notice to inform Party A torenew the labor contract ahead of 30 days. 33、al responsibility.十、违反劳动合同的责任 Breach of duty of the labor contract一赔偿经济损失 Compensation for economic losses甲方有以下情形之一，给乙方造成经济损失的，应当承当赔偿责任：Of any the following circumstances, party A shall be liable for compensation of the economic losses of party B.1 由于甲方制定的劳动合同条款无效的；Since Labor Party established the

34、terms of the invalid contract;2、违反劳动合同法规定的条件解除劳动合同的。Conditions in violation of the provisions of theLabor Contract Law to terminate the labor contract.乙方有以下情形之一，给甲方造成经济损失的，还应当承当赔偿责任：Of any the following circumstances, party Bshall be liable for compensation of the economic losses of party A.1、乙方违反劳动

35、合同法规定的条件或者劳动合同的约定解除劳动合同，给甲方造成经 济损失的，应当按照损失的程度，承当赔偿责任；Party B violated the conditions in the Labor Contract Law or terminated the labor contract to cause the economic losses of party A,Party Bshall be liable for compensation of the economic losses of party A.2、乙方违反劳动合同约定的保密事项，给甲方造成经济损失的，应当依法承当赔偿责任； C

36、onfidential matters Party violations of labor contract, causing economic losses to the Party shall be liable for compensation according to law.3、乙方在合同期内严重违反甲方的有关规章制度、操作规程给甲方造成损失或致甲方聘用 的其他劳动者人身损害的，由乙方根据责任的大小负责赔偿。In the contract period, if Party Bcaused serious violations of relevant rules and regulat

40、he confidentiality period, and breach of contract and non-compete clause.三假设乙方在甲方是从事过管理、经营、技术工作的，在离开甲方两年以内，不得在本 行业内其它企业工作，不得泄露甲方的生产、经营秘密；If Party B is engaged in the management, operation, technical work. After leaving the party in less than two years, Party B can not work in other companies in this

41、 industry, and shall not divulge production, business secrets of Party A.四劳动合同依法解除或终止时，乙方应当归还甲方的保密资料。When the labor contract was cancelled or terminated, Party B shall return confidential information十二、劳动争议处理 Labor dispute settlement本合同发生劳动争议，甲乙双方应本着平等友好原则协商解决，假设协商不成，乙方可以向 甲方所在地劳动争议仲裁委员会申请仲裁。For the

43、visions of the State and Party, does not require consultation by both parties二乙方已确认熟悉甲方的劳动纪律、操作规程、管理制度，按甲方的保密规定保守甲方 秘密，相关纪律、操作规程、管理制度作为本合同附件，由甲方保存；Party B has confirmed labor discipline, procedures, management systems, according to the confidentiality provisions of the conservative Party A.Secrets r
