6、hird time in accordance with the Decision of the General Administration of CustomsArticle 27 Where any entity or individual commits smuggling in violation of these Measures or violates the provisions on customs supervision, the customs house shall deal with himor her according to the Customs Law of

7、the Peoples Republic of China and the Regulation of the Customs of the Peoples Republic of China on the Implementation of Administrative Punishments. Where a crime is constituted, it or he shall be subject to criminal liability.第二十七条违反本办法规 定，构成走私或者违反海关监管 规定行为的，由海关依照中华 人民共和国海关法和中华人 民共和国海关行政处罚实施条 例的有关

8、规定予以处理；构成 犯罪的，依法追究刑事责任。Article 28 The documents as prescribed in these Measures shall be developed and issued by the General Administration of Customs separately.第二十八条本办法所规定 的文书由海关总署另行制定并且 发布。Article 29 The power to interpret these Measures shall remain with the General Administration of Customs.第二十

9、九条 本办法由海关 总署负责解释。Article 30 These Measures shall become effective as of March 1, 2004. The Measures of the Customs of the Peoples Republic of China for the Supervision of the Import and Export Containers and the Goods Carried Therein (No.699 1983 of the General Administration of Customs) implemented

10、 as of January 1, 1984 and the Administrative Measures of the Customs of the Peoples Republic of China for the Examination and Approval of Plates for International Containers Used for the Transport of Goods under Customs Seals (No.566 1986 of the General Administration of Customs) implemented as of

11、July 22, 1986 shall be simultaneously repealed.第三十条本办法自2004 年3月1日起施行。1984年1月 1日施行的中华人民共和国海 关对进出口集装箱和所载货物监 管办法（83）署货字第699 号）、1986年7月22日施行的 中华人民共和国海关对用于运 输海关加封货物的国际集装箱核 发批准牌照的管理办法（86）署货字第566号）同时 废止。10第一章总则第一条为规范海关对用于 装载海关监管货物的集装箱和集 装箱式货车车厢的监管，根据 中华人民共和国海关法第三 十九条规定，制定本办法。第二条用于装载海关监管 货物的集装箱和集装箱式货车车 厢（以下

12、简称“集装箱和集装箱 式货车车厢”），应当按照海关 总署规定的要求和标准制造、改 装和维修，并在集装箱和集装箱 式货车车厢指定位置上安装海关 批准牌照。第三条本办法下列用语的 含义：“营运人”是指对集装箱和集装 箱式货车车厢实际控制使用者， 不论其是否为该集装箱或者集装 箱式货车车厢的所有人。“承运人”是指承载集装箱和集 装箱式货车车厢进出境的运输工 具的负责人。“申请人”是指申请办理海关批to Amend Some Rules by Order No. 262 of the General Administration of Customs of the Peoples Republic o

13、f China on March 9, 2023)Chapter I General ProvisionsArticle 1 These Measures are enacted according to Article 39 of the Customs Law of the Peoples Republic of China for the purpose of regulating the supervision over containers and carriages of container cars used for the transport of the goods unde

14、r customs supervision.Article 2 The containers and carriages of container cars used for the transport of the goods under customs supervision (hereinafter referred to as containers and carriages of container cars) shall be manufactured, modified or repaired according to the requirements and standards

15、 as prescribed by the General Administration of Customs, and customs approval plates shall be affixed to the designated locations of containers and carriages of container cars.Article 3 The definitions of the following terms as used in these Measures:The “operator refers to the actual controller and

16、 user of a container or carriage(s) of container car, no matter whether it is the owner of the container or carriage(s) of container car.The ycarrier” refers to the person in charge of a transport vehicle that carries containers and carriages of container cars into or out of the territory of China.T

18、工具名 称、航（班）次号或者集装箱式 货车车牌号、国籍、卸货港口， 集装箱箱号或者集装箱式货车车 厢号、尺寸、总重、自重，以及 箱（厢）体内装载货物的商品名 称、件数、重量，经营人、收发 货人、提（运）单或者装货单号 等有关内容。Article 6 An operator or its agent shall, according to the customs provisions, transmit the electronic data on cargo manifest (manifest) to the customs office.第六条营运人或者其代理 人应当按照海关规定向海关传输

Containers or carriages of container cars that do not meet the standards as prescribed by the General Adminis

20、tration of Customs or have not been affixed with customs approval plates shall not be used for the transport of the goods under customs supervision.The factories that manufacture, modify or repair containers and carriages of container cars within the territory of China shall be subject to customs in

21、spection.Article 5 When a transport vehicle carrying containers or carriages of container cars enters or exits the territory of China, its carrier or operator or the agent thereof shall faithfully declare it to the customs house and deliver a cargo manifest (manifest). A cargo manifest (manifest) sh

22、all indicate the transport vehicles name, voyage (sailing) number or container car plates, their nationality, port of discharge, number of containers or carriages of container cars, their dimensions, gross weight, bare weight; names, number of packages and quantity of goods carried in containers (ca

28、ges of container cars, alter or blot out the numbers of containers (carriages), take out or put into goods, or transfer the containers and carriages of container cars and the goods carried by them away from the places under customs supervision.Chapter II Approval of Container Manufacture第十条境内制造的集装箱

Where the owner of a co

34、ntainer manufactured abroad applies for a Chinas customs approval plate, the manufacturer or the owner shall submit the relevant drawings of the container, and China Classification Society shall issue a Certificate of Approval Granted at a Stage Subsequent to Manufacture upon examination and on-site

35、 confirmation.Article 13 An applicant for a container customs approval plate shall, after having obtained a Certificate of Approval by Design Type or a Certificate of Approval Granted at a Stage后批准证明书后，应当在经批 准的集装箱上按照本办法规定安 装中国船级社核发的海关批准牌 照，并在箱体外部规定位置标示 序列号。Subsequent to Manufacture, affix the custom

37、 The customs house may review the containers that have been checked by China Classification Society, and may check the customs approval plates handled by China Classification Society. When finding that the approval plates as issued are not properly managed, the customs house may decide whether to st

38、op its authorization to China Classification Society for issuing customs approval plates in light of the circumstances.第三章集装箱式货车车厢的制 造或者改装Chapter III Manufacture or Modification of Carriages of Container Cars第十五条海关总署授权中 国船级社统一办理在境内装载海 关监管货物的集装箱式货车车厢 的海关批准牌照。Article 15 The General Administration of C

44、准牌照。Article 17 Without approval of the customs house, no one may illegally change the structure of containers or carriages of container cars. The structure of containers or carriages of container cars shall keep unchanged after repair; if any change occurs to the container (carriage) body, the owner

45、 or the applicant of a container or carriage of container car shall remove the customs approval plate, and simultaneously file a written inspection application to China Classification Society and apply for a new customs approval plate.第十八条海关可以随时对 维修工厂维修的安装海关批准牌 照的集装箱和集装箱式货车车厢 进行核查。Article 18 The cus
