1、锅炉压力容器制造监督管理方法Supervisory Administration RegulationsFor Manufacture of Boiler and Pressure Vessel第一章 总则Chapter 1 General Provisions第1条为加强对锅炉压力容器制造的监督管理，保证锅炉压力容器产品的平安性能，保障人身财产平安，依据锅炉压力容器平安监察暂行条例的有关规定，制定本方法。Article 1 Supervisory Administration Regulations for Manufacture of Boiler and Pressure Vessel

2、(hereinafter referred to as the “Regulations)is formulated in accordance with the Provisional Regulations on Safety Supervision of Boilers and Pressure Vessels. It is formulated to enhance the supervisory administration for manufacture of boiler and pressure vessel, assure the safety performance pro

3、perty of boiler and pressure vessel products so as to assure the safety both of human life and of property.第2条在中华人民共和国境内制造、运用的锅炉压力容器，国家实行制造资格许可制度和产品平安性能强制监督检验制度。Article 2 The boiler and pressure vessel products, which are manufactured and used in the P. R. CHINA, shall be subjected to the manufactur

4、e-licensing system and mandatory supervisory inspection for their safety performance property.第3条 进出口锅炉压力容器依据中华人民共和国进出口商品检验法、中华人民共和国进 出口商品检验法实施条例及中华人民共和国进出口锅炉压力容器监督管理方法(试行)的 规定执行。其中，制造资格许可及其管理、产品平安性能监督检验依据本方法执行。Article 3 Import and export boiler and pressure vessel shall follow the stipulations of t

5、he Law of the P. R. China on Import and Export Commodity Inspection, Implementation Regulations for the Law of the P. R. China on Import and Export Commodity Inspection, and the Supervisory Administration Regulations for Import and Export Boiler and Pressure Vessel of the P. R. China (for trial use)

The qualification and administration of manufacture licensing and the supervisory inspection of the product safety performance property shall be under jurisdiction of the regulations.第4条本方法所称锅炉压力容器是指：Article 4 The terms of boiler and pressure vessel used in the Regulations are as follows:1 .锅炉 Boi

7、lers1. 承压蒸汽锅炉 Pressurized steam boilers2. 承压热水锅炉 Pressurized hot water boilers3. 有机热载体锅炉Organic fluid boilersA boiler manufacturer can produce any boilers with the Grades equal to or lower than its licensing Grade.3 .持有C级及其以上级别许可证的锅炉制造企业，可以制造有机热载体锅炉，对于只制 造有机热载体锅炉的制造企业，应申请有机热载体锅炉单项制造资格，不须要定级别。 The ma

8、nufacturers with manufacture license of Grade C or higher than Grade C can produce organic fluid boilers. For those manufacturers, that solely produce organic fluid boilers, may apply for the qualification of manufacture license for organic fluid boiler only and no Grade classification of manufactur

9、e licensing is needed.4 .对于产品种类较单一的制造企业，可对其许可范围进行限制，如限部件、材质、品种 等。For those manufacturers only producing rather single products, may give some limitation to their licensing scope such as parts, materials or category of product, etc.5 .持证锅炉制造企业可以制造与相应级别锅炉配套的分汽缸、分水缸。Manufacturer may produce the parts,

10、assembles to be fitted up to the same Grade boiler in its licensing scope, such as, steam distribution cylinder or water distribution cylinder.二、压力容器制造许可级别划分Classification for manufacture Licensing of Pressure Vessels级别制造压力容器范围代表产品A超高压容器、高压容器（A1）；第三类低、中压容器（A2）；球形储罐现场组焊或球壳板制造（A3）；非 金属压力容器（A4）；医用氧舱（A5

11、）A1应注明单层、锻焊、多层包扎、 绕带、热套、绕板、无缝、锻造、 管制等结构形式B无缝气瓶（B1）；焊接气瓶（B2）；特种气瓶（B3）B2注明含（限）溶解乙焕气瓶或 液化石油气瓶。B3注明机动车 用、缠绕、非重复充装、真空绝 热低温气瓶等C铁路罐车（C1）；汽车罐车或长管拖车（C2）；罐式 集装箱（C3）；D第一类压力容器（D1）； 其次类低、中压容器（D2）GradeManufacturing scopeTypical ProductsAUltrahigh pressure vessels(AI); Category III pressure vessels with low- or me

15、pressure vessels shall be in accordance with Safety Technical Supervision Code of Pressure Vessel.2 .超高压容器：设计压力大于及等于100MPa的压力容器；高压容器：设计压力大于及等于10MPa且小于100MPa的压力容器；中压容器：设计压力大于及等于1.6MPa且小于10MPa的压力容器；低压容器：设计压力大于及等于0.1 MPa且小于1.6MPa的压力容器。Extra-high pressure vessel: pressure vessels with design pressure hi

17、higher or equal to 0.1 MPa and less than 1.6MPa.3 .按分析设计标准设计的压力容器，其制造企业应持有A或C级许可证。4 . For pressure vessels designed by analysis, the manufacturer shall have manufacture license with Grade A or Grade C.5 .球体板制造项目含直径大于及等于1800mm各类型封头。Fabrication of petals for spherical tank including the various kinds

18、of heads with diameter bigger or equal to 1800mm.6 .对于产品种类单一的制造企业、应对其许可范围进行限制，如限制产品或制造方法、 材质、种类、用途等。For the manufacturers producing rather single products, their licensing scope shall be restricted such as give the limitation of their products or manufacturing process, material, types or use.附件2：锅炉压

22、the product of pressure and volume not less than 2.5 MPa-L2 .公称工作压力大于及等于0.2Mpa(表压),且压力与容积的乘积大于及等于1.0MPa1 的盛装、液化气体和标准沸点低于60液体的各种气瓶；All kinds of pressure vessels loading gas, liquefied gas and liquid with standard boiling point less than 60; the maximum working pressure no less than 0.2Mpa (gage press

23、ure) and the product of pressure and volume is not less than 1.0 Mpa.3 . 医用氧舱 Oxygen cabins used for medical treatment.本方法不适用于船舶、铁路机车、航空器、军事装备和核设施中运用的锅炉压力容器 以及额定热功率小于0.1MW且输出热水温度低于及等于90的电或燃气加热热水器。 The Regulations are not applicable to the boilers and pressure vessels, which are used in boats, locomo

24、tives, air crafts, military equipment, nuclear devices and the electric heated or gas fueled hot water heaters with rated thermal power less than 0.1 MW and the output hot water temperature no higher than 90.第5条国家质量监督检验检疫总局(以下简称国家质检总局)负责本方法所规定的锅炉压力容 器制造的监督管理工作;地方各级质量技术监督部门负责本行政区域内的锅炉压力容器制造的监 督管理工作。国

25、家质检总局和地方各级质量技术监督部门内设的锅炉压力容器平安监察机构(以 下简称平安监察机构)负责本方法的详细实施。Article 5 General Administration of Quality Supervision, Inspection and Quarantine of the Peoples Republic of China (hereinafter referred to as the “AQSIQ)is in charge of the supervisory administration for the manufacture of boiler and pressur

26、e vessel as stipulated in the regulations.All levels of local quality technical supervision organizations (hereinafter referred to as the “local QTSO) are in charge of the supervisory administration for manufacture of boiler and pressure vessel under their jurisdiction. The safety supervision sectio

27、ns of boiler and pressure vessel under AQSIQ or local QTSO are responsible to the implementation of the regulations, (hereinafter referred to as the safety supervision sections55)第二章 制造许可Chapter 2 Manufacture Licensing第6条境内制造、运用的锅炉压力容器，制造企业必需取得中华人民共和国锅炉压力容器制 造许可证(以下简称制造许可证)。未取得制造许可证的企业，其产品不得在境内销售、 运

28、用。Article 6 For the boilers and pressure vessels manufactured and used in P. R. China, the manufacturer shall obtain the boiler and pressure vessel manufacture license of the P. R. China. (Hereinafter referred to as the manufacture license). The products produced by the manufacturers having not achi

29、eved the manufacture license shall not be sold and used in the P. R. China.第7条 锅炉和压力容器依据附件一的规定，划分为A、B、C、D 4个制造许可级别。D级锅炉和D级压力容器的制造许可证，由制造企业所在地的省级质量技术监督部门颁发， 其余级别的制造许可证由国有质检总局颁发；境外企业制造的用于境内的锅炉压力容器，其 制造许可证由国家质检总局颁发(以下统一简称发证部门)。Article 7 In accordance to the stipulations in attachment 1, the boilers and

30、 pressure vessels are divided into four manufacture licensing grades i.e. Grade A, B, C and D.The domestic manufacture license for Grade D boiler and Grade D pressure vessel is issued by province-level QTSO where the manufacturer locates, for the rest three Grade, the manufacture licenses shall be i

31、ssued by AQSIQ. The manufacturer license for the manufacturers out of the mainland of China, who produce any grades of boilers and pressure vessels to be used in the P. R. China, shall be issued by AQSIQ. (Hereinafter referred to as license-issuing organizations as their general designation)制造许可证式样见

32、附件二。Attachment 2 is a sample of the manufacture license.第8条锅炉压力容器制造企业必需具备以下条件：Article 8 The prerequisite to boiler and pressure vessel manufactures is as follows:I .具有企业法人资格或已取得所在地合法注册；Being a corporate organization or a legal organization registered in the local government;II .具备与制造产品相适应的生产场地、加工设备、

33、技术力气、检测手段等条件；Having production site, processing equipment, technical expertise, and inspection and testing devices suitable to producing its boiler and pressure vessel;III .建立质量保证体系，并能有效运转；Establishing and maintaining a quality assurance system and implementing the system effectively;IV .保证产品平安性能符合国

34、家平安技术规范的基本要求。Assuring the safety performance property of its products in accordance to the basic requirements of national safety-technical standards.详细条件和要求依据锅炉压力容器制造许可条件的规定执行。The concrete requirements shall be followed in accordance to the stipulations as specified in the Requirements for Boiler an

35、d Pressure Vessel Manufacture-Licensing.第9条申请取证的制造企业应向发证部门的平安监察机构提出书面取证申请，并提交有关资料。平安监察机构应在接到申请和全部资料后的15个工作日内做出是否受理申请的确定。Article 9 The applicant shall submit a written application request and the relevant documents to the corresponding safety supervision section being authorized issuing license. The

36、safety supervision section should make decision whether or not the application is acceptable within15 days after having received the application request and whole documentation.第10条 制造企业取证申请被批准受理的，应依据批准范围试制产品，以备审查。两年内不能 完成产品试制的，原批准的受理失效。Article 10 The manufacturer shall make a trial-produced product

37、s within the approved scope for auditing after its application has been accepted, In the case of the manufacturer failed to complete the trail-produced products within two years, the approval of its application shall be expired.第11条 发证部门的平安监察机构或托付审查机构应在产品试制结束后，对制造企业进行工厂 检查和相应的产品检验，并出具审查报告。国家平安技术规范中规

38、定进行型式试验的产品，应在 工厂检查前进行型式试验。Article A The license-issuing organization or its authorized audit agency shall conduct a manufacturer survey and product inspection and draft a survey report after the completion of the trial-produced product. For the product which type test is required in accordance to th

39、e national safety technical standard, the type test shall be performed prior to the manufacturer survey.第12条 发证部门应对审查报告进行审核，并对审核合格的企业签发制造许可证。报告审核 和证书签发工作应在收到审查报告后25个工作日内完成。Article 12 The license-issuing organization shall review the survey report and issue the manufacture license to the manufacturer

40、 if the survey results are acceptable. The review and issuance of manufacture license shall be completed within 25 days from the receipting date of the survey report.取证申请未被受理或受理后经审查不合格的制造企业，1年内不得提出取证申请。The manufacturers, who failed to make license application or failed to pass the manufacturer surve

41、y, are not allowed to submit the licensing application again within 1 year.第13条 锅炉压力容器制造许可的详细工作程序和要求，依据锅炉压力容器制造许可工作程 序的规定执行。Article 13 The procedures and requirements of boiler and pressure vessel manufacture licensing shall conform to the stipulations as specified in the Procedures for Manufacture

42、Licensing of Boiler and Pressure Vessel.第三章 许可证管理Chapter 3 Administration of License第14条 持证企业制造用于境内的锅炉压力容器，不得超出制造许可证所批准的产品范围。 Article 14 The license holder is not allowed to produce the boiler and pressure vessel products sold and used in China out of the approved scope listed in the manufacture lic

43、ense.第15条 锅炉压力容器随机文件中应附有制造许可证复印件。产品铭牌上应标注与制造 许可证一样的制造企业名称和编号。产品随机文件中的产品质量合格证书、产品安装和运用说 明书必需有中文表述。Article 15 Each boiler and pressure vessel product shall attach to a copy of manufacture license on delivery. The name of manufacturer and serial number marked on the product nameplate shall be in accord

44、ance to the name and serial number on the manufacture license. The certificate of compliance and installation and operation manual of the product in the attached documents shall have Chinese version.第16条 发证部门的平安监察机构和制造企业所在地平安监察机构应按规定对制造企业的证书 运用、生产条件、产品质量状况及其管理等状况进行检查。制造企业必需接受检查。Article 16 The safety

45、 supervision section in the license-issuing organization and the local safety supervision section at the manufacturers location should supervise the use of license, manufacturing condition, product quality and its management of the license holder. The manufacturer must accept the supervision.第17条 持证

46、企业不得涂改、转让、转借制造许可证。Article 17 Any alter, alienation or subtenancy of manufacture-license is forbidden.第18条制造许可证有效其为4年。申请换证的制造企业必需在制造许可证有效期满6 个月以前，向发证部门的平安监察机构提出书面换证申请，经审查合格后，由发证部门换发制 造许可证。Article 18 The valid period of manufacture-license is 4 years. A written application for license renewal shall be

47、 submitted to the safety supervision section of license-issuing organization at least 6 months prior to the expiry date of the license if the license holder wants to continuously maintain its validation. If the license holder is qualified the requirements for license renewal, the license-issuing org

48、anization will issue a new license.未按时提出换证申请或因审查不合格不予换证的制造企业，在原证书失效后1年内不得提出新 的取证申请。For the manufacturers having not submitted license renewal application in time or failed to pass the survey for license renewal shall be not allowed to make application for manufacture-licensing within 1 year starting from the expiring date of its original license.因特别缘由不能按期换证的制造企业，可以向发证部门提出暂缓换证申请，经批准后可以暂缓, 暂缓期不超过1年。The manufacturer who can not submit its license renewal application for some special rea
