6、he second time, amended by the Decision of the General Administration of Customs to Amend Certain Rules issued by Order No. 240 of the GeneralCustoms on the clearance of exported goods.Chapter V Specially Delivered Inbound and Outbound Express ConsignmentsArticle 25 The term specially delivered inbo

7、und and outbound express consignmcnts means those express consignments carried by air by operators into or out of China in a way of special delivery under escort.Article 26 An operator that engages in the business of specially delivered inward and outward express consignments shall, in addition to u

8、ndergoing registration formalities in accordance with the applicable provisions in Chapter II of these Measures, register with the local customs office such particulars of the specially delivered inbound and outbound express consignments as the port of entry or exit, the time, route, schedule of the

9、 means of transport, detailed information on the special deliverer, and the mark. In the case of any modification, the operator shall undergo registration formalities at the local customs office five working days prior to such modification.Article 27 Specially delivered inbound and outbound express

10、consignments shall be consigned as luggage, specially packed, and marked with the name of the operator and the words of Specially Delivered Inbound and Outbound Express Consignments” on a conspicuous position of the general packing.Chapter VI Legal Liability理。AA* 第五早进出境专差快件第二十五条 进出境专差 快件是指运营人以专差押运方

11、式承运进出境的空运快件。第二十六条运营人从事 进出境专差快件经营业务，除 应当按本办法第二章有关规定 办理登记手续外，还应当将进 出境专差快件的进出境口岸、 时间、路线、运输工具航班、 专差本人的详细情况、标志等 向所在地海关登记。如有变 更，应当于变更前5个工作日 向所在地海关登记。第二十七条进出境专差 快件应按行李物品方式托运， 使用专用包装，并在总包装的 显著位置标注运营人名称和 “进出境专差快件”字样。第六章法律责任第二十八条违反本办法 有走私违法行为的，海关按照 中华人民共和国海关法、 中华人民共和国海关行政处 罚实施条例等有关法律、行Article 28 Where any smu

12、ggling act is committed in violation of these Measures, the Customs shall impose punishments on the violator in accordance with the Customs Law of the Peoples Republic of China, the Regulation of the Peoples Republic of China on theImplementation of Customs Administrative Penalties, and other applic

13、able laws and administrative regulations; and if the violation is criminally punishable, the offender shall be held criminally liable in accordance with the law.Chapter VII Supplemental ProvisionsArticle 29 The documents set forth in these Measures shall be separately formulated and issued by the Ge

16、Chapter I General Provisions第一条为加强海关对进 出境快件的监管，便利进出境 快件通关，根据中华人民共 和国海关法及其他有关法 律、行政法规，制定本办法。第二条本办法所称进出 境快件是指进出境快件运营人 以向客户承诺的快速商业运作 方式承揽、承运的进出境货 物、物品。Article 1 These Measures are formulated in accordance with the Customs Law of the Peoples Republic of China and other applicable laws and administrative

17、 regulations for the purposes of strengthening the customs supervision of inbound and outbound express consignments and facilitating the customs clearance of inbound and outbound express consignments.Article 2 For the purposes of these Measures, inbound and outbound express consignments“ means inbou

18、nd and outbound goods and articles undertaken or carried by inbound and outbound express consignment operators by means of quick commercial operations which they promise to their clients.第三条本办法所称进出 境快件运营人（以下简称运营 人）是指在中华人民共和国境 内依法注册，在海关登记备案 的从事进出境快件运营业务的 国际货物运输代理企业。Article 3 For the purposes of these

19、 Measures, inbound and outbound express consignment operators (hereinafter referred to as “operators) means the international freight forwarders engaging in the operation of inbound and outbound express consignments which are lawfully registered within the territory of the Peoples Republic of China

20、and have undergone registration or recordation formalities with the Customs.第四条运营人不得承 揽、承运中华人民共和国禁 止进出境物品表所列物品， 如有发现，不得擅作处理，应 当立即通知海关并协助海关进Article 4 No operator may undertake or carry any of the articles listed in the Form of the Peoples Republic of China on the Articles Prohibited from Entering or

23、tion on behalf of another person for any goods or articles which are not undertaken or carried by itself.第六条未经海关许可， 未办结海关手续的进出境快件 不得移出海关监管场所，不得 进行装卸、开拆、重换包装、 更换标记、提取、派送和发运 等作业。Article 6 Without the approval of the Customs, no inbound or outbound express consignment for which the customs formalities

24、have not been completed shall be moved out of the areas under customs supervision or be loaded, unloaded, opened, re-packed, marked with a sign different from the original one, drawn, dispatched, or delivered for transport.第二章运营人登记Chapter II Registration of Operators第七条运营人申请办理 进出境快件代理报关业务的， 应当在所在地海关

25、办理登记手 续。Article 7 An operator that applies for making customs declarations for inbound and outbound express consignments shall undergo registration formalities with the local customs office.第八条运营人在所在地 海关办理登记手续应具备下列 条件:Article 8 An operator that intends to register with the local customs office shall

26、 meet the following conditions:（一）已经获得国务院对外贸 易主管部门或者其委托的备案 机构办理的国际货运代理企 业备案表，但法律法规另有(1) It has obtained the Recordation Form for an International Freight Forwarder handled by the foreign trade authority of the State Council or a recordation agency authorized by it unless otherwise provided forby law

27、 or other regulations.规定的除外。(2) It has obtained the Business License for an Enterprise Legal Person issued by the administrative department for industry and commerce, and is granted approval or verified to engage in the inbound and outbound express consignments business.（二）已经领取工商行政管理 部门颁发的企业法人营业执 照，

28、准予或者核定其经营进 出境快件业务。(3) It has already undergone the recordation formalities for customs declaration enterprises with the Customs.（三）已经在海关办理报关企 业备案手续。(4) It has the domestic and overseas transportation network for inbound and outbound express consignments, as well as two or more overseas branches or a

29、gents.（四）具有境内、外进出境快 件运输网络和二个以上境外分 支机构或代理人。(5) It has special marks and transport documents exclusively for its inbound and outbound express consignments, and its transportation vehicles shall meet the customs supervision requirements and be subject to the confirmation by the Customs for recordation.

30、（五）具有本企业专用进出境 快件标识、运单，运输车辆符 合海关监管要求并经海关核准 备案。(6) It meets the conditions for customs declaration by means of the Electronic Data Interchange (EDI).（六）具备实行电子数据交换 方式报关的条件。(7) The external packing of its express consignments shall be marked with a bar code conforming to the requirements for the customs

31、* automatic inspection.（七）快件的外包装上应标有 符合海关自动化检查要求的条 形码。(8) It has concluded a cooperative transport contract or agreement with an overseas cooperator (or a branch established abroad by a domestic enterprise legal person).（八）与境外合作者（包括境 内企业法人在境外设立的分支 机构）的合作运输合同或协 议。(9) It has obtained anbusiness permit

33、e Measures or has not engaged in the operation of inbound and outbound express consignments within one year, the Customs shall cancel the registration of the operator.第三章进出境快件分类Chapter III Classification of Inbound and Outbound Express Consignments第十条 本办法将进出境 快件分为文件类、个人物品类 和货物类三类。Article 10 For the

34、purposes of these Measures, inbound and outbound express consignments are divided into three categories, namely, the documentation category, the personal effects category, and the goods category.第十一条 文件类进出境 快件是指法律、法规规定予以 免税且无商业价值的文件、单 证、票据及资料。Article 11 The term “inbound and outbound express consign

35、ments of the documentation category” means those documents, certificates, bills, and other materials that shall be exempt from tax as required by any law or regulation and are of no commercial value.第十二条 个人物品类进 出境快件是指海关法规规定自 用、合理数量范围内的进出境 的旅客分离运输行李物品、亲 友间相互馈赠物品和其他个人 物品。Article 12 The term “inbound a

36、nd outbound express consignments of the personal effects category means the luggage transported separately from passengers, articles presented between relatives or friends, and other personal effects, which are prescribed in the regulations of the Customs, to enter or leave the territory for self-us

37、e and within a reasonable scope of quantity.第十三条货物类进出境 快件是指第十一条、第十二条 规定以外的快件。Article 13 The term inbound and outbound express consignments of the goods category“ means the express consignments other than those as provided for in Articles 11 and 12.Chapter IV Supervision over Inbound and Outbound 第四章

38、 进出境快件监管Express Consignments第十四条进出境快件通 关应当在经海关批准的专门监 管场所内进行，如因特殊情况 需要在专门监管场所以外进行 的，需事先征得所在地海关同 息OArticle 14 The clearance of the inbound and outbound express consignments shall be conducted in special workplace(s) under customs supervision approved by the Customs; or if it is necessary to be conduct

39、ed outside special workplace(s) under customs supervision due to special circumstances, it shall obtain the consent of the local customs office in advance.运营人应当在海关对进出境快 件的专门监管场所内设有符合 海关监管要求的专用场地、仓 库和设备。An operator shall have its special site, warehouse and equipment conforming to the customs supervi

40、sion requirements within special workplace(s) under customs supervision for inbound and outbound express consignments.对进出境快件专门监管场所的 管理办法，由海关总署另行制 定。The measures for the administration of special workplace(s) under customs supervision for inbound and outbound express consignments shall be formulated

41、separately by the General Administration of Customs.第十五条 进出境快件通 关应当在海关正常办公时间内 进行，如需在海关正常办公时 间以外进行的，需事先征得所 在地海关同意。Article 15 The clearance of inbound and outbound express consignments shall be conducted within the normal business hours of the Customs; or if it is necessary to be conducted beyond the

42、normal business hours of the Customs, it shall obtain the consent of the local customs office in advance.第十六条进境快件自运 输工具申报进境之日起十四日 内，出境快件在运输工具离境 3小时之前，应当向海关申 报。Article 16 Inbound express consignments shall be declared to the Customs within 14 days as of the day when the means of transport was declare

43、d for entry, and outbound express consignments declared to the Customs three hours before the means of transport leaves China.第十七条运营人应向海 关传输或递交进出境快件舱单Article 17 An operator shall transmit or submit a manifest or checklist of its inbound or outbound express consignments to the Customs, and the Custom

46、pecting the inbound and outbound express consignments, the operator shall assign its employees to be present at the scene, and shall be responsible for the moving, opening and repacking of the inbound and outbound express consignments.海关对进出境快件中的个人物 品实施开拆查验时，运营人应 通知进境快件的收件人或出境 快件的发件人到场，收件人或 发件人不能到场的，

47、运营人应 向海关提交其委托书，代理收 /发件人的义务，并承担相应 法律责任。When the Customs is unpacking the personal effects in inbound and outbound express consignments for inspection, the operator shall notify the addressee of the inbound express consignments or the addresser of the outbound express consignments to be present at the

48、 scene; if the addressee or addresser is unable to be at the scene, the operator shall submit a power of attorney to the Customs to represent the addressee/addresser to perform the obligations, and assume corresponding legal liability.海关认为必要时，可对进出境 快件予以径行开验、复验或者 提取货样。The Customs may, when deeming it necessary, directly open the inbound and outbound express consignments for inspection, re-inspect them or draw samples of goods.第十九条除另有规定 外，运营人办理进出境快件报 关手续时，应当按本办法第十 一条、第十二条、第十三条分 类规定分别向海关提交有关报 关单证并办理相应的报关、纳Article 19 Unless otherwise prescribed, the operator shall, when mak
