4、ues and strengthening supervision and administration of measurement comparisons, these Measures are formulated in accordance with measurement-related laws and administrative regulations, and other relevant provisions.Article 2 These Measures apply to measurement comparisons and their supervision and

5、 administration conducted within the territory of the Peoples Republic of China.第三条本办法所称计 量比对，是指在规定条件下，对 相同准确度等级或者指定测量 不确定度范围内的同种计量基 准、计量标准以及标准物质所复 现的量值之间进行比较的过程。（-）国家市场监督管理总局 考核合格，并取得计量基准证书 或者计量标准考核证书或者标准物质定级证书的计量基准或 者计量标准或者标准物质量值 的比对（以下简称国家计量比（二）经县级以上地方市场监 督管理部门考核合格，并取得计 量标准考核证书的计量标准量 值的比对（以下简称地方计

6、量比 对）。第四条国家市场监督 管理总局负责全国计量比对的 监督管理工作，组织实施国家计 量比对。县级以上地方市场监督管理 部门在各自职责范围内负责本 行政区域内的地方计量比对的 监督管理工作。Article 3 For the purpose of these Measures, the term Measurement comparison, means a process whereby comparisons are made under prescribed conditions between the values realized based on the same measur

7、ement benchmarks, measurement standards, or reference materials with the same accuracy level or within the specified measurement uncertainty range.The measurement comparison specified in the 前款规定的计量比对包括:preceding paragraph includes:(1) comparison (hereinafter referred to as national measurement comp

8、arison) of the values of the measurement standards or reference materials that havepassed the evaluation by the State Administration for Market Regulation and obtained the certificate of measurement benchmark, the certificate of evaluation formeasurement standards, or the certificate of grading for

9、对)； reference materials; and(2) comparison (hereinafter referred to as “local measurement comparison55) of the values of measurement standards that have passed the examination by the local market regulation department at or above the county level and obtained the certificate of evaluation for measur

10、ementstandards.Article 4 The State Administration for Market Regulation is responsible for the supervision and administration of national measurement comparison and organizes the implementation of national measurement comparison.The local market regulation department at or above the county level is

11、charged with the supervision and administration of local measurement comparison within its jurisdiction.第五条市场监督管理 部门根据保证量值传递溯源体 系有效性的需要，按照统筹规 划、经济、合理的原则，实施计 量比对。第六条国家市场监督 管理总局面向社会公开征集国 家计量比对项目及主导实验室， 经专家研究论证后，确定国家计 量比对及主导实验室。国家市场监督管理总局根据 需要可直接确定国家计量比对 项目并指定主导实验室。第七条已取得国家计 量比对所涉及的计量基准证书、 计量标准考核证书或者标准

12、物质定级证书的单位，应当按照有 关规定参加国家市场监督管理 总局组织的国家计量比对。能够 提供正当理由且经国家市场监 督管理总局书面同意的除外。第八条国家计量比对 主导实验室应当具备以下条件：（一）具有独立法人资格;（二）具有的计量基准、计量 标准或者标准物质等符合计量 比对要求，并能够在国家计量比 对期间保证量值准确；Article 5 The market regulation department shall implement measurement comparison under the principles of overall planning, economy, and ra

13、tionality to ensure the effectiveness of the system for tracing values transfer.Article 6 The State Administration for Market Regulation openly solicits national measurement comparison projects and pilot laboratories from the public and determines the national measurement comparison and a pilot labo

14、ratory after expert research and demonstration.The State Administration for Market Regulation may directly determine a national measurement comparison project and designate a pilot laboratory as needed.Article 7 An entity that has obtained the certificate of measurement benchmark, the certificate of

15、 evaluation for measurement standards, or the certificate of grading for reference materials as involved in the nationalmeasurement comparison shall participate in the national measurement comparison organized by the State Administration for Market Regulation in accordance with relevant provisions,

16、unless it can provide justifiable reasons and has obtained written consent from the StateAdministration for Market Regulation.Article 8 A pilot laboratory for national measurement comparisons shall meet the following conditions:(1) Having the status of an independent legal person;(2) Having the meas

17、urement benchmarks, measurement standards or reference materials meet the requirements of measurement comparison, and being able to ensure accurate measurement values during the period of national measurement comparison;（三）能够提供满足计量溯源 性要求的准确、稳定和可靠的传 递标准或者样品；（四）具有与实施国家计量比 对工作相适应的技术人员。第九条主导实验室可 以根据需要成立

18、技术专家组。技 术专家组参与审查国家计量比 对资料，对有争议的技术问题提 出咨询意见。第十条主导实验室应 当在国家计量比对开始前进行 前期实验，包括测定传递标准或 者样品的稳定性、均匀性、重复 性、运输特性和参考值等。第十一条主导实验室 应当根据前期实验情况起草国 家计量比对实施方案，征求各参 比实验室的意见后确定，并报送 国家市场监督管理总局。国家计量比对实施方案应当 包括计量比对针对的量、目的、 方法、传递标准或者样品、路线 及时间安排、技术要求等。必要 时，也可以规定比对实验的具体 方法和不确定度评定方法或者 限定比对结果的不确定度范围。(3) Being able to provide

19、 accurate, stable, and reliable transfer standards or samples that meet the requirements of measurement traceability; and(4) Having technical personnel who fit in with the implementation of national measurement comparison.Article 9 The pilot laboratory may set up a panel of technical experts as need

20、ed. The panel of technical experts participates in the review of data on national measurement comparison and gives advice on controversial technical issues.Article 10 The pilot laboratory shall conduct preliminary experiments before the start of a national measurement comparison, including the measu

21、rement of the stability, uniformity, repeatability, transportation characteristics, and reference values of transfer standards or samples.Article 11 The pilot laboratory shall draft the implementation plan for national measurement comparison according to the previous experiments, finalize it after s

22、oliciting opinions from participating laboratories, and submit it to the State Administration for Market Regulation.The implementation plan of national measurement comparison shall include the quantity, purpose, method, transfer standards or samples, route and time arrangement, and technical require

23、ments for measurement comparison. When necessary, the specific method of comparison experiment and the evaluation method of uncertainty may also be specified, or theuncertainty range of comparison results may be limited.Article 12 The pilot laboratory and participating laboratories shall carry out n

24、ational measurement comparison according to the relevant technical specifications for national measurement and the implementation plan for national measurement comparison.第十二条 主导实验室 和参比实验室应当按照有关国 家计量技术规范，根据国家计量 比对实施方案开展国家计量比 对。Article 13 After a national measurement comparison is completed, particip

25、ating laboratories shall submit the results of the national measurement comparison to the pilot laboratory within the time specified in the implementation plan for national measurement comparison, and be responsible for the authenticity of the materials submitted.第十三条国家计量比 对完成后，各参比实验室应当在 国家计量比对实施方案规

26、定的 时间内，将国家计量比对结果提 交主导实验室，并对所报送材料 的真实性负责。The materials about the results of national国家计量比对结果材料应当measurement comparison shall include:包括：(1) photocopies of the data on national measurement comparison. If the data are deleted, the traces of deletion shall be kept;（一）国家计量比对数据复印 件，数据有删改的，应当保留删 改痕迹；(2) th

27、e report on the uncertainty analysis of the results of national measurement comparison experiments;（二）国家计量比对实验结果 不确定度分析报告；(3) photocopy of the certificate of measurement benchmark, the certificate of evaluation for measurement standards, the certificate of grading for reference materials, or the cer

28、tificate of measurement authorization or other relevant technical documents; and（三）计量基准证书复印件、 计量标准考核证书复印件、标准 物质定级证书复印件以及计量 授权证书复印件或者其他相关 技术文件；(4) other materials required.（四）需要提交的其他材料。第十四条对于具备条 件的国家计量比对，主导实验室 和参比实验室应当对相关实验 过程、数据结果等建立并实施追Article 14 For eligible national measurement comparison, the pi

29、lot laboratory and participating laboratories shall establish and implement a traceability system for relevant experimental processes and dataresults.溯备查制度。Article 15 The pilot laboratory shall make statistics, analysis, and evaluation according to the results of national measurement comparison from

30、 participating laboratories, draft a summary report on the national measurement comparison, and solicit opinions from participating laboratories.第十五条 主导实验室 应当根据参比E验室国家计量 比对结果进行统计、分析和评 价，起草国家计量比对总结报 告，并征求各参比实验室意见。The pilot laboratory shall, within the specified time, submit the revised summary report

32、ent comparison shall include:第十六条国家计量比 对总结报告应当包括：(1) the general situation of national measurement comparison and relevant explanations;（一）国家计量比对概况及相 关说明；(2) the technical status of the transfer standards or samples, including the relevant requirements such as stability, uniformity, repeatability, a

33、nd transportation（二）传递标准或者样品的技 术状况，包括稳定性、均匀性、 重复性和运输特性等相关要求；characteristics;(3) records of data on national measurement comparison and necessary charts;（三）国家计量比对数据记录 及必要的图表；（四）国家计量比对结果分 析，至少包括参比实验室的测量 结果及其测量不确定度、国家计 量比对参考值及其测量不确定 度、参比实验室的测量结果与参 考值之差及测量不确定度；（五）参比实验室存在的问题 及整改建议；(4) an analysis of the

34、results of national measurement comparison, including at least the measurement results of participating laboratories and their measurement uncertainty, the reference values of national measurement comparison and their measurement uncertainty, and the difference between the measurement results of par

35、ticipating laboratories and the reference values and their measurement uncertainty;（六）国家计量比对分析及结 论。(5) Problems existing in participating laboratories and suggestions for rectification; and第十七条国家市场监 督管理总局定期向社会公布国 家计量比对结果。(6) Comparative analysis and conclusion of national measurement.Article 17 The

36、State Administration for Market Regulation regularly announces the results of national measurement comparison to the public.第十八条国家计量比 对结果符合规定要求的，可以作 为计量基准和计量标准复查考 核、标准物质定级、计量授权以 及实验室认可的参考依据。国家计量比对结果偏离正常 范围的，应当限期改正，暂停国 家计量比对所涉及的计量基准、 计量标准的量值传递工作和标Article 18 If the results of national measurement comp

37、arison meet the prescribed requirements, they may be used as a reference for the review and evaluation of measurement benchmarks and measurement standards, the grading of reference materials, the authorization of measurement, and the accreditation of laboratories.If the results of national measureme

39、erials involved in national measurement comparison.Article 19 The pilot laboratory, participating laboratories, and the panel of technical experts shall abide by confidentiality provisions, and shall not disclose data on national measurement comparison before the publication of the results of the na

40、tional measurement comparison.未经国家市场监督管理总局 同意，主导实验室和参比实验室 不得发布国家计量比对数据及 结果。对擅自泄露或者发布国家计 量比对数据及结果的，由国家市 场监督管理总局将有关情况通 报主导实验室、参比实验室所在 单位，取消申报国家计量比对资 格，予以公示；情节严重的，予 以通报批评。Without the consent of the State Administration for Market Regulation, the pilot laboratory and participating laboratories shall not

41、 publish the data on national measurement comparison and the results.For those that disclose or publish the data and results without authorization, the State Administration for Market Regulation shall inform the entities in which the pilot laboratory and participating laboratories are, and disqualif

42、y them from applying for national measurement comparison before publicizing them; if the circumstances are serious, a notice of criticism shall be circulated.第二十条主导实验室Article 20 The pilot laboratory shall not commit the不得有下列行为:（一）抄袭参比实验室国家计 量比对数据，弄虚作假；following acts:（二）与参比实验室串通，篡 改国家计量比对数据；(1) Pract

43、icing fraud or copying the data on national measurement comparison from participating laboratories;(2) Colluding with a participating laboratory to tamper with data on national measurement comparison; or（三）违反诚实信用原则的其 他行为。参比实验室不得弄虚作假，相 互抄袭国家计量比对数据。(3) Any other acts violating the principle of good fa

44、ith.主导实验室和参比实验室存 在以上行为的，国家计量比对结 果无效，取消申报国家计量比对 资格，予以公开；情节严重的， 处三万元以下罚款。Participating laboratories shall not practice fraud or copy the data on national measurement comparison from each other.If the pilot laboratory or a participating laboratory has committed any of the aforesaid acts, the results of

45、 the national measurement comparison shall be deemed invalid, and it shall be disqualified from applying for national measurement comparison, which shall be made public; if the circumstances are serious, a fine of not morethan 30,000 yuan shall be imposed.Article 21 Those who, in violation of Articl

46、e 7 of these Measures, refuse to participate in national measurement comparison without justifiable reasons, shall take corrective action within a time limit; if no corrective action is taken, a notice of criticism shall be circulated.第二十一条违反本办 法第七条规定的，无正当理由拒 不参加国家计量比对的，限期改 正；逾期不改正的，予以通报批 评。Article
