1、中华人民共和国海关行政裁定管理暂行办 法（2001年12月24日海关总署令第92号 发布 根据2023年3月9日海关总署令 第262号海关总署关于修改部分规章的 决定修正）第一条为便利对外贸易经营者办理 海关手续，方便合法进出口，提高通关效 率，根据中华人民共和国海关法的有 关规定，特制定本办法。第二条海关行政裁定是指海关在货 物实际进出口前，应对外贸易经营者的申 请，依据有关海关法律、行政法规和规 章，对与实际进出口活动有关的海关事务 作出的具有普遍约束力的决定。中华人民共和国海关行政裁定管理暂行办法(2023修正)Interim Measures of the Peoples Republ

5、 trade operators to go through the customs procedures, to provide convenience for legal imports and exports and to increase the efficiency of customs clearance, these Measures have been enacted in accordance with the relevant provisions of the Customs Law of the Peoples Republic of China.Article 2 C

18、 as the GAC) or the agencies authorized by the GAC, and shall be uniformly promulgated to the public by the GAC.行政裁定由海关总署或总署授权机构作 出，由海关总署统一对外公布。Administrative rulings shall have the same force as that of the customs regulations.行政裁定具有海关规章的同等效力。Article 3 These Measures shall apply to the following cu

19、stoms affairs:第三条 本办法适用于以下海关事 务：1) Classification of the import and export commodities;（一）进出口商品的归类;2) Determination of the origins of the import and export goods;（二）进出口货物原产地的确定;3) Application of the measures for prohibiting imports and exports and of the licenses;（三）禁止进出口措施和许可证件的适 用；4) Other customs

20、 affairs that the GAC decides these Measures shall apply to.（四）海关总署决定适用本办法的其他海 关事务。Article 4 Applicants for customs administrative rulings shall be the operating entities of import and export goods that have undergone recordation formalities with the Customs.第四条 海关行政裁定的申请人应当 是在海关备案的进出口货物经营单位。The app

21、licants may file applications with the customs office by themselves, or entrust others to file applications with the customs office.申请人可以自行向海关提出申请，也可以 委托他人向海关提出申请。Article 5 Except for special circumstances, the applicant for customs administrative ruling shall file a written application to the GAC o

22、r the customs office directly under the GAC 3 months before the goods are to be imported or exported.第五条除特殊情况外，海关行政裁 定的申请人，应当在货物拟作进口或出口 的3个月前向海关总署或者直属海关提交 书面申请。One application shall include only one customs affair.一份申请只应包含一项海关事务。申请人Where the applicant applies for customs administrative rulings on se

23、veral customs affairs, it shall file the applications one by one.对多项海关事务申请行政裁定的，应当逐 项提出。The applicant may not file applications for administrative ruling on the same customs affair with two or more customs office.申请人不得就同一项海关事务向两个或者 两个以上海关提交行政裁定申请。Article 6 The applicant shall fill in the application

24、 form for administrative ruling according to the requirements of the customs office, including basically the following elements:第六条 申请人应当按照海关要求填 写行政裁定申请书（格式见附件），主要 包括下列内容：1) Basic information about the applicant;（一）申请人的基本情况;2) The matters for which the administrative ruling is applied;（二）申请行政裁定的事项;3

25、) Specific information about the goods for which the administrative ruling is applied for;（三）申请行政裁定的货物的具体情况;4) Estimated date of import or export and port of import or export;（四）预计进出口日期及进出口口岸;5) Other information that the customs office regards needed to be explained.（五）海关认为需要说明的其他情况。Article 7 The a

26、pplicant shall, according to the requirements of the customs office, provide the materials that can sufficiently explain the applied matters, including the copies of contracts or letters of intent for import or export, pictures, specifications and analysis reports, etc.第七条申请人应当按照海关要求提 供足以说明申请事项的资料，包

27、括进出口 合同或意向书的复印件、图片、说明书、 分析报告等。If the documents attached to the application are in foreign languages, the applicant shall provide the foreign originals and the Chinese translations at the same time.申请书所附文件如为外文，申请人应同时 提供外文原件及中文译文。The application form shall bear the seal of the applicant, and a across-

28、page seal shall be put to the application form.申请书应当加盖申请人印章，所提供文件 与申请书应当加盖骑缝章。Where the applicant entrusts others to apply, the letter of authorization and the identity certification of the agent shall申请人委托他人申请的，应当提供授权委 托书及代理人的身份证明。第八条 海关认为必要时，可要求申 请人提供货物样品。第九条 申请人为申请行政裁定向海 关提供的资料，如果涉及商业秘密，可以 要求海关予以

29、保密。除司法程序要求提供 的以外，未经申请人同意，海关不应泄 露。申请人对所提供资料的保密要求，应当书 面向海关提出，并具体列明需要保密的内 容。第十条 收到申请的直属海关应当按 照本办法第六、七、八条规定对申请资料 进行初审。对符合规定的申请，自接受申 请之日起3个工作日内移送海关总署或总 署授权机构。申请资料不符合有关规定的，海关应当书 面通知申请人在10个工作日内补正。申 请人逾期不补正的，视为撤回申请。第十一条海关总署或授权机构应当 自收到申请书之日起15个工作日内，审 核决定是否受理该申请，并书面告知申请 人。对不予受理的应当说明理由。第十二条有下列情形之一的，海关 不予受理：（一）

30、申请不符合本办法第三、四、五条 规定的；be provided.Article 8 The customs office may require the applicant to provide sample goods if it deems necessary.Article 9 If the materials provided to the customs office by the applicant for the application for administrative ruling involve any commercial secret, the applicant m

31、ay ask the customs office to keep secret of them. Except that the submission of those materials is required by judicial procedures, the customs office shall not reveal them without the consent of the applicant.The applicant shall present the request in wring to the customs office for keeping secret

32、of the materials provided, and specifically list the contents that need to be kept secret.Article 10 The customs offices directly under the GAC that receive the applications shall make preliminary examinations according to Articles 6, 7 and 8 of these Measures. Those applications meeting the provisi

33、ons shall be transferred to the GAC or the agencies authorized by the GAC within 3 workdays from the day of acceptance of the application.If the application materials do not conform to the relevant provisions, the customs office shall notify the applicant to supplement or correct them within 10 work

34、days. If the applicant fails to supplement or correct them within the prescribed period, its application shall be regarded as being withdrawn.Article 11 The GAC or the authorized agencies shall, within 15 workdays from receiving the application form, examine and decide on whether to accept that appl

35、ication or not, and shall notify the applicant in writing. For those not accepted, the reasons shall be explained.Article 12 In any of the following situations, the customs offices shall not accept the application:1) The application dose not conform to Articles 3, 4 or 5 of these Measures;2) The app

36、lication is irrelevant to the actual import or export activities;3) The customs office has made effective administrative rulings or other clear provisions on the same customs affairs;4) Other situations that the customs office decides not to accept the application.Article 13 Customs offices may, aft

37、er accepting the application and before rendering the administrative ruling, ask the applicant to supplement relevant materials or sample goods.If the applicant fails to provide valid and complete materials or samples within the prescribed period and thus affects the customs office in the rendering

38、of administrative ruling, the customs may terminate the examination.If the applicant voluntarily provides new materials or samples to the customs as supplement, it shall explain the reasons. And the customs shall make examination and decide on whether to adopt them or not.If the customs accepts the

39、supplemented materials, it shall make an examination anew on the basis of the supplemented facts and materials, and the time limit for rendering administrative rulings shall be calculated anew from the day of receiving the supplemented materials of the applicant.Article 14 The applicant may, before

40、the customs office renders an administrative ruling, declare in writing to the customs to withdraw its application.（二）申请与实际进出口活动无关的;（三）就相同海关事务，海关已经作出有 效行政裁定或者其他明确规定的；（四）经海关认定不予受理的其他情形。第十三条 海关在受理申请后，作出 行政裁定以前，可以要求申请人补充提供 相关资料或货物样品。申请人在规定期限内未能提供有效、完整 的资料或样品，影响海关作出行政裁定 的，海关可以终止审查。申请人主动向海关提供新的资料或样品作 为补充

41、的，应当说明原因。海关审查决定 是否米用。海关接受补充材料的，根据补充的事实和 资料为依据重新审查，作出行政裁定的期 限自收到申请人补充材料之日起重新计 算。第十四条 申请人可以在海关作出行 政裁定前以书面形式向海关申明撤回其申 请。第十五条 海关对申请人申请的海关 事务应当根据有关事实和材料，依据有关 法律、行政法规、规章进行审查并作出行 政裁定。Article 15 The customs office shall, according to the relevant facts and materials and pursuant to the relevant laws, admini

42、strative regulations and rules, make examination of and render the administrative ruling on the customs affair applied by the applicant.In the course of examination, the customs office may seek the opinions of applicant and other interested persons.审查过程中，海关可以征求申请人以及其 他利害关系人的意见。Article 16 The customs

43、 office shall render the administrative ruling within 60 days from the day of accepting the application.第十六条海关应当自受理申请之日 起60日内作出行政裁定。The administrative ruling rendered by the customs office shall be notified to the applicant in writing and be promulgated to the public.海关作出的行政裁定应当书面通知申请 人，并对外公布。Articl

44、e 17 The administrative ruling rendered by the customs office shall be uniformly applicable within the customs boundaries of the Peoples Republic of China.第十七条 海关作出的行政裁定自公 布之日起在中华人民共和国关境内统一适 用。The goods in the same import or export situation shall be governed by the same administrative ruling.进口或者出口

45、相同情形的货物，应当适用 相同的行政裁定。The import and export goods that have gone through the relevant procedures for the ruled matter before the ruling takes effect shall not be subject to that ruling.对于裁定生效前已经办理完毕裁定事项有 关手续的进出口货物，不适用该裁定。Article 18 If the relevant provisions in the laws, administrative regulations an

46、d rules based on which the customs office rendered the administrative ruling have changed, and such change affects the force of the administrative ruling, the original administrative ruling shall be invalidated automatically.第十八条 海关作出行政裁定所依据 的法律、行政法规及规章中的相关规定发 生变化，影响行政裁定效力的，原行政裁 定自动失效。The GAC shall

47、periodically promulgate the administrative rulings that have been invalidated automatically.海关总署应当定期公布自动失效的行政裁Article 19 In any of the following situations, the GAC shall cancel the original administrative ruling:第十九条有下列情形之一的，由海 关总署撤销原行政裁定：1) The original administrative ruling is wrong;()原行政裁定错误的;2)

48、 The original administrative ruling need to be cancelled because the application documents provided by the applicant are inaccurate or incomplete;(二)因申请人提供的申请文件不准确或 者不全面，造成原行政裁定需要撤销的；（三）其他需要撤销的情形。海关撤销行政裁定的，应当书面通知原申 请人，并对外公布。撤销行政裁定的决 定，自公布之日起生效。经海关总署撤销的行政裁定对已经发生的 进出口活动无溯及力。第二十条进出口活动的当事人对于 海关作出的具体行政行为不服，并对该具 体行政行为依据的行政裁定持有异议的， 可以在对具体行政行为申请复议的同时一 并提出对行政裁定的审查申请。复议海关 受理该复议申请后应将其
