6、Administration of Customs to Amend Some Rules issued by Order No. 238 of the General Administration of Customs on April 28, 2018; amended for the third time according to the Decision of the General Administration of Customs to Amend Some RulesArticle 23 The Customs shall make records for the quantit

7、y & weight inspection, and may take pictures, make records or videos. Relevant entities and individuals shall offer cooperation, and sign their names on the records for confirmation; and if any of them has different opinions, relevant notes shall be taken or a memorandum shall be signed jointly.Arti

8、cle 24 The measurement equipment, facilities and management measures of the entities for picking up import goods or delivering export goods as well as the process of picking up or delivering goods shall be subject to the supervision, administration and check of the Customs, and the said entities sha

9、ll, within the time limit prescribed by the Customs, rectify the factors that will affect the inspection and quarantine or the accuracy of inspection and quarantine results.Chapter IV Supervision and AdministrationArticle 25 The Customs shall supervise and administer the various types of import and

10、export commodity inspection institutions established within the territory of China, the institutions and persons engaging in the business concerning the quantity & weight inspection of import and export commodities within the territory of China as well as their activities.Article 26 Various legally

11、formed domestic and overseas inspection and identification institutions may be authorized by the parties involved in foreign economy and trade to implement the quantity & weight inspection of import and export commodities; and accept the check of the Customs.第二十三条海关实施数 量、重量检验时应当记录，可 以拍照、录音或者录像。有关 单位

12、和个人应当予以配合，并 在记录上签字确认，如有意见 分歧，应当备注或者共同签署 备忘录。第二十四条 承担进口接 用货或者出口备发货的单位的 计重器具、设施、管理措施以 及接发货过程应当接受海关的 监督管理和检查，并在海关规 定的期限内对影响检验鉴定工 作及其结果准确性的因素进行 整改。第四章监督管理第二十五条海关依法对 在境内设立的各类进出口商品 检验机构和在境内从事涉及进 出口商品数量、重量检验的机 构、人员及活动实施监督管 理。第二十六条依法设立的 境内外各类检验机构可以接受 对外经济贸易关系人的委托， 办理进出口商品的数量、重量 鉴定，并接受海关的检查。第五章法律责任Chapter V

13、Legal LiabilitiesArticle 27 Where any entity or individual illegally destroys the conditions of on-site quantity & weight inspection of import and export commodities or the import and export commodities, and affects the inspection results, the Customs shall order it or him to make correction and imp

14、ose a fine of less than 30,00() yuan.Article 28 Where any inspection institution engaged in the business of inspection and identification of imported and exported commodities interferes with the inspection and identification order in violation of the relevant provisions of the state, the Customs sha

15、ll order it to take corrective action and confiscate its illegal income therefrom, and may impose a fine of not more than 100,000 yuan on it, and the Customs may suspend its inspection and identification business for a period of less than six monthsArticle 29 Where any functionary in the Customs abu

16、ses his authorities, deliberately creates difficulties for the parties concerned, makes falsehood for private gains, forges inspection results, or neglects his duties and delays the inspection or the issuance of certificates, he shall be given an administrative sanction; and if a crime is constitute

17、d, he shall be subject to criminal liabilities.Chapter VI Supplementary ProvisionsArticle 30 The definitions of the following terms as used in these Measures:第二十七条擅自破坏进 出口商品数量、重量检验现场 条件或者进出口商品，影响检 验结果的，由海关责令改正， 并处3万元以下罚款。第二十八条从事进出口 商品检验鉴定业务的检验机构 违反国家有关规定，扰乱检验 鉴定秩序的，由主管海关责令 改正，没收违法所得，可以并 处10万元以下的罚款，海

18、关可 以暂停其6个月以内检验鉴定 业务。第二十九条海关的工作 人员滥用职权，故意刁难当事 人的，徇私舞弊，伪造检验结 果的，或者玩忽职守，延误检 验出证的，依法给予行政处 分；构成犯罪的，依法追究刑 事责任。第六章附则第三十条本办法下列用 语的含义：公量，是指商品在衡重和化验 水分含量后，折算到规定回潮 率（标准回潮率）或者规定含 水率时的净重（以公量结算的 商品主要有棉花、羊毛、生丝The conditional weight“ refers to the net weight of commodities converted at the prescribed resurgence rat

19、e (standard resurgence rate) after the commodities are weighed and their moisture content is tested (the commodities settled by conditional weight mainly include cotton, wool, raw silk and fiber, etc. sincethese categories of commodities absorb the moisture easily and have high prices.)The “dry meas

20、ure“ refers to the dry weight of commodities, which is the actually calculated wet weight of commodities minus the moisture content in term of actually gauged moisture content ratio (the commodities settled by dry measure mainly include valuable minerals, etc.)The “weight by shore tank“ refers to th

21、e quantity & weight inspection and appraisal (including measurement and calculation) of bulk liquid commodities or liquefied gas commodity by using the tank containers (excluding ship cabins) that have been tested by the national department for measurement and testing, the tank containers include ve

22、rtical tanks, horizontal tanks and groove tanks (both the removable and irremovable).The spot-check & re-weighing refers to a link in the conformity assessment procedure for the weight survey by scale and an inspection method in which the Customs, aiming at conformity assessment targets (mainly refe

23、rring to the consignees or consignors that regularly import or export bulk packed commodities with definite weight), selects some representative commodities at random for re-weighing at a same scale and checking whether the variance between two times of weighing is within the permitted scope so as t

24、o assess the eligibility of the said procedure.和化纤等，这些商品容易吸 潮，价格高）。干量，是指商品的干态重量， 商品实际计得的湿态重量扣去 按照实测含水率计得的水分后 得到的即商品的干态重量（以 干量结算的商品主要有贵重的 矿产品等）。岸罐计重，是指以经过国家合 法的计量检定部门检定合格的 罐式容器（船舱除外）为工 具，对其盛装的散装液体商品 或者液化气体商品进行的数、 重量检验鉴定（包括测量、计 算）。其中，罐式容器包括了 立式罐、卧式罐、槽罐（可拆 卸或者不可拆卸的槽罐）。抽查复衡，是衡器鉴重合格评 定程序中的一个环节。指针对 合格评定对象

25、（主要是经常进 出口大宗定重包装的商品的收 货人或者发货人），由海关从 中随机抽取部分有代表性的商 品在同一衡器上进行复衡，检 查两次衡重的差值是否在允许 范围内，以评定其程序是否处 于合格状态的检验方法。收集地脚，是指在装卸过程中 由于撒、漏的或者是在装卸后 残留的小部分商品称为地脚货 物，地脚货物应当及时收集计 重，扣除杂质，合并进整批重The collection of sweepings refers to the small number of commodities scattered and leaked during the loading and discharging pr

26、ocess or left after loading and discharging, which is called sweeping cargo. The sweeping cargo shall be timely collected,weighed and deducted of impurities, and incorporated into the weight of the whole batch of commodities for issuing a certificate, and shall not be simply deducted as losses.Artic

27、le 31 Where an inspection declarer raises an objection to the quantity & weight inspection results made by the competent customs office, it may, within the prescribed time limit, apply for re-inspection to the competent customs office that has made the inspection results or the customs office at the

28、 higher level even up to the General Administration of Customs, and simultaneously preserve the scene and the commodity status. The Customs that has accepted the reinspection shall draw the re-inspection conclusion within the prescribed time limit.Where any party concerned was dissatisfied with the

29、re-inspection conclusion as drawn by the Customs, it may apply for administrative review, or may lodge a lawsuit with the peoples court.Article 32 Where any party involved in foreign economy and trade raises an objection to the quantity & weight appraisal results made by another inspection and appra

30、isal institution it entrusts, it may make its objection complaint to the local competent customs offices even up to the General Administration of Customs, and simultaneously preserve the scene and the commodity status.Article 33 The Customs shall collect charges according to the relevant provisions

32、货物现状。第三十三条海关依法实 施数量、重量检验，按照国家 有关规定收取费用。第三十四条本办法由海 关总署负责解释。Article 34 The power to interpret these Measures shall remain with the General Administration of Customs.第三十五条本办法自 2007年10月1日起施行，原国 家进出口商品检验局1993年12 月16日发布的进出口商品重 量鉴定管理办法同时废止。Article 35 These Measures shall become effective as of October 1, 2

33、007, and the Administrative Measures for the Weight Appraisal of Import and Export Commodities as promulgated by the former State Administration for Inspection of Import and Export Commodities on December 16, 1993 shall be simultaneously repealed.第262号海关总署关于修改 部分规章的决定第四次修 正）第一章总则第一条为加强进出口商 品数量、重量检验鉴

34、定工作， 规范海关及社会各类检验机构 进出口商品数量、重量检验鉴 定行为，维护社会公共利益和 进出口贸易有关各方的合法权 益，促进对外经济贸易关系的 顺利发展，根据中华人民共 和国进出口商品检验法（以 下简称商检法）及其实施 条例，以及其它相关法律、行 政法规的规定，制订本办法。第二条 本办法适用于中 华人民共和国境内的进出口商 品数量、重量检验鉴定活动。第三条海关总署主管全 国进出口商品数量、重量检验 鉴定管理工作。主管海关负责所辖地区的进出 口商品数量、重量检验鉴定及 其监督管理工作。issued by Order No. 240 of the General Administration

36、ing to the Law of the Peoples Republic of China on Import and Export Commodity Inspection (hereinafter referred to as the Law on Commodity Inspection), the regulation on the implementation thereof, other relevant laws and administrative regulations for the purpose of strengthening the quantity & wei

37、ght inspection and appraisal of import and export commodities, regulating the quantity & weight inspection and appraisal of import and export commodities by the Customs and various kinds of social inspection institutions, maintaining the public interests as well as the legitimate rights and interest

38、s of all the parties involved in the import and export trade, and promoting the smooth development of foreign economic and trade relations.Article 2 These Measures shall be applicable to the quantity & weight inspection and appraisal of import and export commodities within the territory of the Peopl

39、es Republic of China.Article 3 The General Administration of Customs shall be in charge of the administration of the quantity & weight inspection and appraisal of import and export commodities across the country.The competent customs offices shall be responsible for supervising and administering the

40、 quantity & weight inspection and appraisal of import and exportcommodities under their respective jurisdictions.Article 4 The scope for the Customs to implement the quantity & weight inspection and appraisal shall include:1. the import and export commodities that have been incorporated in the entry

41、-exit commodity catalogue for the Customs to implement the inspection and quarantine;2. other import and export commodities that shall be subject to the inspection of the Customs according to laws or administrative regulations;3. dangerous goods, discarded and used articles as imported or exported;4

42、. the import and export commodities for which the verification management or quota management is implemented and the inspection needs to be implemented by the Customs;5. the import and export commodities suspected of being involved in fraud;6. the import and export commodities as provided by bilater

43、al or multilateral agreements or conventions, international treaties, or as authorized or designated by international organizations; and第四条 海关实施数量、 重量检验的范围是：（一）列入海关实施检验检疫 的进出境商品目录内的进出口 商品；（二）法律、行政法规规定必 须经海关检验的其它进出口商 品；（三）进出口危险品和废旧物 品；（四）实行验证管理、配额管 理，并需由海关检验的进出口 商品；（五）涉嫌有欺诈行为的进出 口商品；（六）双边、多边协议协定、 国际条

44、约规定，或者国际组织 委托、指定的进出口商品；（七）国际政府间协定规定， 或者国内外司法机构、仲裁机 构和国际组织委托、指定的进 出口商品。7. the import and export commodities as provided by the international treaties between governments, or as authorized or designated by domestic or overseas judicial organs, arbitrary bodies or international organizations.Article 5

45、The Customs shall implement spot quantity & weight inspection on import and export commodities not prescribed in the previous article according to state provisions.Chapter II Declaration for InspectionArticle 6 For the import and export commodities on which the Customs shall implement the quantity &

46、 weight inspection, the consignee, consignor or the agent thereof shall go through the formalities for inspection declaration at the place and within the time limit as prescribed by the Customs.Article 7 The formalities for declaring the quantity & weight inspection of import commodities shall be ha

47、ndled before discharge in the Customs.Article 8 The formalities for declaring the quantity & weight inspection of bulk import commodities shall be handled in the Customs at the port of shipment within the prescribed time limit.The formalities for declaring the quantity & weight inspection of import

48、commodities in packages (pieces) shall be handled in the Customs at the place of production within the prescribed time limit. Where the change of certificate is required for export at the port, the consignor shall, within the prescribed time limit, apply for inspection to the customs office at the p

49、ort of departure.第五条海关根据国家规 定对上述规定以外的进出口商 品的数量、重量实施抽查检 验。第二章报检第六条需由海关实施数 量、重量检验的进出口商品， 收发货人或者其代理人应当在 海关规定的地点和期限内办理 报检手续。第七条进口商品数量、 重量检验的报检手续，应当在 卸货前向海关办理。第八条散装出口商品数 量、重量检验的报检手续，应 当在规定的期限内向装货口岸 海关办理。包（件）装出口商品数量、重 量检验的报检手续，应当在规 定的期限内向商品生产地海关 办理。需要在口岸换证出口 的，发货人应当在规定的期限 内向出口口岸海关申请查验。对于批次或者标记不清、包装不良，或者在到达出口口岸前的运输中数量、重量发生变化For the commodities whose batch or
