1、人权法教学大纲Humani tarian Law课程代码： M0121240/N0301Z93总学时（理论+实践）：32+0学 分： 2课程性质：选 修课程类别：专业方向课先修课程： 法理学、宪法学、国际法学面向专业：法学开课二级学院： 法学院开课学科：国际法学科一、课程的地位与任务本课程是面向本学院法学专业的方向选修课，主要针对的是大三的学生，通过本课程的 学习，学生可以熟知人权的基本原理和理论；系统把握我国人权法的基本内容和人权保护的 法律规定；掌握人权国际保护的主要公约、制度和主要的国际人权保护组织及其人权保护活 动；了解区域性人权保护公约和人权保护机构及其活动，为进一步完善我国的人权保

2、护事业 提供理论上的积累。二、课程主要内容与基本要求第一编人权的一般原理第一章人权的概念掌握人权的主体和人权的主要内容；了解人权的三种存在形态。第二章人权的本原熟悉西方人权本原的主要理论，尤其是“天赋人权说；掌握我国当代的主耍人权理论 或观点；理解人权源自人的本性的主要根据和理由。第三章人权的分类熟练掌握人权不同分类标准所做出的不同分类，主要是个人人权与集体人权的问题；理 解积极人权和消极人权分类的含义；了解人权的其他分类及其含义。第四章人权的属性熟练掌握人权的普遍性和特殊性的关系、人权意识的含义;理解人的权利和义务的关系; 了解人权的政治性与超政治性的关系。第五章人权的实现熟练掌握人权实现的

3、义务主体及其主要义务；理解人权的国家司法保障机制及其运行情 况；了解人权实现的社会条件和其他条件。第二编国内人权法第六章人权法概述熟练掌握国内人权法和国际人权法概念的不同、两者的关联；掌握国内人权法的渊源; 熟悉国际人权法的渊源。第七章人身人格权熟练掌握人权罪核心的几个层次权利的含义，主要包括生存权、生命权、人身安全权、 人身自由权、人格尊严权等。同时，理解各个权利之间的关系和轻重和保障的先后。第八章自由权重点掌握表达自由、结社、游行、集会自由的含义和限度；掌握宗教自由和创作以及学 术自由的含义和限度；理解自由权的基本原理、信息自由的作用和意义等。第九章平等权熟练掌握不同层次的平等权的含义和保

4、障措施，主要是民族平等权、男女平等权、经济 平等权和政治平等权；理解平等权的基本原理。第十章民主权熟练掌握民主权利的含义；掌握几种基本的民主权利的概念，即选举权和参政议政权、 监督权；理解自治权的含义。第十一章劳动权熟练掌握劳动权的含义、掌握劳动者的就业权、劳动条件权等权利；理解团结权的含义。第十二章社会保障权掌握我国社会保障的主要内容和完善的改革途径;理解社会保障权的概念、历史演进等。第十三章受教育权熟练掌握受教育权的概念和特征；掌握受教育权的几个核心权利，即学习机会权、学习 条件权和学习成功权等的含义和保障措施。第十四章人道权熟练掌握主要针对特殊群体，即残疾人、灾民和累犯的权利；了解人道权

5、的基本原理。第三编国际人权法第十五章国际人权法概述熟练掌握国际人权法的含义；掌握世界人权宣言、国际人权两公约的主要内容；理解专 门性国际人权文书的内容。第十六章集体人权熟练掌握集体人权、人们自决权、发展权等权利的含义；熟悉其他集体权利，如资源权、 环境权等权利。第十七章人权国际保护与国家主权熟练掌握人权国际保护的含义和国家主权的含义；掌握人权国际保护与尊重国家主权的 关系。第十八章国际人权保护机制熟练掌握国际人权保护的主要机构和保护的主要机制；了解国际人权保护的简要历史。第十九章区域性人权保护熟练掌握区域性人权保护的主要机构和主要公约；了解区域性人权保护的救助机制。三、课程教学学时安排教学内容
